BASIS: 1. Bradley Thomas (also "the Licensee") is licensed as a non-resident insurance producer in the stale of Washington, WAOlCNo. 813151, effective July 19, 2012. Bradley Thomas' resident insurance producer license is currently suspended in the state of Arkansas. 2. The Insurance Commissioner received notice through the Regulatory Information Retrieval System (RIRS) that the Idaho Department of insurance had taken administrative action against Bradley Thomas' non-resident license in that state. 3. On April 15, 2015, the Washington requested that Bradley Thomas provide a copy of the Idaho administrative action. The ORDER NO. 15-0119 Oiympia, WA 98504-0255
Licensee did not provide a copy of the Idaho administrative action, but rather responded to the request by indicating that his "license had been suspended for a year." 4. Bradley Thomas' license had actually been revoked by the Idaho Department of Insurance, not suspended for one year as indicated by the licensee. The Washington obtained a copy of the administrative action from the Idaho Depanmem of Insurance (Docket No. 18-3025-15). The Idaho Department of Insurance revoked Bradley Thomas' non-resident insurance producer license due to "incompetence, untrustworthiness, lack of good personal or business reputation, or financial irresponsibility." The Idaho Department of Insurance's revocation was based upon a Consent Order entered into by Bradley Thomas and the Arkansas Department of Insurance finding the Licensee engaged in "incompetence, untrustworthiness, lack of good personal or business reputation, or financial irresponsibility." 5. The obtained a copy of the Arkansas administrative action, A.I.D. No. 2015-008. The Arkansas Department of Insurance issued an emergency suspension order based on "multiple consumer complaints",dating back to 2005. After the issuance of the Emergency Order, Bradley Thomas and the Arkansas Department of Insurance entered into a consent order that suspended Thomas' resident license for one year beginning on January 28, 2015 and after that year, Mr. Thomas will be reinstated with two-years probation. Thomas' Arkansas agency license, Thomas & Associates, was revoked effective immediately. 6. The Licensee did not inform the Insurance Commissioner that actions had been taken against his insurance licenses in Idaho or Arkansas nor did he provide the Insurance Commissioner with copies of the Arkansas administrative action or the Idaho administrative action. 7. RCW 48.17.530(l)(h) allows the Insurance Commissioner to place on probation, suspend, revoke, or refuse to issue or renew an adjuster's license, an insurance producer's license, a title insurance agent's license, or any surplus line broker's license for using fraudulent, coercive, or dishonest practices, or demonstrating incompetence, untrustworthiness, or financial irresponsibility in this state or elsewhere. falsely that his "license had been, suspended for a year," when in fact, his Idaho nonresident producer license had been revoked and by failing to provide the Insurance Commissioner with a copy of the Idaho administrative action as requested, the Licensee violated RCW 48.17.530(l)(h), justifying the revocation of his license. Additionally, Thomas admitted to engaging in "incompetence, untrustworthiness, lack of good personal or business reputation, or financial irresponsibility,'" in th Arkansas Consent Order, violating RCW 48.17.5630(l)(h), justifying the revocation of his license. 8. RCW 48.17.530(i)(i) allows the Insurance Commissioner to place on probation, suspend, revoke, or refuse to issue or renew an adjuster's license, an insurance producer's license, a title insurance agent's license, or any surplus line broker's license for having an insurance producer license, or its equivalent, denied, suspended, or revoked in any other state, province, district, or territory. By having his.license suspended in his home state of Arkansas and his Idaho non-resident license revoked, the Licensee violated RCW 48.17.530(1)0), jusfifying the revocation of his license. 9. RCW 48.17.173(l)(a) and- WAC 284-187-122(1) require a non-resident producer to be currently licensed as a resident and in good standing in the licensee's home stale. By failing to maintain an active license in his state of residence and by failing to remain in good standing in his home state, the Licensee has violated RCW 48.l7.173(l)(a) and WAC 284-17-122(1). 10. RCW 48.17.597(1) provides that an insurance producer shall report to the Commissioner any administrative action taken against the insurance producer in another jurisdiction or by another governmental agency in this state within thirty days of the final disposition of the matter. This report shall include a copy of the order, consent to order, or other relevant legal documents. By failing to notify the Insurance Commissioner of the administrative actions taken by the Arkansas and Idaho insurance departments, the Licensee has violated RCW 48.17.597. IT IS FURTHER ORDERED that you return your insurance producer's license certificate to the Insurance Commissioner on or before the effective date of the revocation of your license, as required by RCW 48.17.530(4).
