1 N MARIANAS COMMONWEALTH ;ECOND REGULAR SESSION, 1988 PUBLIC LAW NO LEG1 SLATURE SENATE BILL NO , S.D.2, H.D.3 AN ACT TO enact a new base salary schedule for classified government employees, by repealing and re-enacting Title 1, CMC, Div. 8, Sections 8211 through 8216; to repeal and re-enact Title 1, Div. 8, Section 8245 (P.L. 4-32, Section 6)(Compensation of certain appointed officials); to repeal and re-enact Title 1, CMC, Div. 8, Section 8246 (P.L. 4-32, Section 7)(Cmpensation of the Executive Directors of Government Corporations, Semi-autonomous agencies); to repeal and reenact.title 1, CMC, Div. 8, Section 8248 (P.L. 4-32, Section 9)(~overnment Salary Ceilings); and for other purposes. BE IT ENACTED BY THE NOKTHERN MARIANAS -!l!h LM;ISLATURE: Section 1. Repeal and Re-enactment. Title 1, CMC, ~ivision 8, Sections 8211 through 8216, are hereby repealed and re-enacted as follows : "Section Short Title. This Act is known as and may be cited as the "Conunonwealth Salary ~ ct of 1988." "Section Purpose. It is the purpose of the Coinmonwealth Legislature, in establishing a new base salary schedule, to provide a uniform salary schedule from which shall be derived the base salary to be paid to all employees of the Government of the Commonwealth except those exempted from the Civil Service System by 1 CtjC his Act also establishes the basic annual compensation of appointed and certain unclassified positions with the Northern Marianas Government. "Section Salary Schedule. The schedule set forth in this Section provides the official bi-weekly base salary schedule for all employees not specially exempted by law. The applicable amount set forth shall be paid to each employee who works or accumulates pay status for at least 80 hours in the pay period.

2 PUBLIC LAW NO SENATE BIU NO , S.D.2, H.D.3 1 TO determine the hourly rate for all employees who work less than 2 80 hours in the pay period or to determine the hourly rate for 3 overtime and applicable differentials, the applicable bi-weekly 4 base salary shall be divided by 80, but this procedure shall be 5 used only for those purposes. No salary increase, raise, change or 6 other salary adjustment shall be made except pursuant to a Salary 7 Schedule enacted pursuant to Sections 5 and 7, Article I1 of the 8 commonwealth of the Northern Mariana Islands Constitution. The 9 Salary schedule shall be as follows: page 2

The salary schedule in 11 Section 8213 shall be implemented based upon the pay level 11 assigned to all positions on the effective date of this ~ct. 4 "Section With-in Grade and Merit Increase. ~n employee 5 may be granted a one step, within-grade increase upon completion of 6 fifty-two (52) consecutive calendar weeks of sustained satisfactory 7 work performance. An employee may be awarded in addition a merit 8 increase (not exceeding one [l] step increase in the base salary) 9 by achieving an overall performance appraisal average score 10 equivalent to wcutstanding/exceptionalw upon completion of II l1 fifty-two (52) consecutive calendar weeks of sustained superior 12 work performance. Such additional merit increase shall not alter 13 the waiting period required for qualifying for the next within- 14 grade step increase. No employee shall be compensated above the 15 maximum step prescribed for the employee's pay level except where 16 the employee was receiving such compensation on the effective date 17 of this Actow 18. Section 2. Repeal and Re-enact. Repeal and Reenact. Title 1, CMC, Div. 8, Section 8246 (P.L. 4-32, Sec. 7) is hereby repealed and re-enacted as follows: "Section Compensation of the Executive Directors of Government Corporations, Semi and Autonomous Agencies. (a) The executive director (the Top Administrative Executive) of government corporations, as defined in 1 CMC, Section r 'i 7103(n), and of other agencies, cammissions, councils, an( offices shall receive an annual salary of not less than $36, or not more than $40,000.00, as determined by the applicable board. Section 4. Repeal and Re-enactment. Title 1, W, Div. 8, Section 8248 (P.L. 4-32, Section 9) is hereby repealed and re-enacted as follows : Page 7

Except as provided by this law, no employee of the Camnonwealth Government shall receive an annual salary of more than $40, Medical doctors, dentists, and veterinarians whose responsibilities include giving professional medical advice may receive an annual salary in excess of $44, as determined by the Governor. This Section shall not apply to employees who receive their paychecks from the federal government. In the event the incumbent of any position within the government, agency and or corporation is receiving an annual compensation in excess of that authorize by this Act upon the effective date of this Act shall continue to receive that amount. The campensation for the affected person will be frozen at that level. Section 5. Amendment - Salary of Judges. Title 1, CMC, Div. 3, Chapter 1 is amended to read: i msection 3107.!the annual salary of the Presiding Judge is $69, The annual salary of the Associate Judge is $66, A full-time judge may not hold another salaried government position or engage in the practice of law.' Section 6. Repeal - Eaayors' Salaries. ~itle 1, W, Div. 5, Chapter 1, Section 5105, reading: "The Mayors of Saipan, Rota, Tinian and Ag~ig~an, and Page 8

Amendment - Mayors' Salaries. ~itle 1, CMC, Div. 8, Chapter 4, Section 8244(c) is amended to read: *(c) The Mayors of an island or a group of islands shall receive an annual salary of $36, ~ Section 8. Authorization. There is hereby authorized to be appropriated out of the General Fund of the Commonwealth of the Northern Mariana islands such sums as may be nkssary to implement Sections 1 and 2 of this A&. The Director of the Department of Finance shall be the custodian of such funds. my unobligated funds on the last day of the Fiscal Year shall revert to the General Fund of the Cammonwealth of the Northern Mariana Islands. Section 9. Severability. If any provision of this Act is held invalid by a court of competent jurisdiction, the remainder of this ~ct shall not be affected thereby. Section 10. Effective Date. Upon approval by the Governor, or upon becoming law without such approval, Section 1 and Section 2 of this A& shall take effect on this first day of the subsequent pay perior 1~fh.q the bill is signed into law.
