Consolidated to March 8, 2010 BY-LAW NUMBER 181-2004 OF THE CORPORATION OF THE CITY OF STRATFORD Being a by-law to license, regulate govern Drain Layers, Drain Contractors, Master Plumbers, Journeyman Plumbers, Plumbing Contractors Backflow Device Testers to repeal By-law 55-2002 any amendments thereto. WHEREAS pursuant to the provisions of Part IV of the Municipal Act, 2001, S.O. 2001 c.25 as amended, the Council of The Corporation of the City of Stratford may pass by-laws for licensing, regulating governing businesses; AND WHEREAS section 150 of the Act allows a municipality to license, regulate govern any business wholly or partially carried on with the Municipality, even if the business is being carried on from a location outside the Municipality; AND WHEREAS sections 390-400 of the Act enable municipalities to pass by-laws for imposing fees or charges for permits services provided or done by them; AND WHEREAS in accordance with section 150 (4)(a) (b) of the Act, proper notice of a public meeting was given a public meeting was held at which any persons who attended had an opportunity to make representation with respect to this by-law; AND WHEREAS pursuant to section 150 of the Act, the Council of The Corporation of the City of Stratford is exercising its licensing powers under this section, including imposing conditions for the following reasons: a) health safety; /or b) nuisance control; /or c) consumer protection; AND WHEREAS the Municipal Council deems it desirable to license, regulate govern drain layers, drain contractors, master plumbers, journeyman plumbers plumbing contractors for the purpose of consumer protection to ensure that the work performed by the contractor is completed by qualified individuals, is up to industry stards in accordance with City of Stratford By-laws; NOW THEREFORE BE IT ENACTED by Council of The Corporation of the City of Stratford as follows: 1.0 SHORT TITLE 1.1 This by-law may be known as the Plumbing Drain Layers Trades Licencing Bylaw. 2.0 DEFINITIONS Backflow Device Tester means a person performing or engaging to perform work which may include performing building surveys to identify cross connections; selection, testing repair of backflow prevention devices completion of applicable test reports. City means The Corporation of the City of Stratford. City Water Distribution System Operator means a City employee who holds a current Provincial Water Distribution System operator s licence who engages in the repair or replacement of existing water services on private property.

2 Consolidated to March 8, 2010 City Water Distribution System Operator Contractor means a Department of the City which engages in, solicits or who in any way advertises or holds the Department out to the public as doing the business of contracting for the repairing or replacement of water services on private property in the City employs on a full time basis a licensed City Water Distribution System Operator. Drain Layer means a person licenced as such under this by-law, except a City Water Distribution System Operator, who is skilled in the planning, superintending installing of drain work, is familiar with the laws, rules regulations governing same, who alone or by a person under his or her supervision performs drainage work. Drain Layer Contractor means a person, except a City Water Distribution System Operator Contractor, who engages in, solicits or who in any way advertises or holds himself/herself out to the public as doing the business of contracting for the making repairing of drainage work in the Province of Ontario, employs on a full time basis a Drain Layer licenced under this By-law. Drainage work means construction, repair or alteration of plumbing not within a building or within one metre (three feet) of a building. Journeyman Plumber means a person who has been issued a Certificate of Qualification in the trade of Plumber under the Trades Qualification Act to do plumbing work Licence shall mean a current valid licence issued under the provisions of this bylaw licenced shall have a corresponding meaning. Licence Inspector means the Chief Building Official for the City or his or her designate. Maintenance shall mean the keeping in repair of plumbing, the repairing or replacement of a valve, faucet or fixture or forcing out a stoppage may include drain maintenance or drain repair, private connection repair, tree root removal, but shall not mean or include the installation, construction or relocation of plumbing or additions thereto. Master Plumber means a person licenced as such under this by-law, who has met the requirements of this by-law, who has a regular place of business in Ontario who alone or through the use of Journeyman Plumbers under his or her supervision performs plumbing work. Owner means a person who is the registered owner of real property; Person includes a natural person, corporation, partnership or sole proprietorship; Plumbing Contractor means a person engaged in the business of contracting for the making repairing of plumbing installations in the Province of Ontario who solicits for plumbing work or who in any way advertises or holds himself or herself out to the public as doing plumbing work or as being a Plumbing Contractor; employs on a full time basis a Master Plumber. Reciprocal Licencing Program means the program for the licencing of Master Plumbers as set out by the Mechanical Contractors Association of Ontario participating municipalities. Registered Apprentice Plumber means a person defined as an apprentice under the Trades Qualification Apprenticeship Act, R.S.O. 1990, Chap. T.17 (the Trades Qualification Act ) who is apprenticed as a plumber; School of Accreditation means any school or college providing a crossconnection control course in backflow prevention device testing that has been accredited by an organization or association that has established the following minimum criteria: a) instructor backflow prevention device tester qualifications;

