BACKGROUND Pursuant to Act 88 of 1992, the undersigned was appointed by the Pennsylvania Labor Relations Board as the Fact Finder in the impasse between the Harbor Creek School District (hereinafter referred to as the School District ) and the Harbor Creek Educational Support Personnel Association (hereinafter referred to as the Association ). The Fact Finder was informed that the following issues remained in dispute: 1. Management Rights 2. Subcontracting 3. Just Cause 4. Longevity Service Increment 20. Fair Share 21. Duration of Contract A fact finding hearing in this case was conducted on February 17, 2009 at the Administrative Offices of the Harbor Creek School District located in Harborcreek, Pennsylvania. The School District was represented by Mark Wassell, Esquire, and Richard Lansbury, Ed.D., Superintendent. The Association was represented by John Revell, Region Field Director and Chris Rupnow, PSEA Research. At the hearing, the parties were afforded full opportunity to present testimony and evidence, to cross-examine the witnesses, and to make arguments in support of their respective positions and presentations. At the conclusion of the hearing, the record in this case was closed. FINDINGS AND RECOMMENDATIONS After consideration and a thorough review of the financial information and documentation supplied by the parties, as well as their presentations and positions, the Fact Finder makes the following recommendations: F. Subcontracting ARTICLE III GENERAL CONDITIONS The School District seeks the right to subcontract in accordance with the current language. The Association proposes the elimination of Article III, Subsection F. Subcontracting. The Fact Finder recommends the retention of the current language in this Section except for the change of the effective date to July 1, 2012. B. Release Time for Meetings ARTICLE IV ASSOCIATION RIGHTS AND PRIVILEGES The School District proposes to retain the current language, which states that: - 1 -

Whenever any representative of the Association or any employee participates during working hours in negotiations or grievance proceedings at the request of the Board, he/she shall suffer no loss in pay. The Association proposes the language of Article IV, Subsection B Release Time for Meetings be changed, as follows: Whenever any representative of the Association or any employee participates during working hours in negotiations, if that time has been mutually selected by the parties or a third party as defined in Acts 88 and 195, he/she shall suffer no loss in pay. Whenever any representative of the Association or any employee participates at the request of the Board, or is subpoenaed to participate by the Board or the Association, during working hours, in grievance proceedings/arbitrations, he/she shall suffer no loss in pay. After reviewing the arguments of the parties, the Fact Finder recommends that the current language be retained in the new Agreement. The Association proposes the inclusion of a new Section H. Fair Share. The School District opposes the new Section H. The Fact Finder recommends the new language for Fair Share in Article IV, Section H, as follows: B. Sick Leave Subsection b. H. Fair Share Association Security 1. Each non-member in the bargaining unit represented by the Association shall be required to pay a fair share fee as provided for by Act 84 of 1988. 2. The School District and the Association agree to comply with all provisions of said law. 3. The Association agrees to extend to all non-members the opportunity to join the Association. ARTICLE VI PAID LEAVES The School District proposes that the Educational and Medical Aides have three days (non-cumulative) and no sick days for Dining Room Aides. The Association proposes that the language remain the same but add to subsection b. under B. Sick Leave, the following: Educational/Medical/Dining Room Aides shall have the following sick days: 2008-09 6 days 2009-10 7 days 2010-11 8 days 2011-12 9 days 2012-13 10 days - 2 -

