Factsheet 13 July 2014 About this factsheet This factsheet explains what assistance may be available to homeowners and tenants to help them meet the costs of repairs, improvements and adaptations. It includes information on the Disabled Facilities Grant and assistance available from the local housing authority and other sources. 1 Recent developments Since1 April 2013, the way in which social housing tenants in England can complain to an Ombudsman has changed. Complaints about registered providers of social housing (including local authorities) with regard to their functions as landlords will now have to be directed to the Housing Ombudsman Services (HOS). However, complaints about local authority wider activities, including applying for mandatory and discretionary housing improvement grants (including the Disabled Facilities Grant) will still be dealt with by the Local Government Ombudsman (LGO). For more information contact the relevant Ombudsman (see section 9). The HOS and LGO are England bodies only. In Wales, the relevant Ombudsman service for all the issues outlined above will be the Public Services Ombudsman for Wales (see section 9). 2 Help from the council (local authority) 2.1 Local housing authority assistance The Regulatory Reform Order (Housing Assistance) (England and Wales) 2002 gives the local authority (LA) general powers to improve living conditions in its area in the ways it considers the most appropriate. The powers may be used to provide assistance for: the repair, improvement and adaptation of housing the demolition of accommodation and help with rebuilding costs getting new accommodation, if the local authority has decided to purchase current accommodation (whether voluntarily or compulsorily), or the local authority has decided that it is not economic to adapt or improve it. Your local authority must publish a policy on how the powers will be used and a copy of this policy must be available for public inspection at its main office. Factsheet 13 July 2014 3 of 22

Copies may also be available from local voluntary organisations (such as the Citizens Advice Bureau), home improvement agencies (HIAs) and public libraries. A summary of the policy must be made available to the public on request. If sent by post a reasonable charge may be made for this service. The summary should tell you what type of assistance is available, whether you are eligible to apply, how to make an enquiry and apply for assistance, the terms of repayment, conditions attached (if any), target timescales for operating different parts of the process and whether there is any advice and assistance offered from a local HIA. Local authority assistance can be provided in any form, including loans, grants, labour, materials or advice. It may be provided unconditionally, or subject to certain conditions such as repayment of all, or part, of the assistance or contribution towards the work. Loans may be made available through equity release schemes (see section 8). The assistance can be provided directly by the local authority or by a third party (see section 3). When providing assistance, the local authority is required to: set out in writing the terms and conditions under which assistance is being given ensure that the person has received appropriate advice or information about the extent and nature of any obligation (financial or otherwise) they will be taking on take account of the person s ability to make a repayment. The local authority must have a written complaints and appeal procedure, freely available. If you are not happy with the local authority s response to your complaint you may be able to refer your case to an Ombudsman service. In England this will be the Local Government Ombudsman (LGO), whilst in Wales you would need to contact the Public Services Ombudsman for Wales (see section 9 for contact details for both organisations). The relevant Ombudsman will look into your complaint if, for example, the local authority has not followed its own procedures correctly. Factsheet 13 July 2014 4 of 22

2.2 Disabled Facilities Grant The provisions of mandatory Disabled Facilities Grants (DFGs) are set out in the Housing Grants, Construction and Regeneration Act 1996, which was amended by the Regulatory Reform (Housing Assistance)(England and Wales) Order 2002 and the Housing Act 2004. DFGs are available to provide facilities and adaptations to help a disabled person to live as independently and comfortably as possible. Who is eligible In order to qualify you must be disabled under the terms of the Housing Grants, Construction and Regeneration Act 1996, which qualifies a person as being disabled if: their sight, hearing or speech is substantially impaired they have a mental disorder or impairment of any kind they are physically substantially disabled by illness, injury, impairment present since birth, or otherwise they are registered disabled (or could be registered) with the social services department under the terms of the National Assistance Act 1948 or the Children Act 1989. You can apply for a DFG whether you are a homeowner or the tenant of the property. Certain licensees or occupiers of houseboats or park homes can also apply. You do not have to be the disabled person for whom the works are required (eg, a landlord, can apply to have the property adapted for a disabled tenant). The applicant will have to provide the council with a certificate stating that the disabled occupant will live in the property for at least five years after the works are completed or for a shorter period if there are health or other special reasons. This may be difficult for private tenants as most of them will have assured-shorthold tenancies with security of tenure for only the first six months of tenancy. Factsheet 13 July 2014 5 of 22

