CORGI HomePlan Terms and Conditions This contract of insurance is between You and Us (Prosight Syndicate 1110 @ Lloyd s). We bind Ourselves, and Our (Executors and Administrators) for 100% proportion of the risk in the event of loss, destruction or damage as defined herein and not jointly with any others. We are authorised by the Prudential Regulation Authority and regulated by the Financial Conduct Authority and Prudential Regulation Authority. Our Firm Reference Numbers and other details can be found on the Financial Services Register at www.fca.org.uk A defined word or phrase is in bold type each time it appears in the Policy and has a specific meaning or they are important words. Other words may be in capital letters which means they are also important words. Words in the singular shall include the plural and vice versa. Words importing the masculine will import the feminine and the neuter. There are also Words with Special Meanings. 1. treat this policy as if it had never existed and refuse to pay all claims and return the premium paid. We will only do this if We provided You with insurance cover which We would not otherwise have offered; 2. amend the terms of Your insurance. We may apply these amended terms as if they were already in place if a claim has been adversely impacted by Your carelessness; 3. charge You more for Your policy or reduce the amount We pay on a claim in the proportion the premium You have paid bears to the premium We would have charged You; 4. cancel Your policy in accordance with Our Cancellation Rights below. We or CORGI HomePlan will write to You if We: 1. intend to treat Your Policy as if it never existed; 2. need to amend the terms of Your Policy; 3. require You to pay more for Your insurance. If You become aware that information You have given Us is inaccurate You must inform CORGI HomePlan as soon as practicable. IMPORTANT INFORMATION Any heading in this Policy is for ease of reference only and does not affect its interpretation, amend the Policy cover or in any way increase Our liability. Like all insurance policies there are exclusions, terms and conditions. If Your boiler, appliance or system is covered by a third party warranty, it s Your responsibility to make sure that any work carried out doesn t affect that warranty The Insurance Contract This Policy is a contract of insurance between You and Us, please read it carefully and if incorrect, return it to CORGI HomePlan for correction. Keep the Policy safe in case You need to refer to it. It is important that You check that the sections You have requested and that the information You have given Us is accurate. You must comply with Your duties under each section and the insurance as a whole. Information you have given us In deciding to accept this insurance and in setting the terms and premium We have relied on the information You have given Us. You must take care when answering any questions We ask and make sure that all information provided is accurate and complete. If We establish that You deliberately or recklessly provided Us with false or misleading information We will treat this Policy as if it never existed and decline all claims. If We establish that You carelessly provided Us with false or misleading information it could adversely affect Your Policy and any claim. YOUR CANCELLATION RIGHTS Cooling off Period You have the statutory right to cancel Your policy within 15 days of the purchase or renewal of the contract or 15 days from the day You receive the policy or renewal documentation, whichever is the later. 1. If You cancel within 15 days of the First Policy Start Date We will return the premium in full. 2. If You cancel within 15 days of the Policy renewal Date We will return the premium less a proportional amount for the time that You have been on cover. No refund of premium will be given in the event of a claim either in whole or in part. Cancellation after the Cooling Off Period If You cancel this insurance outside the Cooling Off Period: 1. You will be entitled to a refund of any premium paid subject to a deduction for any time for which You have been covered calculated on a proportional basis. For example if You have been covered for six (6) months the deduction for the time You have been covered will be half the annual premium; 2. no refund of premium will be given in the event of a claim; 3. if You choose to cancel Your insurance within the first 12 months following the Initial Policy Start Date, CORGI HomePlan may charge You a 30 administration fee and if You have had any claims during that period We may require You rebate to Us 50% of the cost of the claims. How to Cancel Your Policy If You wish to cancel please write to CORGI HomePlan, 1 Masterton Park, South Castle Drive, Dunfermline, KY11 8NX. Cancelling Your Direct Debit does not mean You have cancelled Your Policy. For example We may:
