The Telephone Company makes no guarantee and assumes no liability for the accuracy, performance or non-performance of the Consolidated Communications Centrex Service Features. Credit adjustments for interruptions of service will be made as provided in Section 1 of the Company's Ill. C.C. No. 2 Tariff. 2. The Telephone Company makes no guarantee and assumes no liability for resale or sharing by the customer of the Consolidated Communications Centrex Service Features and its associated facilities, including (without limitation) the failure of any person to pay the customer's or reseller's billing for any reason whatsoever, including (without limitation) denied toll calls and toll fraud. C. CONDITIONS 1. The Company will furnish one alpha and one classified directory listing per Consolidated Communications Centrex Service account, without charge. Additional listings are subject to the provisions set forth in Section 4 of the Company's Ill. C.C. No. 2 Tariff. 2. The rates and charges shown for Consolidated Communications Centrex service apply to establishment of Consolidated Communications Centrex Service only. other services may be furnished in connection with this service at rates and charges specified in the Company Tariffs for such services. 3. Each request for establishment of Consolidated Communications Centrex Service must be placed in writing by the customer. Should the customer elect to cancel such a request after acceptance by the Company and before the start of the initial contract period described below, he may do so subject to notice in writing and payment to the Company for all resulting nonrecoverable labor and material costs incurred by the Company. Consolidated Communications Centrex Service is offered only on a contractual basis. The initial contract period commences on the date the service is established. In addition to any applicable nonrecurring charges, located in Section 2 of the Company's Ill. C.C. No. 2 Tariff. The following rate elements apply as follows: a. During the contract period, the rates shown in Paragraph D following apply for each month of the contract period. Each customer's initial Contract Period rate is fixed at the amount specified in this Tariff on the date installation work is completed and will not change during the initial contract period except as a result of modifications or changes the Illinois Commerce Commission may direct or allow in the exercise of its jurisdiction. b. After the initial contract period, Consolidated Communications Centrex Service will be provided on a monthly basis for as long as the system is in service. The rates for this monthly Consolidated Communications Centrex Service will be identical to the originally contracted rates, except to the extent the Illinois Commerce Commission may from time to time direct or allows changes thereto in the exercise of its jurisdiction. 5. In the event that Consolidated Communicatons Centrex Service is terminated by the customer prior to completion of the initial contract period, the customer shall pay a contract termination charge using the formula described below, which the Company shall develop. a. In the event of termination of Consolidated Communications Centrex Service during the initial contract period, the contract termination charge shall be the present value, using an 8% discount rate, of the charges for the balance of the initial contract period. b. In the event the customer reduces the number of Consolidated Communications Centrex Service lines initially contracted, by 20 percent or more, the termination liability as specified above is applicable and the termination liability will be that portion of the amount calculated as specified above that the number of lines by which service is reduced bears to the highest number of lines specified in the initial contract period. Conditions (Cont'd) 6. When Consolidated Communications Centrex Service is provided, any manual operations at the customer's premises are performed by, and at the expense of the customer. Upon request, the Company will update software records, or make subsequent line and/or feature additions on a time and material basis at the then current hourly labor rates. A call out of a Company employee at a time not concurrent with the business day (8:00 A.M. to 5:00 P.M., weekdays) is subject to a minimum charge of two hours. Basic Time rates apply for the time the Telephone Company is open for business, Monday through Friday. Overtime rates apply at all other times. 7. Full access to all Feature Packages as shown in Paragraph A of this Section is available through Touch Tone Stations. 8. A Consolidated Communications Centrex Service line may be extended to a location outside the same continuous property of the Consolidated Communications Centrex Service customer to any location within the same exchange. 9. Consolidated Communications Centrex Service system lines are not subject to Basic Exchange Telephone Service Rates as listed in Ill. C.C. No. 2, Section Consolidated Communications Centrex Service system lines are not subject to the Business Touch Tone Calling Rate. 11. Consolidated Communicatons Centrex Service is available with basic feature arrangements as follows; Direct Inward Dialing (DID); Direct Outward Dialing (DOD); Station-To-Station Calling; Storing of 24 Dialed Digits; Unrestricted Services. Conditions (Cont'd) 12. Extended Area Service (EAS) as outlined in Ill. C.C. No. 2, Section 3, is provided with Consolidated Communications Centrex Service System lines in the event the customer's Central Office Exchange has EAS. 13. This Tariff contemplates the use of central office equipment selected by the Company. When special central office equipment or features are provided at the request of the customer, special assembly rates and charges may be applied in addition to those shown herein. 14. This Tariff (including the rates and charges shown herein) for Consolidated Communications Centrex Service is subject to such changes or modifications as the Illinois Commerce Commission may from time to time direct or allow in the exercise of its jurisdiction. 