1 Rent Arrears Recovery Policy Reference: HS/ Approved: 09/2013 Scope: Legislation: Housing Solutions Housing Act 1998 Housing Act 2004 Localism Act 2013 Revised: Revised: Date of next Review: Related Policies: Transfer and Mutual Exchange Policy Author: Cherelle Dovey Approved by: ET & SMT 1 Statement of Intent 09/ / / The Housing Solutions Group must ensure the effective management of rent collection as this is crucial to our financial viability. To safeguard its position the Group must endeavour to ensure that all rent payments are made in line with the residents required obligations, as detailed in the Tenancy Agreement or Licence. 1.2 Housing Solutions is committed to helping residents not fall into arrears through early intervention and financial inclusion support. If a resident does fall into arrears through financial difficulty, the rent arrears protocol will be followed (app. 1) to ensure the resident has had adequate opportunity to sustain their tenancy or licence. 1.3 This policy applies to the Housing Solutions Group 2 Aims 2.1 The aims of this policy are to ensure that; Rent arrears are kept to a minimum and rental income is maximised; Residents are offered financial inclusion support to prevent rent arrears increasing; Vulnerable residents are afforded appropriate support if they fall into rent arrears; Legal guidelines and good practice are adhered to (please see Appendix 1 for
2 the Pre-Action Protocol on Possession Claims for Rent Arrears) to ensure Housing Solutions adopt a firm but fair approach to rent recovery Former tenant arrears are dealt with promptly and, where there is a high probability that the debt is irrecoverable, that it is written off. 3 Rent Arrears Management 3.1 Housing Solutions employ a generic team of Tenancy and Neighbourhood Officers, Community Housing Officers and Supported Housing Officers to manage the collection of rent arrears. 3.2 The Teams work in partnership with relevant external agencies (eg local authority Housing Benefit Departments and the CAB) to deliver a comprehensive rent arrears management service. 3.3 The teams work to an agreed set of service standards which are outlined in Appendix All rent accounts are managed securely on the Group s Capita housing management software package. 4 Rent Collection & Arrears Prevention Services 4.1 Rent Collection Housing Solutions offers a wide range of methods to make rent payments designed to meet the diverse needs of our customers. Current rent payment options include: Cash desk facility in the Group s customer reception; Direct Debit; Standing Order; By Text; All Pay swipe card which can be used in any pay point outlet; Debit or Credit Card (in person or over the telephone); Via internet banking; Online Payments via It is Group policy that Direct Debit is the preferred method of payment and tenants will be encouraged to use this method where possible. A credit will be offered to residents accounts when setting up a new direct debit. Should the direct debit be cancelled or referred to payer within the first 6 months, the amount credited will be retracted. 2 Policy Title
3 4.3 New Tenants All new residents are clearly advised of their responsibilities to ensure that their rent is paid in full and on time. They are also advised that it is their responsibility to ensure that they make and maintain claims for Housing Benefit with the relevant local authority, submitting all paperwork immediately when requested from the authority The Group will provide advice and assistance on rent payment responsibilities and benefits entitlements to any new tenant requiring such help. A pretenancy assessment may be carried out by a member of the Financial Inclusion Team to ensure the rent is affordable for the prospective resident. A prospective tenant may be refused for a property should the assessment prove unaffordable At sign up to a new property, 1 week s rent payment is required before handover and if the resident is going to be claiming full housing benefit, the amount will stand at 1 week s payment of the statutory minimum All new tenants on starter tenancies will be visited by their Tenancy and Neighbourhood Officer (TNO) 3 times during the first year of the starter tenancy to check they are settled in and to address any early concerns with the tenancy that may have arisen. These visits will allow the Officer establish whether an Assured or Fixed Term tenancy is then granted or whether there has been tenancy breaches and a notice is served to terminate the starter tenancy Any residents transferring internally or any new residents in supported or sheltered accommodation will receive a visit after 6 weeks to ensure they have settled in and to address any concerns with the rent. The visit will be conducted by a TNO in general needs properties, a Community Housing Officer (CHO) in Sheltered properties, or a supported services officer (SSO) for those in supported accommodation. 4.4 Current Tenants All tenants will receive a quarterly statement of their rent account to ensure that they are kept up to date with the balance of their rent account Residents falling into rent arrears will receive prompt notification of this from Housing Solutions (see Rent Arrears Procedure in Appendix 3). It is also the residents responsibility to contact Housing Solutions should they see their account is in arrears Residents can receive guidance on how to manage their rent payments, any rent arrears and other debts from the Group via their Financial Inclusion team Residents are entitled to an End of Tenancy Bonus where 100 is paid at the end of a tenancy if the tenant has paid all rent and other monies due as well as left the property in a good and empty condition. 4 good, clean condition, and there are any arrears on the account, the 100 will be used to credit the account. This is for anyone leaving Housing Solutions or transferring to another property. This payment is not made where residents are undertaking a mutual exchange Residents are entitled to a Downsizing payment should they be underoccupying a property and wish to transfer or mutual exchange to another property within Housing Solutions stock. Should permission be given for a resident to downsize in arrears, permission may be granted if the payment will cover the debt and will be used to credit the account. Permission will only be given where the resident is making regular payments to reduce any current debt The effectiveness of incentive schemes is regularly monitored to ensure that they are providing value for money for Housing Solutions and may be subject to review at any time. They are also subject to budget availability. 