OUR CANCELLATION RIGHTS We can cancel this insurance by giving You thirty (30) days notice in writing. We will only do this for a valid reason (examples of valid reasons are as follows): Non-payment of premium. A change in risk occurring which means that We can no longer provide You with insurance cover. Non-cooperation or failure to supply any information or documentation We request. You using threatening or abusive behaviour or the use of threatening or abusive language. If CORGI HomePlan are not able to find parts to keep Your system or appliance working. If any recommended remedial or maintenance works notified to You by the CORGI HomePlan engineer during a gas boiler service breakdown or repair are not carried out within 28 days of such notification. Your domestic central heating boiler does not meet Our eligibility criteria (for example if spare parts are no longer available). If We cancel and provided You have not made a claim You will be entitled to a refund of any premium paid subject to a deduction for any time for which You have been covered calculated on a proportional basis. The Consumer Insurance (Disclosure and Representations) Act 2012 sets out situations where failure by You to provide Us with complete and accurate information as We require allows Us to cancel the Policy sometimes back to its start date and to keep any premiums paid. CONTACTING CORGI HomePlan Please note that certain times of the week are busier than others, especially during the autumn and winter periods, so there might be a delay in answering Your call please be patient as we will do our best to limit Your waiting period. HOW TO MAKE A CLAIM Claims must be made via the CORGI HomePlan 24 Hour Claims Number by You or a person with Your authority calling on Your behalf at the time of the breakdown and/or failure. We will not cover the costs of work carried out by contractors not authorised by CORGI HomePlan. You must comply with the following conditions. If You fail to do so, We may not pay Your claim or any payment could be reduced. 1. Notify CORGI HomePlan as soon as practicable giving full details of what has happened; 2. Provide CORGI HomePlan with any information required and take all care to limit any loss, damage or injury. 3. Provide Us with evidence of value or age (or both) if We require. 4. Retain ownership of Your property at all times. We will not take ownership of, or accept liability for any of Your property unless We agree with You in writing in advance to do so. 5. It is Your responsibility to prove Your loss and retain receipts, photographs and guarantees where possible. If You or anyone acting on Your behalf makes a claim knowing it to be false or fraudulent in amount or in any other respect this insurance will become invalid. This means We will not pay the false or fraudulent claim or any subsequent claim. HOW WE HANDLE YOUR CLAIM Our Rights If any event happens which may give rise to a claim under this Policy We will be entitled to: 1. enter any building where the Damage has occurred and take and keep possession of Damaged Property Insured and deal with the salvage and this condition shall be proof of Your consent for such purpose. No property may be abandoned to Us; 2. exercise sole conduct and control over the defence or settlement of any claim made upon You or any other person or any other party covered by this Policy; and 3. prosecute in Your name or the name of any person covered by this Policy but for Our benefit any claim for compensation. COMPLAINTS We and CORGI HomePlan will always aim to do our best but unfortunately there may be times when things go wrong. CORGI HomePlan will try to deal with the matter immediately and keep You regularly informed about the progress of their investigation. We will write to You within two weeks with Our response. If You have not received Our response within 14 days You may contact Lloyd s direct. If You refer the matter to Lloyd s they will then conduct a full investigation of Your complaint and provide You with a written Final Response. If You appoint someone to act on Your behalf or if You ask someone else to act on Your behalf You must provide Us with written authority to allow Us to deal with them. If You employ a professional to represent You, You will need to meet their costs Yourself. WORDS WITH SPECIAL MEANINGS Arbitration If there is a dispute between You and Us this can be settled independently. If a dispute goes to arbitration it is settled by an independent referee who is referred to as an Arbitrator appointed by You and Us in accordance with the Statutory provisions being in force at that time. This avoids having to use the courts to settle the dispute. Going to arbitration does not affect Your statutory rights and is not binding on either party. Conditions Precedent There are conditions contained within the Policy that are condition precedent to Our liability. If You breach any of these conditions precedent this may render Your claim null and void or reduce the amount payable or We may treat this insurance as though it never existed. You may find Conditions Precedent apply only to a particular Section in which case it may also be shown under that Section. POLICY CONDITIONS PRECEDENT Annual Boiler Service It is a Condition Precedent to Our Liability that Your boiler has an annual service and safety check and is maintained in accordance with the manufacturer's instructions. In the event of a claim You must produce the current maintenance record should We or the CORGI HomePlan engineer require You to do so. DEFINITIONS 1. Contents means the contents of Your Home including removable fixtures and fittings and Your personal effects and those of any other person residing or visiting Your Home. 2. Damage(d) means impairment requiring repair or replacement arising from a cause not otherwise excluded. We do not cover Damage caused by You. 3. Excess means the first amount of each and every claim payable by You before CORGI HomePlan deploy an engineer or as otherwise stated herein. 