2 Volunteer Insurance Coverages* 1. Excess Medical Accident Policy 2. Volunteer Excess Liability 3. Volunteer Excess Auto Liability *This presentation contains a broad outline of coverages and does not include all the terms, conditions and exclusions of the policies that may be issued to you. The policies will contain the full and complete agreement with regard to coverage. In the event of any inconsistency between this presentation and the policies, the policy language would control. 2

3 VOLUNTEER EXCESS MEDICAL ACCIDENT POLICY 1. Who is eligible A. All volunteers designated or registered with the Policyholder in a volunteer project or program sponsored by the Policyholder. or B. All Court Referred Alternative volunteers designated or registered with the Policy holder in a volunteer project or program sponsored by the Policyholder. 2. Coverage A. Excess Accidental Death and Dismemberment - $2,500 benefit 1) 100% of benefit for loss of life 2) 100 % if benefit for two or more members lost 3) 50% of benefit for one member lost 4) 25% of benefit for thumb and index finger of the same hand 3

4 B. Excess Medical and Dental Expense 1) $50,000 Total Maximum for all Accident Medical and Dental 2) $5,000 Total Maximum for all Dental 3) $250 Maximum per tooth C. Pays for Accident Medical Expenses 1) for usual and customary charges incurred 2) for those Medically Necessary Covered Expenses incurred by or on behalf of the covered person 3) for covered expenses incurred within 365 days after the date of the covered accident 4

Exclusions, Partial Eyeglasses, contract lenses, hearing aids Damage to or loss of dentures or bridges or damage to existing orthodontics Treatment of a hernia, Osgood-Schlatter s disease, osteochondritis, appendicitis, osteomyelitis, cardiac disease or condition, pathological fractures, congenital weakness Travel in or on any vehicle for aerial navigation including boarding; While riding as a passenger in any aircraft not intended or licensed for transportation of passengers Services or treatment by a family member Injuries paid under workers compensation Suicide, self-destruction, attempt or intentional self-inflicted injury Sickness or disease or any bacterial infection, except one from cut or wound or accidental ingestion or contaminated substances. Drug or narcotics use unless prescribed by a Physician Injury resulting from use of alcohol or/and illegal drugs Service or active duty in the armed forces. 5

6 VOLUNTEER EXCESS LIABILITY & EXCESS AUTO LIABILITY 1. Who is eligible A. All designated or registered volunteers of the named organization but only with respects to the liability for volunteer service activities of the named organization or performance of volunteer service by registered volunteer Registered Volunteer is one who has been accepted to perform volunteer services and whose name has been recorded on a roster of volunteers 2. Policy Limits Excess Liability A. $1,000,000 Per Each Occurrence B. $3,000,000 Annual Aggregate Excess Auto Liability A. $500,000 6

Excess Liability 1) Pays third party the sums that exceed underlying insurance coverage and limited to Policy limit 2) when the insured becomes legally obligated to pay as damaged because of bodily injury, property damage, or personal injury a) must arise out of the performance of the insured s volunteer service on behalf of named organization B. Excess Auto Liability - Volunteer must have a personal insurance policy 1) Pays third party the sums that exceed limits of volunteers personal insurance coverage and limited to Policy limit 2) Pays when the insured becomes legally obligated to pay as damage because of bodily injury, property damage, or personal injury a) Does not cover when volunteer is driving agency vehicle. 7

Exclusions-Partial 1) Expected or intended injury 2) Arising out of liability assumed in a contract or agreement 3) Workers Compensation and similar laws 4) Pollution 5) Aircraft or watercraft 6) War 7) Damage to Property 8) Personal Injury criminal acts intentional libel/slander 9) Professional Services 10) Racing 11) Work Release and Alternative Sentencing 12) Sexual Abuse and Sexual Molestation 13) Certain Volunteer assignments (firefighters, police, etc.) 14) Nuclear Incidents & Railroad Operations and Maintenance The following apply solely to Volunteer Excess Auto 1) Uninsured/Underinsured Motorist 2) Operations of mobile equipment 3) Handling of Property 4) Movement of Property 8

