1 WCD LITIGATION SUPPORT AND CLAIMS EXPERIENCE WCD Group, LLC, its Principals and key consultants have been providing consulting, engineering, strategic and technical litigation support, claims consulting, expert report preparation and expert testimony for more than 25 years. We have assisted Owners, Developers, Contractors, Insurance Carriers, Insureds and their counsel in various types of litigation, including class actions involving exposure to microbiological and asbestos-containing materials and a wide array of hazardous substances. We have investigated and defended wrongful death and Legionella fatality claims. We have responded to and managed claims associated with explosions and fires. We have represented clients on post-catastrophe environmental, property and business interruption claims in excess of $1.0 billion. During litigation, we have completed Performance Bond work on projects as large as $148 million. We have performed schedule analysis for delay and business interruption claims. We have performed forensic engineering in construction defect claims and testified in Professional Liability claims. We regularly advise clients with respect to Pollution Legal Liability claims. We have supported litigation surrounding such events as the 911 attacks on the World Trade Center, Hurricane Katrina and Super Storm Sandy. We have also assisted clients with a myriad of other environmental claims of every type, size and scope. Our staff and resources include Ph.D. Engineers, Construction Managers, Certified Industrial Hygienists, Professional Engineers, Certified Hazardous Materials Managers, Forensic Accountants, former State Regulators, PMP Managers and Schedulers, OSHA and Safety Professionals, State and EPA Licensed Asbestos, Mold and Lead Professionals, Certified Litigation Management Professionals, a Certified Risk and Insurance Specialist and a Court-Approved Civil Mediator. The WCD senior consulting staff also includes a former NJDEP Assistant Administrator and NJDOT Director, with over 25 years managing the NJ Site Remediation Program, the NJ Brownfields Act, and the deepening/dredging program of the NY/NJ harbor. The staff also includes an accomplished Environmental Attorney. Her experience and accomplishments include litigating technically challenging environmental disputes, including class actions, toxic torts, and RCRA citizen suits, on behalf of manufacturing clients in a wide range of industries. She has represented Superfund potentially responsible parties (PRPs) and has served as common counsel for CERCLA PRP groups with respect to remedy negotiations with the US Environmental Protection Agency, implementation of landfill remedies, operations and maintenance activities, allocation determinations and contribution litigation.