4. Initial Policy Start Date means the date You take out Your first Policy as stated in the Schedule. Insurance cover does not commence until 30 days after the Initial Policy Start Date 5. Home means the building in which You permanently reside including permanent fixtures and fittings at the address as stated in the Schedule. 6. Policy means this document which contains all the terms and conditions of the insurance. 7. Policy Period means the period as stated in the Schedule. 8. We/Us/Our means ProSight Syndicate 1110 at Lloyd s of London. 9. Sum Insured means the maximum amount We will pay as stated in each section. 10. You/Your/Yourself means the person living in the Home as named in the Schedule. MAIN POLICY EXCLUSIONS The following are fully detailed in the relevant section: Section 1 Damage to the Central Heating System and any related pipework caused by or resulting from or for the removal of sludge, corrosion, scaling or debris. Damage to indirect mains pressure hot water thermal storage systems, for example Boilermate, Gledhill, Heatbank, Megaflo, Pandora by DPS, Potterton Suprima, Thermflow, Tribune or any other similar thermal storage heating system. Damage to underfloor heating. Section 2 Claims are limited to 300 in the first three months of cover when taking out Your very first Policy. For Boilers over 7 years old You will pay the first 50 of every claim. Damage to the Central Heating Boiler any related pipework caused by or resulting from or for the removal of sludge, corrosion, scaling or debris. Any system re-programming or batteries other than following the installation of a replacement boiler. Section 3 Any boiler which is beyond economical repair will not be replaced during the first 6 months following the Initial Policy Start Date. Boilers over 7 years old when taking Your very first Policy. Boiler replacement if spare parts are not available for the make or model of boiler which is specified in the Policy Schedule. Replacement of a boiler which is over 10 years old. Section 4 Taps, water softeners, filters, combined pop-up waste mechanisms, toilets cisterns, baths and shower seals and grouting. Leaking baths, toilets, shower trays and any Damage as a result of a leak. Any kind of electrical device used at a terminal end, for example light bulbs, domestic appliances. Wiring not installed to regulatory standards or in a dangerous condition, sheathed or cased in fabric. Damage to Your Contents. All Sections Pre-existing faults, system design faults and inaccessible components. Cost of repairs or maintenance carried out by You or an engineer not instructed by CORGI HomePlan. Damage if Your home is unoccupied for more than 30 consecutive days. Landlords and tenants. Damage caused by You.
WHAT LEVEL OF COVER DO I HAVE Your selected level of cover is stated in the Policy Schedule. WHAT WE COVER During the Policy Period We will pay for Damage from a cause as selected by You and We will pay up to the amounts stated below provided that the Damage is covered by this Policy. SECTION 1 CENTRAL HEATING SYSTEM 1.1 We will pay for Damage to Your central heating system including the external thermostat, radiators and valves, feed and expansion tank, vented or unvented hot water tank, pipes and fittings. Section 1 What we do not cover We will not pay in respect of Damage: 1.2 to the central heating boiler and or boiler controls; 1.3 to separate gas hot water heaters; 1.4 to electric, Liquid Petroleum Gas (LPG), solid fuel or oil fuelled boilers, back boilers and dual purpose boilers (for example such as Aga, Rayburn); 1.5 to gas fires, solar panels or green or renewable energy systems; 1.6 to parts either internal or external to the boiler; 1.7 to mains pressure hot water thermal storage systems, for example BoilerMate, Gledhill, Heatbank, Megaflo, Pandora by DPS, Potterton Suprima, Thermflow, Tribune and any other similar thermal storage heating system; 1.8 to central heating system and or heating controls specifically designed for piped or underfloor heating systems; 1.9 to remote control central heating systems, mobile phone or any other internet connected heating control equipment whose primary purpose is operating Your central heating system; 1.10 to electric central heating systems; 1.11 to warm air central heating systems; 1.12 due to or resulting from lack of normal day-to-day maintenance for which You are responsible, for example: re-pressurising or balancing of the central heating system, adjustments to the timing, temperature and other controls of the domestic central heating boiler, venting (bleeding) of radiators, or the addition of corrosion inhibitors; 1.13 caused by or arising from sludge, scale and other debris in the central heating system and related pipework. 