2 GOBIERNO DE EDUCACION. CULTURA Universities Australia and the Council of Universities of Spain - Ministry of Education, Culture and Sport of Spain (hereafter referred to as "the Signatories"), wishing to consolidate the cultural and educational relations and the promotion of academic links and exchanges between their two countries, in the interests of the universities in both countries, make the following proposals: FIRST PURPOSE Under this memorandum the Signatories intend to promote cooperation which will advance university teaching, research, scholarship and management in their member institutions. The memorandum will facilitate access to higher education institutions and mutual recognition of studies, academic programs and courses that are recognised in the Signatories' education systems All member institutions of the Signatories shall be eligible for consideration as participants in the program of cooperative activities This memorandum is prefaced on the principles agreed to by both Australia and Spain as signatories to UNESCO's 1997 Lisbon Recognition Convention which promotes mobility and the timely transparent and defensible decisions on recognition of higher education qualifications The Signatories commit to an ongoing dialogue on qualifications recognition for the benefit of progressing future bilateral university agreements between Spain and Australia This memorandum does not recognise diplomas in either country nor does it cover the processes of the granting of qualifications. It does not establish precedence in respect of any other admission requirements of institutions such as eligibility for places The Signatories agree that respect for the principle of institutional autonomy in the higher education systems of both Spain and Australia underpins this memorandum. SECOND PARTICIPATION Officially credited and recognised universities and higher education institutions in Spain are such as defined by article 3 of the Universities Organic Law 6/200 I (21 December) and modified by the Universities Organic Law (12 April) and authorised by the Ministry of Education, Culture and Sport of Spain. Participating Australian universities are members of Universities Australia and providers of higher education as legislated in the Higher Education Support Act in Australia. -2

CULTUM Participating institutions with official recognition are listed in Annex I (Spain) and Annex II (Australia) respectively Universities in both countries may, by means of an agreement in accordance to their own regulations, establish joint academic programs for a joint degree or a double degree both at graduate and postgraduate levels The Signatories will support the signing of agreements between their universities to develop joint postgraduate programs. FIELDS OF COOPERATION THIRD Cooperation between the Signatories will involve the following areas: information sharing staff and student exchanges mutual recognition of qualifications including postgraduate programs staff development scholarships, researcher exchange and fellowship programs university management and governance quality assurance and regulation Further areas for cooperation may be agreed upon by mutual consent and in writing from time to time. IMPLEMENTATION FOURTH To implement this memorandum the Signatories will maintain a Joint Working Group with at least one representative from each signatory. The Joint Working Group shall consider and recommend possible programs of activities for cooperation under the memorandum and provide suggestions for improvement. Meetings of the Joint Working Group shall be held alternatively in Spain and Australia as required, or may meet through electronic procedures This agreement is not intended by Universities Australia and the Spanish Ministry of Education, Culture and Sport to have a legally binding nature, and its eventual costs are subject to availability of budget funds. DURATION FIFTH This memorandum shall be valid for five (5) years from the date of signing. Amendments to the memorandum shall come into effect after the Signatories have agreed in writing. -3
