This booklet explains exactly what is covered by your warranty and how to make a claim if you have a mechanical or electrical breakdown. www.workox.co.nz

CERTIFICATION OF COVER This Customer Policy Wording combined with Your Policy Schedule certifies that insurance has been effected between You and Us. In return for payment of the premium We agree to insure You in accordance with the terms and conditions contained in and endorsed on these documents. We (the Insurer) have entered into a Binding Authority Contract reference number 111581WQP with the Administrator (Rothbury Group Ltd) under which We authorise the Administrator to sign and issue these documents on Our behalf. Signed on behalf of Rothbury Group Ltd: UNDERSTANDING YOUR EXTENDED WARRANTY Please read this Extended Warranty Customer Policy Wording carefully and make sure You understand and fully comply with its requirements. Failure to do so may jeopardise the payment of any repairs which might arise and could lead to the Extended Warranty becoming void. Please ensure You keep this document in a safe place so You can read it again if needed. WHAT IS COVERED BY YOUR EXTENDED WARRANTY The sole purpose of this insurance is to indemnify You against the unforeseen Breakdown of the Components. The warranty duration and maximum indemnity will be those as stated on the Policy Schedule. No claim payment can be paid until the Administrator has received the application form and premium payment in full. Our liability shall be only the actual failed parts required to return the Machine to its pre-claim condition. This is not a service or maintenance policy. THE EXTENDED WARRANTY This Extended Warranty: Contains details of the cover You have bought, what is excluded and the other requirements of this Extended Warranty. Is designed to pay for Repair Costs, or at Our option, the Replacement Costs, as a result of Breakdown. Will only become effective when We have received payment of the premium in full. Provides only the coverage as stated in this document. 02

THE SCHEDULE Please check that the information contained in the Policy Schedule is correct. If it is not please contact Us. NB: This Extended Warranty does not affect the Machine supplier s liability to You if the Machine is found to be unfit for the purpose for which it was intended, or is not as described, or is not of satisfactory quality. TYPE OF COVER This insurance provides cover for Repairs or Replacement Costs, incurred as a result of Breakdown (as defined in this wording) occurring during the Period of Insurance. You are covered up to the Single Repair Limit in respect of each repair, except where otherwise stated in the Level of Cover, and the aggregate value limit as a total for all repairs during the Period of Insurance. The Aggregate Repair Limit will be reduced by the cost of any repairs during the period. DEFINITIONS Administrator Rothbury Group Ltd, Level 18, 1 Queen Street, Auckland. Telephone No: (09) 355 7347. Aggregate Repair Limit means $50,000 sum insured. You, Your, You, Your, is the individual person or company purchasing this Extended Warranty as stated in Your Policy Schedule. We, Us, Our means Certain Underwriters at Lloyds, London ( Insurers ) per WhiteOak Underwriting Agency Ltd - WhiteOak Consortium 9566. Dealer Licensed Retailer, who You purchased Your Machine from. Breakdown The sudden and unforeseen failure of a Component, arising from any permanent mechanical or electrical defect, (for a reason other than wear and tear, normal deterioration or negligence) causing sudden stoppage of its function, necessitating immediate repair or replacement of the component before normal operation can be resumed. Component(s) means any mechanical, electrical and electronic part, which forms part of the Machine s original specification, insured under the relevant Level of Cover of this policy. Excess means the first part of each and every claim made under this policy which will be payable by You. WorkOx is part of the Rothbury Group of Companies www.workox.co.nz 03