1.14 any defect or failing which may be attributed to the original design of Your central heating system or its component parts; 1.15 any filter or related device for the purpose of removing sludge, scale or other debris from Your central heating or plumbing system; 1.16 repair or replacement of non-standard or extended flue systems; 1.17 any problems relating to pipes and condensate pipes caused by freezing weather conditions. The most We will pay for Damage arising from any one claim under Section 1 and Section 2 combined is 2000. SECTION 2 CENTRAL HEATING BOILER 2.1 We will pay for Damage to Your gas fired domestic central heating boiler as stated in the Schedule, including its integral controls, thermostats, frost thermostats, circulating pump, motorised valves, time clock or programmer, primary flue and draught diverter, any flue or flue terminals under 1 metre in length (but not including the central heating water pipework or controls). 2.2 If Your boiler is more than 7 years at the Initial Policy Start Date You will have to pay the first 50 of each and every claim where CORGI HomePlan deploy an engineer unless as otherwise stated in the Schedule. 2.3 For the first three months after the Initial Policy Start Date Our limit of liability for any boiler Damage (excluding replacement) is a maximum of 300 arising from any one claim. The most We will pay for Damage arising from any one claim under Section 1 and Section 2 combined is 2000. Section 2 - What we do not cover 2.4.1 to separate gas hot water heaters: 2.4.2 to electric, Liquid Petroleum Gas (LPG), solid fuel or oil fuelled boilers, back boilers and dual purpose boilers, for example: similar to Aga, Rayburn; 2.4.3 to gas fires or any other gas fired device not being a central heating boiler used for domestic purposes only; 2.4.4 to electric heaters; 2.4.5 to condensate lift pumps; 2.4.6 caused by or arising from sludge, scale and other debris in the central heating boiler and related pipework; 2.4.7 for any filter or related device for the purpose of removing sludge, scale or other debris from Your central heating or plumbing system, unless integral to the boiler; 2.4.8 due to or resulting from lack of normal day-to-day maintenance for which You are responsible, for example re-pressurising the boiler, adjustments to the timing, temperature and other controls of the domestic central heating boiler, venting (bleeding) of radiators or the addition of corrosion inhibitors; 2.4.9 attributed to the original design of Your gas fired domestic central heating system, central heating boiler or its component parts; We will not pay: 2.4.10 for repair or replacement of non-standard or extended flue systems; 2.4.11 for any problems relating to condensate pipes caused by freezing weather conditions; 2.4.12 for any defect or failing which may be attributed to the original design of Your gas fired domestic central heating boiler or its component parts; 2.4.13 programming Your central heating boiler controls or replacing batteries other than following the installation of a replacement boiler. SECTION 3 BOILER REPLACEMENT 3.1 If the CORGI HomePlan engineer cannot repair Your central heating boiler We have the option to replace the boiler with one of equivalent specification or as close as possible to Your original boiler subject to: i) At the Initial Policy Start date Your boiler must be less than 7 years old. We will pay up to 2500 for boiler replacement in any Policy Period.
ii) At the Initial Policy Start date if Your boiler is more than 7 years but less than 10 years old We will pay a contribution of up to 400 for boiler replacement in any Policy Period. 3.2 However if We have replaced Your gas fired central heating boiler during the first 12 months of You taking out Your first CORGI HomePlan Policy and You choose to cancel Your Policy You agree to reimburse Us with 50% of the cost of the replacement boiler within 30 days of Our request for such reimbursement. Section 3 - What we do not cover 3.3 The boiler will not be replaced during the first 6 months following the Initial Policy Start Date should the CORGI HomePlan engineer determine that the boiler is beyond economical repair. 3.4 The boiler will not be replaced if spare parts are not available for the make/model of boiler specified in the Schedule during the term of cover. 3.5 The boiler will not be replaced if You ignore any previously identified faults, defects or advice on maintenance and repairs given by a CORGI HomePlan engineer and which You have not completed. 3.6 Your boiler will not be replaced if it is over 10 years old. SECTION 4 PLUMBING AND ELECTRICS 4.1 We will pay for Damage to: i) internal plumbing; and ii) electric systems provided that the electrical supply is 240v and the Damage occurs within Your Home, beyond the electricity company s supply meter or other monitoring or measuring device. 