The Fact Finder recommends that the Association s proposal for Section B, Subsection b be included in the Agreement except as follows: B. Sick Leave Subsection h. Dining Room /Educational/Medical Aides shall have the following sick days: 2008-09 5 days 2009-10 5 days 2010-11 5 days 2011-12 5 days 2012-13 5 days The School District maintains that subsection h does not apply to Educational, Medical, or Dining Room Aides. The Association proposes the language of subsection h be changed to the following: h. An employee who retires from the Harbor Creek School District and receives full retirement benefits, without penalty, from the PSERS or retires during a legislativelyapproved window period (excluding disability retirement) will be paid for all unused sick days at a rate of twenty-five dollars ($25) per day for 2008-2009, thirty dollars ($30) per day for 2009-2010, thirty-five dollars ($35) per day for 2010-2011, forty dollars ($40) per day for 2011-2012, and forty-five ($45) per day for 2012-2013 for all accumulated sick days. The Fact Finder does not recommend the Association proposal for subsection h. B. Sick Leave Subsection I (new) The Association proposes the addition of new Subsection i, as follows: i. Bargaining unit employees may use no more than ten (10) paid sick leave days annually for the purpose of temporary leave, limited to the illness, injury or hospitalization care of a spouse, parent, child, or dependent. After an absence of more than two (2) consecutive days, the District may request documentation for reason of absence. The School District opposes the new subsection. The Fact Finder recommends that the Association s proposal be added to the new Agreement. C. Emergency Day The School District proposes the inclusion of the following language at the end of Subsection C.2 although it is understood educational and medical aides are not entitled to any emergency days but may use their sick days or that purpose. The Association proposes to delete Paid Leaves, Section C. Emergency Day and to change Section D. Annual Leave, 1. to read as follows: D. Annual Leave 1. Bargaining unit members will be eligible for the following annual leave per year based on the number of hours worked. 1,850 hours and above three (3) annual leave days per year 900 hours and above two (2) annual leave days per year Less than 900 hours one (1) annual leave day per year. - 3 -

2. The use of annual leave shall be subject to the following conditions: a. The employee shall notify his/her supervisor forty-eight (48) hours in advance. b. No more than five (5) employees in any building worksite may utilize this leave on any single day; no more than three (3) employees in any building/worksite may utilize this annual leave to extend a holiday. c. In the event of unforeseen emergencies of a serious nature, the limitations under a. and b. above will be waived by the Board. In such instances, notice will be given as soon as feasible. d. With the exception of one (1) annual leave day per year, which may be broken into two half-day units, leave days must be taken as full days. If an employee has already taken the two available half-day units during a school year and then later in that year requests the use of an annual leave day to accumulate a less than full day absence (e.g., for an unforeseen emergency), he/she shall be charged for a full day of annual leave, even though less than a full day is enough. 3. An employee will be eligible to accumulate up to five (5) annual leave days. 4. A leave of more than three (3) consecutive days will require thirty (30) calendar days advance written notice to his/her supervisor. 5. At the end of any school year, unused annual leave, including one-half (1/2) days not credited to accumulations will be converted to accumulated sick days. 6. Annual leave may not be used on the first or last student day or an in-service day. The Fact Finder recommends the retention of the current language in Section C with the inclusion of the following language at the end of Subsection C.2 although it is understood that Dining Room, Educational, Medical Aides are not entitled to any emergency days, they may use their sick days for that purpose. The Fact Finder does not recommend the Association s proposal for Sections C and D. The Fact Finder recommends that the current language in Section D be included in the new Agreement. E. Legal The Association proposes that the word employee includes the newly acquired aides. The School District opposes the inclusion of the Educational and Medical aides. The Fact Finder recommends the inclusion of Dining Room, Educational, and Medical Aides. F. Bereavement The Association proposes to add grandparent-in-law to three (3) consecutive days off with pay. The School District opposes the inclusion of grandparent-in-law in this provision. The Fact Finder does not recommend the Association s proposal. B. Child-Rearing Leave ARTICLE VII UNPAID LEAVES The School District proposes to add to the end of the first paragraph Educational and medical aides are not entitled to this leave. - 4 -