Local authority (LA) tenants and tenants of registered providers of social housing are eligible to apply for a DFG and are assessed based on their needs on the same basis as private tenants and owner-occupiers. However, in these circumstances, the LA or housing association will decide whether to carry out the work using its own resources for capital works or to refer the applicant for DFG. What types of work are covered DFG is a mandatory grant in specific circumstances. It must be given if you are disabled and do not have access to your home and to the basic amenities within it, provided that you qualify on income grounds. The council will also have to agree that the work is reasonable and that it is possible to carry it out. Examples of the types of work covered by a mandatory grant include: making it easier for you to get into and out of your home (eg, by widening the doors and installing ramps) making access easier to the living room, bedroom, kitchen and bathroom (eg, by installing a stair lift or providing a downstairs bathroom) providing suitable bathroom and kitchen facilities that you can use independently making your home safe for you and people living with you (eg, by providing a specially adapted room where it is safe to leave a disabled person unattended or improve lighting to ensure better visibility) adapting heating or lighting controls to make them easier for you to use improving the heating system in your home to make it suitable for the needs of the disabled person improving access to a garden by making it easier or safer. Note: A DFG can also be provided for adaptations to common parts of a building containing one or more flats. See Age UK s Information Guide, Adapting your home for more information. Discretionary assistance Local authorities have powers to give discretionary assistance for adaptations or to help you move to alternative accommodation (see section 2.1). There is no restriction on the amount of assistance that may be given. It may be paid in addition, or as an alternative to, the grant. It may be given for example to: provide small adaptations that are not covered by the grant or to deliver remedies for urgent adaptations more quickly top up the grant because the work is particularly expensive or the applicant cannot afford the contribution, or some work required is not eligible for the grant assist the disabled person to move to a more suitable property where it is more cost effective than adapting their current home to make it suitable for his/her needs, even though the new property may need some adaptations. Applying for a Disabled Facilities Grant DFG is available from the housing department of the local council. You can approach either the local housing department or the local social services department at your council about applying for DFG. Whilst the formal application must be made to the housing department, in many cases you may be advised to make your first approach to the social services department. You can also ask your local home improvement agency (HIA) to assist you with the application (see section 3). Although the housing department has the responsibility for deciding whether you will get a grant, it must consult with the social services department to decide what adaptations are necessary and appropriate. This will normally mean that you will receive a visit from an occupational therapist from social services. An occupational therapist is someone trained to assess the special needs of people with disabilities. They will assess your needs and make recommendations on what work needs to be done. The housing department must be satisfied that the works are reasonable and practical in relation to the age and condition of the property. This assessment is usually done by an environmental health officer, a building surveyor from the council or possibly someone from a home improvement agency (HIA) jointly with the occupational therapist who visited your home to carry out the needs assessment. Note: You will not normally get any DFG if you start work on your property before the council approves your application. The means test DFG is means tested (unless granted for disabled children). In its assessment the council will only take into account the disabled person s income and savings and that of their partner. This applies even if the disabled person is not the applicant (eg, where the application was made by the owner of the house where the disabled person lives). This means that if you are, for example, a single, disabled person living with your grown-up daughter in the home that she owns: only your income and not hers should be included in the means-test calculation. The means test for a DFG will take into account the average weekly income of the relevant people. Certain disability benefits and savings below 6,000 will be ignored; for savings above 6,000, an assumed weekly tariff income is taken into account which is set against an assessment of basic needs recognised by a range of premiums and allowances. If the disabled person s resources are less than this assessment, then they will not normally be expected to contribute to the costs of the works. If the resources are more than the allowances, they may only get a part of the grant, or none at all. If a disabled person receives the following benefits they will not normally have to make a contribution unless there are others being assessed who are not receiving such benefits: the Guarantee Credit part of Pension Credit Income Support income-related Employment and Support Allowance Factsheet 13 July 2014 8 of 22

income-based Jobseeker s Allowance Housing Benefit Council Tax Benefit (for applications approved before 1 April 2013) or Council Tax Reduction/Support Working Tax Credit or Child Tax Credit with gross taxable income of less than 15,050. Note: At the time of writing the government has not yet stated how the test of resources will be amended to take account of Universal Credit. The maximum amount for a mandatory DFG in England is 30,000. In Wales it is 36,000, following additional legislation made by the Welsh Government in 2008. Property charge In England, a local authority has discretion to impose a maximum charge of 10,000 on a property that has been adapted with a DFG if it is sold within 10 years. However, this applies only to adaptations where the cost of the DFG exceeds 5,000. In Wales, a local authority can seek to recover money in the same way and in the same circumstances, but there isn t a specified maximum charge. In both England and Wales a charge should only be imposed after taking into account individual circumstances on a case-by-case basis. Factsheet 13 July 2014 9 of 22