DEFINITIONS Level of Cover means the section of cover as stated in Your Policy Schedule. Machine means the machine stated in Your Policy Schedule. Period of Insurance means the dates shown on the Policy Schedule. Policy Schedule means the Schedule attached to, and forming part of, this policy which gives details of this insurance. Replacement Costs means the cost of replacement Components of similar make and quality as the Component that had suffered the Breakdown in line with the part manufacturer s list prices, including the labour cost of fitting the new Component. Sum Insured is the maximum amount that can be claimed in total as stated on the Policy Schedule during the Period of Insurance. TERMS AND CONDITIONS 1. This Extended Warranty consisting of this Customer Policy Wording and Policy Schedule shall be read together as one contract and any word or expression to which a special meaning has been given shall have the same meaning wherever it may appear. Only the parts specifically listed will be covered by the Extended Warranty. 2. In the event of any occurrence giving rise to a claim, You must advise the Administrator as soon as is reasonably possible, and You must adhere to the claims procedure specified within this document. 3. You, shall take all reasonable steps to avoid further damage occurring. NB: No liability for additional damage after a fault has occurred will be covered if You continue to use the Component. 4. No claims will be considered unless all servicing has been carried out in accordance with the manufacturer s servicing requirements. The Administrator, or their agent, reserves the right to examine the Machine and failed Component/s to obtain an expert assessment. 5. No liability will be accepted for any claim where it is apparent or becomes apparent that the terms and conditions of the Extended Warranty have not been fully complied with. 6. If You, or Your agent, makes any claim knowing it to be false or fraudulent in any respect, then this Extended Warranty shall be null and void and You shall repay all sums paid in respect of any previous false or fraudulent claims. Legal action will be taken to recover costs and damages. 7. The Extended Warranty will not cover any claim covered by any existing insurance policy or policies, or any Manufacturer s warranty. 04

8. The Extended Warranty may be transferred to another purchaser, subject to approval by Us. No refund of premium is available. 9. Prior to sale the Dealer must conduct a pre-delivery inspection to confirm so far, as is reasonably possible, that the covered Components are in sound condition. You must ensure all warning lights and gauges are operating correctly at all times. No liability is accepted for continued use of the Component after any relevant warning light is illuminated or gauge indicates abnormal operation. i.e. should a low oil pressure warning light become illuminated for example, and You choose to continue to use the Component and ignore this warning light, then any subsequent resulting damage would not be covered by this Extended Warranty. 10. It is your responsibility to provide proof that the Machine service schedule has been fully complied with. You cannot rely solely on the hourage reading to determine when a service is due. 11. The geographical limit of this Extended Warranty is New Zealand. 12. No repairs may commence under the terms of the extended warranty unless the Administrator has issued an authority number for an agreed amount. Labour times are calculated using the standard repair times and do not include diagnosis, timing adjustments or the cleaning of assemblies or refacing costs. Remember, NO liability will be accepted for work carried out without prior authorisation. 13. We reserve the right to specify the use of guaranteed reconditioned, exchange units or guaranteed factory parts. The parts liability for any claim will be limited to the cost of these components. NUMBER OF CLAIMS Within the Period of Insurance the number of claims are unlimited up to the warranty limits as set out on Your Policy Schedule. GST Where you are GST registered, GST will apply. CASINGS Should the failure of a covered Component result in damage to any associated casing the replacement of the casing will constitute part of the claim (within the warranty claims limit). OIL SEALS & GASKETS Camshaft seals, oil seals, gearbox seals and other seals and gaskets are covered where removal of the engine, gearbox or differential unit is essential to effect a repair (within the warranty claims limit). WORKING MATERIALS Where an authorised repair requires the replacement or topping up of oils, anti-freeze or other fluids, or replacement of the oil filter, these will also constitute part of the claim (w ithin the warranty claims limit). WHAT IS COVERED COVERED COMPONENTS Only the Components listed under the following headings are covered, any item not specifically mentioned is not covered. The following specifically listed Components and labour costs (to the warranty limit) are covered against Breakdown, provided that You comply with the terms and conditions of this warranty. ENGINE Big end bearings, cam followers, camshaft, camshaft bearings, con-rods, crankshaft bearings, crankshaft, cylinder block, cylinder bores and cylinder head (excluding cracks and skim). Cylinder head gasket, flywheel, gudgeon pins, hydraulic lifters, oil pump, piston rings, pistons, push rods, rocker shaft, rockers, small end bearings, timing chains (excluding tensioners), timing gears, inlet and exhaust valves, valve guides and valve springs. (Excluding overheating, de-coking, burnt, pitted and sticking valves). TRANSMISSION Ball and roller bearings, bushes, gears and gear clusters, needle bearings, selectors, shafts and synchromesh assemblies. (Excluding transfer gears). Differential: Bearings and bushes, bevel gears, crown wheel and pinion assembly, internal shafts, planetary gear assembly, spacers and thrust washers. ELECTRICAL Starter, Solenoid, Alternator, Voltage Regulator, Indicators, Sensors, Switches, Instruments, Wiper Motor. TRANSMISSION Manual Shift Transmission, Flywheel Clutch, Torque Converter, All Internal Valves, Retarder, Divider, And All Internal Transmission Components, Shift Control Linkage, Differential Oil Cooler. DRIVE SYSTEM Drive Axle (Front/Rear) Motor Piston Group (Hydraulic Drive), Wheels and Axles On Wheel Equipment, Differential Steering, Steering Clutches For Track Machines. HYDRAULIC SYSTEM - (excluding pipework) Steering System, Cooling System, All Hydraulic Controls (Tip-Lift-Tilt), Steering Linkage, Tie Rod Ends, Brake Valve, Brake Accumulator, Brake Pump, Valves (Unloading) Pressure Reduction Valve. Accumulator/ Relief Valves, Levers/Handles, Control Rods, Filter Tubes, Sensors, Sending Unit. IMPORTANT NOTE You, must authorise the dismantling of any components for inspection and diagnosis & if after such dismantling has taken place no liability has been found under this Extended Warranty, You, must bear this cost. If a claim is accepted under this Extended Warranty by the Administrator, then the costs of both dismantling & diagnosis will form part of the total claim. 06