The Association proposes that the language refer to all bargaining unit members and the references to 2080, 1920, and term employees be deleted. The Fact Finder recommends the current language for Article VII, Section B, except that at the end of the first paragraph the following language be added Dining Room, Educational, and Medical Aides are not entitled to this leave. C. Temporary Medical Disability The School District proposes to add to the end of the first paragraph Educational and medical aides are not entitled to this leave. The Association proposes that the language refer to all bargaining unit members and the references to 2080, 1920, and term employees be deleted. The Fact Finder recommends the current language for Article VII, Section C, except that at the end of the first paragraph the following language be added Dining Room, Educational, and Medical Aides are not entitled to this leave. E. Educational Improvement The School District proposes to retain the current language of this provision with the inclusion of and the educational and medical aides at the end of the first sentence. The Association proposes an increase the maximum amounts to be paid by the Board for reasonable and accountable expenses to the following: 2008-2009 $3,700 2009-2010 $4,700 2010-2011 $5,700 2011-2012 $6,700 2012-2013 $7,700 In addition, the Association proposes that the following language be included: For all paraprofessional required to complete 20 hours per year under the new regulations, the District will provide in-house training for all hours and pay the employees their hourly rate while attending the training. The Fact Finder recommends the inclusion of and the Educational and Medical Aides at the end of the first sentence. In addition, the Fact Finder recommends an increase in the maximum amounts to be paid by the Board, subject to approval of the Building Principal and the Board, for reasonable and accountable expenses, as follows: 2008-2009 $1,900 2009-2010 $1,950 2010-2011 $2,000 2011-2012 $2,050 2012-2013 $2,100 ARTICLE IX HOLIDAYS The Association proposes that Article IX. Holidays be expanded to add the day after Thanksgiving and the day after Christmas, as these holidays apply to the 2080 and 1920 employees. The School District opposes the change. The Fact Finder does not recommend the Association s proposal. - 5 -

ARTICLE X INSURANCE PROTECTION A. Medical Insurance The School District proposes the Teachers PPO with the expanded costs and premium shares in excess of what the teachers pay. The Association is willing to pay one half the premium share the teachers pay which would be $68.03 in 2008-2009, 2009-2010, and 2010-2011. The teachers contract will need to be negotiated in the 2011-2012 school year. The Fact Finder recommends the continuance of Direct Blue as the medical insurance for the Association s members. The Fact Finder also recommends an annual premium share payment, as follows: Year 1 $ 80.00 Year 2 $ 100.00 Year 3 $ 120.00 Year 4 $ 140.00 Year 5 $ 160.00 B. Dental Insurance The Association proposes to have family coverage added to all employees who currently have individual coverage. The School District opposes the addition. The Fact Finder recommends the addition of family coverage for those employees who currently have individual coverage. D. Life Insurance The School District proposes the retention of the current language which provides for a $25,000 group term life insurance policy for full-time employees. The Association proposes that all employees receive the life insurance with the following increased amounts: 2008-2009 $26,000 2009-2010 $27,000 2010-2011 $28,000 2011-2012 $29,000 2012-2013 $30,000 The Fact Finder does not recommend the increased amounts for life insurance proposed by the Association. ARTICLE XI WAGE RATES The School District proposes a 2.75% increase in each of the five years for all categories and classifications except Educational, Medical, and Dining Room Aides. The School District proposes that Educational Aides in the first year in addition to the 2.75% increase receive a.50 increase then 2.75% in the remaining four years. Medical Aides are to receive a 2.75% increase in each of the first years and Dining Room Aides receive a 2.00% increase in each of the five years. - 6 -

The Association proposes for all categories a 3.9% increase in each of the five years. The Educational and Dining Room Aides will receive $10.90/hour the first year of the agreement and 3.9% in each of the next for years. The Medical Aides will receive $16.00/hour the firs year of the agreement and 3.9% in each of the next four years. The Fact Finder recommends that a $.50 increase be applied to the current wage rates for the Dining Room, Educational, and Medical Aides. It is then recommended that the wage rates for all employees be increased 3% for 2008-2009, 3% for 2009-2010, 3.25% for 2010-2011, 3.25% 2011-2012, and 3.25% for 2012-2013. The wage schedule for each year is attached as Appendix A. ARTICLE XIV SENIORITY The Association proposes to modify the current language of Subsection A to exclude the provision in the second paragraph which states that Classification seniority will not accrue for part-time or term employees. The School District proposes to retain the current language and to add or Educational and Medical Aides to the sentence which the Association wishes to delete. The Fact Finder recommends that the School District s proposal be added to the new Agreement. ARTICLE XV LAYOFFS The School District proposes to add a new Section J to the current language, as follows: Despite the foregoing provisions of this Article, it is understood that educational and medical aides may not exercise seniority rights in cases of layoff and also may not bump. The Association objects to the exclusion of the Educational and Medical Aides. The Fact Finder recommends that the School District s proposal be added to the new Agreement. ARTICLE XVI VACANCIES FOR MAINTENANCE, CUSTODIAL, SECRETARIAL/CLERICAL AND FOOD SERVICE EMPLOYEES The School District proposes to add a new Section J to the current language, as follows: Despite the foregoing provisions of this Article, it is understood that educational and medical aides are selected on the basis of skill, ability, and qualifications. Seniority and bargaining unit status need not be taken into account when filling a position. The Association objects to the exclusion of the Educational and Medical Aides. The Fact Finder does not recommend the School District s proposal for a new Section J. A. Food Service Workers ARTICLE XVIII WORKING CONDITIONS The Association proposes to increase the amounts in Subsection 2, as follows: 2. Food service workers will receive $11.47 per hour for banquet work for 2008-2009. The Association also proposes a 3.9% increase per year as follows: - 7 -

