To achieve our mission we have developed a unique recipe of activities and services. Our offer to you is to be active, experience a quality setting and achieve an outcome which will be fulfilling for you. The Tallebudgera Leisure Centre, at the Tallebudgera Active Recreation Centre, provides a range of community sport and recreation facilities and also has a fully equipped gymnasium. The Tallebudgera Leisure Centre Gymnasium The Tallebudgera Leisure Centre Gymnasium provides a community focused fitness environment to help you achieve your personal fitness goals and a healthier lifestyle. We have qualified, professional and friendly staff to provide advice and instruction. The gym has a combination of machine and free weight equipment, together with cardio equipment. A range of fitness services and advice to complement a fitness program is available. Gymnasium Membership Fees Gymnasium Memberships are available for 12 months, 6 months, 3 months and 1 month 12 Months $528.50 6 Months $376.50 3 Months $225.85 1 Month $101.55 Off Peak (12 months) $121.90 These fees are inclusive of GST and are subject to change without notice. Membership fees paid are non-refundable, except as prescribed in the Gymnasium Membership Terms and Conditions. Refer Schedule 2. Gymnasium Membership Entitlements Membership to the Tallebudgera Leisure Centre Gymnasium includes: One (1) Fitness Assessment; One (1) Exercise Program, which can be reviewed and updated as required; and Access to the Gymnasium during the Centre s operating hours. Pay to Play Services The following Pay to Play services are available to members: Additional Fitness Assessments; New Exercise Programs; and Use of other Tallebudgera Leisure Centre facilities (e.g. indoor courts, squash court, outdoor courts). Please contact Gym staff for the charges related to the above Gym services and the procedures to book these. Centre and Gymnasium Hours The gymnasium hours are the published standard opening hours of the Tallebudgera Leisure Centre, being: Monday Friday 6:00am 8:30pm Saturday and Sunday 7:00am 5:00pm The centre hours are subject to change without notice. The centre is closed on public holidays. The hours of supervision of the gymnasium vary each day. Please refer to the Gymnasium Supervision Schedule posted on the Centre s noticeboard. The gymnasium is not supervised on weekends. Gymnasium Staff and Supervision At certain times during the day our gym instructors may not be present in the gymnasium, as they will be conducting fitness assessments, preparing exercise programs or providing personalised advice. Supervisory gym staff are not rostered on weekends. During these times it is important that all members: Have been inducted into the gym; Are familiar with the use of all of the equipment; Comply with the Gym User Obligations as stated below; and Follow the personal exercise program that has been prepared for you. Off Peak Membership A limited number of 12 month Off-Peak Memberships are available. Access to the gymnasium is restricted to Monday to Friday between the following supervised times: 10.00am 12.00noon 2.30pm 3.30pm TALLEBUDGERA LEISURE CENTRE
Casual Access to the Gymnasium Casual access to the Gym is limited to the times that the Gymnasium is supervised by our staff. Gymnasium Members have priority access to the Gym at all times. The Centre therefore reserves the right to limit or refuse casual access at any time. Casual users are required to complete a Gymnasium Casual User Agreement and are not entitled to the benefits of Gym Membership. Please refer to the separate Gymnasium Casual Agreement for full details and terms and conditions of casual gym use. Gym User Obligations Each time you visit the gym, members are required to: Be a current financial member of the gym; Sign or Scan in at the Centre Reception desk before proceeding to the Gymnasium; Bring a towel for use on all benches; Wear appropriate covered footwear at all times; Wear appropriate exercise clothing lightweight, comfortable, breathable Bring a drink bottle to maintain hydration during your exercise program; Only use equipment you are familiar with and use this equipment in accordance with staff instructions; Exercise within your personal limits and use correct technique; Respect other gym users, our staff and other Centre users; Not be under the influence of alcohol or any prohibited substance; Disclose any new injury, illness or condition not included within your Pre-Fitness Medical Questionnaire; and Conduct themselves in accordance with the Centre and Gymnasium rules. Membership Renewal Two (2) weeks prior to the expiry of your membership we will send to your nominated postal address a Gymnasium Membership Renewal Notice. To ensure that your membership is continuous, you must return a completed and signed Membership Form at the Centre and make full payment, before the expiry date of your current membership. After the expiry date, access to the gym will be suspended until the membership is renewed. If membership is not renewed within fourteen (14) days after the expiry date, the membership will not be automatically renewed. The membership application will be placed at the end of the waiting list (if any). Renewal of a member s membership will be in accordance with the Fees, Terms and Conditions of Gymnasium Membership in force at the time of the renewal. Lockers, Valuables and CCTV Lockers are available for member use. Small lockers are located within the Gymnasium where you can place small personal items and valuables. Larger lockers are located outside the Gymnasium in the Leisure Centre Foyer for bags and clothing. Please contact Gym or Centre staff to gain access to these. The Centre does not take responsibility for any loss of personal items brought to the Centre. Do not leave personal items unattended. A Closed Circuit Television surveillance system is in place within the Centre. Members are