Casual Franchise Trainers are charged a gym usage fee on a 10 session basis, there will be no additional charge to you if you use this arrangement. Special(Note( (Inclusive(Classes:( There may be occasion where we host within the club classes lead by a Franchisee, or an external trainer and they will not be included in any of the packages above and must be paid for separately. Such classes will be clearly marked as not included in Activ8 membership. Where possible we will arrange for package members to receive a discount. When a discount is available with your consent we can also arrange for the charge of these classes to be added seamlessly to your billing. Special(Note( (Trainer(of(your(choice:( For those packages which specify trainer of your choice we will always endeavour to provide you with that trainer, however some circumstances are beyond our control in which case we will provide you with options and should you wish to cancel the session we will waive the cancellation of PT sessions policy. In the event that the selected Personal Trainer is no longer available long term we will work with you to find a suitable replacement to fulfil the remainder of your package. The unavailability of a selected trainer cannot be used as grounds for cancellation. Trainers must be Activ8 staff. Page: 4
What are the Joining Fees? Our joining fee applies when you start a new membership. It is not refundable, even if you cancel during your cooling off period. The amount is on your membership agreement. If you have deferred your start up fee or any other fees to be taken from your next direct debit, we will charge you the higher fortnightly amount until you pay the deferred fees, as in your membership application and agreement. Are there any Age Restrictions? Our younger members must be at least 14 years old, unless we have received medical clearance. If you are under 16, a parent or guardian must complete your pre-exercise questionnaire and an adult must supervise you when you are using our facilities. You must be at least 16 to do weight-based group exercises or resistance training activities. See our section on Kids In Gyms. We welcome all our senior members but strongly recommend they seek advice from their medical partitioner before commencing with us and complete the Pre-exercise questionnaire. When does my contract/membership begin? It begins once both parties have signed the agreement. Is there a cooling off period? You have a 14-day cooling off period from date of signing contracts, where you can cancel your membership. To cancel your membership, please refer to cancellation options. Your start up fee is not refundable if you wish to cancel within this period. What about your health before commencement of membership? Before commencement of your membership, we highly recommend that you seek medical advice and take all necessary action before undertaking exercise. On the day you sign your agreement and each time you use our facilities, you promise to us that: You are in good physical condition You know of no medical or other reason why you cannot do active or passive exercise that may damage your health, safety, comfort or physical condition. Our staff and contractors are not medically trained. They are not medically qualified to assess if you and your guests are in good physical condition and can exercise without damaging health, safety, comfort or physical condition. If you or your guests are in any doubt, we strongly urge you to seek expert advice before starting an active or passive exercise program. Written notice from your health professional before commencement of your membership is required if applicable. Information you need to know once you become a member. When do you pay membership fees? You pay fees for ongoing memberships in advance each fortnight, by direct debit from a transaction account or credit card through the nominated company. You have the option to pay either 6 or 12 months upfront for a discounted rate. When your membership is due to end, you can renew it before the date it expires at your current rate. If you do not renew it before then, your membership fee will be set at the current rate. By renewing your membership, you agree to the current membership terms that apply at that time. Your Direct Debit Agreement. We will regularly debit your fortnightly club fees from your nominated account at a specific time, as agreed in your membership application and agreement. We will debit fees: On every second Wednesday night for fortnightly memberships. If a payment day is a public holiday, we will debit your account on the next business day. Note: debit dates are pre set for all members. Page: 5
What are your responsibilities for direct debits? You are responsible for: Making sure that your account can accept direct debits (your financial institution can confirm this) Making sure there is enough money in your account on the payment day and the 5 following days Telling us in advance (at least 48 hours before your next direct debit) if you are transferring or closing your account Telling us in advance (at least 48 hours before your next direct debit) about any changes to your credit card, such as its expiry date or number. What happens if your payment is late or disallowed? If you do not fully pay your fees on the due date, we will suspend your club access until your payments are up to date and you have given us your direct debit account details. You will charge a late payment fee for a failed payment. This will be debited from your account, and you authorize