1978, No. 75 New Zealand Council for Postgraduate 779 1. Short Title and commencement-(l) This Act may be cited as the New Zealand Council for Postgraduate Medical Education Act 1978. (2) This Act shall come into force on the 1st day of April 1979. 2. ~nterpretation-in this Act, unless the context otherwise reqmres,- "Appointed member" means a member of the Council appointed under section 3 (2) (j) of this Act: "Colleges Liaison Committee" means the committee known as the Colleges Liaison Committee established by the professional colleges of medical practitioners in New Zealand: "Committee of the Council" means- (a) The national executive committee of the Council established under section 9 of this Act; or (b) A special committee established under section 10 of this Act; or (c) A regional executive committee established under section 13 of this Act: "Council" means the New Zealand Council for Postgraduate established by section 3 of this Act: "Employee" means an officer, or other employee of the Council, appointed under section 17 of this Act: "Financial year" means a year ending with the 31st day of March: "Minister" means the Minister of Health: "Person who is for the time being immediately responsible", in relation to postgraduate medical education at a faculty or division of a faculty, means- ( a) The one person (if any) who is responsible to the head of the faculty or division for the conduct of postgraduate medical education; or (b) If there is no such one person, other than the head of the faculty or division, the head himself: "Postgraduate medical education" means medical education for registered medical practitioners: "Registered medical practitioner" has the same meaning as it has in section 2 of the Medical Practitioners Act 1968: "Secretary" means the secretary to the Council appointed under section 17 of this Act.

Establishment of Council-( 1 ) There is hereby established a Council to be called the New Zealand Council for Postgraduate. (2) The Council shall consist of the following members: (a) The Director-General of Health: (b) The Chairman of the Medical Council of New Zealand: ( c) The Chairman of the New Zealand Postgraduate Medical Federation (Incorporated): (d) The person who is for the time being immediately responsible for postgraduate medical education at the Dunedin Division of the Faculty of Medicine of the University of Otago: ( e) The person who is for the time being immediately responsible for postgraduate medical education at the Faculty of Medicine of the University of Auckland: (f) The person who is for the time being immediately responsible for postgraduate medical education at the Christchurch Division of the Faculty of Medicine of the University of Otago: (g) The person who is for the time being immediately responsible for postgraduate medical education at the Wellington Division of the Faculty of Medicine of the University of Otago: (h) The regional director of the Waikato region: (i) The regional director of the Central region: (j) Eight other persons to be appointed by the Governor General on the advice of the Minister, of whom- (i) Three shall be persons who are registered medical practitioners (including at least one member of the New Zealand College of General Practitioners) to be appointed on the nomination of the Colleges Liaison Committee; and (ii) Two shall be persons who are registered medical practitioners to be appointed on the nomination of the New Zealand Medical Association; and (iii) One shall be a person who is a registered medical practitioner to be appointed on the nomination of the New Zealand Resident Medical Officers' Association; and
1978, No. 75 New Zealand Council for Postgraduate 781 (iv) One shall be a person who is a member of the University Grants Committee; and (v) One shall be a person who is not a medical practitioner. {3) The Council is a body corporate with perpetual succession and a common seal, and may acquire, hold, and dispose of real and personal property, and sue and be sued and do and suffer all other things that bodies corporate may lawfully do and suffer. ( 4) The powers of the Council shall not be affected by any vacancy in its membership. 4. Term of office of appointed members-( 1) Every appointed member of the Council shall hold office for a term of 2 years from a date to be specified in his appointment, and may from time to time be reappointed. (2) Notwithstanding subsection (1) of this section, the followh'"lg provisions shall apply in respect of the first persons appointed as members of the Council under section 3 (2) (j) of this Act: ( a) Three of the 6 members specified in subparagraphs (i), (ii), and (iii) of section 3 (2) (j) of this Act shall retire from office on the 31st day of March 1980: (b) All of the other members appointed under section 3 (2) (j ) of this Act shall retire from office on the 31st day of March 1981: ( c) The members who are to retire in the year 1980 shall be determined either by unanimous agreement between all of the members to whom this subsection applies or (failing such agreement) by lot conducted by the chairman, and in such a way that during the year ending with the 31st day of March 1981 at least one member specified in each of subparagraphs (i), ( ii ), and (iii) of section 3 ( 2 ) (j) of this Act continues in office. (3) Notwithstanding subsection (1) of this section, no appointed member who has held office for 3 consecutive terms shall be eligible for reappointment before the expiry of one year after he has last ceased to hold office. ( 4 ) Notwithstanding subsection (1) or subsection (2) of this section, every appointed member shall, unless he sooner vacates his office under section 5 of this Act, continue in office until his successor comes into office.