Problems and complaints There can be lengthy delays in applying for DFG, often because there is a long waiting list for assessment by an occupational therapist. However, as you do have certain rights to assistance, you should not have to wait an unreasonable amount of time. The law says that you should not have to wait more than six months after you make a formal application for DFG to hear whether you will get one. The decision must be made in writing and specify the works that are eligible for a grant and the amount of grant to be paid. If your application is refused, you must be told why. If you do not get a decision within six months of applying, you can make a written complaint to the local authority and request they make a decision. If you still do not get a decision, seek further advice or make a complaint to the relevant Ombudsman service the Local Government Ombudsman in England, or in Wales, the Public Services Ombudsman for Wales (see section 9 for contact details). Local authority decision-making can also be challenged in courts by judicial review proceedings. Take further advice about how to follow this course of action. For more information see Age UK s Factsheet 43, Getting legal advice. If you are eligible for DFG, the housing department cannot refuse to pay on the grounds that it has not got sufficient money. The law also says that you should not have to wait more than 12 months from the date that you apply for a grant until the money is paid. The Government has said that payment should only be delayed in exceptional circumstances. 2.3 Help from social services Minor adaptations and equipment in England Social services departments provide funding for some types of adaptation works. In England, under The Community Care (Delayed Discharges) Act (Qualifying Services)(England) Regulation 2003, any item of community equipment which a person is assessed as needing as a community care service, and for which the individual is eligible, is required to be provided free of charge. All minor adaptations costing 1,000 or less (including the cost of buying and fitting the adaptation) are required to be provided free of charge. Factsheet 13 July 2014 10 of 22

Minor adaptations and equipment in Wales A local authority social services department may expect someone to pay towards minor adaptations and equipment that they have been assessed as needing (the 1,000 rule mentioned above does not apply in Wales). However, any charge that the local authority imposes must be reasonable for you to pay based on your individual financial circumstances this is explained in more detail in Age Cymru s Factsheet 42w, Disability equipment and how to get it in Wales. There is also a Rapid Response Adaptations Programme (RRAP) in Wales. This is a Welsh Government programme which is administered by Care and Repair Cymru see section 9 for contact details. Under the programme, small-scale alterations to a person s home can be completed to allow them to return to live safely at home if they have been in hospital, or recently been discharged. People who haven t been in hospital may also be eligible if they want to carry on living independently at home. Up to 350 worth of help is available for adaptations such as small ramps, rails and hand-grips, levelling of paths or community safety alarms. The RRAP programme is not means tested however, clients must be referred to the programme by a health or social care professional and cannot apply directly themselves. The work should be finished within 15 days of the day that someone was referred to the programme. Social services duties Social services departments have a duty to provide certain services to disabled people. This duty is a result of the Chronically Sick and Disabled Persons (CSDP) Act 1970 which states that a council has to provide services to meet the needs of disabled people, including: provision of practical assistance within the home provision of disability aids and equipment assistance with adaptations to the home. If you need adaptations and are having difficulty getting a DFG, your social services department may still have a duty to assist you. Factsheet 13 July 2014 11 of 22