4.5 Housing Benefit Residents must endeavour to ensure that any delays in the payment of Housing Benefit from the relevant local authority are kept to an absolute minimum. This includes the prompt provision of information to Housing Benefit Departments when it is requested. Residents must ensure they inform the relevant Housing Benefit Department of any rent or service charge increases Housing Solutions insist that where rent is paid directly to the resident through Housing Benefit or Universal Credit that a Direct Debit is set up for the same day that money is received Housing Solutions will endeavour to work closely with local authority Housing Benefit Departments to ensure that there is a positive working relationship and that there are clear channels of communication open to effect the swift resolution of any problems. Where possible Housing Solutions will establish formal service level agreements with Housing Benefit Departments to define their working relationship formally Where there is a claim of over-payment of Housing Benefit onto a tenant s rent account, Housing Solutions will ensure that these comply with regulations and any service level agreement in place. Where repayments of overpayments are made, the affected tenant will be informed immediately by the local authority and appropriate recovery action taken by Housing Solutions to recoup the monies owed. 5 Universal Credit 5.1 Universal Credit is a significant change in that residents will receive a single monthly household payment. To safeguard residents properties Housing Solutions may request the Department for Work and Pensions pay the housing cost element of Universal Credit direct to Housing Solutions. 4 Policy Title
5 Housing Solutions will request direct housing payments should the resident be in any of the below situations. Discretion will be used by DWP as to whether this is approved: Claimant is currently in arrears for their rent of 2 or more months; Claimant has been evicted for rent arrears and/or failed a tenancy within the last 12 months; Claimant is subject/threatened with eviction and/or repossession; Claimant is not in arrears but may have been within the last 12 months and was subject/threatened with eviction and/or possession. Universal Credit factors will be continuously under review as the new system is put into place. The policy will be updated to take into account changes of legislation whilst the system is still in trial. 5 Policy Title
6 6 Under Occupancy Charge (Bedroom Tax) As of April 2013 the Government introduced an under-occupancy charge for working age residents who are deemed to be under-occupying their properties. This falls under the Welfare Reform Act This is commonly known as the bedroom tax The size criteria in the social rented sector will restrict housing benefit to allow for one bedroom for each person or couple living as part of the household, with the following exceptions: Two children under 16 of same gender expected to share Two children under 10 expected to share regardless of gender Disabled tenant or partner who needs non-resident overnight carer will be allowed an extra bedroom Approved foster carers will be allowed an additional room so long as they have fostered a child, or become an approved foster carer in the last 12 months Adult children in the Armed Forces will be treated as continuing to live at home when deployed on operations In addition, local councils have been advised to allow an extra bedroom for children who are unable to share because of their severe disabilities. All claimants who are deemed to have at least one spare bedroom will be affected. This includes: Separated parents who share the care of their children and who may have been allocated an extra bedroom to reflect this. Benefit rules mean that there must be a designated main carer for children (who receives the extra benefit) Couples who use their spare bedroom when recovering from an illness or operation Parents whose children visit but are not part of the household Disabled people including people living in adapted or specially designed properties. The cut will be a fixed percentage of the Housing Benefit eligible rent. The Government has set this reduction at 14% for one extra bedroom and 25% for two or more extra bedrooms. There are some differences between how the bedroom tax will operate under housing benefit (from April 2013) and under Universal Credit when it is introduced. These differences are summarised in the table below: 6 Policy Title
7 From April 2013 Those over State Pension Credit age will not be affected, including where one member of a couple is over. Non-dependant deductions (NDD): six separate rates varying by income and under 25s on benefit are exempt. Non-dependants: couples get one room between them. They pay the NDD unless both are exempt. Lodgers get a room but income is taken into account and deducted pound for pound from benefit apart from first 20. In joint tenancy cases the bedroom tax can still apply. Protection on death for up to 52 weeks. 