4.2 The maximum We will pay for Damage arising from any one claim under Section 4 is 2000. Section 4 - What we do not cover 4.3 to taps and any related tap fault, water softeners and water filters, combined overflow and pop-up waste mechanisms; 4.4 to any plumbing or electrics external to Your Home; 4.5 to toilet cisterns, bath and shower seals or grouting, jacuzzi or spa baths including pumps and valves, swimming pools or similar, ponds, fountains and any associated pipes, valves or pumps; 4.6 to the plumbing or electric power supply between Your Home and any outbuildings; 4.7 caused by or resulting from leaking appliances (for example such as showers, shower trays, toilet pan and or toilet flushing systems); 4.8 to the Contents of Your Home; 4.9 to the electric company s supply meter or any other type of monitoring or measuring device, any kind of electrical appliance for example household domestic appliances, computers, mobile telephones, laptops or any other device which can be plugged into the electricity supply or any other form of power supply (for example such as batteries, power packs or solar power) or to electric hot water pumps or any part of Your water system designed to increase mains water pressure; 4.10 to alarm systems or security lighting, solar or photovoltaic panels or heat pumps; 4.11 to electrical Terminal Ends (for example such as light bulbs, electric showers); 4.12 to any wiring not installed to the regulatory standards or in a dangerous condition; 4.13 to any wiring that is sheathed or cased in fabric; 4.14 caused by or resulting from inadequately lagged pipes; 4.15 to any fixtures including lead piping where replacement is only necessary as a result of legislation or health and safety guidelines or to meet current best practice; 4.16 to plumbing systems which have not been installed serviced or maintained in accordance with established practice statutory regulations, British Standards or EU standards; 4.17 any reason more specifically excluded under Section 9. SECTION 5 INTERNAL DRAINS AND WASTE PIPES 5.1 We will pay for Damage to blocked or leaking internal drains and waste pipes for which You are responsible located inside Your Home. 5.2 The CORGI HomePlan engineer will unblock, repair or replace the drain or waste pipe in order to resolve the immediate emergency. Replacement of the drain or waste pipe will only be carried out if the replacement cost is the same or less than the emergency repair cost. 5.3 The most We will pay arising for any one claim under Section 5 is 1000. 5.4 You will have to pay the first 50 of each and every claim where CORGI HomePlan deploy an engineer. Section 5 - What we do not cover 5.5 to drains or waste pipes for which You are not solely responsible; 5.6 to temporarily frozen pipes which have not resulted in Damage which would have been covered had the Damage otherwise occurred; 5.7 to sewers, cesspits, septic tanks and any outflow pipes external to Your Home which are or are not connected to the main sewer; 5.8 to vacuum drainage systems, shared drains or sewers, and drains or sewers outside the boundary of Your property; 5.9 which occurs following a CORGI HomePlan engineers previous visit in the Policy Period for a claim under Section 5 where You have previously been advised of the need to install access points at Your own cost; 5.10 to swimming pools or similar, jacuzzi or spa baths, decorative features including but not limited to ponds, fountains and any associated pipes, valves or pumps; 5.11 to the Contents of Your Home; 5.12 caused by or resulting from leaking appliances, for example showers, shower trays, toilet pan and or toilet flushing systems, jacuzzi or spa baths, swimming pools or similar; 5.13 to pumps, for example sewerage pumps any associated electrics or valves, water softeners, waste disposal units and macerators, jacuzzi or spa baths, swimming pools or similar, ponds, fountains and any associated pipes, valves or pumps; 5.14 to drains or sewers caused by tree roots or subsidence, heave or landslip, earthquake or sink hole; 5.15 caused by or resulting from inadequately lagged pipes. 5.16 any repair work that may be required in addition to an emergency repair, repairs required to avoid the problem re-occurring or to ensure Your drainage system is restored to an adequate functional standard for ongoing use. We will not indemnify You for any realignment of drains or sewers or pipe work thereto to avoid a recurrence; 5.17 the removal from drains and or waste pipes of any items deemed to be unsuitable for disposal in drains, public drains and sewers.