9 Is a Volunteer covered if operating an Agency vehicle? Volunteer Excess Accident Medical Policy Volunteer would be covered up to the $50,000 limit for his or her own injuries. ($25,000 limit for court referred volunteers) Volunteer Excess Liability and Excess Auto Liability Policy No coverage Volunteer is operating an Agency owned vehicle. Volunteers should not be allowed to operate Agency owned vehicles without providing proof of liability insurance that is applicable to the government-owned vehicle. 9

Is a Volunteer covered while operating a personally owned vehicle? Volunteer Excess Accident Medical Policy Volunteer would be covered up to the $50,000 limit for his or her own injuries.

10 Is a Volunteer covered while operating a personally owned vehicle? Volunteer Excess Accident Medical Policy Volunteer would be covered up to the $50,000 limit for his or her own injuries. ($25,000 limit for court referred volunteers) Volunteer Excess Liability and Excess Auto Liability Policy Coverage is provided ONLY if it is their personal vehicle and has his/her own automobile coverage (state statutory minimum) This coverage pays for damages to a third party. 10

11 Is Volunteer covered if operating an All-Terrain Vehicle (ATV)? Volunteer Excess Accident Medical Policy Provides coverage if the volunteer has the proper licensing or certification if required to operate. Volunteer Excess Liability and Excess Auto Liability Policy Coverage is provided under the Excess Liability for property damage or bodily injury to a third party. 11

12 Is Volunteer covered if operating an Utility Type Vehicle (UTV)? Volunteer Excess Accident Medical Policy Provides coverage if the volunteer is a passenger or has the proper licensing or certification if required to operate. Volunteer Excess Liability and Excess Auto Liability Policy Coverage is provided under the Excess Liability for property damage or bodily injury to a third party. 12

13 Can UTVs such as a Gator or Mule be operated by volunteers on a public roadway, or crossing over a public road? Volunteer Excess Accident Medical Policy The volunteer policy does not limit coverage based on where the UTV is operated when a Covered Accident occurs. Volunteer Excess Liability and Excess Auto Liability Policy UTVs are not licensed for public road travel. UTV usage should be limited to agency premises. 13

14 Is Volunteer covered if operating an Neighborhood Electric Vehicle (NEV)? Volunteer Excess Accident Medical Policy Volunteer would be covered up to the $50,000 limit for his or her own injuries. ($25,000 limit for court referred volunteers) Volunteer Excess Liability and Excess Auto Liability Policy No coverage Volunteer is operating an Agency owned vehicle. Volunteers should not be allowed to operate Agency owned vehicles without providing proof of liability insurance that is applicable to the government-owned vehicle. 14

15 Is Volunteer covered if operating mobile equipment such as lawnmowers, forklifts, backhoes, tractors? Volunteer Excess Accident Medical Policy Provides coverage if the volunteer has the proper licensing or certification required to operate. Volunteer Excess Liability and Excess Auto Liability Policy Provides coverage for property damage an bodily injury to a third party due to the volunteer operation of this type of mobile equipment. 15

16 Is Volunteer covered if operating an Agency owned watercraft? Volunteer Excess Accident Medical Policy Provides coverage for his/her own injuries up to $50,000 limit - Volunteer should not be allowed to operate watercraft without providing proof of liability insurance that is applicable to government owned watercraft. Volunteer Excess Liability and Excess Auto Liability Policy No coverage is provided 16

17 Is Volunteer covered if operating his/her personally owned watercraft? Volunteer Excess Accident Medical Policy Provides coverage for his/her own injuries up to $50,000 limit - Volunteer should not be allowed to operate watercraft without providing proof of liability insurance that is applicable to government owned watercraft. Volunteer Excess Liability and Excess Auto Liability Policy Coverage is provided for property damage or bodily injury to a third party due to the volunteer operation of a personally owned watercraft that is less than 26 feet long, as long as they are not carrying passengers for a charge. 17