782 New Zealand Council for Postgraduate 1978, No. 75 5. Extraordinary vacancies-( 1) An appointed member may resign his office by delivering a notice in writing to that effect to the Minister. (2) An appointed member may be removed from office by the Governor-General for disability, bankruptcy, neglect of duty, or misconduct, proved to the satisfaction of the Governor-General. (3) If an appointed member dies or resigns, or is removed from office- ( a) The vacancy so created shall be filled in the manner in which the appointment to the vacant office was originally made; and (b) The person appointed to fill the vacancy shall be appointed for the residue of the term for which his predecessor was appointed. 6. Chainnan and deputy chairman-(l) At its first meeting, and thereafter at its first meeting in every financial year, the Council shall elect one of its members to be its chairman, and another of its members to be its deputy chairman. (2) The chairman and the deputy chairman, unless they sooner vacate their offices or cease to be members of the Council, shall respectively hold office until their successors are appointed and come into office. (3) Where the chairman or deputy chairman vacates his office or ceases to be a member of the Council before the expiration of the term for which he was elected, the Council shall elect another of its members to his office until the expiration of that term. ( 4) During every vacancy in the office of chairman, and while the chairman is for any reason unable to perform his ftmctions, the deputy chairman shall exercise and perform the functions, powers, and duties of the chairman. 7. Deputies-(l) The Director-General of Health may from time to time appoint a registered medical practitioner who is an officer of the Department of Health to attend a meeting of the Council as his deputy in his absence. (2) A person who is a member of the Council by virtue of holding office in or being a member of Cl body specified in any of paragraphs (b), (c), and (j) (iv) of section 3 (2) of this Act may from time to time appoint a member of that body to attend a meeting of the Council as his deputy in his absence.
1978, No. 75 New Zealand Council for Postgraduate 783 (3) A member of the Council specified in any of paragraphs (d) to (g) of section 3 (2) of this Act may from time to time appoint a member of the teaching staff of his faculty or division, as the case requires, to attend a meeting of the Council as his deputy in his absence. (4) The regional director of the Waikato region or the Central region may from time to time appoint a member of his regional executive committee to attend a meeting of the Council as his deputy in his absence. (5) Where a deputy appointed under any of subsections (1) to (4) of this section attends a meeting of the Council in the absence of the person he represents, he shall be deemed for the purposes of this Act to be a member of the Council, except that he shall not be deemed to be the chairman or deputy chairman by reason of the fact that he represents the chairman or deputy chairman. 8. Meetings of Council-( 1) The first meeting of the Council shall be held in the month of May in the year 1979, or as soon as practicable thereafter, at a time and place to be appointed by the Minister. (2) Subsequent meetings shall be held at least once in every financial year, at such times and places as the Council or the chairman from time to time appoints. (3) The chairman shall call a special meeting within one month after being required in writing by not less than 3 members to do so. (4) The secretary shall give to every member not less than 7 days' notice in writing of each meeting, and of the business to be transacted at the meeting. (5) No business may be transacted at a special meeting unless it is specified in the notice required under subsection ( 4) of this section. (6) Notwithstanding subsection (4) of this section, an inadvertent failure to comply with that subsection shall not invalidate the proceedings at a meeting that is not a special meeting. (7 ) Notwithstanding subsections (4) and (5) of this section, any business may be transacted at an ordinary or special meeting if all the members who are for the time being in New Zealand agree to its transaction at that meeting. (8) At every meeting, 9 members shall be a quorum. (9) At every meeting, the chairman shall preside.