SECTION 6 - EXTERNAL DRAINS 6.1 We will pay for Damage to blocked or leaking external drains or waste pipes connected to the mains drainage system outside Your Home for which You are solely responsible located within the boundary of Your property. 6.2 The CORGI HomePlan engineer will unblock, repair or replace the drain or waste pipe in order to resolve the immediate emergency. Replacement of the drain or waste pipe will only be carried out if the replacement cost is the same or less than the emergency repair cost. 6.3 The most We will pay arising for any one claim under Section 6 is 2000. 6.4 You will have to pay the first 50 of each and every claim where CORGI HomePlan deploy an engineer. Section 7- What we do not cover 7.4 to any water supply pipe which is the responsibility of the water supply company; 7.5 to any water supply pipe outside the boundary of Your property or for which You are not responsible, or fresh water pipes beneath or inside any building or outbuilding; 7.6 to frozen pipes the Damage from which has not resulted in a leak or permanent blockage; 7.7 to swimming pools or similar, jacuzzi or spa baths, decorative features, ponds, fountains and any associated pipes valves or pumps; 7.8 caused by or resulting from inadequately lagged pipes; 7.9 to the Contents of Your Home. Section 6 - What we do not cover 6.5 to drains or waste pipes for which You are not solely responsible or which are beneath or inside Your Home or any other building or out building; 6.6 to temporarily frozen pipes which have not resulted in Damage which would have been covered hereunder had the Damage occurred; 6.7 to sewers, cesspits, septic tanks and any outflow pipes external to Your Home which are or are not connected to the main sewer; 6.8 to vacuum drainage systems, shared drains or sewers, and drains or sewers outside the boundary of Your property; 6.9 which occurs following a CORGI HomePlan engineers previous visit in the Policy Period for a claim under Section 6 where You have previously been advised of the need to install access points at Your own cost; 6.10 to swimming pools or similar, jacuzzi or spa baths, decorative features, ponds, fountains and any associated pipes valves or pumps; 6.11 to pumps, for example sewerage pumps and any associated electrics or valves, water softeners, waste disposal units and macerators, jacuzzi or spa baths; 6.12 to drains or sewers caused by tree roots, subsidence, heave or landslip, earthquake or sink hole; 6.13 any repair work that may be required in addition to an emergency repair, repairs required to avoid the problem re-occurring or to ensure Your drainage system is restored to an adequate functional standard for ongoing use. We will not indemnify You for any realignment of drains or sewers or pipe work thereto to avoid a recurrence; 6.14 the removal from external drains and or waste pipes of any items deemed to be unsuitable for disposal in drains, public drains and sewers. SECTION 7 WATER SUPPLY PIPES 7.1 We will pay for Damage to fresh water pipes which are Your sole responsibility located within the boundary of Your property that connect Your Home to the mains water supply. 7.2 The CORGI HomePlan engineer will repair or replace the Damaged section of pipe in order to resolve the immediate emergency to reconnect Your property to the mains water supply. This will include temporary reinstatement of any excavations carried out as part of the claim. A permanent repair will only be carried out if the cost of this is the same or less than the emergency repair cost. In all other cases, the CORGI HomePlan engineer will carry out an emergency repair. 7.3 The maximum We will pay arising from any one claim under Section 7 is 2000. GAS LEAKS Any gas leaks MUST in the first instance be reported to the National Gas Emergency Service on 0800 111 999 SECTION 8 GAS SUPPLY PIPES 8.1 We will pay for Damage to gas supply pipes for which You are responsible located within Your Home which supply the central heating boiler and other gas appliances but not including the gas company's meter or other monitoring or measuring device. 8.2 The most We will pay arising from any one claim under Section 8 is 2000. Section 8 - What we do not cover 8.3 repairs to any gas appliance or central heating boiler; 8.4 any gas supply pipe which is the gas supply company s responsibility. SECTION 9 - TAPS AND TOILETS 9.1 We will pay for Damage to taps and toilet systems located within Your Home including: i) repair of leaking or dripping taps and the replacement of non-ceramic tap washers; ii) repair of leaking or running toilets including the repair or replacement of toilet ball cocks, valves and syphons. 9.2 The maximum We will pay arising from any one claim under Section 9 is 2000. 9.3 You will have to pay the first 50 of each and every claim where CORGI HomePlan deploy an engineer. Section 9 - What we do not cover 9.4 replacing taps, faucets, shower heads, hoses, riser rails, shower mixer valves or electric shower units; 9.5 replacing ceramic discs in taps or faucets; 9.6 extractor fans or macerator units for toilets for example Saniflo; 9.7 any Damage to cisterns, sinks, baths, showers, jacuzzi or spa baths; 9.8 Damage to Your Home or Contents; 9.9 any reason which is more specifically excluded under Section 4.