13 week protection where the tenant could previously afford the rent and Housing Benefit has not been claimed in the last 52 weeks. Under Universal Credit Mixed age couples - both will need to be over pension age to not be affected by the bedroom tax. Those where one is already in receipt of Pension Credit will however be protected. One, flat-rate Housing Cost Contribution (HCC). All under 21s are exempt from HCC. Each adult non-dependent gets a room. Each pays the HCC unless exempt. No room allowance but any income from lodgers is disregarded. Bedroom tax not applied in non-couple joint- tenancy cases. Benefits run-on for 3 months. Size criteria applies immediately. Move Home Downsizing Assistance To assist residents who wish to downsize and cannot afford the additional payments the under occupancy charge will create, Housing Solutions Move Home Adviser can apply the following scheme in discretionary circumstances. Once a resident affected by the under occupancy charge has decided they wish to downsize, Housing Solutions will aim to find an appropriate property 12 months of the date of application to downsize. This is subject to location and type of property to be agreed between the resident and Housing Solutions to ensure this is achievable and the type of property is available within our stock. During the waiting time for the move, Housing Solutions will credit the residents account with the shortfall due to the under occupancy charge for 12 months. The sum credited will be deducted out of the downsizing payment due to the resident after the move. This scheme is subject to mutual agreement. The remaining rent and any court order or agreement to clear arrears must be paid during this time as the credit will only cover the under occupation shortfall of 14% (if under occupying by 1 bedoom) or 25% (if under occupying by 2 bedrooms) of rent per week. The scheme only applies to those downsizing to a property which will meet their needs. The mutual agreement will be made by the Lettings and Homeownership Manager, or the Housing Manager. Lodgers - From April 2013 lodgers will count as occupying a room under the size criteria rules. Any income from a lodger will be taken into account and deducted pound for pound from benefit apart from the first 20. This reverses under Universal Credit lodgers will not be counted as occupying a room and 7 Policy Title
8 the size criteria reduction will apply, but any income from lodgers will be fully disregarded and will not impact on the amount of a claimant s Universal Credit award. 7 Rent Arrears Recovery 7.1 Housing Solutions full rent arrears recovery procedures are outlined in Appendix 3 and aim to be in full compliance with the Protocol for Possession Claims (Appendix 1). The core principles of these are outlined below: 7.2 Early Intervention The Group believes that the best way of minimising rent arrears is by preventing them becoming a major, long-term problem wherever possible It is Housing Solutions policy to inform tenants of rent arrears as soon as they accrue or payments are missed. All arrears are notified as standard by the quarterly rent statement Wherever possible, personal contact with residents in arrears is attempted prior to any legal notices being served. Letters will always be sent directly to the resident and legal notices delivered by hand. 7.3 Repayment Arrangements It is required that rent arrears are repaid as quickly as possible. Arrangements to repay arrears of rent that have accrued will be made according to an acceptable offer made by the resident or following a financial inclusion assessment by a Financial Inclusion Officer. Should an acceptable agreement of repayment not be agreed, the case may be taken to court for a judge to deem the amount. 7.4 Vulnerable Residents All residents must pay their rent and Housing Solutions recognises that some have difficulties maintaining their responsibility for reasons often beyond their control. Housing Solutions refer to such tenants as vulnerable Residents may be classed as vulnerable for a number reasons including physical and mental health disabilities, learning difficulties, being elderly, chronically sick and having temporary or permanent financial management problems resulting from these or a wide range of other causes Housing Solutions will ensure that the needs of vulnerable tenants are taken into account when taking action to recover rent arrears. This includes liaising with appropriate external agencies and family to provide support with vulnerable residents financial affairs. 8 Policy Title
9 7.5 Legal Action and Alternatives Housing Solutions will take legal action to recover rent arrears where the tenant responsible is failing to take adequate steps to resolve the situation. Housing Solutions will do this to protect its position in the event of the tenant defaulting on payments for long periods of time or failing to maintain regular repayments of a debt as per an agreement Initial legal action for assured and fixed term tenants involves the service of a Notice of Seeking Possession (NOSP). This will only be done after the Tenancy and Neighbourhood Officer has attempted to contact the tenant in question in person in line with the Protocol (Appendix. 3). A NOSP will be reserved on a tenant without prior warning should the previous notice have expired, but the agreement is being kept to Where a resident has a starter tenancy or assured shorthold tenancy, a Section 21 notice will be served in line with the Protocol. A Section 21 notice equates to mandatory possession with a court order and gives 2 months notice before the process of gaining the court order for possession Where a resident has a licence agreement, a Notice to Quit will be served in line with the Protocol. A Notice to Quit equates to mandatory possession from the court and gives 28 days notice before the process of gaining the court order for possession Housing Solutions will serve a NOSP, Section 21 or Notice to Quit but not commence legal action against a tenant while a claim for Universal Credit or Housing Benefit is confirmed as in process Applying to Court for a possession hearing for rent arrears will be done only where a tenant has failed to make or maintain arrangements to repay the debt owed and/or failed to claim Housing Benefit/Universal Credit or provide relevant documentation or evidence of income to support a claim Housing Solutions will seek to evict tenants where there is a breach of the order set by the Court and disregarding offers of support and assistance from the Financial Inclusion Team. All eviction proceedings are signed off by a Manager within the Association Rent is recoverable under the following Grounds for Possession: Ground 8 is a mandatory possession and is used for residents in general needs shared accommodation with rent arrears at 8 weeks or over. It may be used in other high rent arrear situations with sign off from the Senior Management Team. Ground 10 is used in all cases where arrears are at a stage to be referred to court. Ground 11 is used where there are residents who do not pay consistently, leading to frequent arrears accruing. Ground 8 Rent is unpaid at the time of service of Notice Seeking Possession and at the time of the hearing for a Possession Order; 9 Policy Title