3 Consolidated to March 8, 2010 b) laboratory facilities; c) course content duration; d) examinations; e) minimum passing criteria; f) issuance of a certificate for certified testers from an accredited organization. 3.0 GENERAL LICENCE REQUIREMENTS 3.1 Every person engaged in or working at the business of plumbing either as a Master Plumber, Journeyman Plumber or Backflow Device Tester in the City shall submit evidence of qualification to the City shall be required to obtain a licence from the City as hereinafter provided. 3.2 Every person engaged in or working at the business of drainage work as a Drain Layer in the City shall submit evidence of qualification to the City shall be required to obtain a licence from the City as hereinafter provided. 3.3 No person shall carry on any activity as a Master Plumber, Journeyman Plumber, Plumbing Contractor, Drain Layer, Drain Layer Contractor or Backflow Device Tester in the City without holding a current licence from the City for such premises, trade, calling, business or occupation issued under the provisions of this by-law. 3.4 The following shall be exempt from the requirements to be licenced by the City under the provisions of this part of this by-law a) a person who contracts to construct a new dwelling unit may contract to provide the plumbing for such dwelling unit so long as all such work is done under a building permit by a licenced plumbing contractor; b) an owner wishing to install plumbing in a single family dwelling in which he/she is actually residing in which he/she intends to continue to reside maintain solely as a single family dwelling or which he/she is erecting solely as a single family dwelling in which he/she his/her family will reside, he/she may do so providing he/she abides by all rules regulations pertaining to plumbing under Regulations made pursuant to the Ontario Building Code Act amendments thereto respecting plumbing, as well as with the requirements of this by-law, as the City may require; c) an owner or an employee of an owner, except for a backflow device tester, carrying out maintenance or repair in respect of premises owned by that owner; or d) Any employee with the City of Stratford with a water distribution system operator licence a Backflow Device Testers Certificate. 3.5 Every licence shall be valid for the calendar year in which it is issued shall expire on the 31 st day of December of the calendar year in which it is issued. 3.6 No licence issued under this by-law is transferable to any other person. 3.7 No person shall apply for a licence on behalf of another person. 3.8 Every licence shall be subject to renewal annually. Without limiting the powers of the Licence Inspector to review a licence at any time, every licence shall be subject to review annually upon renewal the Licence Inspector may request confirmation or renewal of any of the information requested or provided in support of the initial application. 3.9 Licence fees are as prescribed in Schedule B attached hereto forming part of this by-law. 3.10 Every person issued a licence by the City shall carry the licence while engaged in that occupation shall produce the licence on dem for inspection by the Licence Inspector.

4 Consolidated to March 8, 2010 3.11 No person shall advertise or promote or carry on a business except under the name stated on the licence application. 3.12 No person shall engage in the business of contracting for the making or repairing of plumbing installation or drainage work without a licence issued by the City. 3.13 Notwithsting Section 3.12 above, a Plumbing Contractor or Master Plumber who employs a Registered Apprentice Plumber as provided under the Trades Qualification Apprenticeship Act, may permit a Registered Apprentice Plumber to assist in the performing of restricted skill sets as outlined in Ontario Regulation 1073. 3.14 The licence issued to a Plumbing Contractor or Drain Layer Contractor shall be posted in public view at the contractor s regular place of business at all times. 