784 New Zealand Council for Postgraduate 1978, No. 75 (10) Where for any reason neither the chairman nor (during a vacancy in the office of chairman or in the absence of the chairman) the deputy chairman is able to preside at a meeting, the members present shall elect one of their number to preside at that meeting. (11) Where a matter that is of special interest to a professional college of medical practitioners that participates in the appointment of members to the Colleges Liaison Committee is being discussed at a meeting of the Council, any members of that professional college (not exceeding 3 in number) may- (a) Attend the meeting; and (b) With the leave of the Council, speak at the meetingbut no person who attends pursuant to this subsection may vote on any question before the meeting. (12) Where a matter that is of special interest to a body (other than the Colleges Liaison Committee) that has power to nominate a member of the Council is being discussed at a meeting of the Council, any members of that body (not exceeding 3 in number) may- (a) Attend the meeting; and (b) With the leave of the Council, speak at the meetingbut no person who attends pursuant to this subsection may vote on any question before the meeting. (13) Every question before a meeting shall be decided by a majority of the votes of the members present at the meeting. ( 14) On every question before a meeting, the person presiding shall have a deliberative vote, and in the case of an equality of votes he shall also have a casting vote. (15) A resolution signed, or assented to by letter or telegram, by every member for the time being in New Zealand shall have the same effect as a resolution passed at a meeting. (16) Subject to this Act, the Council may regulate its procedure in such manner as it thinks fit. 9. National executive committee-( 1) There shall be a standing committee of the Council, to be called the national executive committee. (2) The national executive committee shall consist of the chairman of the Council, who shall preside, and 2 other members of the Council.
1978, No. 75 New Zealand Council for Postgraduate 785 (3) The members of the national executive committee (other than the chairman of the Council) shall be elected by the members of the Council, and shall hold office during the pleasure of the Council. (4) Subject to the control of the Council, the national executive committee shall be responsible for the management and direction of the affairs of the Council. (5) At every meeting of the national executive committee, 2 members of the committee (including the chairman) shall be a quorum. (6) At every meeting of the Council, the national executive committee shall report to the Council on the operations of the committee since the previous meeting. (7) Subject to this Act, to any rules made under section 22 of this Act, and to the control of the Council, the national executive committee may regulate its procedure in such manner as it thinks fit. 10. Special committees-( 1) The Council may from time to time appoint, alter, and discharge committees, consisting of one or more persons (whether members of the Council or not), and define and vary the terms of reference of such committees. (2) Subject to this Act, to any rules made under section 22 of this Act, and to the control of the Council, every committee appointed under this section may regulate its procedure in such manner as it thinks fit. 11. Regions-(l) For the purposes of this Act, New Zealand shall be divided into the following regions: (a) The Northern region: (b) The Waikato region: (c) The Central region: (d) The Wellington region: (e) The Canterbury region: (f) The Southern region. (2) Every region shall comprise the hospital districts specified in relation to that region in the First Schedule to this Act. (3) The Governor-General may from time to time, by Order in Council, vary the boundaries of a region by adding or excluding a hospital district.
786 New Zealand Council tor Postgraduate 1978, No. 75 M edical Education ( 4-) Where an Order in Council is made under subsection ( 3) of this section varying the boundaries of a region to include a new hospital district, the Order in Council may be made with effect retrospectively to come into force on the day on which the hospital district is constituted. 12. Regional directors-( 1) Each region shall have a regional director. (2) The following persons shall be the regional directors: (a) In the case of the Northern region, the member of the Council who is for the time being immediately responsible for postgraduate medical education at the Faculty of Medicine of the University of Auckland: (b) I n the case of the W aika to region, a registered medical practitioner, residing or practising in the region, appointed as the regional director by the Council: (c) In the case of the Central region, a registered medical practitioner, residing or practising.in the region, appointed as the regional director by the Council: ( d) In the case of the Wellington region, the member of the Council who is for the time being immediately responsible for postgraduate medical education at the Wellington Division of the Faculty of Medicine of the University of Otago: (e) In the case of the Canterbury region, the member of the Council who is for the time being immediately responsible for postgraduate medical education at the Christ church Division of the Faculty of Medicine of the University of Otago: (f) In the case of the Southern region, the member of the Council who is for the time being immediately responsible for postgraduate medical education at the Dunedin Division of the Faculty of Medicine of the University of Otago. (3) In respect of the regional directors of the Waikato region and the Central region, the following provisions shall apply: (a) Each of those directors shall be appointed as an officer of the Council under section 17 of this Act: (b) Subject to section 14 (5) of this Act, the salary and allowances of each of those directors shall be determined and paid in accordance with section 17 of this Act:
1978, No. 75 New Zealand Council for Postgraduate 787 (c) The employment of each of those directors may be determined in accordance with section 17 ( 3) of this Act: ( d) For the purposes of exercising any of its functions or powers with regard to the employment of each of those directors- (i) The Council shall not include those directors; and (ii) Eight members of the Council shall be a quorum. (4) Nothing in paragraphs (a) to (c) of subsection (3) of this section or in section 22 ( 1) ( d) of this Act shall be construed as limiting the status, as members of the Council, of the regional directors of the Waikato region and the Central region while they continue to hold their appointments as such directors. 13. Regional executive committees-( 1) There shall be a regional executive committee of the Council for each region. (2) Every regional executive committee shall consist of the following members: (a) The regional director, who shall be the chairman: (b) Five other persons to be appointed by the Council, of whom- (i) One shall be a person who is a member of a professional college of medical practitioners in New Zealand, to be appointed on the nomination of the Colleges Liaison Committee; and (ii) One shall be a person who is a member of a postgraduate medical society in the region, to be appointed on the nomination of the New Zealand Postgraduate Medical Federation (Incorporated); and (iii) One shall be a person who is a member of the New Zealand Medical Association, to be appointed on the nomination of the New Zealand Medical Association; and (iv) One shall be a person who is a resident medical officer in the region, to be appointed on the nomination of the New Zealand Resident Medical Officers' Association; and (v) One shall be a person who is a member of a hospital board the district of which is within the region, to be appointed on the nomination of the Hospital Boards Association.