July 1, 2009 $11.92 July 1, 2010 $12.38 July 1, 2011 $12.87 July 1, 2012 $13.37 The School District opposes the increase. The Fact Finder recommends an increase of 2.5% per year, as follows: B. Lunch July 1, 2009 $11.32 July 1, 2010 $11.60 July 1, 2011 $11.89 July 1, 2012 $12.19 The School District proposes that the language be modified, as follows: Employees may leave the building during their duty free lunch with approval of their supervisor. The Fact Finder does not recommend the School District s proposal. 2. Breaks The School District proposes that the language be modified, as follows: For every continuous four (4) hours of work per day, an employee will receive one ten (10) minute break. This time includes going to and from the job site. These breaks will be scheduled by the Supervisor with consideration of the employee s work schedule. Educational and Medical Aides are not eligible for breaks. The Association opposes the exclusion of the Educational and Medical Aides. The Fact Finder does not recommend the School District s proposal. 7. Longevity Service Increment The current language provides that: Bargaining unit members working 2080 hours (custodial), 1920 hours (secretarial), and term secretaries retiring from the Harbor Creek School District after completion of ten (10) or more consecutive years in the District will receive a longevity payment at the rate of $75.00 per year to a maximum of $2,205. A full-time employee retiring but not eligible for state retirement will be eligible for the service increment after twenty-five (25) years of service in the Harbor Creek School District. The School District proposes the addition of a new Subsection B., as follows: B. Educational and Medical aides are not eligible for the longevity service increment. The Association opposes the exclusion of the Educational and Medical Aides and proposes the following language: 7. Longevity Service Increment - 8 -

All bargaining unit members retiring from the Harbor Creek School District after completion of ten (10) or more consecutive years in the District will receive a longevity payment at the rate of $80 per year with a maximum of $2,800 in 2008-09. A rate of $85 per year with a maximum of $2,975 in 2009-10, a rate of $90 per year with a maximum of $2,150 in 2010-11, a rate of $95 per year with a maximum of $3,325 in 2011-12, and a rate of $100 per year with a maximum of $3,500 in 2012-13. The Fact Finder recommends the School District s proposal, with the inclusion of Dining Room Aides. Subsection 8 (new) The School District proposes the addition of the following new Subsection 8: 8. Educational and Medical Aides The selection, reassignment, and termination of Educational and Medical Aides is in the sole discretion of the District. The Association opposes the new Subsection 8. The Fact Finder recommends the School District s proposal with the deletion of the word termination. Any termination shall be subject to the just cause provision in the Agreement. The Association proposes the following new language under Article XVIII, Working Conditions, Section B. General: Employees who are required to administer medication to students or provide first aid shall be indemnified and held harmless by the District for any liability arising out of the administration of medication or first aid. The School District rejects the Association s proposal. The Fact Finder recommends that the Association s proposal be added to the new Agreement. The Association proposes the following new language under Article XVIII, Working Conditions, Section B. General: Bargaining unit employees will receive their pay bi-weekly. The School District rejects the Association s proposal. The Fact Finder recommends that the Association s proposal be added to the new Agreement. The Association proposes the following new language under Article XVIII, Working Conditions, Section B. General: The District shall permit the Association President or his/her designee up to nine (9) paid Association days per year to carry out Association business. The scheduling of these days shall be in consultation with the administration. The School District rejects the Association s proposal. TENTATIVE AGREEMENTS At the hearing in this matter the parties revealed that they had reached tentative agreement concerning several issues discussed during negotiations. It is recommended that these tentative agreements be incorporated into this report as if set forth herein and made a part of the parties Agreement.