3.15 A licenced Plumbing Contractor shall install all plumbing under or within a building including rainwater leaders. A Plumbing Contractor or a Drain Layer Contractor may install drainage work provided they hold the proper licences from the City to perform such work such work is also performed pursuant to a valid Building Permit issued by the City. 3.16 The Licence issued to a Backflow Device Tester does not entitle the holder of such Licence to perform any Plumbing or Drain Work. 3.17 The Plumbing Contractor should always exercise due diligence in supervising any work or task being completed by the registered apprentice plumber 4.0 GENERAL APPLICATION REQUIREMENTS 4.1 Every application for a licence under this by-law shall be accompanied by the applicable completed application form in Schedules A-1 to A-6, the fee required pursuant to Schedule B additional information as set out in Schedule E of this by-law. 4.2 No person shall be eligible to apply for a Master Plumber s licence until he/she has submitted proof to the Licence Inspector that he/she holds a current Certificate of Qualification under the Trade Qualification Act, as a Plumber in the Province of Ontario submits evidence that he/she has held such Certificate of Qualification as a Plumber in the Province of Ontario for at least two years prior to the date of the said application. 4.3 Every applicant applying for a Journeyman Plumbers licence shall possess a current Certificate of Qualification under the Trade Qualification Act as a plumber in the Province of Ontario. 4.4 Every application for a licence or examination under this by-law shall be made in writing. 4.5 Notwithsting 4.2, every applicant for a Drain Layer s licence shall be required to undergo an examination to prove his or her knowledge of the provisions of this bylaw of all relevant codes stards relating to the design installation of plumbing drainage work including systems equipment used in connection therewith.. 4.6 Notwithsting 4.4, every applicant who holds a current Master Plumber s Licence issued by any one of the municipalities listed in Schedule D of this by-law attached hereto shall be exempt from the requirements for an examination provided that a) he or she is in possession of a current Certificate of Qualifications as a plumber in the Province of Ontario, b) he or she submits a copy of such licence accompanied by a letter to the Licence Inspector for the City signed by the licensing authority of a municipality in which he or she holds a current Master Plumber s Licence

5 Consolidated to March 8, 2010 certifying that he or she has successfully passed the Master Plumber s examination for that municipality that such licence is valid. 4.7 A person shall be deemed to be qualified to be licenced as a Master Plumber who a) was licenced as a Master Plumber by the City for the year immediately preceding the calendar year for which he or she seeks a licence; or b) is the holder of a valid Master Plumber licence issued by at least one of the municipalities listed in Schedule C attached hereto who submits a copy of such licence accompanied by a letter to the Licence Inspector for the City signed by the licensing authority of the municipality in which he or she holds an existing Master Plumber licence certifying that he or she has successfully passed the Master Plumber examination for the municipality that his or her licence is in good sting. 4.8 A person shall be deemed to be qualified to be licenced as a Drain Layer who a) was licenced as a Drain Layer by the City for the calendar year immediately preceding the year for which he or she seeks a licence, or b) is the holder of a valid Drain Layer s licence issued by at least one of the municipalities listed in Schedule C attached hereto who submits a copy of such licence accompanied by a letter to the Licence Inspector for the City signed by the licensing authority of the municipality in which he or she holds an existing Drain Layer s licence certifying that he or she has successfully passed the Drain Layer s examination for the municipality is in good sting; or certifies that he/she has successfully passed an examination qualifying him/her to be licenced as a Drain Layer. 4.9 In addition to the requirements in section 4.1, an applicant for a Drain Layer Contractor licence under this by-law shall provide the following information to support his or her application for licence: a) an undertaking from each licenced Drain Layer that he/she is employed by such contractor to perform or supervise the repairing of drainage work for the Drain Layer Contractor, b) proof of liability insurance in the amount of $1,000,000.00 inclusive of public liability property damage, c) where the Drain Layer contractor employs persons other than him or herself, a certificate of clearance from the Workplace Safety Insurance Board. 4.10 A Plumbing Contractor applicant shall provide the following information with his or her application for licence a) an undertaking from each licenced Master Plumber that he/she is employed by such contractor to perform or supervise plumbing work for the Plumbing Contractor, b) proof of liability insurance in the amount of $1,000,000.00 inclusive of public liability property damage, c) where the Plumbing Contractor employs persons other than him or herself, a certificate of clearance from the Workplace Safety Insurance Board. 4.11 All fees shall be paid to the City at the time of application for examination shall be in compliance with Schedule B of this by-law as amended by Council from time to time. Examination fees shall not be refundable. 4.12 The fees for licensing of Plumbing Contractors, Drain Layer Contractors, Drain Layers, Master Plumbers, Journeyman Plumbers Backflow Device Testers shall be in accordance with Schedule B of this by-law shall be payable at time of application. Licence fees shall not be refundable.

