Hire Car Cover

Demands and Needs Statement This policy meets the demands and needs of a driver who requires a replacement car if their own vehicle is confirmed as a total loss or has been stolen and remains unrecovered. As an alternative, this policy will pay 200 to the policyholder if a replacement car is not needed. These benefits are only available where costs for replacement vehicle hire are not recoverable from any third party. As with any insurance, it does not cover all situations and you should read the terms and conditions of this policy to make sure that it meets your specific needs. Hire Car Cover Policy Summary 1 Policy Summary Hire Car Cover This Policy Summary does not contain full terms and conditions of the cover, which can be found in the policy document. It is important that you read the policy document which follows this Policy Summary. Who the Cover is Underwritten By Admiral Insurance (Gibraltar) Limited, Suite 3G, Eurolife Building, 1 Corral Road, Gibraltar Type of Insurance and Cover The Elephant Hire Car Policy provides insurance to cover the funding of vehicle hire charges to help you stay mobile following the insured vehicle being confirmed as a total loss by EUI Limited, or where that vehicle is stolen and remains unrecovered. Alternatively, in the same circumstances, you may choose to claim 200 instead of a hire car. This cover applies where the costs for replacement vehicle hire are not recoverable from any third party. Significant Features and Benefits: A hire car or 200 for when the insured vehicle is declared a total loss (Section 1. Definitions: insured incident and total loss) A hire car or 200 for when the insured vehicle has been stolen and not recovered (Section 1. Definitions: insured incident) Where the hire car option has been selected: Up to 21 days of continuous vehicle hire (Section 2. What is Covered?) A vehicle which is a similar physical size to your insured vehicle up to a 2.2 litre engine and 7 seats, subject to availability, as determined by Helphire Ltd, supplied within territorial limits. (Section 1. Definitions: hire car) Significant and Unusual Exclusions or Limitations: The insured person must be a full driving licence holder. (Section 1. Definitions: insured person) Any claim for a replacement car or 200 where the cost of a replacement vehicle is recoverable from any third party (Section 5. What is Not Covered? g.) The insured person must have a valid motor insurance policy in place at the time of loss (Section 4. Conditions a.) Any claim 28 days after the insured vehicle is stolen or confirmed a total loss (Section 5. What is Not Covered? d.) Duration of the Cover From the date Hire Car Cover was added to the associated motor policy until its renewal or cancellation, up to a maximum of twelve months. As long as the policyholder remains eligible, this policy will automatically renew with the associated motor policy unless you inform EUI Limited otherwise. Your Right to Cancel You may cancel this product and receive a full refund, if you inform us within 14 days from the receipt of the confirmation letter or email.

2 Hire Car Cover Policy Summary Should you cancel outside the 14 day cancellation period, you will be charged on a daily pro rata basis for the time you have been on cover, plus a 5 cancellation fee. However, if a claim is made or has arisen during the period of insurance, the full premium is payable and no refund will be given. For further information on cancellation please refer to the section in the policy wording headed Cancellation Rights. How to Make a Claim To make a claim please call the Claims Line on 0844 543 4422. If the insured vehicle has been stolen you must also report it to the Police. Financial Services Compensation Scheme Admiral Insurance (Gibraltar) Limited is covered by the Financial Services Compensation Scheme (FSCS). You may be entitled to compensation from the scheme if Admiral Insurance (Gibraltar) Limited is unable to meet its obligations to you under this contract. Cover is provided for 90% of the claim without any upper limit. Further information can be obtained from the Financial Services Compensation Scheme by phone on 020 7741 4100 or 0800 678 1100 and on their website at www.fscs.org.uk. Hire Car Cover Terms and Conditions 3 Terms and Conditions Policy Document Your Hire Car Policy This is to confirm that Admiral Insurance (Gibraltar) Limited will provide the cover described below during the period of insurance. Cover is subject to the terms and conditions that follow. The premium must be paid before cover is provided. Helphire Ltd or a supplier of Helphire Ltd provides the benefits under this policy, however the insurance contract is between Admiral Insurance (Gibraltar) Limited and the policyholder. 1. Definitions Please find below an explanation of the words used in this insurance policy. Wherever these words are bolded, they will have the meaning given below: Associated Motor Policy The valid motor insurance arranged by EUI Limited which has been taken out by the policyholder. Courtesy Fuel Petrol or diesel worth 15 in value which will be in the hire car upon delivery to ensure the car has sufficient fuel to meet your immediate journey requirements. EUI Limited Elephant is a trading name of EUI Limited. Hire Car A vehicle which is a similar physical size to your insured vehicle up to a 2.2 litre engine and 7 seats, (subject to availability), as determined by Helphire Ltd, supplied within territorial limits. Insured Incident An incident which results in the insured vehicle being confirmed as a total loss by EUI Limited or where the insured vehicle has been stolen and remains unrecovered, and the costs of the claim are not recoverable from any third party. Insured Person/You/Your A full driving licence holder who appears on the current Certificate of Motor Insurance issued by EUI Limited. Insured Vehicle Any motor vehicle insured through EUI Limited that appears on the current Certificate of Motor Insurance, and for which a premium has been paid for Hire Car Cover. Period of Insurance From the date Hire Car Cover was added to the associated motor policy until its renewal or cancellation, up to a maximum of twelve months. As long as the policyholder remains eligible, this policy will automatically renew with the associated motor policy unless you inform EUI Limited otherwise. Policy This policy of insurance for Hire Car Cover. Policyholder The person named as the policyholder on your current Certificate of Motor Insurance issued by EUI Limited, where a premium for Hire Car Cover has been paid.

