3 Arrests in Wisconsin 2012 Statistical Analysis Center Wisconsin Department of Justice Arrests Stay Flat, Arrests for Crimes Against Society Down 340,893 total arrests 0.2% increase in total arrests Arrests in Wisconsin 2012 provides an overview of 2012 arrests reported by law enforcement. For the state overall, counties, and individual jurisdictions, arrests statistics are presented for violent, property, drug, Society, and other crimes. Between 2011 and 2012, the State of Wisconsin experienced 0 percent change in the number of overall arrests. A 5.9 percent decline in arrests for crimes against society such as disorderly conduct, driving while intoxicated, and liquor law violations was offset by increases in all other arrest categories. Violent arrests were up 6.7 percent, property arrests up 5.8 percent, drug arrests up 7.3 percent, and other arrests were up 2.2 percent. There were 340,893 total arrests made in Wisconsin in This equates to 5,968 arrests made per 100,000 Wisconsin residents. Readers should note that the number of arrests does not necessarily equal the number of persons arrested, since a single person can be arrested multiple times in one year. iii

4 Arrests by Category Arrests for violent crimes were up 6.7 percent. Increased aggravated assault arrests and murder arrests contributed to the increase, and were partly offset by decreases in arrests for forcible rape and robbery. Arrests for property crimes increased 5.8 percent. This increase was primarily driven by an 8.4 percent increase in arrests for theft. Drug arrests increased more than any other arrest category, up 7.3 percent in Drug arrests include arrests for the cultivation, manufacture, distribution, sale, purchase, use possession, transportation, or importation of dangerous drugs. The majority of drug arrests were for marijuana possession. The next highest class of drug arrest was arrests for possession of other dangerous drugs, which increased 25 percent over Arrests for crimes against society decreased 5.9 percent. Arrests for crimes against society made up more than a third of total arrests and decreased 5.9 percent from The largest decreases were seen in arrests of runaways and arrests for prostitution. Arrests for driving while intoxicated increased 0.3 percent, and arrests for other sex offenses increased 7.6 percent. arrests, excluding those for traffic offenses, increased 2.2 percent. Arrests for negligent manslaughter increased 86.4 percent, while arrests for family and children offenses increased 7.3 percent, arrests for other assaults increased 5.2 percent, and arrests for all other offenses (excluding traffic) increased 1.5 percent. iv

7 Introduction As mandated by the Wisconsin Legislature [Wisconsin Statute (1m)(g)], the Wisconsin Department of Justice (DOJ) is responsible for reporting information concerning the number and nature of criminal offenses known to have been committed in the state. This includes collecting crime and arrest data from 398 separate law enforcement agencies for the FBI s Uniform Crime Reporting Program (a nationwide cooperative statistical effort of more than 17,000 law enforcement agencies voluntarily reporting data on crime). The primary objective of UCR is to generate reliable information for use in law enforcement administration, operation, and management. Today, the American public looks to the Uniform Crime Reports for information on fluctuations in the level of crime, and criminologists, sociologists, legislators, municipal planners, the media and other students of criminal justice use the statistics for varied research and planning purposes. This report, prepared by the DOJ Statistical Analysis Center (SAC), is a collection of arrest data reported by Wisconsin law enforcement agencies in It contains detailed information on arrest volume, rates, and trends for law enforcement agencies throughout the State of Wisconsin. In addition, it provides information on arrestee characteristics such as age, race, and sex for five separate crime categories: Violent, Property, Drug, Society, and. The report also includes a breakdown of arrests by adults and juveniles. Background The Uniform Crime Reporting (UCR) Program was first initiated in 1930 by the International Association of Chiefs of Police (IACP). Recognizing a need for national crime statistics, IACP formed the Committee on Uniform Crime Records. The committee evaluated crimes on the basis of their seriousness, frequency of occurrence, pervasiveness in all geographic areas of the country, and likelihood of being reported to law enforcement. After studying state criminal codes and evaluating the recordkeeping practices in use, the Committee identified seven main classifications known as Part I crimes: murder and non-negligent manslaughter, forcible rape, robbery and aggravated assault; and the