788 New Zealand Council for Postgraduate 1978, No. 75 (3) Every member of a regional executive committee (other than the regional director) shall hold office during the pleasure of the Council. (4) Subject to the control of the Council and of the national executive committee, every regional executive committee shall be responsible for the management and direction of the affairs of the Council within its region. (5) Where a matter that is of special interest to a professional college of medical practitioners that participates in the appointment of members to the Colleges Liaison Committee is being discussed at a meeting of a regional executive committee, any members of that professional college (not exceeding 3 in number) may- (a) Attend the meeting; and (b) With the leave of the regional executive committee, speak at the meetingbut no person who attends pursuant to this subsection may vote on any question before the meeting. (6) Where a matter that is of special interest to a body (other than the Colleges Liaison Committee) that has power to nominate a member of a regional executive committee is being discussed at a meeting of that regional executive committee, any members of that body (not exceeding 3 in number) may- (a) Attend the meeting; and (b) With the leave of the regional executive committee, speak at the meetingbut no person who attends pursuant to this subsection may vote on any question before the meeting. (7) Subject to this Act, to any rules made under section 22 of this Act, and to the control of the Council, every regional executive committee may regulate its procedure in such manner as it thinks fit. 14. Remuneration of members of Council and committees ( 1 ) The Council and every committee of the Council are hereby declared to be statutory Boards within the meaning of the Fees and Travelling Allowances Act 1951. (2) There may, if the Minister so directs, be paid out of the funds of the Council to-- ( a) The chairman of the Council; and (b) The deputy chairman of the Council; and ( c) Any member of the Council; and ( d) The chairman of a committee of the Council; and
1978, No. 75 New Zealand Council for Postgraduate 789 (e) Any member of a committee of the Councilfor his services as such, remuneration by way of salary or fees in accordance with the Fees and Travelling Allowances Act 1951. (3) There shall be paid out of the funds of the Council, to every person specified in any of paragraphs (a) to (e) of subsection (2) of this section, travelling allowances or travelling expenses in accordance with the Fees and Travelling Allowances Act 1951 in respect of time spent by him travelling in the service of the Council and of committees of the Council. (4) Except as provided in subsection (5) of this section, subsections (2) and (3) of this section shall not apply to an employee of the Council. (5) Notwithstanding any other provision in this Act, the following provisions shall apply in respect of the attendance of the regional directors of the Waikato region and the Central region as members at meetings of the Council and of committees of the Council: (a) If the Minister so directs, they may be paid remuneration by way of salary or fees under subsection (2) of this section, instead of salary under section 17 of this Act: (b) They shall be paid travelling allowances or travelling expenses under subsection (3) of this section, instead of travelling allowances or travelling expenses under section 17 of this Act, in respect of time spent by them travelling in the service of the Council or of any such committee to or from such meetings. (6) The Fees and Travelling Allowances Act 1951 shall apply accordingly. 15. Proceedings not affected by irregularities-no proceedings of the Council or of a committee of the Council, or act by a person who is a member of the Council or of a committee of the Council, shall be invalid by reason of any defect in the appointment or election of any person under this Act. 16. Limitation of personal liability of members-no member of the Council or of a committee of the Council shall be personally liable for any act done in good faith by him, or omission made in good faith by him, in the course of the operations of the Council or the committee.