4 Hire Car Cover Terms and Conditions Premium The payment for Hire Car Cover, which needs to be paid to EUI Limited by you to get the benefit of this policy. Provider Helphire Ltd who supply the hire car. Albany Assistance Ltd who administer claims for the hire car. EUI Limited who administer claims for the 200. Territorial Limits Great Britain, Northern Ireland, Isle of Man and the Channel Islands. Third Party The other person(s) and/or party(s) responsible for the insured incident, excluding the insured person and/or policyholder (as defined in this policy). Total Loss Where the insured vehicle has been confirmed as uneconomical to repair due to circumstances covered under the terms of your associated motor policy OR by a third party insurer OR by a garage who is a member of the Vehicle Builders and Repairers Association (VBRA) or the Motor Vehicle Repairers Association (MVRA) or a similarly recognised body, due to a road traffic accident, storm, flood, vandalism or malicious damage. Underwriter Admiral Insurance (Gibraltar) Limited, Suite 3G, Eurolife Building, 1 Corral Road, Gibraltar. We/Us/Our Albany Assistance Ltd, Helphire Ltd, EUI Limited and/or the underwriter. 2. What is Covered? Up to 21 days of continuous car hire within the territorial limits or 200 following an insured incident during the period of insurance The hire car must be returned to Helphire Ltd or its designated agent no later than 144 hours after payment is authorised to the policyholder on EUI Limited s total loss valuation of their claim OR no later than the 21st day of hire (whichever comes first). If the insured vehicle is recovered after being stolen and is deemed repairable by EUI Limited, the hire car must be returned to Helphire Ltd or its designated agent. You may extend the hire by contacting Albany Assistance Ltd on 0844 571 9215 who will then contact Helphire Ltd to make arrangements. A discounted rate is available to EUI Limited customers. 3. How to Claim Your Benefit Following an insured incident, you must report it immediately to EUI Limited on 0844 543 4422, and to the Police if the insured vehicle has been stolen. If you choose to claim a hire car, EUI Limited will advise Albany Assistance Ltd, who will contact you to arrange the supply of a hire car. If you choose to claim 200 this will be issued to you by EUI Limited. In both cases the insured vehicle must have been confirmed as a total loss or reported as stolen and not recovered before a claim can be made.

