County Courts-FTA Appearance Scheduling and Warrant Hold Practices 11 Operator (Non-Owner) Insurance 13 BASIC REINSTATEMENT STEPS The steps you must take to reinstate a California Driver s License (CDL) depend on whether the Department of Motor Vehicles (DMV) cancelled, suspended, or revoked it. The DMV cancels a CDL which it incorrectly issued or which you turn in for a different CDL or any reason other than a court or DMV order to surrender it. The DMV suspends a CDL for repeated non-serious violations (infractions or 1 st time misdemeanors) or a failure to correct or pay non-serious violations. The DMV revokes a CDL for serious violations (felonies or repeated misdemeanors) or a failure to appear in court as required on serious violations. To reinstate a cancelled CDL: 1. Apply for a new CDL on DMV Form Give the DMV one s Social Security number, thumbprint and photo. 3. Show the DMV a certified copy of one s birth or naturalization certificate, or, if not a U.S. citizen, one s passport or resident alien card. 4. Pay the DMV the non-refundable $31 application fee. To reinstate a suspended or revoked CDL: 1. Complete the suspension or revocation conditions and term. 2. Apply for reinstatement on DMV Form Give the DMV proof of insurance. 4. Pay the DMV the reinstatement fee of:

4 $24 for suspension for possession of an illegal drug, $125 for a DUI suspension or revocation, or $55 for all other suspensions or revocations. Reinstatement is never allowed if a CDL was revoked for the felony of assault with a deadly weapon and a car was the deadly weapon.) REQUIRED REVOCATIONS AND SUSPENSIONS PAGE 2 State law requires the DMV to revoke or suspend a CDL for certain violations. It specifies the conditions, term, and when, if ever, a restricted license for driving to and from work, treatment, or both is possible before reinstatement. The DMV charges $15 for the restricted license. CORRECTING A DMV RECORD ERROR PAGE 3 The steps you must take to correct a DMV driving record, a printout of which the DMV gave you when it denied your application for reinstatement, depend on whether your court record shows that you completed the suspension or revocation term and conditions. If you re not sure what your court record shows, take photo ID and the court docket number on your DMV printout to the court that has your record and ask the court clerk to let you see the record for that docket number. But, no matter what, you need to correct your DMV record as soon as possible because the DMV reports points and violations as follows: 1 point and accidents-3 years; 2 points-10 years; DUI and FTA on DUI-10 years; all other FTA and all FTP - 5 years; suspension and revocation - 3 years from date license restored. If your court record shows that you have completed the suspension or revocation term and conditions: 1. Give the court clerk $28 or an approved fee waiver (court forms FW-001 and FW-003) to make and send a certified copy of that court record to DMV Mandatory Actions Unit, Mail Station J233, P.O. Box , Sacramento, CA Allow 1 processing time before contacting the DMV Mandatory Actions Unit at (916) to get your reinstated license. If your court record doesn t show that you completed traffic school as required: 1. Get a certified copy of completion from the traffic school or, if it no longer exists or has a copy, by sending a $5 check or money order with the school s name, address, and

6 your attendance and completion dates to DMV Traffic Violator School Unit, P.O. Box (L_224), Sacramento, CA Take the certified copy to the court clerk to correct your court record. 3. Give the court clerk $28 or an approved fee waiver (court forms FW-001 and FW-003) to send a certified copy of your corrected court record to the DMV Mandatory Actions Unit, Mail Station J233, P.O. Box Sacramento, CA Allow 1 for the DMV Mandatory Actions Unit to process the corrected court record before contacting it at (916) to get your reinstated license. CORRECTING A DMV RECORD ERROR PAGE 4 If your court record doesn t show that you completed DUI treatment as required: 1. Get the DUI treatment program to send a certified copy of completion to the court and to the DMV Mandatory Actions Unit, Mail Station J233, P.O. Box , Sacramento, CA If the program no longer exists or has a copy, send the program s name, address, your attendance and completion dates, and program payment receipts to your county DUI Programs Supervisor, to certify completion to the court and to the DMV Mandatory Actions Unit. In Los Angeles County send that information to: DUI Programs Supervisor L. A. County Alcohol and Drug Program Administration 1000 S. Fremont Ave., Bldg. DMV Field Offices DMV field offices are open 9am-5pm Mondays, Tuesdays, Thursdays, and Fridays and 8am- 5pm Wednesdays. DMV field offices are closed on the following holidays:

7 Martin Luther King Day (Monday, January 17), Presidents Day (Monday, February 21), Cesar Chavez Day (Thursday, March 31), Memorial Day (Monday, May 30), Independence Day (Monday, July 4), Labor Day (Monday, September 5), Veteran s Day (Friday, November 11), Thanksgiving (Thursday-Friday, November 24-25), and Christmas Day (Monday, December 26). Call for the DMV field office nearest you and make an appointment for faster service. CORRECTING A FAILURE TO APPEAR (FTA) PAGE 5 The steps you must take to correct a failure to appear depend on whether a court appearance was required or an alternative of paying the fine by the date specified on your ticket. If you didn t appear on a serious violation - which requires a court appearance - the court may issue an arrest warrant and can impose fines ranging from $385-$685. If you didn t appear on a non-serious violation, the court may still issue an arrest warrant and also can impose fines ranging from $385-$685. Generally, if it s been more than (See Pages for the specific amount of time in L.A. County courts) since you were to appear on a serious violation: 1. From your employer or job trainer, treatment provider, or both, get and copy a letter that explains why you need a restricted license. The letter must be typed on the employer or job trainer s letterhead, dated, addressed Your Honor, and include the name and title of the person signing it below the signature. 2. Call the court clerk at the number on your ticket, court notice, DMV printout, or in the phone book to ask if you can schedule an appearance and get a hold on the arrest warrant until you see the judge. See Pages for L.A. County courts granting appearance scheduling, warrant holds, or both. If a warrant hold isn t possible, you may be arrested on walking in to court to see the judge. 3. Give the letters to the judge and the copies to the District Attorney to read before you enter a plea, generally No Contest unless you have a good reason, like being in a hospital or on active military duty overseas, for your failure to appear, and ask the judge to: dismiss the arrest warrant and any outstanding fines, give community service or a payment plan for the original fine; and

8 order a restricted license for going to work, treatment, or both. If the judge grants community service, you ll be sent to a volunteer center that charges a $60-$100 fee unless you bring proof that you are on General Relief (GR). 4. Give the court clerk $28 or an approved fee waiver (court forms FW-001 and FW-003) to send a certified copy of the court order record to: DMV Mandatory Actions Unit, Mail Station J233, P.O. Box , Sacramento, CA Allow 1 for the DMV Mandatory Actions Unit to correct your DMV record before contacting it at (916) to get your reinstated license. CORRECTING A FAILURE TO APPEAR (FTA) PAGE 6 Generally, if it s been more than (See Pages for the specific amount of time in L. A. County courts) since you were to appear on a non-serious violation: 1. Call the county collection service, which for L. A. County is GC Services at (800) or (800) , and ask to speak to a supervisor. 2. Ask the collection supervisor for an appointment to work out an affordable payment plan and possible court date. How soon, if at all, a court date is possible depends on whether you corrected a fix-it ticket, had a good reason for your FTA, or stick to the payment plan you work out. 3. Take proof of the following to the appointment: your income and expenses, good reason, if any, for your failure to appear, and correction of a fix-it ticket, if one is involved. From your employer or job trainer, treatment provider, or both, get and copy a letter that explains why you need a restricted license. The letter must be typed on the employer or job trainer s letterhead, dated, addressed Your Honor, and with the name and title of the person signing it below the signature. 