10 a) In the case of rent paid weekly or fortnightly at least eight weeks rent is owing. b) In the case of rent paid monthly at least two months rent is owing. c) In the case of rent paid quarterly at least one quarters rent is more than three months overdue. d) In the case of rent paid yearly at least three months rent is more than three months overdue. Two months rent arrears will normally give the landlord an automatic right to a Possession Order. Ground 10 Rent which is lawfully due from the tenant has not been paid by the time the possession proceedings are started and was owed at the time the Notice Seeking Possession was served. If a tenant has been offering the landlord rent and the landlord refused to take it, the tenant will have a defence to the possession proceedings but must pay the amount owed in to court. Ground 11 The tenant has repeatedly failed to pay rent on time. There need not be rent arrears at the time possession proceedings are started. Residents affected by the Under-Occupancy Charges If a resident is struggling to pay the additional rent required as a result of benefit cuts through under-occupancy charges, Housing Solutions will support these residents in the choices they have. Housing Solutions will follow the procedure as per the appendix and required Pre Action Protocol when recovering debts as a result of the under-occupancy charges. Housing Solutions will offer the following assistance to residents who are finding it difficult to cover the cost of the rent: All residents affected by the under-occupancy benefit cuts can access free financial assistance from our Financial Inclusion team. Court action may be withheld at Housing Solutions discretion if a resident has applied to downsize, and is actively looking for a suitable property through a mutual exchange on homeswapper or any other means. An Assisted Transfer Scheme is available to help residents move home should they need it, more details can be found in the Changing Your Home Policy. 10 Policy Title
11 8 Advice and Assistance 8.1 Housing Solutions will provide financial advice and assistance on rent account management, debt advice and welfare benefits, including Housing Benefit and Universal Credit, as a standard service to all tenants who require such. This support will be available throughout their tenancy; tenants can access this support directly or via their Tenancy & Neighbourhood Officer, Community Housing Officer or Supported Services Officer. 8.2 However, Housing Solutions cannot provide in-depth assistance in cases going through the courts where Housing Solutions is the claimant. 8.3 Housing Solutions will develop relationships with external agencies such as the Citizen s Advice Bureau to provide a referral service for tenants requiring detailed independent advice and assistance with their rent arrears and wider problems. The contact details of such organisations will be provided generally to all tenants via publications such as Streets Ahead and the Tenants Handbook, but also directly to tenants in rent arrears via arrears letters, leaflets and personal contact. 8.4 Such external agencies are also available to tenants wishing to obtain an independent opinion or legal advice on their rent arrears situation and any legal action Housing Solutions might be taking against them to recover unpaid rent. 9 Disincentives to Arrears 9.1 Residents who are in rent arrears are failing to maintain the responsibilities of their tenancy as detailed in the tenancy agreement. The Association will withdraw certain services from residents in rent arrears to reflect this breach of contract. Examples of services that will be withdrawn are listed below: Residents are allowed to register on the transfer list should they have rent arrears. If they reach the top of the list, they will be contacted to see if they can clear their rent account as a property has become available. If a resident cannot clear their account within the required allocation time scale, they will be overlooked for that property. Arrears due to Housing Benefit only will not be considered as arrears and residents will be offered a property should they be next in line for the odder. Specific discretionary permission is granted by Housing Solutions where a downsizing payment will cover arrears if the arrears are being reduced by the resident and an arrangement is being kept to. If a downsizing payment will not cover the full arrear, the arrears need to be reduced by the resident to a sum that the payment will cover. Residents will be given the opportunity to do this within the allocation period Mutual exchanges will be refused unless specific permission is granted where a downsizing payment will cover arrears if the arrears are being reduced by the resident. 11 Policy Title
12 9.2.3 Assignments to the tenancy will be refused; Planned maintenance and improvement works (such as new kitchens and bathrooms) may be withheld*; Garages will be repossessed following service of a Notice to Quit where there are any arrears of rent on the main tenancy. Repayment arrangements are not accepted on garage tenancies Non-essential response repairs (e.g. fencing) may be withheld.* *Except where health and safety requirements demand the work takes place. In this instance only the absolute minimum of work will take place (e.g. there will be no choice in style or colour of a replacement kitchen or bathroom). 