us to do this. We will continue to debit your nominated account without notice, until we have received the total amount owing. We will make a reasonable effort to let you know before we do so either by phone, in person at your club, or by writing to the address you last gave us. For membership/s in your name, you must make sure that the payment method you choose on your agreement continues throughout your agreement term, including nominated third party accounts. If the account details you give us fail, you are liable for all the resulting fees and debts. Can we change the terms of your agreement? We may sometimes add to, change or remove terms and conditions, club code and other membership conditions. This includes changing the club s opening and closing hours, its services and facilities and membership fees. The most up-todate terms and conditions always apply. You can find copies on our website at www.activ8fitness.com.au We will give you at least 3 Fortnights notice of any such changes by: Publishing them in our newsletter, or Placing a notice in the club, or Writing to the address you last gave us, or Contacting you by phone, or Advising on our website Can we increase fees? We reserve the right to increase your fees at any time after the minimum period of your agreement has ended. We will make a reasonable effort to tell you about this at least 3fortnights beforehand by writing to the address you last gave us (which may be an email address). We will consider that you will receive our letter or email on the second business day after it is sent. Where we have made a reasonable effort to let you know about a fee increase, you authorize us to increase any debits from your nominated account in line with this increase. Can you freeze your membership payments? You can freeze your membership in multiples of 1 fortnight, for any period of time. Each time freeze period must start and end on a fee payment day. We will charge you a $4.95 fee for each fortnight you freeze your membership. The fee can be paid in advance or by direct debit. NOTE: If you are within minimum agreement Time Freeze is not classified as a full payment toward your minimum agreement period Before freezing your membership, you must: ensure you pay all fees owing and have your membership fees up to date. Using your access card You will be given an access card when you join. We will also attach your photo to your account on our digital membership database. If you visit the club without valid access card or photo identification, we may refuse you entry. The card is our property you cannot lend your access card to anyone else or allow anyone else to use it. If you lose or damage your card, we will replaced at a cost of $10. Looking after your health. If you believe there is a risk to your health from doing any club fitness activities, you must tell us this in writing, with full details. You must also tell us if your medical condition changes after you join. We may choose to refuse your membership application, until: your doctor agrees in writing to your club exercise program, or you show us proof that you have received medical advice on an appropriate exercise program. Looking after others health. You will not use club facilities while suffering from: an infection, or a contagious illness, or a physical ailment, such as an open cut or sore, or where there is any other risk, however small, to other members and guests. Cancellation of Scheduled PT sessions. We understand that due to unforseen circumstances there is a need to cancel sessions. With notice we will make the best effort to reschedule these sessions to maintain consistency with your training. Members must provideus with 24hrs notice of any cancellations of Personal Training session. Failure to observe this request will incur a cancellation fee of the full session charge. Feedback and Complaints. We welcome all positive and negative feedback and complaints. This helps us continually improve. If you have any feedback or questions about anything within Activ8s clubs and/or services, please do so by either filling in form at reception, speak directly to staff member or on the website www.activ8fitnes.com.au Page: 7
Information about 24hr Operations Who can use the Gym 24/7. Only full paid active members are entitled to 24/7 access to Activ8 Facilities. Any member who brings a non-member into the Club during unstaffed hours acknowledges that: They accept responsibility and liability on their personal behalf for any injury, loss and/ or damage attributed to the non-member whether or not caused through the negligence of Activ8. Their membership may be terminated immediately without written notice with all termination fee s applicable. They will be fined a $250 non-compliance fee charged to their account to be taken on the next debit. They may be prohibited from re-joining any Club operating under the Activ8 brand. Unstaffed Hours. 