Social services departments may also be able to help with the cost of work not covered by DFG, eg, providing top-up funding if people are not able to find the money to meet their assessed contribution or if works cost more than the 30,000/ 36,000 limit on DFG. For further information about the rights of disabled people to social services see Age UK s Factsheet 41, Local authority assessment for community care services (if you live in England), or Age Cymru s Factsheet 41w, Local authority assessment for community care services in Wales (if you live in Wales). 3 Home improvement agencies (HIA) Home improvement agencies, sometimes called Care & Repair or Staying Put, are not-for-profit organisations managed locally by housing associations, councils or charities. They provide support for vulnerable homeowners and for people living in private rented accommodation to help them undertake adaptations, repairs and improvements to their home. Their service will include guidance on how to get financial support to undertake the work, help in accessing that financial support, technical support in planning the work and ensuring that the work is undertaken by accredited trade persons. Most HIAs provide a range of housing-based services for vulnerable people that will enable them to retain independence in their own home. These may include a handyperson service, gardening and decorating services, safety and security improvement, and improved energy efficiency measures. Even if you can afford to pay for the work yourself, you can take a lot of the worry out of organising it by using an agency service. your local council s housing department; or Care & Repair Cymru (see section 9 for contact details) You can also locate your nearest HIA on the Elderly Accommodation Counsel website at www.housingcare.org. 4 Heating and insulation improvements In England The Green Deal provides help with heating and insulation improvements. Customers take out loans from authorised providers to have their homes made energy efficient by accredited installers, repaying the loan over 25 years in instalments through their electricity bill. In Wales There is a Welsh Government scheme called Nest, which aims to reduce the number of households in Wales in fuel poverty. A range of home improvements may be available from Nest if you live in a property that has a poor energy efficiency rating and you receive certain means-tested benefits (eg, Pension Credit). The Green Deal scheme, outlined above, is also available in Wales. For more information see Age Cymru s Factsheet 1w, Help with heating costs in Wales. 5 The Social Fund and other local welfare provision If you receive Pension Credit, income-related Employment and Support Allowance, Income Support, income-based Jobseeker s Allowance or Universal Credit, you might be able to get help with the cost of minor repairs or decoration from: a local authority s or devolved administration s welfare scheme (which have replaced help previously administered centrally via the Social Fund); or Factsheet 13 July 2014 13 of 22

a budgeting loan/budgeting advance from Jobcentre Plus (a part of the Social Fund which is administered centrally). The payments are discretionary and the Social Fund/welfare schemes budgets are limited. Staff at your local Jobcentre Plus will decide if you can get a budgeting loan or budgeting advance. In England, your local authority will decide whether you are eligible for help through their local welfare scheme. In Wales, you will need to apply to the Discretionary Assistance Fund (DAF) which is the Welsh Government s welfare scheme see section 9 for contact details. See Age UK s Factsheet 49, The Social Fund, Advances of Benefit and Local Welfare Provision for further information on all of the above. 6 Charities If you have checked that you are getting all the benefits you are entitled to and you are not able to get any help (or enough help) from the Social Fund you could approach charities and benevolent funds. There may be charities or trust funds that can help towards the cost of smaller repair work. Organisations such as Charity Search and Turn2Us can help you find charities to apply to (see section 9). 7 Help with interest payments on loans for essential repairs Pension Credit, income-related Employment and Support Allowance, incomebased Jobseeker s Allowance, Income Support and Universal Credit are social security benefits that can include help towards the cost of loans taken out to fund home repairs and improvements. Help is only given towards the interest charges, not repayments of the sum borrowed. The amount paid towards the interest is not the same as actual interest you have to pay, but is based on a standard rate of interest linked to the Bank of England average mortgage rate. If other adults live with you (and your partner if you have one), they may be expected to contribute towards your repayments and you may get less, or even no, help with the interest on your loan. A loan for repairs and improvements only qualifies if it is spent within six months on: essential works to adapt the home for a disabled person the provision of a bath/shower, sink, WC, ventilation, natural light, insulation, electric lighting and sockets, drainage, damp proofing the provision of facilities to prepare and cook food, store fuel or refuse the provision of a separate bedroom for children/young people depending on their age/gender repairs to heating systems repairs to unsafe structural defects. A loan may also qualify if it was used to pay service charges for the repairs and improvements specified above, or to pay off an earlier loan taken out for this purpose. Note: If you are hoping to get help with the interest on a loan for repairs or improvements from a social security benefit, take advice before you make a commitment. 8 Using your home as capital There are schemes where you can use the value of your home to generate income or a lump sum, either with a mortgage repayable on death (lifetime mortgage), or by selling the property (or a part of the property) but continuing to live in it during your lifetime. Whether you qualify, and how much cash you receive, will depend on your age and the property s value. For more information see Age UK s Factsheet 65, Equity release. From 1 April 2013 a complaint has to go first to a designated person such as an MP, a local councillor or a designated tenant panel who will try to resolve the complaint. If the designated person cannot resolve the complaint, they will refer it to the HOS. Complaints can only be referred to the HOS directly by the tenant if either they waited eight weeks after exhausting their landlord s procedure, or the designated person either refused to refer the complaint, or agreed for the tenant to make a complaint directly.