GENERAL EXCLUSIONS applicable to all sections. This Policy does not cover: 10.1 any loss resulting from inadequate pipe lagging; 10.2 Damage to any building, ground, land (unless otherwise stated herein), Your Home or Contents; 10.3 any Damage arising from circumstances where a fault is present prior to the start of the Initial Policy Period; 10.4 costs incurred where You have been advised of the need to carry out permanent repair work to avoid repetitive situations leading to a breakdown and/or failure. Such work will need to be carried out at Your own expense; 10.5 any Damage occurring where Your Home has remained unoccupied for 30 or more consecutive days; 10.6 Damage arising as a result of disconnection or re-connection from or interruption to the gas, electricity or water mains services to Your Home; 10.7 normal day-to-day maintenance of the elements covered by Your Policy at Your Home, for which You are responsible; 10.8 other than 7.2 the restoration of any fixtures or fittings removed in the process of conducting the repair for example fitted units, special floor coverings, wood block or ceramic tiles; 10.9 any liability for consequential loss whatsoever; 10.10 any repair which is too difficult or dangerous to access safely or where asbestos is present; 10.11 Damage caused by rodents or pests; 10.12 any fixtures where replacement is only necessary as a result of legislation or health and safety guidelines or to meet current best practice. Systems and/or equipment which has not been installed, serviced or maintained in accordance with established practice, statutory regulations, British Standards, EU standards or manufacturer's instructions; 10.13 any defect, Damage or breakdown caused through malicious or wilful action, negligence, misuse or third party interference including any attempted repair or modification to the domestic central heating boiler, heating system, electrics, plumbing or drainage which was not carried out by a CORGI HomePlan engineer; 10.14 other than 7.2 Damage to Your Home or Contents whilst completing a repair will not be reinstated to the original condition. The CORGI HomePlan engineer will advise if any Damage is likely to occur before the work commences; 10.15 any costs above the limits of cover. If there are any additional costs You are responsible for agreeing and settling these costs directly with the CORGI HomePlan engineer or as agreed with CORGI HomePlan; 10.16 any losses which are indirectly associated with the incident that caused You to claim unless caused by Our negligence or that of Our agents, or loss of earnings due to time taken off work to deal with the incident; 10.17 the costs of any work carried out by You or contractors not authorised by Us in advance; 10.18 any investigative work (for example CCTV) not authorised by Us in advance; 10.19 any defect, loss or Damage occasioned by fire, lightning, explosion, storm, tempest, flood, earthquake, impact or sprinkler leakage; 10.20 any loss arising from subsidence, heave of the site or landslip, bedding down of new structures, demolition or structural repairs or alterations to the property, faulty workmanship or the use of defective materials, river or coastal erosion; 10.21 any loss or Damage arising as a consequence of war, invasion, act of foreign enemies, terrorism, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection, coup, riot or civil disturbance, ionising radiation or contamination by radioactivity from any nuclear fuel or from any nuclear waste from combustion of nuclear fuel, the radioactive toxic explosive or other hazardous properties of any explosive nuclear assembly or its nuclear component; 10.22 landlords or tenants; 10.23 the cost of repairs needed because of design faults or faulty materials, operating error or omission by You or which the CORGI HomePlan engineer could not identify using reasonable care and skill; 10.24 Damage caused by You or for work undertaken by a third party which results in Damage; 10.25 any loss, Damage, cost or expense of whatsoever nature directly or indirectly caused by, resulting from or in connection with the actual or threatened malicious use of pathogenic or poisonous biological or chemical materials, regardless of any other cause or event contributing concurrently or in any other sequence thereto; 10.26 any loss, Damage, claim, cost, expense or other sum directly or indirectly arising out of or relating to mold, mildew, fungus spores or other micro-organism of any type, nature or description including but not limited to any substance whose presence poses an actual or potential threat to human health. This exclusion applies regardless whether there is; a) Damage to property insured; b) any contingency or cause whether or not contributing concurrently or in any sequence; c) any loss of use, occupancy or functionality; d) any action required including but not limited to repair, replacement, removal, clean-up, abatement, disposal, relocation or steps taken to address medical or legal concerns. This exclusion supersedes and replaces any provision either in whole or in part in this Policy that provides insurance for these matters. 10.27 any Damage which is the subject of cover under any other Policy covering the Damage; 10.28 only You will be able to benefit from this agreement which cannot be passed to someone else without Our prior agreement. 10.29 First service or annual service costs. EMERGENCY REPORTING GAS LEAKS Any gas leaks MUST in the first instance be reported to the National Gas Emergency Service on 0800 111 999 If You suffer a breakdown of Your central heating system, burst radiator (steel panels only) or failure of external controls, You must as soon as practicable call CORGI HomePlan on the 24 Hour Claims Number 0800 085 0845.