property crimes of burglary, larceny-theft and motor vehicle theft. By Congressional mandate, arson was added as the eighth Part I offense category in Agencies classify and score these offenses according to a hierarchy rule in which only the most severe offense is counted (in cases with more than one offense). During the early planning of the program, it was recognized that the differences among criminal codes precluded a mere aggregation of state statistics to arrive at a national total. Further, because of the variances in punishment for the same offenses in different state codes, no distinction between felony and misdemeanor crimes was possible. To avoid these problems and provide nationwide uniformity in crime reporting, standardized offense definitions by which law enforcement agencies were to submit data without regard for local statutes were formulated. The amount and type of data collected and disseminated by the UCR program remained virtually unchanged for nearly sixty years. Yet by the 1980s it had become clear that the nature of law enforcement investigations and reporting had changed dramatically since the inception of the program. As a result, the FBI initiated a thorough evaluation of the existing system with the purpose of formulating a phased-in redesign effort to enable the program to meet the needs of law enforcement into the 21 st century. Based upon the recommendations of the evaluation, the FBI developed a new system known as the National Incident-Based Reporting System (NIBRS). Unlike the aggregate summary-based system, NIBRS is designed to collect information on multiple aspects of a crime, including characteristics of the offense and its associated victims, offenders, property, and arrestees. In 1998, the FBI released the final data elements and offense specifications of the new system. At that time, Wisconsin and other state programs began their efforts to implement this enhanced reporting system. Due to the increased reporting requirements of the new program, DOJ is implementing it in phases to Arrests in Wisconsin September 2013

8 allow law enforcement agencies the time and resources needed to acquire the necessary technological capabilities. Today, the state has 300-plus law enforcement agencies participating in Summary-Based Reporting (commonly referred to as UCR) and 80-plus agencies participating in Incident-Based Reporting (IBR). As the State of Wisconsin moves forward with the implementation of this data collection program, a number of additional agencies will be submitting IBR data in Due to the changing landscape of statistical information dissemination and available resources, in 2007 the Statistical Analysis Center followed the lead of the FBI and their annual report, Crime in the United States, by discontinuing all printed versions of this publication to focus exclusively on internet technology for future distributions. This allows the agency to maximize its limited resources, while continuing to provide useful and valuable data to a broad audience. Format & Structure This report is separated into four main sections: Introduction, How to Read UCR Arrests Data, Arrests in Wisconsin, and Appendix. The Arrests in Wisconsin section provides statewide statistical information such as volume, rates, and trends for each of the five major UCR arrest categories. The Appendix contains detailed tables on arrests volume and rates by county and law enforcement agency, as well as definitions used by the Uniform Crime Reporting program. 9 How to Read UCR Arrests Data What to Look For The data presented in this report represent one snapshot in time. Reported arrests can continue to be revised as updates and additions are submitted by agencies. Therefore, the official record of reported arrests made in 2012 may be slightly different days, weeks, or months from the time of this publication. This report is therefore best read with a focus on large trends in Wisconsin arrests, rather than on the exact numbers of arrests reported in each category. Percentages presented in this report may add to more than 100 percent due to rounding. Reading Arrest Rates Throughout the report, arrests are frequently reported in terms of arrest rates. These arrest rates are calculations of how many arrests were made per 100,000 residents. This is done to provide a point of comparison between jurisdictions and over time as populations change. Arrest rates are calculated as: ARREST RATE PER 100,000 RESIDENTS = 100,000 * TOTAL ARRESTS POPULATION Below is an example of how to read arrest rates. 