1 CONTINUING PROFESSIONAL DEVELOPMENT All references are in italics and blue font; references from the Act are bolded. Interpretation For the purposes of the Rule Continuing Professional Development, except as otherwise stated: Act; 15(2)(k) setting standards for continuing education and the participation of members in continuing education; Reg. Bylaw; 2.1(a) Act means The Accounting Profession Act, [(Saskatchewan)] as amended from time to time. Reg. Bylaw; 2.1(d) Board rule means a rule approved by the Board consistent with and permitted under specific provisions in the Act or Bylaws. Act; 2(c) business day means a day other than a Saturday, Sunday or holiday; Reg. Bylaw; 2.1(e) Bylaws mean these Bylaws and any other Bylaws of the Institute that may be in force from time to time. Reg. Board rule; 340.1(a) caregiver means a member who is on leave to care for a child, a parent or a family member with a critical terminal or chronic medical condition, or who otherwise qualifies for special consideration and who temporarily has ceased providing professional service. Reg. Bylaw; 2.1(l) CPA Canada means the national organization of Chartered Professional Accountants in Canada. Reg. Bylaw; 2.1(p) Discipline Committee rule means a rule approved by the Discipline Committee and consistent with specific provisions in the Act or Bylaws and permitted under subsection 30(3) of the Act. Reg. Board rule; 340.1(b) means a member who is on leave for a medical reason substantiated by a certificate from a doctor or medical practitioner licensed to practice in Saskatchewan indicating that the member is medically unable to be providing professional service. Reg. Board rule; 340.1(c) non-resident member means a member who does not reside in Saskatchewan and pays resident fees to any other provincial institute. Reg. Board rule; 340.1(d) on leave means a member who, with acknowledgement from their workplace, is absent from the workforce. Page 1 of 6

2 Reg. Board rule; 340.1(e) resident member means a member who resides in Saskatchewan or a member who resides in another jurisdiction but is not a resident member of any other provincial institute. Reg. Board rule; 340.1(f) retired means a member who is no longer providing professional service in any category of practice with no intention to provide professional service. Reg. Bylaw; 2.1(ii) Rule means any right, requirement or obligation of a registrant or duty or power of the Institute that is set out in the Act, a Bylaw, a Board rule, a Discipline Committee rule and the Uniform Rules of Professional Conduct, as established or amended from time to time. Reg. Bylaw; 2.1(qq) Uniform Rules of Professional Conduct means the obligations and requirements for professional conduct and professional competence of registrants established by CPA Canada. Duties of the Institute Authorities Reg. Board rule; The Registration and Licensing Committee may: (a) approve matters relating to continuing professional development in accordance with the Rules; or (b) review documentation provided under Board rule for determination of acceptability for purposes of the Rules. Registrant Rights and Requirements Compliance Reg. Bylaw; 4.1 An individual who is submitting information to the Institute relating to his application for registration, licence or re-instatement shall not sign or associate with any letter, report, statement or representation which the applicant knows, or should know, is false or misleading. Reg. Bylaw; 4.2 A registrant who becomes aware of his non-compliance with the Rules shall declare that non-compliance to the Registrar within thirty (30) days. Reg. Bylaw; 4.3 Each registrant by their application for and continuance of registration shall be deemed to have agreed to comply with the Rules. Reg. Bylaw; 4.4 Upon receipt of a notice in writing from the Institute, a registrant shall submit to the Institute any documents or records required pursuant to the Rules in a manner and within the time specified in the Rule or notice. Reg. Bylaw; 23.1 Every member shall participate in continuing professional development pursuant to the Rules. Reg. Bylaw; 23.2 The minimum hours requirement for continuing professional development is the standard as specified by CPA Canada, as amended from time to time. The current standard is one Page 2 of 6