WHAT IS NOT COVERED General Exclusions We will not cover claims caused by, or arising from or in connection or for any of the following: 1. Breakdown arising from manufacturer s defects, inherent design faults, or recall campaigns, during or after the manufacturer s warranty period. 2. Breakdown to Components which have been modified or altered where the modification or alteration falls outside the approved manufacturer s specifications. 3. Breakdown where We are unable to verify the actual hourage of the machine at the time of the claim. 4. Routine maintenance operations and/or adjustments of any Components. 5. Breakdown which is recoverable under any other insurance or warranty. 6. Breakdown resulting from :- wear and tear overheating, frost, corrosion, flooding, impact, fire, abuse or neglect a defect which existed prior to the insurance taking effect lack of coolant, lubricant or hydraulic fluids incorrect servicing or faulty repair an incorrect grade of lubricants, fuel or hydraulic fluids ingress of foreign matter into fuel, lubricants or cooling system. 7. Breakdown to uninsured components or any consequential damage or loss. The Extended Warranty does not cover Breakdown occurring during the period of guarantee of a manufacturer or supplier, or failed parts which have been subject to recall by manufacturers, or as a result of inherent design faults, or components not originally fitted by the manufacturer. 8. Excess wear and tear, freezing, overheating, intrusion of foreign matter, corrosion, neglect, lack of servicing, lack of lubrication or anti freeze, gradual deterioration or replacement of parts which have reached the end of their effective working lives. 9. Consequential damage on, or caused by parts not specifically listed in this document, faults on the Machine at the time of purchase, attributable to the faulty previous repair or servicing of the Machine, use of an incorrect grade or type of fuel or oil, faults associated with routine maintenance or servicing or progressive failures. 10. Any third party claims, consequential losses, bodily injury, road hazard or fire damage claims or losses occurring as a direct result of impact damage to the Machine. WHAT IS NOT COVERED cont. General Exclusions 11. The cost of establishing preventative maintenance procedures or the cost of recall by the manufacturers of the Machine or any part thereof nor the cost of alterations, additions, improvements or overhauls. 12. Loss of use of the Machine or any other consequential loss, penalties for delay or detention, or in connection with guarantees of performance or efficiency, or any legal liability of whatsoever nature. 13. Any Breakdown:- (a) caused by the application of any tool or process during the course of maintenance, inspection, modification or overhaul; (b) due to fire, lightning, explosion, extinguishing of a fire or subsequent demolition, aircraft or other aerial devices or articles dropped there from, theft or attempted theft, collapse of buildings, flood inundation, escape of water from water containing apparatus, earthquake, subsidence, landslide, avalanche, hurricane, cyclone, volcanic eruption, or similar natural catastrophes. 14. The cost of remedying or making good or loss or damage arising out of the normal wearing out or wearing away or any part of the Machine or its degradation or the reduction in operational performance due to working stresses, abrasion, erosion or corrosion which are not attributable to defects in materials. 15. Any loss arising from any incomplete, ineffective or inappropriate repair of the Machine. 16. Recurring failures of Components occurring within 30 days of one another. 17. The costs of transporting the covered Machine to a repairing workshop is excluded in the event of a claim not being valid. 18. Any Breakdown resulting from the alteration or modification from the manufacturer s specification. 19. Any Breakdown caused by:- (a) Intentional act or willful neglect by You; (b) Yo u ignoring warning lights and gauges at any time. No liability can be accepted for drive on damage, neglect or abuse of any kind. 08