10 Miscellaneous 10.1 Joint Tenants Joint tenants are jointly and severally liable for any arrears that occur. This means that each joint tenant can be individually and separately responsible and pursued for rent arrears, eg where one joint tenant leaves without terminating their tenancy the remaining joint tenant will be liable for all of the rent not 50% and vice versa. For this reason assignments are not allowed where there are arrears Housing Solutions will endeavour to contact joint tenants separately in the event of serious arrears occurring and prior to and during any possible or actual legal action. A separate Notice will be served for each tenant Death of Tenant The full rent for a property remains payable following the death of a tenant until possession of the property is returned to the Association (the keys are returned) where there is no successor to the tenancy. Any Housing Benefit entitlement will cease at the end of the week after the date of death The Assocation will seek to recover outstanding rent from the deceased s estate where appropriate. Where there is no estate and/or no resources available to settle the account of the deceased Housing Solutions will move to write off the monies owed Where there is a successor to the tenancy any arrears owed by the deceased will remain on the tenancy and will be recoverable by the successor once the tenancy is assigned. Should the successor remain in a property, under use of occupation, any outstanding arrears from the deceased and ongoing use of occupation payments must be made. Arrears will be transferred to a new tenancy when signing up to the property via a supplement which is to be signed at the same time. 12 Policy Title
13 10.3 Rights to Buy and Acquire All rent and other monies owed must be paid at completion or the Association will not agree to proceed Garages A Notice to Quit will be served on garage tenancies where there are arrears. The garage will be repossessed on expiry of the notice if the debt is not cleared and any cost of the lock change and clearance of vehicles or property within will be recharged to the tenant. Garage rent must be paid in advance. Should a garage tenant also be a tenant of Housing Solutions where there are arrears on the tenancy of the home, the garage may be repossessed as it would be considered as unaffordable Utilities Utility accounts will be billed quarterly and tenants will receive quarterly account statements. Failure to pay within seven days of receipt of a Quarterly Statement will result in a reminder being sent. A final reminder will be sent after four weeks, and if the account remains unpaid after a further seven days has lapsed, a Notice of Disconnection will be hand delivered. If no arrangement is then made to settle the account the utility supply will be disconnected. Any reconnection may be subjected to a deposit charge. 11 Former Tenant Arrears and Write-Off policy 11.1 Housing Solutions will ensure residents end their tenancies with a clear rent account. If this is not possible, Housing Solutions will seek to ensure an agreement is in place before the tenancy ended. In situations where we do not have the forwarding address (such as evictions or abandonments) Housing Solutions will send the debt to the debt collection agency for tracing If an agreement cannot be made before a tenancy ends, a letter will be sent to the resident requesting they make an agreement with us to clear the debt. Should no contact be made, the debt will be sent to a collection agency to recover Housing Solutions employs a reputable collection agency to recover FTAs and this will be reviewed as necessary to ensure value for money All former debts that prove to be irrecoverable by the agency, will be written off with the permission of the Board except those debts listed in The debt will remain with the agency should it become recoverable at any future point Former arrears of deceased tenants without funds in the estate will be written off immediately, as well as arrears under 50 where it is not in the 13 Policy Title
14 Association s financial interest to pass on to the debt recovery company. Write offs for deceased residents and amounts under 50 will only need approval from the Executive Team. Support account arrears and Garage arrears will also be written off in the same manor under consideration of feasibility and not passed on to the agency All former debts are subject to write offs twice a year in September and March Records of written off debts are maintained by the Group so that future recovery action is still possible if the former tenant reapplies for housing at a later date. 12 Market Rent Tenants 12.1 Tenants who rent homes via Payton Homes market rent schemes are subject to the terms of this policy outlined above under the terms of an Assured Shorthold Tenancy All such tenants are expected to maintain regular monthly payments of rent in advance, preferably by Direct Debit, a month in credit A deposit is held by Payton Homes for such tenancies. This deposit may not be used in lieu of rent at any stage during the tenancy Failure to maintain regular rent payments will result in appropriate notice being served to terminate the tenancy and legal action commenced to recover all monies owed by the serving of a S21 notice at 1 month s arrears. 13 Legislation 13.1 Housing Act Housing Act Localism Act Equal Opportunities 14.1 Housing Solutions is committed to its Equality & Diversity Strategy. An equality impact assessment has been undertaken and this policy is considered to have no adverse impact. 15 Monitoring and Review 15.1 The Association monitors a range of key performance indicators for its Rent Recovery services. 16 Income Management & Rent Arrears Recovery Policy - Appendix 1 Protocol for Possession Claims Based on Rent Arrears 1 Aims and scope of the protocol 1.1 This protocol applies to residential possession claims by social landlords (such as local authorities, Registered Social Landlords and Housing Action Trusts) which are based solely on claims for rent arrears. The protocol does not apply to claims in respect of long leases or to claims for possession where there is no security of tenure. 1.2 The protocol reflects the guidance on good practice given to social landlords in the collection of rent arrears. It recognises that it is in the interests of both landlords and tenants to ensure that rent is paid promptly and to ensure that difficulties are resolved wherever possible without court proceedings. 