advised that this system is in place to monitor use and provide security within the Centre. IMPORTANT Please read the following carefully. Ask any staff member to guide you into the most suitable program. Work at a low level on your first visit and concentrate on learning to do the exercise with correct technique before you increase intensity. On each visit you will be able to work a little harder. Be sure to limit yourself to a pace where you can still talk comfortably. It is recommended that all males over 35 and females over 45 have a medical clearance including an Exercise ECG and Cholesterol/Lipid count prior to commencing exercise. Your Guide to Joining the Gym To help you to prepare for your visit to the Tallebudgera Leisure Centre Gymnasium: Read this Gymnasium Information Guide and the Gym Membership Terms and Conditions included in Schedule 2. Please do not hesitate to ask any questions about our Gymnasium Memberships. Seek independent advice from your medical practitioner before joining or commencing any fitness program. Complete, sign and return Schedule 1 - Gym Membership Form (including Pre-Fitness Medical Questionnaire) with your full payment to the Centre s Reception staff. Book a day and time for your Fitness Assessment. On completion of the Fitness Assessment our Gym Instructors will prepare a Personalised Exercise Program to meet your fitness goals. Our gym staff will provide an induction session to the gymnasium including Centre / Gym rules, gym user obligations and equipment use. You re now ready to start your training program. TALLEBUDGERA LEISURE CENTRE GYM SCHEDULE 2 - CASUAL USER TERMS AND CONDITIONS Interpretation Gymnasium Membership Agreement means the Gymnasium Membership Form; Centre means Department of Communities Queensland s Tallebudgera Leisure Centre; Centre Manager means the person with overall management responsibility for the Centre or their representative; Department means the State of Queensland as represented by the Department of Communities; Fees and Charges means the current approved fees and charges displayed on Page 1 of the Gymnasium Information Guide; Member means the Applicant whose offer to take up membership to the Centre s Gymnasium has been accepted by the Department; Cooling-Off Period means the 48 hours immediately after membership is agreed between the Centre and the Member. Acceptance of Application for Membership The Department, through the Centre Manager may accept the Applicant s offer of membership of the Gym, but is not bound to do so. Access Access to the Tallebudgera Leisure Centre is at all times through the main front entry doors, unless otherwise authorised by the Manager. Application for Membership By completing and signing the Gymnasium Membership Form, the Applicant offers to take up membership of the Centre s Gymnasium ( the Gym ) on the terms and conditions set out below and agrees to comply with these terms and conditions in any use of the Centre. An application can only be made by a natural person. Cancellation of Memberships Agreement by The Department The Department, as represented by the Centre Manager, may at its absolute discretion cancel all or part of the Membership Agreement by giving the member at least two weeks notice in writing. The member acknowledges this right and agrees to irrevocably waive all rights to pursue any claim it may otherwise have in respect of any such cancellation. Charges The charge rate for the use of the Centre is to be calculated in accordance with the Fees and Charges displayed on Page 1 of the Gymnasium Information Guide. The Department reserves the right to increase charges without notice. Disclaimer of Liability and Indemnity The applicant agrees to indemnify and keep indemnified the Department, the State of Queensland, and their servants and agents from and against all actions, proceedings, claims, demands, costs, losses, damages, liabilities and expenses (except those arising from negligent acts or omissions of the Department, the State of Queensland or its servants, agents or employees), which may be brought against the Department, the State, and their servants, and agents as a result of the Applicant s or its agents, servants or invitees attendance at the Centre, and the Applicant hereby releases and discharges the Department, the State, their servants and agents from all such actions, proceedings, claims, demands, costs, losses, damages, liabilities and expenses. Fitness Service Supplied Fitness Service Supplied shall be the pro-rata membership fees paid, calculated on the number of days between the Membership Agreement Date and the Termination Date proportional to the Term of the Membership, after firstly deducting the administration fee. Goods and Services Tax The parties agree that monetary obligations and amounts referred to in this Membership Agreement are inclusive of GST (unless otherwise stated). Health of Applicant The applicant agrees that prior to executing the membership application form they are required to inform the Manager in writing should they believe there is any risk to the applicant s health by participating in a fitness service at the Tallebudgera Active Recreation Centre. It is strongly recommended that if there is any medical history that could influence your ability to participate in a fitness program that you seek a medical practitioner s approval prior to commencing the program. Limit of Membership The applicant will be entitled to the use of that part or parts of the Centre which are nominated in the Gymnasium Membership Application Form and must vacate these parts of the Centre at the Centre close time as notified at the Centre s entrance. Medical Advice The Applicant acknowledges that exercise specialists are not able to provide medical advice in regard to the applicant s medical fitness and that the Pre- Fitness Medical Questionnaire information is used only as a guideline to the