Staff-Cl) In addition to the regional directors for the Waikato and Central regions, the Council shall from time to time appoint a secretary to the Council. (2) The Council may from time to time appoint such other officers and employees and such agents as it thinks fit for the effective and efficient conduct of the affairs of the Council. (3) Subject to the terms of any agreement, the Council may from time to time terminate the employment of any of its employees and the engagement of any of its agents. ( 4) The secretary shall be paid such salary and allowances as are from time to time determined by the Higher Salaries Commission. (5) The Higher Salaries Commission shall also from time to time determine the salaries and allowances that (subject to section 14 (5) of this Act) shall be paid to the regional directors of the Waikato region and the Central region. (6) Subject to the Higher Salaries Commission Act 1977, the other employees of the Council shall be paid such salaries and allowances as the Council from time to time determines after consultation with the State Services Commission. (7) The Council may pay to any of its agents such fees as may be agreed between it and the agent. (8) All salaries, fees, and allowances payable under this section shall be paid out of the funds of the Council. (9) The Council may, for the purpose of providing a superannuation fund or retiring allowance for any of its employees, subsidise out of its funds any scheme under the National Provident Fund Act 1950 containing provision for employer subsidy or any other employer-subsidised scheme approved by the Minister of Finance. 18. Status of members and staff-no person shall, by reason of his being a member of the Council, or of a committee of the Council, or by reason of his being an employee or agent of the Council, be held to be employed in the State services for the purposes of the State Services Act 1962 or in the Government service for the purposes of the Government Superannuation Fund Act 1956. Functions and Powers of Council 19. Functions of Council-The Council shall have the following functions:
1978, No. 75 New Zealand Council for Postgraduate 791 (a) To advise the Minister on national and regional needs in respect of the organisation and financing of postgraduate medical education: (b) To initiate, co-ordinate, and support schemes for postgraduate medical education: ( c) To collect and disseminate information on postgraduate medical education: ( d) To liaise with universities and other teaching institutions offering courses in postgraduate medical education: (e) To initiate, co-ordinate, and support research into and the evaluation of programmes for postgraduate medical education. 20. General powers of Council-The Council shall have the following powers: (a) Subject to the terms of any trust or endowment, to expend the money of the Council for the purposes of carrying out its functions: (b) To make grants to approved persons to assist them to undertake studies approved by the Council: (c) To make grants to universities in New Zealand and to institutions and bodies of persons (whether incorporated or not) for the purposes of postgraduate medical education: ( d) Such other powers as are reasonably necessary or expedient to enable the Council to carry out its functions. 21. Delegation of powers-( 1) The Council may from time to time, in respect of a specified matter or class of matters, or in respect of a specified area within New Zealand. by writing delegate any of its powers to a member, officer, or committee of the Council. (2) Notwithstanding subsection (1) of this section, the Council shall not delegate to a member, officer, or committee- (a) The power of delegation conferred by subsection (1) of this section; or (b) Any power to borrow money.
792 New Zealand Council for Postgraduate 1978, No. 75 (3) Notwithstanding subsection (1) of this section, the Council shall not delegate to a member, officer, or committee (other than the national executive committee or a regional executive committee) any power to expend money or otherwise to deal with any property of the Council. (4) Subject to any general or special directions given to him or to it by the Council, a member, officer, or committee to whom any powers are delegated under this section may exercise those powers in the same manner and with the same effect as if they had been conferred on him or on it directly by this Act and not by delegation. (5) Every member, officer, or committee purporting to act pursuant to a delegation under this section shall, in the absence of proof to the contrary, be presumed to be acting in accordance with the terms of the delegation. (6) Every delegation under this section shall be revocable at will, and no such delegation shall prevent the exercise of any power by the Council. 22. Rules-(l) The Council may from time to time, by resolution, make rules (binding on the members, employees, and agents of the Council, and on the committees of the Council) for all or any of the following purposes: ( a) Regulating the proceedings of the Council: (b) Regulating the proceedings of committees of the Council, including the manner of voting at the proceedings of such committees and (in respect of committees other than the national executive committee) the quorums at meetings of those committees: ( c) Providing for the custody of the property of the Council and the use of its common seal: ( d) Prescribing the duties of the employees of the Council. (2) Notice of every proposed resolution for the making, amendment, or revocation of a rule (including a copy of the proposed rule, amendment, or revocation) shall be given to every member of the Council for the time being in New Zealand, not less than 14 clear days before the day fixed for the meeting. (3) On making any rule under this section, the Council shall make a copy of the rule available, free of charge, to each person who is bound by the rule.