1.3 Its aim is to encourage more pre-action contact between landlords and tenants and to enable court time to be used more effectively. 1.4 Courts should take into account whether this protocol has been followed when considering what orders to make. Registered Social Landlords and local authorities should also comply with guidance issued from time to time by relevant authorities. 2 The Protocol 2.1 Initial contact The landlord should contact the tenant as soon as reasonably possible if the tenant falls into arrears to discuss the cause of the arrears, the tenant s financial circumstances, the tenant s entitlement to benefits and repayment of the arrears. Where contact is by letter, the landlord should write separately to each named tenant The landlord and tenant should try to agree affordable sums for the tenant to pay towards arrears, based upon the tenant s income and expenditure (where such information has been supplied in response to the landlord s enquiries). The landlord should clearly set out in pre-action correspondence any time limits with which the tenant should comply The landlord should provide, on a quarterly basis, rent statements in a comprehensible format showing rent due and sums received for the past 13 weeks. The landlord should, upon request, provide the tenant with copies of rent statements in a comprehensible format from the date when arrears first arose showing all amounts of rent due, the dates and amounts of all payments made, whether through housing benefit or by the tenant, and a running total of the arrears. 16 Policy Title
17 2.1.4 (a) If the landlord is aware that the tenant has difficulty in reading or understanding information given, the landlord should take reasonable steps to ensure that the tenant understands any information given. The landlord should be able to demonstrate that reasonable steps have been taken to ensure that the information has been appropriately communicated in ways that the tenant can understand. (b) If the landlord is aware that the tenant is under 18 or is particularly vulnerable, the landlord should consider at an early stage: I. Whether or not the tenant has the mental capacity to defend possession proceedings and, if not, make an application for the appointment of a litigation friend in accordance with CPR 21; II. Whether or not any issues arise under Disability Discrimination Act 1995; and III. In the case of a local authority landlord, whether or not there is a need for a community care assessment in accordance with National Health Service and Community Care Act If the tenant meets the appropriate criteria, the landlord should arrange for arrears to be paid by the Department for Work and Pensions from the tenant s benefit The landlord should offer to assist the tenant in any claim the tenant may have for housing benefit Possession proceedings for rent arrears should not be started against a tenant who can demonstrate that he has: (a) Provided the local authority with all the evidence required to process a housing benefit claim; (b) A reasonable expectation of eligibility for housing benefit; and (c) Paid other sums due not covered by housing benefit. The landlord should make every effort to establish effective ongoing liaison with housing benefit departments and, with the tenant s consent, make direct contact with the relevant housing benefit department before taking enforcement action. The landlord and tenant should work together to resolve any housing benefit problems Bearing in mind that rent arrears may be part of a general debt problem, the landlord should advise the tenant to seek assistance from CAB, debt advice agencies or other appropriate agencies as soon as possible. 2.2 After service of statutory notices 17 Policy Title
18 2.2.1 After service of a statutory notice but before the issue of proceedings, the landlord should make reasonable attempts to contact the tenant, to discuss the amount of the arrears, the cause of the arrears, repayment of the arrears and the housing benefit position If the tenant complies with an agreement to pay the current rent and a reasonable amount towards arrears, the landlord should agree to postpone court proceedings so long as the tenant keeps to such agreement. If the tenant ceases to comply with such agreement, the landlord should warn the tenant of the intention to bring proceedings and give the tenant clear time limits within which to comply. 2.3 Alternative dispute resolution The parties should consider whether it is possible to resolve the issues between them by discussion and negotiation without recourse to litigation. The parties may be required by the court to provide evidence that alternative means of resolving the dispute were considered. Courts take the view that litigation should be a last resort, and that claims should not be issued prematurely when a settlement is still actively being explored. The Legal Services Commission has published a booklet on Alternatives to Court, CLS Direct Information Leaflet 23 ( which lists a number of organisations that provide alternative dispute resolution services. 2.4 Court proceedings Not later than ten days before the date set for the hearing, the landlord should: (a) Provide the tenant with up to date rent statements; (b) Disclose what knowledge he possesses of the tenant s housing benefit position to the tenant (a) The landlord should inform the tenant of the date and time of any court hearing and the order applied for. The landlord should advise the tenant to attend the hearing as the tenant s home is at risk. Records of such advice should be kept. (b) If the tenant complies with an agreement made after the issue of proceedings to pay the current rent and a reasonable amount towards arrears, the landlord should agree to postpone court proceedings so long as the tenant keeps to such agreement. (c) If the tenant ceases to comply with such agreement, the landlord should warn the tenant of the intention to restore the proceedings and give the tenant clear time limits within which to comply. 18 Policy Title