3 hundred and twenty (120) hours of continuing professional development every three (3) years and twenty (20) hours annually. Reg. Bylaw; 23.3 The minimum hours requirement for verifiable continuing professional development is the standard as specified by CPA Canada, as amended from time to time. The current standard is sixty (60) hours of verifiable continuing professional development every three (3) years and ten (10) hours annually. Reg. Bylaw; 23.4 The Board shall establish additional requirements or exemptions for verifiable and unverifiable continuing professional development. Reg. Board rule; A member may apply to the Registrar for an exemption to engage in the activity of continuing professional development of one (1) year who is: (a) On medical leave, (b) On caregiver leave, (c) Retired, or (d) In a special circumstance. Reg. Board rule; Except for members who have been retired continuously for the last five (5) consecutive years, an application for exemption from requirements for one (1) year is due on or before February 15 of the following year. Reg. Board rule; An out of country non-resident member that holds membership in an equivalent professional body outside of Canada which has substantially similar continuing professional development requirements to that of the Institute, may request an exemption from the minimum requirements of the Institute. Reg. Board rule; A resident member who has reported to another jurisdiction in Canada may declare such reporting by February 15 of the following year. Reg. Board rule; Every member, regardless of exemption is eligible for selection in a continuing professional development audit, which shall be conducted by the Registrar. Reg. Board rule; At least one percent (1%) of members shall be selected annually for continuing professional development audit. Reg. Board rule; Notification of selection of continuing professional development audit shall be made on or about December 1 of each year. Reg. Board rule; A member notified under Board rule shall provide documents in accordance with Board rules and which support continuing professional development activities during the period stated in the notification. Application Reg. Bylaw; 23.5 A member shall submit a report in the form and within the time established by the Board declaring whether the requirements for continuing professional development have been fulfilled. 4 Reg. Bylaw; 23.6 A member who is not able to fulfill continuing professional development requirements may apply for an exemption of the requirements by providing an explanation in writing for noncompliance in conjunction with the member s report and declaration under Bylaw Reg. Bylaw; 23.7 A member who satisfies the criteria for exemption shall have all or a portion of the member s continuing professional development requirements waived. Reg. Bylaw; 23.8 Upon receipt of a notice in writing from the Institute, a member shall submit to the Institute documentation demonstrating completion of the requirements under Bylaws 23.2 and 23.3 with particulars, and within the time specified in the Rules or notice. Qualifications Reg. Board rule; For an activity to be recognized towards a continuing professional development requirement the activity shall: (a) be quantifiable, meaning that it must be specifically identifiable and be able to be expressed in terms of a specific time requirement; (b) be relevant to the member s current professional needs and/or long-term CPA career interests; and (c) contain significant intellectual or practical content. Reg. Board rule; Verifiable continuing professional development means that the learning can be objectively* verified by a competent source and may include: (a) presentation or attendance at courses, conferences, seminars, briefing sessions, discussion groups and in-house training; (b) teaching a session or continuing professional development in an area that is relevant to a professional role; (c) research projects in areas that expand professional knowledge of the member and that result in presentations, reports or similar documentation; (d) research, including reading professional literature or journals for specific application in a professional role; (e) participation and work on technical committees; (f) published professional writing or academic work; (g) writing technical articles, papers or books; (h) formal study such as leading to a designation, degree or diploma; (i) pre-professional re-examination or formal testing; (j) self-study involving successful completion of an examination or leading to a designation. *Objective means not influenced by personal feelings or opinions in considering and representing facts and is a standard of professional conduct in Rule Reg. Board rule; Unverifiable continuing professional development means independent and informal learning activities and may include: (a) on-the-job training for new software, systems, procedures or techniques for application in a professional role; (b) self-study that does not involve an examination or other objective certification of completion, such as conference reference material or self-study by electronic media or device; Page 4 of 6

5 (c) casual reading of professional journals or magazines that is not part of research for a specific application in a professional role. Reg. Board rule; Submission of verifiable continuing professional development supporting documentation includes: (a) Evidence of the date of continuing professional development, (b) Evidence of the hours of continuing professional development, and (c) Documents that existed or were created at the time the continuing professional development activity was undertaken which support the substance of that activity. Reg. Board rule; Submission of unverifiable continuing professional development supporting documentation includes: (a) Documentation of the date of continuing professional development, and (b) Documentation of the hours of continuing professional development. Reg. Board rule; Members are required to retain continuing professional development supporting documentation and records of enrolment for four (4) years for purposes of Board rules and Terms Reg. Board rule; A resident member shall: (a) report continuing professional development activities completed during each year ended December 31, (b) declare whether the member complied with the requirement established in Bylaw 23.2 and 23.3 for that year and the three (3) year period ending on that date, and (c) file the report and declaration with the Institute on or before February 15 of the following year. Reg. Board rule; A non-resident member shall file a declaration with the Institute on or before February 15 of each year indicating to which of provincial institute, including the Institute of Chartered Professional Accountants of Bermuda, continuing professional development for the previous year ended December 31 is reported. General Provisions Service of Notices Act; 53(1) Unless otherwise provided for in this Act or the bylaws, any notice or other document that is required to be served pursuant to this Act may be served by: (a) personal service made: (i) in the case of an individual, on that individual; (ii) in the case of a partnership, on any partner; or (iii) in the case of a corporation, on any officer or director; (b) registered mail addressed to the last business or residential address of the person to be served known to the registrar. Act; 53(2) A notice or document sent by registered mail is deemed to have been served on the tenth business day following the date of its mailing, unless the person to whom it was mailed establishes Page 5 of 6

6 that, through no fault of that person, the person did not receive the notice or document or received it at a later date. Act; 53(3) If it is for any reason impractical to effect service of any documents in the manner provided for in subsection (1), the court may, on application that may be made ex parte, make an order for substituted service. Act; 53(4) A document served in accordance with the terms of an order mentioned in subsection (3) is deemed to have been properly served. Reg. Bylaw; 5.1 In addition to the methods of service of notices prescribed by section 53 of the Act and unless otherwise specifically provided in the Rules, any document, notification, letter or other form required to be given or sent to a registrant by the Institute pursuant to the Rules may be delivered or served as the case may be if: (a) a facsimile number has been designated by the registrant, by facsimile transmission addressed to the designated facsimile number; or (b) an electronic address has been designated by the registrant, by electronic transmission addressed to the designated electronic address. Reg. Bylaw; 5.2 A document, notification, letter or other form shall be deemed to be received by the registrant on the: (a) day it is personally delivered; (b) tenth (10th) calendar day after the day it is mailed; (c) business day next following the day of the facsimile transmission; (d) business day next following the day of the electronic transmission; or (e) business day next following the day of the delivery or service by courier. Reg. Bylaw; 5.3 A document, notification, letter or other form required to be given or sent to the Institute by a registrant pursuant to the Rules may be: (a) delivered or served personally on the Registrar; (b) sent by mail, facsimile, electronic transmission, courier or any electronic medium by which the Institute is able to receive data, to the attention of the Registrar; provided that anything required to be in a form approved by the Board is in such form, that anything required to be signed is signed, and that anything required to be received at the Institute within a period of time or by a specific date is received within such time or by such date.
