3 Comparison Guide to Maryland Medical Professional Liability Insurance Rates How to Shop for Medical Professional Liability Insurance Do comparison shopping. Comparison shopping is the key to getting the most for your insurance dollar and this is as true with regard to medical professional liability insurance as it is with other lines of insurance. You should contact several insurance producers (agents or brokers) and ask them which companies they represent and what your premium would be for insurance through each company. You may want to ask co-workers and business contacts for recommendations or referrals to a licensed producer. The best time to shop for insurance is well before your current policy expires, you change or begin your practice, open or relocate your facility. Ask for price quotes. In order to make an "apples to apples" price comparison, you must provide the same information to each producer (agent or broker). Ask for discounts. To keep rates down, ask what discounts the company offers and how you can qualify for them. Some companies may offer discounts such as new practitioner discounts, part-time discounts, risk management program discounts, or government employee discounts. Ask about deductibles and the required deductible offers. A deductible is the amount you agree to be responsible for in the event of a claim before the insurance company is required to make payments on your behalf. Deductibles may apply to liability coverage only or to other obligations or coverages, including defense costs, so be sure to ask the company when the deductible applies. If you select a high deductible, you will pay more out of your own pocket for a claim; however, your premium should be lower as a result. Pursuant to Section of the Insurance Article (HB 2, Special Session, 2004), companies are required to offer deductibles in the amount of $25,000, $50,000 and $100,000. Please note that these specific statutorily required deductible offerings may be applied only to the liability coverage provided by the policy and not to any other obligations or coverages, including defense costs. However, the insurer may cancel your policy for nonpayment of the deductible in the event the deductible is due and payable under the policy. By law, the insurer must provide you with a 10-day notice of cancellation if the deductible is not paid by the due date. Defense Coverage for Disciplinary Hearings. By law, a Medical Professional Liability Policy can no longer, as part of the liability policy, provide coverage for the defense of a health care provider in a disciplinary hearing arising out of the practice of the health care provider's profession. If such coverage is desired, some insurers may offer, and price, this coverage in a separate, standalone policy. Ask your producer if the company offers such a policy and get a quote for the cost of this policy if you want this coverage.

4 Protect yourself from insurance fraud. Once you have selected the insurance company, contact the Maryland Insurance Administration ("MIA") to verify that your producer is placing you with a company that is licensed to sell medical professional liability insurance in the State. It is illegal for unlicensed producers or companies to sell insurance. You can get this information on our website, under Consumer Information, then Queries. Surplus Lines Carriers and Risk Retention Groups. Surplus Lines Carriers and Risk Retention Groups usually specialize in the underwriting of certain specialties or physicians which licensed companies will not write. Surplus Lines Carriers and Risk Retention Groups are not included in this Rate Comparison Guide, as these types of insurers do not have uniform rating structures and individual physicians are rated on an individual basis. Thus, providing premiums in a comparison guide is not feasible. Please note that if you are insured by a Surplus Lines Carrier or a Risk Retention Group, you are not protected by the Property and Casualty Insurance Guaranty Corporation; nor are you eligible for a premium subsidy under Section et seq. of the Insurance Article. What Factors Impact Rates? Insurers determine rates based on the experience of their book of business and other factors that affect the ultimate amount of the premium charged to you. These rates are then classified by specialty or groups of specialties. Other factors that impact premiums paid by physicians/healthcare providers: Location of practice Limits of liability Length of extended reporting period Claims experience

Please note that the premiums listed in this Rate Comparison Guide reflect a mature physician with a clean claims history and limits of $1,000,000/$3,000,000. Thus, the premium you are quoted may differ from that which is listed in this guide. Note: Rates and Availability are subject to change by the insurers Notes to Rate Tables: Throughout this guide, you will notice various specialties and specialty descriptions. These descriptions may vary by company and there may not be comparable premiums among insurers for your particular specialty. You will need to contact the producer to determine which classification is available for your specialty. You may notice that some specialties are not listed and this is because either the insurers do not write these specialties or they are only written by surplus lines insurers or risk retention groups. Additionally, some specialties may not be found because they are relatively new specialties and may be included in a more general class description. The premiums shown for each specialty are base premiums by territory for policy limits of $1,000,000 per incident / $3,000,000 annual aggregate based upon mature claims-made rates, with a clean claims history, in effect on October 1, Premiums shown in this guide do not account for other variables; such as any discounts for which you may qualify or any deductibles you may choose. Also, the premiums do not take into account where an insurer rates a specialty on multiple rate levels based on exposures. Because individual circumstances may vary, it is not possible to provide the exact amount of your premium for any one company. Some medical professionals may pay actual premiums less than or greater than those provided in this guide, based on their individual circumstances. If you would like to identify how your final premium will be determined, you should contact your insurance producer. The premiums shown in this guide are mostly on a claims-made basis. However, a few carriers write certain healthcare professional liability policies on an occurrence basis. When buying a policy, please make sure whether your policy is on a claims-made or an occurrence basis.

Refer to company for Classes B through D, as they may vary. The differences between Physician Assistant classes are as follows: Class 1 - A physician assistant who performs tasks ordinarily reserved for a physician/ works under the direction and supervision of a qualified licensed physician to assist the physician in the diagnostic management of patients. Class 2 - A physician assistant who is involved in one or more of the following, but also limited to such responsibilities: 1. Assisting in Surgery - Exposure to an operating room other than for observation with General Practitioner/Family Practice or General Surgeon; may or may not include other surgical specialties. 2. Any exposure to Trauma/Emergency room procedures or responsibilities thereof (10-15 hours or less a week); 3. OB exposure limited to prenatal or postnatal care; and 4. Assisting in anesthesiology, or other surgical procedures. Class A Employed and Self-Employed: Adult/Geriatric/Family Planning/Gynecology/Women's Health/Adult Oncology

7 Class 3 - A physician assistant who may be involved in any of the following; but can also be rated as a physician surgical assistant: 1. Assisting in Surgery - Exposure to an operating room other than for observation. Surgeons include Orthopedic Surgeon, Cardiovascular Surgeon, Thoracic Surgeon, Neurosurgeon to name a few. 2. Any exposure to Trauma/Emergency room procedures or responsibilities thereof (more than hours a week); 3. Exposure to OB including delivery room responsibilities; and 4. Any other major surgical procedures. 8 How to File A Complaint: Consumers may contact the Maryland Insurance Administration to file a complaint against an insurance company or producer (agent or broker). Your complaint may relate to a carrier's refusal to insure you, a proposed cancellation or non-renewal or with regard to a claim. Complaints must be received in writing or filed on-line using the agency's website, Under Consumer Information, you will find a link titled, File A Complaint. This page describes the process and provides instructions for filing a complaint. Please provide as much detail as possible, including copies of relevant documents. A trained, professional investigator will handle your complaint. The investigator will contact the company/producer and try to resolve the issue. Meanwhile, you will be advised of the steps being taken on your behalf. Complaint files are not closed until the Maryland Insurance Administration has made a determination regarding the complaint.