6 Consolidated to March 8, 2010 4.13 If an applicant fails to pass the required examination, he/she shall be required to pay the prescribed fee for the second each subsequent examination. 4.14 Records of applications, examinations results of each applicant shall be kept on file in the office of the Licence Inspector. 4.15 The Licence Inspector shall set the time of examination, which examination may be of the following character, written, chart or oral. The applicant must obtain a 70% sting in each section of the examination in order to receive a passing grade overall. 4.16 The City Building Planning Department must receive applications for annual renewals of licences no later than January 31 st of each calendar year. 4.17 An additional late fee as set out in Schedule B of this By-law is applicable if an application is not received by January 31 st of each year. 5.0 DRAIN LAYER 5.1 A person licenced as a Drain Layer shall carry a copy of his/her licence with him/her at any time that he/she is doing drainage work shall produce the licence upon the dem of a Licence Inspector. 5.2 No person shall do any drainage work within the City except in accordance with the Ontario Building Code under the supervision of a licenced Drain Layer or licenced Journeyman Plumber licenced in accordance with this by-law. 5.3 No licenced Drain Layer shall carry out any drainage work within the City unless he or she is a licenced Drain Layer Contractor or is employed by a licenced Drain Layer Contractor. 5.4 The Licence issued to a Drain Layer does not entitle the holder of such licence to perform any plumbing work within a building or within one metre (three feet) of a building. 5.5 A licenced Drain Layer shall, in writing, notify the Licence Authority within 2 days of their termination of employment. 6.0 DRAIN LAYER CONTRACTOR 6.1 The licence issued to a Drain Layer Contractor does not entitle the holder of such licence to perform any plumbing work within a building or within one metre (three feet) of a building. 6.2 No licenced Drain Layer Contractor shall perform or permit to be performed by any person employed by he or she any drainage work within the City except in accordance with the Ontario Building Code under the direct, personal supervision of a Licenced Drain Layer. 7.0 JOURNEYMAN PLUMBER / REGISTERED APPRENTICE PLUMBER 7.1 No Journeyman Plumber or Registered Apprentice Plumber licensed hereunder shall do or perform any plumbing work within the City except in accordance with the Ontario Building Code under the supervision of a licensed Master Plumber. 7.2 A person who is qualified as a Journeyman or Registered Apprentice Plumber shall carry a copy of his or her Licence under this by-law Certificate of Qualification under the Trades Qualification Apprenticeship Act at any time that he or she is doing plumbing or drainage work shall produce the papers upon the dem of a Licence Inspector. 7.3 A person who holds a Certificate of Qualification under the Trades Qualification Apprenticeship Act in the trade of plumber as a Journeyman Plumber or Registered

7 Consolidated to March 8, 2010 Apprentice Plumber may do plumbing work or drainage work while working in the service of under the supervision of a licensed Master Plumber. 8.0 MASTER PLUMBER 8.1 Every Master Plumber who supervises the plumbing work of a Plumbing Contractor shall file a statement with the Licence Inspector as to the name of his/her employer. 8.2 Deleted. 8.3 Every person holding a valid Master Plumber Licence shall be deemed to have obtained to hold a Drain Layer Licence. 8.4 No Master Plumber shall be employed as such by more than one Plumbing Contractor at any one time. Every person licenced as a Master Plumber, upon ceasing to act for a Plumbing Contractor, shall notify the Licence Officer within 5 days thereafter. 8.5 No Master Plumber licenced hereunder shall do or perform any plumbing work within the City except in accordance with the Ontario Building Code. 9.0 PLUMBING CONTRACTOR 9.1 No Plumbing Contractor shall cause or permit any person in their employ not licenced under this by-law as a Master Plumber or Journeyman Plumber to do or perform or assist in doing or performing any plumbing or plumbing work. 9.2 No licenced Plumbing Contractor shall perform or permit to be performed by his employees any plumbing work within the City except in accordance with the Ontario Building Code under the supervision of a licenced Master Plumber. 9.3 A Plumbing Contractor shall employ on a full time permanent basis a licenced Master Plumber. 9.4 Backflow Device Tester In addition to Section 3.3 of this by-law: a) every Applicant for a Backflow Device Tester Licence shall have a regular place of business shall include the mailing address of the business premises; b) every Applicant for an initial Backflow Device Tester Licence shall provide the following documentation: i) a current certificate from a School of Accreditation as a certified Backflow Prevention Device Tester; ii) a valid calibration certificate for testing equipment; iii) confirmation of an additional trade as defined in the Cross Connection Control By-law 50-2004, Appendix A, Authorized Functions List, as amended from time to time, or any successor thereof. 10.0 EXAMINATION 10.1 The Licence Inspector shall be responsible for all examination processes including record keeping, applications examinations. 11.0 PENALTY 11.1 Every person who contravenes any provision of this by-law every director or officer of a corporation who participates in such contravention by a corporation is guilty of an offence is liable, upon conviction, to a penalty as provided for by the Provincial Offences Act.

