1 AMENDMENT NUMBER FOUR FIVE TO AGREEMENT N BETWEEN THE COUNTY OF ORANGE AND RANCHO SANTIAGO COMMUNITY COLLEGE DISTRICT DBA: SANTA ANA COLLEGE This AMENDMENT NUMBER FOUR FIVE to CONTRACT number N (hereinafter AMENDMENT NUMBER FOUR ) between the County of Orange, a political subdivision of the state of California (hereinafter COUNTY ) and (hereinafter CONTRACTOR ) with a place of business at 2323 North Broadway, Santa Ana, CA 92706, is made and entered upon execution of all necessary signatures. WITNESSETH: WHEREAS, COUNTY and CONTRACTOR executed CONTRACT for Registration and Tuition Fees for Criminal Justice Academy Classes, Contract N (hereinafter ORIGINAL AGREEMENT ), for a one-year term of September 18, 2007 through September 17, 2008; WHEREAS, COUNTY and CONTRACTOR renewed Contract N , as Contract N (hereinafter AMENDMENT NUMBER ONE ), for a one (1) year term of September 18, 2008 through September 17, 2009; WHEREAS, COUNTY and CONTRACTOR renewed Contract N , as Contract MA (hereinafter AMENDMENT NUMBER TWO ), for a one (1) year term of September 18, 2009 through September 17, 2010; WHEREAS, COUNTY and CONTRACTOR renewed Contract MA , as Contract MA (hereinafter AMENDMENT NUMBER THREE ), for a one (1) year term of September 18, 2010 through September 17, 2011; WHEREAS, COUNTY and CONTRACTOR renewed Contract MA , as Contract (hereinafter AMENDMENT NUMBER FOUR ), for a one (1) year term of September 18, 2011 through and including September 17, 2012; 1

2 WHEREAS, COUNTY and CONTRACTOR desire to amend ORIGINAL AGREEMENT to reflect the increase in California College Tuition fees from $26.00/unit to $36.00/unit, effective 8/15/2011 and Contract shall not exceed $150,000.00/year; WHEREAS, COUNTY and CONTRACTOR desire to renew ORIGINAL AGREEMENT to continue receiving services from CONTRACTOR for an additional one (1) year term and the CONTRACTOR has agreed to provide those services at the rates set forth in the ORIGINAL AGREEMENT; NOW THEREFORE, in consideration of the mutual obligations set forth herein, Both COUNTY and CONTRACTOR agree as follows: 1. ARTICLES a. Attachment A, Scope of Work, of the ORIGINAL AGREEMENT is amended to read in its entirety as follows: Attachment A Scope of Work: 1. Scope of Services: District shall provide Criminal Justice Academy Classes for the Sheriff s Department recruits. The recruits in the Sheriff s Criminal Justice Academy shall be able to obtain college credits for course taken as part of their academy training. 2. District shall provide the following Classes: CLASS UNITS FEE a. Basic Academy 24.0 $ b. Correction Officer Core Class 3.0 $ c. Reserve Level III 3.0 $ d. Reserve Academy Program $7.20-$ e. Basic Narcotics Investigation 2.0 $72.00 f. Coroner Course 3.0 $ Contract shall not exceed $150,000.00/year. a. Section A, Term, of the ORIGINAL AGREEMENT is amended to read in its entirety as follows: 2

3 1. Term: This Contract shall commence upon execution of all necessary signatures, and continue in effect from 9/18/07 through and including 9/17/12, unless otherwise terminated by COUNTY. The period of 9/18/07 through 9/17/08 shall be known as Contract number N The period of 9/18/08 through and including 9/17/09 shall be known as Contract number N The period of 9/18/09 through and including 9/17/10 shall be known as Contract number MA The period of 9/18/10 through and including 9/17/11 shall be known as Contract number MA The period of 9/18/11 through and including 9/17/12 shall be known as Contract number. 2. A true and correct copy of the ORIGINAL AGREEMENT (Contract N ) is attached hereto as Exhibit A and incorporated by this reference. 3. A true and correct copy of AMENDMENT NUMBER ONE (Contract N ) is attached hereto as Exhibit B and incorporated by this reference. 4. A true and correct copy of AMENDMENT NUMBER TWO (Contract MA ) is attached hereto as Exhibit C and incorporated by this reference. 5. A true and correct copy of AMENDMENT NUMBER THREE (Contract MA ) is attached hereto as Exhibit D and incorporated by this reference. 6. A true and correct copy of AMENDMENT NUMBER FOUR (Contract MA ) is attached hereto as Exhibit E and incorporated by this reference All other provisions of the ORIGINAL AGREEMENT, AMENDMENT NUMBER ONE, AMENDMENT NUMBER TWO, and AMENDMENT NUMBER THREE, and AMENDMENT NUMBER FOUR to the extent they are not inconsistent with this AMENDMENT NUMBER FOUR FIVE, remain unchanged and in full force and effect. All obligations of the Parties that would have been terminated on September 17, 2011 are hereby extended to September 17, (Signature page follows) 3