20. (a) directly or indirectly caused by or arising out of war, invasion, act of foreign enemy, hostilities (whether war be declared or not), civil war, rebellion, revolution, insurrection or military or usurped power, riot, civil commotion, strikes, lockout, confiscation or detention by customs or other officials or authorities, malicious intent or vandalism. (b) directly or indirectly caused by or contributed to by or arising from: (i) ionising radiations or contamination by radioactivity from any irradiated nuclear fuel or from any nuclear waste from the combustion of nuclear fuel. (ii) the radioactive toxic explosive or other hazardous properties of any explosive nuclear assembly or nuclear component thereof. (c) occasioned by pressure waves caused by aircraft or other aerial devices travelling at sonic or supersonic speeds. 21. Costs that are directly or indirectly caused by the event which led to Your claim unless specifically stated in this policy. 22. Breakdown from any external cause, including any collision or other accidental damage external to the Machine. 23. Any of the following parts: Bodywork, paintwork, exterior trim, glass, mirrors, interior trim, door handles, and seating frames or runners. Light fittings and bulbs, wiper arms, batteries, exhaust systems, catalytic converter, wheels and tyres. Normal wear and tear/service items including but not limited to: plugs, leads, glow plugs, brake and clutch frictional material, wiper blades, cables, pipes, hoses, wiring, wiring looms and belts (timing belts are covered please see special notes in service schedule). GOVERNING LAW 1. This insurance shall be governed by the law of New Zealand whose Courts shall have jurisdiction in any dispute arising hereunder; and 2. Any summons, notice or process to be served upon the Insurers for the purpose of instituting any legal proceedings against them in connection with this insurance may be served upon; 3. Lloyd s General Representative in New Zealand c/o Hazelton Law of level 3, 101 Molesworth Street, Wellington; who have authority to accept service on their behalf. CLAIMS Please read the How to Claim section thoroughly and remember 1. It is essential that an authority number is obtained from Our Claims Department before any repairs commence. 2. The above components are covered against Breakdown due to sudden and unexpected circumstances only. 3. Oil leaks are only covered under this Extended Warranty if the removal of the engine, gearbox or differential unit is essential to effect repair. How to Make a Claim 1. If at any time You suspect You have a fault covered by Your Extended Warranty first contact Us BEFORE any work is undertaken. Contact WorkOx Ltd, Claims (09) 8108414. Remember: No repairs must commence until an authority number has been received from our Claims Co-ordinators. You must take all reasonable steps to avoid further damage occurring. 2. We will require the following information: (Please have ready prior to telephoning) - a) Your name, policy number b) Confirmation that Your relevant service schedule has been complied with and original receipts are available. c) Hourage at time of breakdown. 10

3. Take Your Machine to the repairer agreed or nominated, and obtain an estimate for the repairs. The repairer must then contact Us quoting the above warranty information and an exact cause of failure. 4. If We accept the claim We will issue a CLAIMS AUTHORITY NUMBER for an agreed cost. Any amount in excess of this amount will remain Your responsibility. 5. An original fully detailed itemised invoice and any proof of servicing requested, should be sent to Us, QUOTING THE AUTHORITY NUMBER WITH A CLEAR INDICATION TO WHOM PAYMENT SHOULD BE MADE. 6. FRAUD If any claim is in any way fraudulent or if You or anyone acting on Your behalf or with Your knowledge or consent has used any fraudulent means, including inflating or exaggerating the claim submitting forged or falsified documents, all benefits under this Extended Warranty shall be forfeited and the warranty deemed null & void and legal action taken. 7. Authorisation of repairs will remain valid for 30 days. If no communication is made during this period the authority will be rescinded and the claim rendered null and void.