8 Consolidated to March 8, 2010 12.0 SUSPENDING, REVOKING OR REFUSING OF A LICENCE 12.1 Any licence may be suspended or revoked or refused for any breach of any requirement of this by-law by resolution of City Council. Council, in considering whether or not to grant a licence, or to revoke or suspend a licence, shall have regard to the following: a) whether or not the Applicant or Licencee complies with all requirements of this By-law; b) whether or not the Applicant or Licencee has failed to promptly remedy any reasonable concern with regard to those matters set out in this By-law or has committed past breaches of this By-law; c) whether or not the Applicant or Licencee has failed to comply with any requirements of any other applicable By-law of the City or of any local board thereof, or of any statute, Orders-in-Council, or Regulation of the Legislature of the Province of Ontario or the Parliament of Canada or of any Agency, Board or Commission thereof, in, upon, or in connection with the licenced activity of the business or place of business, facilities, equipment, vehicles other property used or kept for hire in connection with the licenced activity; d) has past breaches of this By-law; e) has any outsting fines or penalties imposed under the Provincial Offences Act for the contravention of any provision of this By-law or any other municipal by-law or Provincial Statute where such fine is associated with an offence arising out of the conduct, operation or activity within or in conjunction with such business; f) where Council believes it is not in the public interest to do so. 12.2 Council may, in its sole discretion, afford any other person who applied to be heard who appears to have an interest in the matters under discussion, an opportunity to present material evidence relevant to the issue before Council to ask questions of any person presenting evidence or a report to Council relevant to the said issues, a) for the purposes of this section of this By-law, a quorum of Council shall be a majority of the members of Council, a decision by the majority of members present shall be the decision of Council. 12.3 Where the applicant has been provided with Notice of Hearing does not attend, Council may proceed with the meeting in the absence of the applicant. 12.4 The City may be represented at the Hearing by the City s Solicitor, who is entitled to adduce evidence submit arguments in reply to evidence argument that has been submitted on behalf of the Applicant or Licencee. 12.5 Council may, after hearing all of the evidence submissions made to it by the Applicant or Licencee the Director of Building Planning, hold an in-camera session, where allowed by law, to debate the matter to reach its decision. 12.6 The decision made by Council in in-camera session, shall be confirmed in Open Council by resolution, a certified copy of such resolution shall be mailed to the Licencee to any person who has appeared before Council who has requested that a copy of the Resolution be provided to them. 12.7 The decision of Council to issue a licence, refuse to issue a licence, revoke a licence or suspend a licence may be subject to such terms as Council shall impose shall be final. 12.8 a) The Director of Building Planning shall notify the Applicant or Licencee of the decision of Council by serving a copy of the Resolution personally or by registered mail to:

9 Consolidated to March 8, 2010 i) the Applicant or Licencee at the address shown on the application, or the address last on file with the Building Planning Office, or ii) the counsel or agent of the Applicant or Licencee, if any, at the address as stated to the Director of Building Planning. b) If the decision rendered is to grant the Applicant the licence applied for, the licence shall be issued. c) If the decision is to suspend or revoke the licence, the licencee shall within, 24 hours of service of notice by registered mail, or immediately if the notice is personally served, return the licence to the Director of Building an Planning or any other duly appointed individual shall have access to any premises or other property of the licencee for the purpose of receiving or taking the licence. d) If the decision is to impose conditions on the licence, the licencee shall within 24 hours of service of notice by registered mail, or immediately if the notice is personally served, advise the Director of Building Planning as to his or her acceptance of the conditions. 12.9 In addition to Section 12.1, a Council may, by resolution, place conditions upon the licence of any person may require such person to submit himself/herself for reexamination. 13.0 INTERPRETATION AND SCHEDULES 13.1 If a court of competent jurisdiction declares any provision or any part of a provision of this by-law to be invalid, or to be of no force effect, it is the intention of Council in enacting this by-law that each every provision of this by-law authorized by law be applied enforced in accordance with its terms to the extent possible according to law. 13.2 All Schedules referred to in this By-law are deemed to be part of this By-law. 14.0 REPEAL 14.1 That By-law 55-2002 all amendments thereto, are repealed upon this By-law coming into effect. 14.2 This By-law comes into force on January 1, 2005.