4. Have the letters and proof with you on your court date for the judge to read before you enter a plea, generally No Contest unless you have a good reason, like being in a hospital or on active military duty overseas, for your FTA, and ask the judge to: dismiss the added $385 fine, give community service or a payment plan for the original fine, and order a restricted license for going to work, treatment, or both. 10 CORRECTING A DUI VIOLATION PAGE 7 The steps to correct a DUI depend on whether it s a 1 st, 2 nd, 3 rd or more DUI in 10 years, whether alcohol only or a drug was involved, and whether anyone was injured. The main condition you must meet is to complete the DMV-approved treatment for that DUI. See page 2 for required treatment. By law the treatment fee is on a sliding scale-the lower the income, the lower the fee-down to $5 a month for anyone on General Relief (GR). If denied a sliding scale fee, call the county Alcohol and Drug Program Administration s In-House Duty Officer. In L.A. County the number is (626) To get a restricted license for a 1 st DUI: 1. Get a DMV-approved 1 st DUI (AB 541) treatment list from and register with Community Services at the county court so that treatment enrollment, attendance, and completion are reported to the court. 2. Take income proof and enroll in a listed treatment. Have the treatment program send enrollment proof to the court and to the DMV Mandatory Actions Unit, Mail Station J233, P. O. Box , Sacramento, CA Get a list of approved ignition interlock places from the court, DMV, or DUI treatment provider, have a listed place put one in your car, send the court proof that it was done, and after 30 days (60 days if anyone was injured) ask the judge to grant you a restricted license. 4. From your employer or job trainer, get and copy a letter that, in addition to DUI treatment, explains why you need a restricted license. The letter must be typed on the employer or job trainer s letterhead, dated, addressed Your Honor, and with the name and title of the person signing it below the signature. 5. Call the county court clerk if it s over 30 days (60 days if anyone was injured) since the DUI and ask for a court date to get a court order for a restricted license. 6. Give the judge the letter and the District Attorney the copy to read before you ask the judge to order a restricted license for going to work and DUI treatment. 7. Give the court clerk $28 or an approved fee waiver (court forms FW-001 and FW-003) to send a certified copy of the court order record to the DMV Mandatory Actions Unit. 8. Allow 1 for the DMV Mandatory Actions Unit to correct your DMV record before contacting it at (916) to get a restricted license.

11 CORRECTING A DUI VIOLATION PAGE 8 To get a restricted license if it s your 2 nd or 3 rd DUI in the past 10 years: 1. Get the 2 nd (SB 38) or 3 rd or more (SB 1365) DMV-approved DUI treatment list from and register with Community Services at the county court so that treatment enrollment, attendance, and completion are reported to the court. 2. Take income proof and enroll in listed treatment. Have the treatment program send enrollment proof to the court and to the DMV Mandatory Actions Unit, Mail Station J233, P.O. Box , Sacramento, CA If it s your 2 nd or 3 rd Alcohol-only DUI, get a list of approved ignition interlock places from the court, DMV, or DUI treatment provider; have the listed place put an ignition interlock in your car; send the court proof that it was done; and after 90 days on your 2 nd DUI or 6 months on your 3 rd DUI ask the judge to grant you a restricted license. 4. If it s your 2 nd Drug DUI or your 2 nd or 3 rd Injury-Causing DUI, do the 12 months of treatment required for a restricted license. Have the treatment program send treatment proof to the court and to the DMV Mandatory Actions Unit. Then, get a list of approved ignition interlock places from the court, DMV, or DUI treatment provider. Have a listed place put one in your car, and send the court proof that it was done. 5. From your employer or job trainer, get and copy a letter that, in addition to DUI treatment, explains why you need a restricted license. The letter must be typed on the employer or job trainer s letterhead, dated, addressed Your Honor, and with the name and title of the person signing it below the signature. 6. Go to the county court clerk if it s over 12 months since your 2 nd or 3 rd DUI and ask for a court date to get a court order granting a restricted license. 7. Give the judge the letter and the District Attorney the copy to read before you ask the judge to grant a restricted license for going to work and DUI treatment. 8. Give the court clerk $28 or an approved fee waiver (court forms FW-001 and FW-003) to send a certified copy of the court order to the DMV Mandatory Actions Unit. 9. Allow 1 for the DMV Mandatory Actions Unit to correct your DMV record before contacting it at (916) to get a restricted license.

