ESTATE PLANNING FACT FINDER How much of your estate do you want to leave to your spouse/life partner, friends, relatives, and charitable organizations?

ESTATE PLANNING: AS IMPORTANT AS EVER The estate tax legislation passed in June, 2001 has not made estate planning unnecessary. It may, however, have made it more confusing for you and your family. In 2011, all the provisions of the 2001 estate tax legislation will disappear. This means that the federal estate tax reappears, and a single person will be able to leave only up to $1 million at death without federal estate tax exposure. Amounts in excess of $1 million will be subject to federal estate tax, with tax rates starting at 41% and rising to 55%, the same as they were prior to the 2001 legislation. The bottom line is that estate planning is more important today than ever. Smart planning can only be based on current law not on changes hoped for in the future so most individuals and couples with sizable estates will want to continue to plan for dealing with the burden of estate taxes at death. When it comes to estate planning, here are a few things to consider. 1. Do you have current estate planning documents? A family trust? Burial instructions? Necessary powers of attorney? Guardians selected for minors? 2. How do you want your property distributed at death? 3. Have you taken any action to reduce the amount of estate taxes that may be due at death? 4. Do you have children, parents, or other family members or dependents with special needs? 5. Have you thought about benefiting a charity, educational institution, or other nonprofit organization at your death? 6. Have you arranged your life insurance so that it will be excluded from your estate, to avoid federal estate taxes at death? If you have not found the time to address these questions, this brochure should help you and your advisor assess your estate quickly and simply. Following this assessment, you can expect to receive suggestions from your advisor on how you can meet your estate planning objectives. These recommendations may help you keep or pass on more of your hard-earned assets. Appropriate estate planning can also help dramatically reduce your estate taxes, while also allowing you to make arrangements to pay any necessary associated costs.