15. The minimum period for which service is provided and for which rates and charges are applicable is one month unless otherwise established. D. RATES 1. The following rates and charges apply where service is available. a. Consolidated Communications Centrex Service rates are dependent upon the number of lines and the distance of these lines measured in airline mileage from the customer's locations to the serving Central Office and the initial contract period offered. The Service is offered for the following initial contract periods: 12 months, 36 months, 60 months and 84 months. b. The total number of lines is used to determine the line group of the service being provided. The rates are then applied based on the distances between the customer's locations and the serving central office. Consolidated Communications Centrex Service lines may be terminated on key, PABX or equivalent type system. A key/pabx termination rate of $15 per month will be applied per centrex line in addition to the applicable Consolidated Communications Centrex line rate. j. Subsequent line additions/deletions. (1) Subsequent line additions will be rated: (a) under a new contract with its own initial contract period, or (b) an addendum to an existing contract, which shall be deemed to have an initial contract period equal to the remaining portion of the initial contract period of the contract to which it is added. If the line addition results in the customer's total Consolidated Communications Centrex Service line count exceeding the threshold of the line group previously contracted, only the quantity of additional lines will be billed at the rate for the larger group. (2) Subsequent line deletions resulting in reductions equal to or exceeding 20 percent of the initial lines under contract will be treated as set forth in D.i.1. preceding. If the reduction causes the total number of lines to fall within a different line group, all remaining lines will thereafter be billed for the group remaining as set forth in paragraph D.i.1. preceding. k. If a customer requests an upgrade of an existing Feature Package (i.e., from Basic Package to Enhanced Package or the addition of optional features), his existing per line contract rate will be changed to reflect the appropriate rate applicable to the new Feature Package, as set forth in Paragraph D.d. preceding. This service is filed pursuant to Section (b) of the Public Utilities Act. It is a competitive local exchange telecommunications service available only to customers within the exchanges of Charleston, Mattoon, Effingham, Arcola, and Arthur where facilities allow. 2. Consolidated Communications Voice Messaging Service is a service arrangement which consists of central office interface equipment and Voice Messaging hardware and software located on Company premises. 3. Consolidated Communications Voice Messaging Service provides for the recording, storage, and retrieval of voice messages. Calls placed to Voice Messaging client lines, when they are busy and/or don't answer, will be forwarded to the Voice Messaging System at which time each caller will be given the opportunity to record a voice message. The recorded messages can later be retrieved by the Voice Messaging Client by transmission of retrieval signals to the Voice Messaging System using a Touch-Tone pad. 4. Consolidated Communications Voice Messaging Service offers Residential Mailbox Service, Basic Business Mailbox Service, and Enhanced Business Mailbox Service. Call Forward Busy Line - Fixed This service, permanently activated, provides the ability to redirect incoming calls to Voice Messaging client's home or business to the Voice Messaging System when such incoming calls encounter a normal busy line condition. 2. Call Forward No Answer - Fixed This service, permanently activated, provides the ability to redirect incoming calls to Voice Messaging client's home or business to the Voice Messaging System when incoming calls encounter a no answer condition after a specific number of rings. 3. Call Forward Busy Line/No Answer - Fixed This service, permanently activated, provides the ability to redirect incoming calls to Voice Messaging client's home or business to the Voice Messaging System when such incoming calls encounter either a normal busy condition or a no answer condition. 4. Message Waiting indication - Audible This feature provides clients with an indication (stutter dial tone) that a message is awaiting retrieval. The stutter dial tone occurs when the client lifts the receiver. 5. Message Waiting Indication - Visual This feature provides clients who have a multi-line phone or centrex service withn an indication (light) that a message is awaiting retrieval. Outcall Notification This feature provides for the Voice Messaging system to notify the subscriber of messages waiting in their mailbox through pagers, etc. 7. Automated Attendent This feature answers calls and routes the caller to the desired extension by instructing the caller to press certain numbers on the touch tone pad. 8. Greeting Length Incoming calls forwarded to the Voice Messaging system will reach a one, two, or three minute message recorded by the Voice Messaging client. 9. Message Length A two, three, or four minute message for the Voice Messaging client may be recorded by the caller. 10. Message Life Messages will be stored in the Client's Voice Mailbox for fifteen or thirty days. Messages will be automatically deleted by the system after fifteen or thirty days from date of receipt. 11. Message Storage Capacity Twenty, thirty-two, or forty-eight messages may be stored in the client's mailbox at one time. 12. Send Message This feature provides clients the ability to send messages to other Consolidated Communications Voice Messaging Service clients. 13. Extension Mailbox This feature allows complete telephone answering, voice messaging, and message waiting functionality to individuals that share a single telephone access line. The Telephone Company makes no guarantee and assumes no liability for the accuracy, performance, or non-performance of the Voice Messaging Service features. Credit adjustments for interruptions of service will be made as provided in Section 1 of the Company's ILL. C.C. No. 2 tariff. 2. The Company is not liable for any loss or damages arising from the content of messages, errors, interruptions, defects, failures, mistakes, or malfunctions of this service. D. CONDITIONS 1. The minimum service period for Voice Messaging Service is one month. 2. Voice Messaging Service will be provided 24 hours per day, 7 days per week. 3. Voice Messaging Customers must have Customer Premise Equipment capable of Dual Tone Multi-freguency generation (commonly known as Touch Tone Service). Touch Tone Service is not included in the Voice Messaging Service. Touch Tone rates listed in ICC No. 2 Section 4 apply. 4. Fixed Call Forwarding is included in the Voice Messaging Service rates listed in this tariff. If the customer elects to use Universal Call Forwarding, the charges listed in ICC No. 2 Section 4 apply and are not included in the Voice Messaging Service rates.
