Innovative Collections NYC Comptroller s Office: Class Action Lawsuits for Personal injury and property damage claims: 1. Strip-search cases: inmates in local correctional facilities sued the city for illegal strip searches. settlement awards applied to 3,556 cases; OCSE received $2,951,003.20 from 2998 ncps.
Innovative Collections NYC Comptroller s Office continued: 2. Unconstitutional statutes cases: ncps arrested/prosecuted for vague loitering violations in the NYS Penal Law. Arrestees sued the City, NYPD, and District Attorneys Offices for damages; Expectation is $1 million to OCSE from ncps in the class action.
Innovative Collections NYC Comptroller s Office continued: 3. Co Defendants Information: Increasing our collections by seizing settlement money set aside by codefendants named in the city s lawsuit; 4. Helping the State increase collections: Matching ncps data against all NYS counties so they, too, can seize settlement money.
Innovative Collections NYC Law Enforcement Collaboration: 1. NYPD s Civil Enforcement Unit: Seizing money vouchered for safekeeping by Police upon arrest of ncp and applying it to delinquent cases; 2. District Attorneys Offices: Vehicle and Traffic Law arrests/driving with a suspended license for failure to pay child support. Forfeitures from plea agreements-asking the D.A. to think of OCSE when accepting a plea agreement.
Innovative Collections NYC Licensing Agencies: NYPD-firearms licenses; FDNY-certificates of fitness for sprinkler systems, etc. Department of Buildings: licenses for inspections of electrical work, etc. Business Integrity Commission: licenses wholesalers of meats, fish, produce.
Innovative Collections NYC Licensing Agencies, continued: Taxi and Limousine Commission licenses for drivers and vehicles for hire; Department of Consumer Affairs licenses for vendors of food, etc. Department of Health and Mental Hygienelicenses for child care businesses; Department of Education certifying teachers.
Innovative Collections NYC Licensing Agencies Collaboration: 1. Denying a license or granting a 6-month temporary license, for delinquent ncps: Going from manual to electronic transmittal of data; Collecting better address information to locate ncps. 2.Tracking payment agreements: Following up with the threat of suspension for failure to comply with an agreement; Collecting information on voluntary payments.
Innovative Collections NYS Office of Court Administration: 1.Amended the Registration Requirements of Attorneys: pursuant to statute, attorneys MUST respond to child support questions. 2.Amended the Attorney Registration Forms: Attorneys MUST certify to TELL THE TRUTH!
Innovative Collections NYC OCSE Passport Policy: Emergency Release Policy: Prior policy: immediate release with no request for payment; New Policy: requesting a payment before we release the hold. Result: 3 ncps who made a voluntary payment, proving that it doesn t hurt to ask!
Innovative Collections NYC Collaboration with NYS Department of Taxation and Finance 1000 days at sea/how we reached the ncp: 1.Attempt to seize the ncp s PayPal account; 2.Paying the entrance fee to ncp s fundraiser by personal check to follow the money trail; 3. Crashing the ncp s fundraising party and seizing the proceeds!
Innovative Collections NYC Collaborating with NYS Department of Taxation and Finance, continued: Seizure of Taxi cab medallion: ncp owned a new Ford taxi and medallion for his cab worth $500k, but owed $17k. Medallion was removed from the hood of the vehicle and held in a safe until the ncp paid ALL his child support obligation!
Innovative Collections How it all adds up: 1. Collections for New York City in CY 2010; $699.9 MILLION! 2. Collections for New York City in CY 2011. Our goal was $720 MILLION, but we expect to exceed that number!! 3. What do we project for next year?