1,136 Property Arrest Rates Arrests per 100,000 Wisconsin residents 1, This means that in 2012 there were roughly 998 property arrests made in Wisconsin for every 100,000 residents. This does NOT mean that there were only 998 property arrests total made in Wisconsin Understanding Data Limitations Caution should be taken when comparing the results to other previous annual reports. Shifting of a law enforcement agency s jurisdictional population based on annual re-estimation population figures may have an effect on rates. Changes to law enforcement policies and procedures and other factors may also affect agencies arrest rates. As presented by the FBI in their annual report, Crime in the United States, adequate assessment of criminality and law enforcement s response from jurisdiction to jurisdiction requires the consideration of many variables, some of which are difficult to measure or not applicable to all locales. Some of the factors known to affect volume and type of crime in different locations are: Population density and degree of urbanization; Variations in composition of the population, particularly youth concentration; Stability of population with respect to residents mobility and commuting patterns; Economic conditions, including median income, poverty level and job availability; Cultural factors and educational, recreational and religious characteristics; Family conditions including divorce and family cohesiveness; Climate; Effective strength of law enforcement agencies; Arrests in Wisconsin September 2013

10 Administrative and investigative emphases of law enforcement; Policies of other components of the criminal justice system (i.e., prosecutorial, judicial, correctional and probational); Citizens attitudes toward crime; and Crime reporting practices of the citizenry. Valid assessments are possible only with careful study and analysis of the particular conditions affecting each local law enforcement jurisdiction. The data used in this report were from all Wisconsin law enforcement agencies participating in the UCR Program (including those submitting less than 12 months of data). Arrest totals by race given in this report reflect only those persons arrested by law enforcement agencies that provided race information to the UCR Program. Therefore, these totals may not match those shown in other arrest tables in this report. These data represent the number of persons arrested. However, some persons may be arrested more than once during a year. Therefore, the arrest statistics in this report could, in some cases, represent multiple arrests of the same person at different times. The composition of arrests shifted in 2012 compared to A 5.9 percent decline in society arrests was offset by increases in other arrest categories. 12 Arrests Arrest Demographics Arrests by Age Juvenile arrests One in five arrestees in 2012 were younger than 18 years old. Categories with juveniles as a higher percentage of arrestees were society arrests (25 percent juvenile), and violent arrests (22 percent juvenile). Juvenile 20% Arrests by sex 71 percent of arrestees were male, and 29 percent female. Property arrests were the only with a higher rate of female arrests, with 37 percent of arrestees being female. Arrests by race The FBI s Uniform Crime Reporting program uses a four-race racial categorization. Adult 80% Arrests by Sex Over two-thirds of arrestees were White. 24 percent were Black, 3 percent were American Indian or Alaskan Native, and 1 percent were Asian or Pacific Islander. Violent crime arrests had the highest minority share of arrests (44 percent Black, 4 percent American Indian or Alaskan Native, 1 percent Asian). 13 Violent Arrests UCR Definition Violent arrests include arrests for aggravated assault, forcible rape, murder, and robbery. 14 UCR Definition Property Arrests Property arrests include arrests for arson, burglary, embezzlement, forgery and counterfeiting, fraud, motor vehicle theft, stolen property, theft, and vandalism. 15 Drug Arrests UCR Definition Drug arrests include arrests for the cultivation, manufacture, distribution, sale, purchase, use, possession, transportation, or importation of: opium or cocaine and their derivatives (such as morphine, heroin, and codeine), marijuana, synthetic narcotics (such as methamphetamine, Demerol, and methadone), or other dangerous non-narcotic drugs (such as barbiturates, Benzedrine). There were 479 drug arrests per 100,000 residents. 86 percent of drug arrests were of persons aged 18 and up. Drug Arrest Categories Arrests for possession made up 83 percent of drug arrests. Arrests for marijuana possession specifically made up 56 percent of all drug arrests. Arrests for possession of other dangerous drugs and sales of synthetic narcotics saw the largest percent increase in Sales: Synth. 16 UCR Definition Society Arrests Society arrests include arrests for crimes against society, including: weapons violations, prostitution, other sex offenses, gambling, driving under the influence, liquor law violations, disorderly conduct, and vagrancy; and for persons under age 18, curfew and loitering, and runaways.