24/7 operation will be unstaffed on some occasioning out of set hours. As a member utilising the facilities you acknowledge that you enter and use the facilities at your own risk. If you feel there is a risk to your personal property, health and safety or you have any other concerns regarding the undue effect of exercising in an unstaffed facility, then DO NOT sign this Agreement. Staffed Hours. The staffed hours for the Club are displayed at the entrance to the Club. Activ8 reserves the right to make amendments to staffed hours without notice. Video Surveillance. For the safety of all members video surveillance equipment is monitoring the Club on a 24 hour basis. By signing this agreement you acknowledge that by accessing the facility you will be subject to video surveillance and recording. Video surveillance is limited to the floor area only, and is not within the walls of the bathrooms or client screening rooms. Mobile Alert/Problem Pendent. You have the responsibility to wear and use the mobile pendent when training out of staffed hours. First Aid Kits There is a first aid kit provided on the wall within the gymnasium. This will be pointed out in the orientation. You accept it is responsibility to follow the correct procedures when using this kit. These procedures will be explained in orientation Minimum Ages. Kids in Gym Guidelines are that any children under the age of 16 must be supervised by an a adult with a qualified registered staff member on premises. As such members under the age of 16 may only attend during staffed hours, with an adult. Training with a Franchise Trainer If you train with a Franchise trainer you and your trainer may only use the gym during staffed hours. Page: 8
What you need to know about ending your membership. While we never want to see a member leave we fully respect that you may want to leave our club. Below are the details of how you can do this. Please understand that there a certain timelines and contract agreements that we both need to fulfil. Cancelling your membership You can request to cancel your membership by one of these ways: At reception of your club Phone us If you wish to cancel you can do so by paying out the remainder of your agreement. This is calculated by multiplying the fortnightly fee on your membership agreement by the number of fortnights left in your minimum term. How do you cancel after the initial term? After the expiry of the initial term of your membership you or we may cancel your membership with written notice of 2 fortnights. You can cancel your membership before the minimum term ends, so that your membership expires at the end of the minimum term or at any time after that, by giving us at least 2 full fortnights notice taken from your next direct debit date. You cannot freeze your membership payments during the 2 fortnights notice period. When you cancel your membership, you must pay any fees owed or outstanding fees to us, or we may take action to recover them. Is it possible to cancel without paying out the remainder of your agreement? You can cancel your membership during the minimum term if: You become sick or incapacitated. You must show us a certificate agreement from a qualified medical practitioner stating that you cannot exercise for the remainder of your term. You become bankrupt., and provide supporting documents of this. We make changes to the contract that adversely affect you. Club rules You must at all times follow club rules. What happens I break the code? We can refuse entry to anyone, including members. If you act unreasonably, or break these terms and conditions or the club rules, we may warn you that you risk having your membership cancelled. If you continue to behave in the same way, we may cancel your membership immediately. We can cancel your membership without warning if you behave in a way that is risky or seriously inappropriate, such as: Threatening or harassing others Damaging equipment Using illegal or performance-enhancing drugs. Providing instruction to other members where you are not authorized by us to do so. Use equipment correctly You are responsible for using our facilities and equipment correctly, including adjusting levels or settings. If you are not sure how to operate any equipment; please see a club staff member before you use it. For members who wish to use the Weights Area outside of staffed hours Activ8 strongly recommend that members select and use weight levels that they have trained with before and can comfortable complete the sets and reps desired. Specifically (but not inclusive), exercises utilising the bench press, squat rack and cable machine with inappropriate weight levels could result in serious injury Page: 9
Respect our club facilities You are responsible for any damage to club facilities caused by you or your guests through a wilful act or negligence. We will provide you of the costing of any damage and this will be added to your next debit transaction. Lockers We provide lockers for you to use while exercising. These are not security lockers, so please keep valuable items with you. We try to safeguard the contents of your locker, but thefts can occur. We do not accept responsibility for any loss or damage to any belongings not kept in a locker, or if someone breaks into your locker. Please keep your access card with you and keep it safe. If you leave belongings in your locker overnight, we may remove them. Clothing and hygiene All members and guests must wear suitable clothes and enclosed sports shoes in any exercise areas, except for wet areas. We do not allow clothes with offensive images or inappropriate advertising. Please use a clean towel when you use equipment, including exercise mats. Failure to do so may lead to refusal entry to the club Parking You park in the club s car park or on club premises at your own risk. We are not liable for any loss or damage to your vehicle or its contents. Smoking The Smoke-free Environment Act 2000 requires enclosed public places in NSW to be smoke-free. This fact sheet outlines how the Smoke-free Environment Act 2000 affects sporting organisations. File link: What does it mean for sporting organisations? Drugs / Alcohol We have zero tolerance for illicit drug use, and evidence of such use will result in cancellation of any contracts immediately with full contractual payment due. We also fully respect the international sports association with regards to performance enhancing drugs and we will enforce our drug/alcohol policy to this extent. We hold the right to refuse entry or training to anyone whom we feel is under the influence of alcohol or in the stages of having been under the influence of alcohol. With 24hrs operations we cannot monitored directly. During unstaffed hours Activ8 has the right to use Security Surveillance systems to review footage and interview members who have exhibited behaviour that may indicate they were either intoxicated or under the influence. Further Activ8 retain the right to terminate membership unconditionally based on said video surveillance. Additionally Activ8 retain the right to hand over any Video surveillance to the appropriate authorities if exhibited behaviour display activities which may result in criminal charges. Guests You can bring guests into the club for a fee outlined in membership options. All guests must: Be at least 14 years old Be accompanied by you and leave when you do Sign the guest register and show a photo identity Complete a pre-exercise questionnaire (PARQ) on their first visit Follow the code and terms set out in the guest register and PARQ form, and any other club code on signs and handouts. For security reasons, children can only wait in the club if accompanied by an adult who s seated with them Page: 10
Kids In Gyms We welcome our youngest members and we follow the industry guidelines. Full details are available here http://www.dsr.nsw.gov.au/assets/pubs/industry/kidsingyms.pdf Age of entry and centre membership The ages at which children and young adolescents may enter or become members of centres will depend on the type of classes or programs available at each centre. Classes or programs are divided into the following categories: Non-weights-based group fitness classes and use of cardiovascular equipment Weights-based group fitness classes Unsupervised resistance training Other structured or supervised programs. Non-weights-based group fitness classes and use of cardiovascular equipment For the purposes of centre membership and the use of centre facilities and services as a centre member, it is recommended that the minimum age of entry to centres be 14 years of age for participation in general adult non-weightsbased group fitness exercise classes, including water-based activities and use of cardiovascular equipment. A pre-exercise screen should be assessed by a member of staff who has completed a Certificate IV Specialisation Module in Exercise for Children and Young Adolescents (see Role of the fitness professional, page 13) before the individual concerned commences any exercise program. Weights-based group fitness classes For the purposes of centre membership and the use of centre facilities and services as a centre member, it is recommended that the minimum age of entry be 16 years of age for participation in adults weights-based group fitness classes, including adults weights-based circuit classes and classes that incorporate boxing type exercises. A pre- exercise screen should be assessed by a qualified member of staff who has completed a Certificate IV Specialisation Module in Exercise for Children and Young Adolescents (see Role of the fitness professional, page 13) before the individual concerned commences any exercise program. Unsupervised resistance training For the purposes of centre membership and the use of centre facilities and services as a centre member, it is recommended that the minimum age of entry be 16 years of age for participation in unsupervised resistance training. An unsupervised resistance training program should only occur after a pre-exercise screen has been assessed by a member of staff who has completed a Certificate IV Specialisation Module in Exercise for Children and Young Adolescents (see Role of the fitness professional, page 13), and an initial resistance training program has been developed and supervised by a suitably qualified member of staff. Where a centre staff member is placed in a position of one-on-one supervision, or supervises a group fitness class behind closed doors with children or young adolescents, that person is subject to all laws and requirements under the Child Protection (Prohibited Employment) Act 1998 (NSW) and the Child Protection (Offenders Registration) Act 2000 (NSW). Membership contracts Normally, it is recommended that parents or guardians sign centre membership contracts entered into by children or young adolescents under the age of 18 years. However, centres may, at their discretion, sign a membership contract directly with an adolescent between 16 and 18 years old. Membership contracts entered into by a child or young adolescent under the age of 16 years must be signed by a parent or guardian. Casual use of facilities by children and young adolescents No children or adolescents under the age of 14 years should be admitted into a centre unless they are part of a scheduled program or are participants in: a sporting team a junior athletic squad a school group a special physical activity program conducted by the centre a water-based or swim class or any other supervised or structured activities. The Legal stuff Which laws apply to disputes? Your agreement is subject to Australian law and is governed by the state laws where your home club is located. If