Annual estimates-( 1) The Council shall prepare and deliver to the Minister before the 31st day of December in every year an estimate (in this section called an annual estimate) of- (a) All payments that the Council proposes to pay during the next financial year commencing after that date; and (b) All receipts that the Council expects to receive during that next financial year. (2) The annual estimate shall show separately the amount of every sum that the Council expects to receive under section 24 of this Act during the financial year to which it relates. (3) Where thr Minister so requires, the Council shall prepare and deliver to him before such date as the Minister shall specify, being a date not before the 1st day of July in any financial year, an estimate (in this section called a preliminary estimate) in respect of any matters to be included in an annual estimate, or in respect of any matters to be included in the annual estimates for any future financial years that the Minister specifies. (4) Where the Minister so requires, the Council shall prepare and deliver to him an amendment to any annual estimate or preliminary estimate that has been delivered to him. (5) All annual estimates, preliminary estimates, and amendments to estimates shall be confirmed by the Council at special meetings convened for that purpose, before they are delivered to the Minister. 24. Annual grants to Council-For the purposes of providing funds for the carrying out of the functions of the Council, the Minister may in the financial year ending with the 31st day of March 1980 and in every subsequent financial year pay to the Council, out of money appropriated by Parliament for the purpose, such sum or sums as the Minister of Finance may from time to time approve. 25. Gifts-Any local authority within the meaning of the Local Authorities Loans Act 1956, public body, body corporate, trustee or trustees, unincorporated body of persons, or other person may, unless expressly prohibited from doing so by any enactment or by the terms of any trust or endow-
794 New Zealand Council for Postgraduate 1978, No. 75 ment, make to the Council any gifts of money, or land or interests in land, or chattels; and the Council may accept any gifts so made. 26. Borrowing powers--the Council may from time to time, with the consent of the Minister of Finance and subject to such conditions (if any) as he thinks fit to impose, borrow money and for that purpose issue securities or mortgage or charge any of its real or personal property. 27. Bank accounts-( 1) The Council shall open in its own name and maintain a principal bank account at the Bank of New Zealand. (2) The Council may from time to time open in its own name and maintain such imprest accounts as it may determine at the Bank of New Zealand. (3) All money lawfully received by the Council shall, as soon as practicable after receipt by a proper officer, be paid into the bank account opened under subsection (1) of this section or, subject to any general or special directions of the Council, into an imp rest account opened under subsection ( 2) of this section. (4) No money shall be paid out of a bank account opened under this section except with the authority and in accordance with any general or special directions of the Council. (5) A bank account opened under this section may only be operated on by cheque or other instrument (not being a promissory note or bill) signed by a member or officer of the Council who is authorised by it to sign cheques drawn on the account, and countersigned by another member or officer of the Council who is authorised by it to sign such cheques. 28. Investment of money-subject to the terms of any trust or endowment, the Council may from time to time with the consent of the Minister of Finance invest, in any manner in which trustees are for the time being authorised to invest trust funds, any money of the Council that is available for investment. 29. Unauthorised expenditure-the Council may in any financial year expend out of its funds, for purposes not authorised by this Act or any other enactment, any sum or sums not amounting in the aggregate to more than $500.

Exemptions from taxes and duties-for the purposes of the Inland Revenue Acts (as defined in section 2 of the Inland Revenue Department Act 1974), the Council is hereby declared to have been established exclusively for charitable purposes in New Zealand. 31. Accounts-( 1) The Council shall keep full and correct accounts of all money received and expended by it. (2) The Council shall, as soon as practicable after the end of every financial year, prepare a balance sheet and such other statements of account as are necessary to show fully the financial position of the Council and the financial results of its operations during that financial year. 32. Audit of accounts-the accounts of the Council shall be audited by the Audit Office, which for that purpose shall have the same powers as it has under the Public Finance Act 1977 in respect of public money and stores and of persons dealing with public money and stores. Miscellaneous Provisions 33. Annual report-the Council shall, as soon as practicable after the end of every financial year, furnish to the Minister a report of the proceedings and operations of the Council for that financial year, together with a copy of its audited accounts for that financial year and the report of the Audit Office on those accounts. 34. Tabling of report in Parliament-A copy of the report and of the audited accounts, together with a copy of the report of the Audit Office on those accounts, shall be laid before Parliament as soon as practicable after they have been received by the Minister. 35. Application of other enactments-the enactments specified in the Second Schedule to this Act are hereby amended in the manner indicated in that Schedule.
