PARTIES AND INTERESTS (a) The Company's name and address whose tariff is being revised is : Windstream Communications Southwest Little Rock, AR (b) Windstream Communications Southwest ("Windstream"), is a local exchange telephone company providing telephone and telecommunications services to customers within its authorized territory within the State of Oklahoma, and is subject to the jurisdiction of the Oklahoma Corporation Commission ("Commission") in so far as this matter is concerned. (c) Other parties that may be interested in these revisions include the Attorney General of the State of Oklahoma, interexchange service providers and other telecommunications service providers. 2. FACTS ~,._, -S, m (a) The rationale and purpose for this filing is to grandfather Windstream's exis ~t4 Flex Call Pak-Home service offering, and the residential version of Windstream's ValueChic e,r r.:; Essentials Plan II. 2 (c) The proposed tariff revisions are governed by the thirty (30) days approval period under OAC 165 : The effective date of this revision will be March 15, LEGAL AUTHORIT Y Jurisdiction over the subject matter of this Notice and Filing of Tariff Revisions exists with the Oklahoma Corporation Commission by virtue of Article IX, 18 of the Oklahoma State Constitution; 17 O. S. 131 et seq. ; and, by OAC 165 : STATEMENT OF COMPLIANCE Windstream will cause a copy of this Notice and Filing of Tariff Revisions to be provided directly to the Attorney General of the State of Oklahoma, and to any interexchange service provider or telecommunications service provider that has previously requested in writing to receive this filing 5. Flex Call Pak -Home is available to residence individual line customers only. When a customer orders four (4) or more of the eligible features, a discount applies to all of the eligible features. The discount percentage is applied to the total of the individual feature rates subscribed to by the customer. All features ordered by the customer must be billed on the same residence account. A ny fea ture may be substituted for another, or additional features may be ordered at a later date. The combination of features is not important to qualify for the discount only the number of features (four). When a customer subscribes to the quantity of four (or more) of the eligible features, his/her account. the discount will automatically apply to If the customer removes an eligible feature (or features) so that the total number is less than four (4), the discount percentage no longer applies. Instead the billing of those services will reve rt back to the indivi dual feature rate. Se rv ice charges are NOT applicable, when : - an order is placed which qualifies the customer for the Flex Call Pak - Home discount, or - when a Flex Pak customer rearranges his/her features, provided at least four (4) of the eligible feature are retained. (1) This service is restricted to existing customers at existing locations. (2) Anonymous Call Block and Cancel Call Waiting are not included toward the threshold for the discount.