limitations of ability to exercise and in the exercise prescription process to prescribe an exercise program. The Applicant hereby consents to voluntarily engage in a fitness appraisal. The applicant acknowledges that the Pre-Fitness Medical Questionnaire has been completed to the best of their ability and they understand the advice above. Membership Suspension The applicant may apply in writing to suspend their membership when a medical certificate is provided and is subject to approval by the Manager. Notices All notices required to be given under the Membership Agreement must be in writing and delivered to the address of the party that is stated in the Membership Agreement. Notices take effect from the time of receipt unless a later time has been specified. Notices sent by post are taken to be received on the second business day after posting. Payment of Fees and Charges Payment to the Department for the total fees and charges due shall accompany a completed Gymnasium Membership Agreement. Rules and Directions The member must comply with the rules that apply to the use of the Centre ( the Rules ) in any use of the Centre. A copy of the Rules that currently apply to the use of the Centre forms part of these Terms and Conditions. The Department reserves the right to change the Rules that apply to the use of the Centre at any time by the giving of fourteen (14) days notice of such change to the member. The member must comply with any additional orders and directions as considered appropriate by the Department through the Centre Manager for the use of the Centre. Severability If any part of these terms or conditions is determined to be invalid, unlawful or unenforceable wholly or to any lesser extent, such terms or conditions shall be severed from the remaining terms and conditions. The remaining terms & conditions shall continue to be valid and enforceable to the fullest extent permitted by law. Termination of Membership There shall be no refund of membership fees paid, other than during the coolingoff period or due to permanent sickness or physical incapacity. Termination of Membership by Centre Failure to comply with the Terms and Conditions of Gym Membership may result in cancellation of membership and forfeiture of all fees paid. Termination of Membership due to Permanent Sickness or Incapacity An applicant may terminate their membership due to their permanent sickness or incapacity by providing written notice of termination and a copy of a medical certificate stating that the applicant cannot use the Centre facilities because of the applicant s permanent sickness or incapacity. In this case the Tallebudgera Active Recreation Centre shall refund those monies paid for membership less any Fitness Service Supplied and an administration fee of 10% of the total membership. Termination of Membership during Cooling-Off Period If the applicant changes their mind after entering into the agreement, the applicant may terminate their membership during the Cooling-Off period by providing written notice of termination to the Manager. In this case the Tallebudgera Active Recreation Centre shall refund those monies paid for membership less any Fitness Service Supplied and an administration fee of 10% of the total membership. Transfer of Membership and Sub-Hiring The applicant must not sub-hire, transfer or assign any right or benefit under the membership, or any right to use or occupy all or part of the Centre. This specifically applies to third parties / private contractors such as personal trainers, who are not permitted to operate from the Centre. Page 3
Centre Rules Areas Off-Limits Members are strictly not to enter: Camper accommodation and activity areas; Swimming Pool unless a Lifeguard is present; Equipment Storage areas; Kitchens; and Other restricted areas as signed for safety reasons. Breakages or Damage The Hirer must report any facility problems or breakage to the reception of the Centre immediately. Members will be responsible for the cost of malicious acts and vandalism causing any loss, breakage of or damage to equipment and/or facilities. Disorderly Behaviour The Department through the Centre Manager may refuse to admit any person who, in his or her opinion, is inappropriately dressed or who is affected by drugs or alcohol. The Centre Manager may eject from the Centre any person who, in his or her opinion, is behaving in a disorderly, disruptive or dangerous manner for such period as will be determined by the Centre s Policy from time to time. Food and Drinks Food and drinks (other than water in a drink bottle) are not permitted within any of the indoor courts or carpeted areas of the Centre unless by prior arrangement and the agreement of the Department through the Centre Manager. Footwear Only non-marking rubber soled sports shoes are permitted to be worn on any of the indoor courts of the Centre, unless by prior arrangement and the written agreement of the Centre Manager. Gambling Gambling is not permitted on the premises. Injuries Any injury sustained within the Centre must be reported to the Centre Manager before leaving the Centre and as soon as is practicable. Prohibited Items The following items are not allowed within the Centre: Bicycles, Mini-Scooters, Pets, Skateboards/blades/roller-skates, Firearms, Fireworks, Prohibited substances, Offensive items, and unauthorised visitors. Rules and Directions The member must comply with the following rules that apply to the use of the Centre in any use of the Centre Smoking / Consumption of Alcohol Smoking is not permitted within the Centre (including all buildings and grounds) except within designated areas. Alcohol may not be consumed in any areas of the Centre, including all buildings and grounds. Workplace Health & Safety All persons at the Centre must comply with accepted practices and reasonable directions of the Department regarding workplace health and safety. Page 4