Conditions You should note that the following conditions apply in all circumstances: a. you must have a valid motor insurance policy arranged through EUI Limited to take advantage of this cover b. the benefit under this policy will only be provided once EUI Limited have confirmed that the insured vehicle is a total loss, OR faxed confirmation is received (at the insured person s expense) from a garage who is a member of the Vehicle Builders and Repairers Association (VBRA) or the Motor Vehicle Repairers Association (MVRA) or a similarly recognised body, and where a hire car is being provided, this confirmation has been received by Albany Assistance Ltd c. if the insured vehicle has suffered theft damage or has been stolen you must supply a Police crime reference number before the benefit can be provided d. only one benefit, either a hire car or 200, can be claimed for under this policy for each insured incident. You should note that the following conditions apply when a hire car is provided: e. when receiving the hire car, the driver will need to produce their full current driving licence and proof of address f. the insured person must have a valid driving licence and must not be breaking the conditions of that licence g. we will not provide a hire car if we believe doing so would cause a risk to its security or your safety or the safety of our staff h. hire cars are provided in accordance with Helphire Ltd or its agent s standard requirements, terms and conditions We must draw your attention to the additional terms and conditions of Helphire Ltd. These are set out in the vehicle hire agreement, which will be given to you to review and sign should you need to make a claim on this policy. This may affect the provision of the hire car. This can also be reviewed at any time upon request. 5. What is Not Covered? The following are not covered under this insurance in any circumstances: a. any claim where the insured vehicle was being used for hire or reward b. any claim where EUI Limited do not provide cover under the terms of the associated motor policy c. no benefit will be paid if the insured person: is found to be over the prescribed limit of alcohol is driving whilst unfit through drink or drugs, whether prescribed or otherwise fails to provide a sample of breath, blood or urine when required to do so, without lawful reason d. if you or anyone acting for you recklessly or deliberately misrepresents information we require at any time during the policy that would impact either the terms and conditions or our ability to offer cover itself, your policy and all other policies to which you are connected through EUI Limited will

6 Hire Car Cover Terms and Conditions be cancelled or voided. We will seek to recover any costs we have incurred and will not return any premium. We will not pay a claim which is in any part fraudulent, false, exaggerated or if you or anyone acting for you makes a claim in a fraudulent or false way, or where we have been given any documents which are false or stolen. Your policy and all other policies to which you are connected through EUI Limited will be cancelled or voided. We will seek to recover any costs that have been incurred and will not return any premium. e. any claim for theft which has not been reported to the Police f. any claim for a hire car or 200 more than 28 days after the insured vehicle is stolen or has been determined a total loss g. any claim arising out of a deliberate or criminal act or omission, which is found to the provider s satisfaction to be of a fraudulent or false nature. The insured person will be held responsible for any costs paid or incurred as a result h. any insured incident which took place outside of the period of insurance i. any claim where the cost of a replacement vehicle is recoverable from any third party j. any claim for a hire car where an insured person has one or more motoring convictions with a UT offence code k. any claim for a hire car where the DVLA have confirmed that an insured person is not allowed to drive on medical grounds The following are not covered under this insurance when a hire car is provided: l. all fuel, fares, fines and fees relating to the hire car whilst in your possession excluding courtesy fuel m. any further hire charges incurred after 21 days, or more than 144 hours after payment is authorised for a total loss or unrecovered theft (whichever comes first) n. sea transit charges in the delivery and collection of the hire car o. any excess payable in the event of a claim involving the hire car. On comprehensive policies these will be the amounts shown on your associated motor policy schedule issued by EUI Limited under Excess Details, up to a maximum of 500. On third party fire and theft policies, for fire or theft claims these will be the amounts shown on your associated motor policy schedule issued by EUI Limited under Excess Details, for an accidental damage claim this will be 500, for a windscreen repair claim this will be 25 and for windscreen replacement this will be 75. p. any further hire charges after the insured vehicle has been recovered after being stolen and is deemed repairable by EUI Limited 6. Notice to the Policyholder/Insured Person Subrogated Rights a. The insured person must take all appropriate steps to keep the costs of the claim to a minimum

If any of the costs, charges or fees relating to the benefits of this policy are recovered from the third party, the insured person must pay them to the underwriter c. The insured person must take all action possible to recover any costs, charges or fees the underwriter has paid or is responsible to pay and return them to the underwriter d. Upon conclusion of the claim under this policy, the underwriter can take over and if necessary conduct proceedings in the name of the insured person to recover the hire costs of the hire car or 200 from the third party Governing Law and Language This insurance shall be subject to English Law, unless specifically agreed to the contrary. All communication is to be conducted in English. Cancellation Rights Cancellation by you You may cancel this product and receive a full refund, if you inform us within 14 days from receipt of the confirmation letter or email. Should you cancel outside the 14 days, you will be charged on a daily pro rata basis for the time you have had on cover plus a 5 cancellation fee. Cancellation by us Your policy may be cancelled by us in the event of: You making a claim of a fraudulent or false nature Your associated motor policy being cancelled Your circumstances changing and you no longer meet the eligibility criteria to make a claim If we cancel your policy, you will be charged on a daily pro rata basis for the time you have had on cover plus a 5 cancellation fee. If a claim is made or has arisen during the period of insurance, the full premium is payable and no refund will be given.
