Domain Name Suspension Request EASYDNS This Alert is issued by the United Kingdom s Police Intellectual Property Crime Unit (PIPCU). It provides you with notification of a domain(s) directly linked to online crime. This information is for your immediate attention and response.

1. Domain name suspension request Date 24/09/2013 The Police Intellectual Property Crime Unit (PIPCU) helps to direct the UK s response against intellectual property crime. The PIPCU alerts process is the way in which we provide information to non-law enforcement bodies, including the private sector to combat and disrupt online crime. We have identified the following domain(s) that we say are facilitating online crime. torrentpond.com 91.213.8.186 2. What we would like you to do We request that you review your processes to see if you provide a service for the identified domain(s). If so, we would ask you to review the terms and conditions on the basis of which that service is provided and withdraw or suspend the service if you are satisfied that the terms and conditions have been breached. You should also ensure that no changes to the DNS and WHOIS records are made by any party before the date of expiration of the domain. 3. The grounds on which PIPCU is making the request The owners of the aforementioned domains are suspected to be involved in the criminal distribution of copyrighted material either directly or indirectly and are liable to prosecution under UK law for the following offences: Conspiracy to Defraud Offences under the Fraud Act 2006 Copyright, Design & Patents Act 1988 Should a conviction be brought for the above offences, UK courts may impose sentences of imprisonment and/or fines. PIPCU has criminal and civil powers in UK law to seize money, belongings and any property in connection with these offences.

4. Breach of ICANN policy The ICANN Registration Accreditation Agreement (RAA) states in section 5.5.2.1.3 that accreditation as a Registrar can be terminated if the Registrar is found to have permitted illegal activity in the registration or use of domain names. The agreement also dictates that recorded WHOIS data must be accurate. As such we request that you review the WHOIS data in relation to the domain name(s) and consider suspension of the domain(s) on the basis of inaccurate information. 5. Breach of TERMS OF SERVICE PLEASE CONSULT YOUR TERMS OF SERVICE TO ASCERTAIN IF THERE ARE ANY MATERIAL BREACHES AS A RESULT OF THE CRIMINAL ACTIVITY IDENTIFIED. easydns Terms of Service easydns reserves the right to revoke any or all services associated with a domain or user account, for policy abuses. What constitutes a policy abuse is at the sole discretion of easydns and includes (but is not limited to) the following: transmitting Unsolicited Commercial Email (UCE) transmitting bulk email posting bulk Usenet articles Denial of Service attacks of any kind excessive use of the easydns web forwarding service excessive use of the easydns mail forwarding or spooling service copyright infringement misrepresentation of easydns services reselling or attempting to resell easydns services unlawful or illegal activities of any kind (this includes ponzi schemes and HYIPs) promotes net abuse in any manner (providing software, tools or information which enables net abuse) causing lossage or creating service degradation for other easydns users whether intentional or inadvertent. Is listed in the DNS Providers' Blacklist or in any other blacklist / RBL which easydns may reference.

6. Your response to this request Suspension of the domain(s) is intended to prevent further crime. Where possible we request that domain suspension(s) are made within 48 hours of receipt of this Alert. In respect of the information provided by us, we respectfully ask you to consider your liability and the wider public interest should those services be allowed to continue. We reserve the right to refer the matter to overseas counterparts/governmental organisations, and/or to ICANN. Please can you contact us via the e-mail address provided below, when you have taken action, or to communicate to us any circumstance in which you feel unable to process the request.