CORGI HomePlan will then; 1. advise You how to protect Yourself and the property; 2. organise the engineer call-out for the repair or replacement; and 3. in the event that a part needs to be ordered to rectify the breakdown, CORGI HomePlan s best endeavours will be made to source the part in the quickest available time and carry out the necessary work. Unfortunately there may be delays which are out with our control therefore We cannot accept any liability for any delay in obtaining any spare parts. SPECIAL NOTICE CONTACTING CORGI HomePlan Please note that certain times of the week are busier than others, especially during the autumn and winter periods, so there might be a delay in answering Your call please be patient as we will do our best to limit Your waiting period. Your 1. It is Your responsibility to allow CORGI HomePlan s engineer access to Your property to carry out any necessary work. 2. If the CORGI HomePlan engineer cannot gain access or considers that the circumstances are such that it is difficult or dangerous to carry out the work or where there is a risk to health or safety, the CORGI HomePlan engineer may at his discretion discontinue the service or repair. You will be contacted by CORGI HomePlan about this. 3. Should there be the presence of hazardous materials or infestation or should the CORGI HomePlan engineer be subject to any abuse (physical or verbal), the engineer may at his discretion discontinue the service or repair. You will be contacted by CORGI HomePlan to discuss the reason behind the engineer s discontinuance and how this might be resolved. 4. If You do not arrange an appointment or grant access Your Policy will continue even though the necessary work has not been carried out. If after several attempts You have not made an appointment or otherwise granted access We may cancel Your Policy. We will tell You in writing if this is the case. 5. If replacement parts are not readily available We are not responsible for any delays caused by CORGI HomePlan their agents or suppliers in obtaining spare or replacement parts. 6. Replacement parts for plumbing and electrical systems are not provided on a like for like basis but are replaced with the industry standard equivalent at CORGI HomePlan s discretion. 7. If a leak from internal pipework is discovered and is not easily accessible, the leak must be exposed prior to the CORGI HomePlan engineer s attendance. 8. We may change any of the terms upon which We provide the level of cover or any other term whatsoever. Where this change benefits You, We will make the change immediately and notify You of the change. In all other cases we will write to advise You of the change at least 30 days prior to any change taking effect. If You do not agree with the amendments You can cancel the Policy. We will return the premium subject to a deduction for any time for which You have been covered calculated on a proportional basis and there is no charge for administration fees. No refund of premium will be given in the event of a claim DATA PROTECTION You should understand that any information You have given Us will be processed by Us in compliance with the provisions of the Data Protection Act 1998 or any amendments, for the purpose of providing insurance and handling claims or complaints. As part of such processing, data may be requested from and transferred to insurance intermediaries, other insurer s, police forces, professional advisers, regulators, re-insurers and other service providers. LAW AND JURISDICTION This Policy is subject to the law of England and Wales. You are free to choose the court jurisdiction. Unless You tell us otherwise the jurisdiction of the courts of England and Wales shall apply. OTHER PARTIES A person who is not a party to this contract has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this contract but this does not affect any right or remedy of a third party which exists or is available apart from that Act. OTHER INSURANCE Sometimes what is covered under one insurance policy may also be covered under another insurance policy. For example: the cover or maybe some of the cover insured under this Policy could also be insured under Your household policy. If it is insured under two or more Policies We will either pay the full claim and claim half of this back from Your other policy insurers, or alternatively, We will pay only half of the claim and leave You to claim the other half back from Your other policy insurers. PREMIUM PAYMENT You undertake that the premium will be paid in full within thirty (30) days of the start of the Policy or by the date stated in the Schedule. If the premium is not received by midnight on the due date the Policy will automatically cancel. In the event of cancellation We will allow a return of premium made based on the number of days remaining in the Period of Insurance. However, the full premium is payable in the event of a loss prior to the date of cancellation which gives rise to a valid claim under this Policy. If Your premiums are paid monthly and should You fail to pay an instalment or fail to maintain a Direct Debit Mandate and such default is not corrected within 30 days the whole of the outstanding payments will become due and payable.