12 CORRECTING A CHILD SUPPORT VIOLATION PAGE 9 The steps you must take to correct a child support violation depend on your income and family support expenses. But, no matter what your income and expenses are, you need to correct the violation as soon as possible to prevent the 10% interest on past-due payments, including interest, from doubling or tripling the amount you owe. If your income is less than it was when the support judgment (order) was entered or, is the same or more but your expenses are more: 1. Go to the clerk of the county court that entered the judgment, which for L. A. County is Central Civil West at 600 S. Commonwealth Avenue, with $3 to get a copy of the judgment if you don t have one and to get the following family law (FL) court forms: FL 300-Order to Show Cause, FL 310-Application for Order and Supporting Declaration, FL 320-Responsive Declaration, FL 155-Financial Statement Simplified, and FL 335 Proof of Service by Mail. 2. Take the judgment, forms, income and expense proof (3 most recent pay, disability, unemployment, or welfare check stubs, lease or rent receipts, and any other support judgment you have), to the court s Family Law Facilitator office, to complete and make 2 copies of the forms which ask the judge to reduce or, if you have GR, SSI, or monthly income of $1000 or less, to stop support payments, and to order the DMV to reinstate your driver s license. At Central Civil West the Family Law Facilitator s office is Room 1602; walk in between 8am-4pm Monday to Friday, or call between 8-9 am from Monday to Friday for telephone hours. Clients are serviced on a first-comefirst-serve basis. It is strongly recommended that you arrive before 6am for walk-ins. People who are severely handicapped, live outside California, or live within California but need a minimum of two hours travel time can make appointments from 8am-9pm by calling Please note that the court closes for most services the third Wednesday of each month due to the statewide financial crisis. 3. Give the court clerk the completed forms and one copy to get a court date, file and serve on the county Child Support Services Department (CSSD) Chief Attorney. 4. Bring a copy of the completed forms and income and expense proof to your court date. 5. Ask the court clerk to send a certified copy of the court order record to the DMV Mandatory Actions Unit, Mail Station J233, P. O. 13 CORRECTING AN UNSATISFIED JUDGMENT PAGE 10 The steps you must take to correct an unsatisfied (unpaid) judgment against you as the driver or owner of a car involved in an accident depend on whether you can afford a settlement for the total shown on the costs sheet attached to the judgment. If you don t have a copy of the judgment, take $3 to the clerk of the county court where judgment was entered for a copy. But, no matter what, you need to correct the judgment as soon as possible to prevent the 10% interest on it, including unpaid interest, from doubling or tripling the amount you owe. If you can afford a settlement for the total shown on the costs sheet: 1. Write the attorney or insurance company whose name, address, and phone number appears on the judgment, offer to settle for that amount, and specify the settlement terms- payment dates and amounts- you can afford. 2. Wait two weeks for a response and, if none, call the attorney or insurance company you wrote to follow-up on your settlement offer. 3. Get the attorney or insurance company s acceptance of your settlement offer, including the settlement terms, in writing and signed. 4. Keep your settlement terms till completed to get a signed satisfaction (payment) of judgment filed with the court clerk. If you don t keep your settlement terms, you ll owe what was due before the settlement agreement plus interest since then. 5. Ask the court clerk to send a certified copy of the court record that shows you satisfied (paid) the judgment to the DMV Mandatory Actions Unit, Mail Station J233, P. O. Box , Sacramento, CA Allow 1 for the DMV Mandatory Actions Unit to correct your DMV record before contacting it at (916) to get your reinstated license. If you can t afford to settle for the total shown on the costs sheet, you can file bankruptcy to get a discharge of the judgment amount plus interest since then. To get your license reinstated have the bankruptcy court clerk send a certified copy of the bankruptcy discharge to the DMV Mandatory Actions Unit. If after 3 years you still can t afford to settle or finish paying a settlement, you can file proof of insurance with the DMV Mandatory Actions Unit to get your license reinstated.