a court decides that any section of your agreement is invalid or unenforceable, that section will be deleted from the agreement. The other sections will remain valid and enforceable. Can we transfer your agreement? We can assign or transfer the benefit of your contract to a person, firm or company at any time. We will give you three fortnights notice in writing. We can also sub-contract our obligations to someone else without notice - but if we do, we are still responsible for ensuring those obligations are met. Can you transfer your Agreement? Activ8 memberships are transferrable to an existing or new member if deemed appropriate by Activ8 Management and will incur a fee of $50 charged to original membership holder. What if the GST rate changes? All agreement fees include goods and services tax (GST). Your fees will change in line with any government GST rate changes, even if you are in your minimum term. Keeping us informed. Your responsibilities, including payment of membership fees, do not depend on how often you use a club. You must tell us about anything that affects your membership, and any changes to your Contact and bank details Privacy statement and acknowledgement When you join and during your membership, we will have access to personal information about you, such as about your health and financial situation. We will only use, disclose or deal with your information in accordance with our privacy policy. Photographs of you. We may sometimes film or photograph the club. It is possible you may appear in the background. By signing your membership agreement you agree to allow us to use your image in promotional and other business-related material. Mobile Phones and Cameras. As a courtesy to other members, please keep taking and receiving calls to an absolute minimum. Cameras aren t permitted in club without written authorisation. Issues with outside providers. Contractors, tenants and franchisees provide some services in our club, such as personal training, physiotherapy and massage. Service fees are paid directly to them and we are not responsible for those fees. If you make a claim because of something an agreement or, tenant or Franchisee has or has not done; your claim should be brought against the provider, not us (Activ8), whether you have paid them or not. You releases from, and hold us harmless from, any claim resulting from an act or omission by an agreement or, tenant or franchisee. Wherever we can, we will help you to resolve issues with providers. We will also make sure that personal trainers in our clubs have up to-date qualifications and insurance. We only allow personal trainers from the activ8 franchise to work in our clubs. Release and Indemnity. You use the Facilities provided by Activ8 at the Club at your own risk and acknowledge that the use of the Facility may involve risk of injury, whether caused by you or another party. You release, to the fullest extent permitted by law, Activ8 Page: 12
against and from all expenses, costs, liabilities, claims, actions, proceedings, damages, judgements and losses of any kind whatsoever arising out of, caused by, attributable to or resulting from any accident, damage, loss, damage to property, injury or death to any person. You indemnify Activ8 against and from all expenses, damages, costs, liabilities, claims, actions, proceedings, judgements and losses of any kind whatsoever that Activ8 incurs arising out of, caused by, attributable to or resulting from any accident, damage, loss, damage to property, injury or death to any person caused by you at or in the Club or in the vicinity of the Club. Equipment. You understand and acknowledge that Activ8 purchases or leases the equipment from a third party and therefore does not manufacture any of the fitness or other equipment used in the Club. You understand and acknowledge that Activ8 is providing recreational services and may not be held liable for defective products or equipment. Physical condition and no medical advice You represent that you are in good physical condition and have no medical reason or impairment that might prevent you from your using the equipment at the Club. You acknowledge that Activ8 did not give you medical advice before you used the equipment, and cannot give you any medical advice after you use the equipment. If you have any health or medical concerns now or after you join as a member of the Club, you must discuss them with your doctor before using the equipment. Liability for property Activ8 is not liable to you for any personal property that is damaged, lost, or stolen while on or around the Club including, but not limited to, a vehicle or its contents or any property left in an open locker. If you cause damage to the Club or any equipment you are liable to Activ8 for its cost of repair or replacement. Change of details You must provide us with any changes to your details which are relevant to your membership. Entire agreement and enforcement You acknowledge that neither Activ8 nor any other party has made any representations or promises upon which you have relied when entering this agreement. This document contains the entire agreement between you and Activ8 and replaces any oral or other written agreement. Any manual or hand written changes to this agreement are not valid. If a court declares any part of this agreement invalid, it will not invalidate the remaining parts, which continue unaffected. If Activ8 does not enforce any rights in this agreement for any reason, Activ8 does not waive its right to enforce it later.