19 2.4.3 If the landlord unreasonably fails to comply with the terms of the protocol, the court may impose one or more of the following sanctions: (a) An order for costs (b) In cases other than those brought solely on mandatory grounds, adjourn, strike out or dismiss claims If the tenant unreasonably fails to comply with the terms of the protocol, the court may take such failure into account when considering whether it is reasonable to make possession orders. 19 Policy Title
20 Income Management & Arrears Recovery Policy - Appendix 2 Service Standards 3 Rent accounting 3.1 When setting and accounting for rent we charge we will: Maintain rent levels within the Government s target rent policies; Provide information and advice to tenants at sign up regarding methods of payment and benefits; Issue rent payment cards which can be used at any PayPoint of Post Office; Provide an over the phone payment service so rent can be paid by credit or debit card during office hours; Offer the choice to pay rent by Direct Debit, and provide a choice of payment dates and frequencies for Direct Debits; Set up or amend Direct Debits within 48 hours of receipt; Liaise with the Housing Benefit service to ensure that as many new benefit claims as possible are set up within the target of 14 calendar days from the receipt of all information from the resident; Issue statements or rent accounts to all tenants every 3 months and send out statements within 24 hours of any request; Offer all residents the chance to meet with a Financial Inclusion Adviser to help with rent, benefits and budgeting. Referrals to the Financial Inclusion Team can be made via , there is no specific referral form to complete. 4 Rent Arrears 4.1 When recovering unpaid rent we will: Maintain a firm but fair approach; Take appropriate action to prevent an individual s arrears increasing further with early intervention; Make a referral to the Financial Inclusion Team to look at ways of maximizing income, budgeting advice, debt advice; Write to residents before serving notices or applying to court; Work in partnership with other agencies such as debt counselling organisations, social services and benefits services to assist tenants in debt, and; Ensure that monies owed by former tenants are recovered where possible. 20 Policy Title
21 Income Management and Arrears Recovery Policy - Appendix 3 Rent Arrears Procedure 5 Pre-Tenancy 5.1 As part of the sign up procedure a Tenancy and Neighbourhood Officer, Community Housing Officer or Supported Services Officer will interview the tenant and go through their rent responsibilities and payment options. 5.2 Advice and assistance will be available to ensure that the tenant is given suitable guidance in choosing the most suitable payment method. 5.3 General Welfare Benefits advice will be given if needed via a pre assessment meeting with a Financial Inclusion Officer. 5.4 New residents will be informed at sign up of how to apply for benefits and Universal Credit and where local internet access is available if required. Help will be provided by the Financial Inclusion Team to make claims for benefits via online or completion of forms. 5.5 A rent payment card will be issued at sign up. 5.6 A direct debit mandate will be completed at time of sign up if appropriate. 6 Method of payment 6.1 Tenants can pay by: Cash or cheque at the Association s offices or at the Post Office or any PayPoint by swipe card; Monthly or weekly direct debit. A choice of all dates will be available up until the 28 th of the month. Payments will be collected monthly in advance. When the Direct Debit is set up any arrears will be taken into consideration and collected along with the monthly rent to ensure the tenancy rent account shows a nil balance at the end of the financial year; Weekly or monthly standing order (due in advance); Through the post by cheque or postal order; Telephone with a credit or debit card, and; Online Banking; 6.2 Online payments through the Association website will be developed to meet customer demand. 21 Policy Title
22 7 Monitoring Procedures 7.1 Rent is due on the Monday of each week and in advance for the forthcoming week. 7.2 Tenants choosing to pay monthly agree to pay in advance for the forthcoming month. 7.3 Each Tenancy will have a dedicated TNO, CHO or SSO who will check accounts which fall into arrears once a week. They will then make a referral to the Financial Inclusion Team as soon as the tenant falls into arrears for budgeting and debt advice as well as a benefit check. 7.4 All tenants that have a liability to pay their rent weekly Benefit or Universal Credit claims will be monitored and are the responsibility of the tenant to maintain. 7.5 All Tenants who have an entitlement to Universal Credit will be monitored in line with the payment schedule from the DWP and direct debits must be set up on the day of payment from DWP. 7.6 All garage tenancies will be monitored weekly. 7.7 Utility Accounts will be monitored every month. 8 Recovery Procedures 8.1 Tenants will be contacted by letter 3 times before a Notice of Seeking Possession, a Section 21 or a Notice to Quit is served. 8.2 A Notice of Seeking Possession under Ground 10 will be served at 4 weeks of arrears. A Notice of Seeking Possession under Ground 8 will be served at 8 weeks of arrears. Where payments are missed regularly and for low level arrears a Notice of Seeking Possession under Ground 11 will be served. A Section 21 or a Notice to Quit will be served on assured shorthold tenants as soon as arrears accrue. 8.3 Any formal arrangements to clear arrears will be written down with a full breakdown of the debt outstanding, the agreed repayment along with the current rent charge and the repayment time span. The tenant and a member of staff will sign this agreement. Any arrangement that is broken will be notified to the Tenant in writing and the Association will continue with appropriate action if there is no satisfactory response. 8.4 Arrangements will be reviewed at the request of the tenant. 22 Policy Title
