Statutory Disclosure Notice to Commercial Lines Short-term Insurance Policyholders This disclosure notice is issued in terms of the General Code of Conduct for Authorised Financial Services Providers and Representatives, 2003 This document contains important information please read carefully and retain a copy. What is a statutory disclosure notice and why is it important? You will receive a Statutory Disclosure Notice at the inception of your policy and at each subsequent renewal or anniversary date. This notice does not form part of the Insurance Contract or any other document. The Disclosure Notice provides details about your Financial Services Provider and Product Supplier, additional general information about your rights and the Financial Services Provider s duties in terms of the FAIS Code of Conduct. It also provides information about the process to resolve disputes with your Financial Services Provider. 1. Legal status and relationship with the Insurer Stalker Hutchison Admiral is licensed as a Category 1 Financial Services Provider; license number 2167 Stalker Hutchison Admiral does not, directly or indirectly, hold more than 10% of any of the Insurer s shares. Stalker Hutchison Admiral received more than 30% of its total remuneration during the preceding 12 months from the Insurer. Stalker Hutchison Admiral is a 100% owned Subsidiary of the Insurer acting under mandate from the Insurer. Stalker Hutchison Admiral is authorised to write the following classes of short-term policies on behalf of the Insurer - Liability - Motor - Accident and health - Miscellaneous and to provide a claims service. The Insurer accepts responsibility for the insurance product underwritten by the intermediary on behalf of the Insurer within the scope of the mandate. 4. Written mandate to act on behalf of the Insurer Stalker Hutchison Admiral is acting in terms of a written mandate with the Insurer. A confirmation letter is available on request from the Insurer. 5. Whether in possession of a professional indemnity insurance cover Stalker Hutchison Admiral has Professional Indemnity Insurance. 6. Completing the proposal form and supplying information to your Insurer Any information provided to your Insurer for the purpose of obtaining insurance forms the basis of the insurance contract between you and your Insurer. This includes information provided in your proposal form if applicable. All questions on the proposal form must be fully and truthfully completed. Should you be unsure if an answer provided in your proposal form is correct or sufficient, or whether information not asked on your proposal form, but which is within your personal knowledge should be disclosed, discuss this with your broker before signing your proposal form. All material information which could affect the Insurer s decision to accept the risk or the premium to charge or impose conditions for acceptance should be provided. Information which is within your personal knowledge and which has not been requested on the proposal form should also be provided if such information could reasonably influence the Insurer s decision in any way. If you fail to disclose information which is material or misrepresent such information, the Insurer could avoid your Policy. Should any material aspect of the risk change after completing the proposal form, you should inform your broker without delay. 7. 8. Extent of monetary obligation assumed We have provided your broker with details of your premiums and fees due. Your broker should provide you with a detailed statement indicating the total monetary obligation in respect of the insurance policy, including details of the commission payable to your broker and the frequency of the required payment. 9. Manner of payment of premium, due date of premiums and consequences of non-payment The cover provided by this Policy is conditional upon payment of the premium. If the premium has not been paid on the due date, the policy will be deemed void from inception. The due date for payment of premium is the date of inception or renewal. If a broker has an IGF or guarantee as required by the Short-term Insurance Act to collect premiums, you may pay the premiums over to the broker. If a broker does not have an IGF or guarantee then you must pay the premium to the Insurer and the banking details can be obtained from the compliance department of Stalker Hutchison Admiral (Pty) Ltd or from the broker. 10. Duties of a Financial Services Provider In terms of the General Code of Conduct developed in terms of the FAIS Act, Product Suppliers (Insurers) and Financial Services Providers (Intermediaries) are required to render financial services honestly, fairly, with due skill, care and diligence and in the interest of the client and the integrity of the financial services industry. 11. Details of how to institute a claim on the policy Procedures for the submission of claims are given in the policy document. Should the policy document not contain the procedure for instituting a claim, the claim should be submitted to your broker, or alternatively to Stalker Hutchison Admiral at the address mentioned in 1(a) above. 12. Internal complaints resolution procedure Should you wish to lodge a complaint regarding the intermediary service rendered to you, you may address your complaint - in writing to complaints@sha.co.za - in writing to us at the postal address indicated in 1 (a) above; or - telephonically to the Compliance Officer at the number indicated at 1(a) above. Your complaint should provide full details of the intermediary service of which you are complaining. A copy of all relevant documentation should accompany your complaint. If your complaint is not satisfactorily resolved within 6 weeks from the date that you have lodged it with us, you may proceed to lodge a complaint with the appropriate Ombudsman. Details of the Ombudsman If the complaint is against your insurer as identified in 2(a) above, you must lodge a complaint with the Ombud for Short-Term Insurance. If you have a complaint against your intermediary you must lodge a complaint with the FAIS Ombud. Other matters of importance You will be informed of any material changes to the information referred to in paragraph 1 and 2. You are entitled to a copy of the policy free of charge. No person may request or induce you to waive the rights as set out in this disclosure notice. Any excesses for which you will be responsible in the event of a claim will be indicated in your policy and the schedule. Details of exclusions of liability are indicated in your policy document. 14. Warning Do not sign a blank or partially completed application form. Complete all forms in ink. Keep all documents handed to you. Make notes as to what is said to you.