23 8.5 If no response is made to the letters sent, attempts will be made to make personal contact with the tenant(s). This will be by telephone or by a visit to the tenant s property. The tenant(s) will be offered a meeting with the Financial Inclusion Team. Where a Housing Benefit problem exists, staff will liaise with the relevant Housing Benefit Department where the resident has provided them with permission to discuss their claim with us. It will be made clear to the tenant(s) that the ultimate responsibility to chase up housing benefit payment remains with the tenant(s) and if the claim is through UC, Housing Solutions do not have the option to liaise. 8.6 After expiry of the NOSP, S21 or NTQ and the account remaining unpaid and with no formal agreement in place, a Warning of Court Action letter will be sent outlining the Association s plans to obtain a Possession Order. The letter will give a further seven days for contact. If, after seven days have passed there has been no response, attempts will be made to make personal contact either by telephone or personal visit to the property. Housing Solutions will once again offer an appointment to see a member of the Financial Inclusion Team to offer additional financial and benefit support. 8.7 If no satisfactory arrangement to clear the arrears have been made and there has been no response to attempts to contact the tenant(s) and the account remains unpaid an immediate Application to Court will be made. 8.8 Whilst waiting the Court Date, the TNO, CHO or SSO will continue to make every effort to try to resolve the matter. 8.9 On receiving the Court Date notification from the County Court, the Association staff will write to the tenant to confirm the date and once again attempt to come to an arrangement. Any arrangement, other than full payment, will be offered to the District Judge on the Court Date, and be formalized as a Suspended Possession Order should the Judge agree. This means the tenant can remain in the property on the condition he/she continues to pay current rent plus the agreed arrears payment on a regular agreed basis. Any costs awarded by the court will also be added to the arrears and the repayments will continue until the arrears and costs have been paid in full. The tenant(s) will be advised to attend the Court Hearing. The Association will attempt to keep costs of Court action down by using inhouse Staff that have been fully trained in Court procedures. Please note this is only for assured or fixed term tenants. Other notices are mandatory possession in court. Should an order from the court be breached, this leaves the resident in contempt of court and residents will need to bring their account in line with the order, otherwise an eviction warrant will be applied for If there is no contact before the Court Hearing, or there is a history of persistent arrears with no satisfactory explanation or proof of a current Housing Benefit Claim, an Outright Possession Order will be sought. The outcome of the Court Hearing will be confirmed in writing within three days of 23 Policy Title
24 the Hearing. An Eviction warrant will then be sought at the earliest opportunity Any decision to seek an Eviction Warrant will be made after discussion between the Tenancy and Neighbourhood Officer, Community Housing Officer or Supported Services Officer and the Housing Manager or Community Services Team Leader. Final approval will be sought from the Head of Housing. The decision will be in written form and a copy will be held on the House/Court File Once an Eviction Warrant has been requested and a date with the Bailiff confirmed, the Association will inform the Tenant of the date in writing During this period the Association will advise that the only way an eviction can be stopped is if payment is received in full and a financial assessment by the Financial Inclusion team proves that the property is affordable The eviction, conducted by a Court Bailiff, will be attended by a Tenancy and Neighbourhood Officer and a member of the trades team to change the locks and secure the property The property will be secured and any items left at the property after repossession will be subject to an inventory. Items will be removed into storage once the repossession has taken place. Items will be stored in a locked garage but the Association cannot be held responsible for the security of any items held in store after the eviction has taken place. Items will be disposed of, if no attempt is made to recover the items after 28 days from the date of the eviction. Former Tenant Rent Arrears (including write-off policy) If an account is terminated and showing an arrears balance, this will be monitored by Housing Solutions. A letter will be sent to the former tenant where an address is available. At that stage an agreement will be set up where possible. If Housing Solutions cannot make contact with the former resident, the account will be sent to an external debt collection agency. If there is no forwarding address, the account will be sent to the debt recovery agency to trace immediately The External Debt Collection Agency will be appointed with the approval of the Housing Manager and Head of Housing. The Agency appointment will be subject to regular value for money reviews Where a former tenant is deceased, the Housing Assistant will seek to recover the debt from the estate. If there is no money available in the estate, the debt will be written off with approval from the Executive Team twice a year in September and March Arrears under 50 will be written off should Housing Solutions not be able to make contact with the resident. These debts will not be passed to the 24 Policy Title
25 collection agency as it would not be in the Association s financial interest. Support account arrears and Garage arrears will also be written off under consideration of feasibility should Housing Solutions exhaust all methods of contact. These debts will be written off with approval from the Executive Team twice a year in September and March Debts written off through proving unrecoverable by the agency will be written off but will remain with the agency in case they ever become tracable. Write offs for these debts require approval by the Board and will be provided to the Board in September and March Records of written off debts are maintained by the Group so that future recovery action is still possible if the former tenant reapplies for housing at a later date. 25 Policy Title
