4 Welcome to Incolink Welcome to the Incolink Services Handbook. It is a great pleasure to bring you this book, as its content is a reflection of the progressive, productive and vibrant industry we work in. We are committed to helping workers through the tough times. Our members are part of a unique and dynamic industry, and face a number of challenges from irregular work patterns to health and safety issues. Incolink is the trading name of the Redundancy Payment Central Fund Limited. Established in 1988, Incolink provides income security and a range of services for workers in the building and construction industry. Financial Support for Workers Incolink provides financial support to unemployed workers through the administration of redundancy funds. Employer contributions fund these payments and are available to workers when they become unemployed. Protection for You and Your Family * Incolink provides a range of insurance covers to workers should they suffer an accident or illness outside working hours, which prevents them from working. Understanding your Industry Incolink is managed by people who understand the commercial building and construction industry. Our eleven-member Board comprises an Independent Chairman, an Executive Director, equal numbers of employer and union representatives, plus an Independent non-voting Director. A number of Advisory Committees are drawn from key industry groups who also provide specialist advice and assistance to the Board. The Incolink Board of Directors works hard to protect the interests of members. John spent a number of years at the Master Builders Association (MBA) and Leighton Holdings prior to his appointment. 9 Incolink administers two approved worker redundancy funds: Fund Number 1 For Building Construction/Contracting Industry workers. Fund Number 2 For Metal Construction/Contracting, Engineering Construction/Contracting and Labour Hire Industries. Employers make monthly redundancy contribution payments to Incolink on behalf of their workers. The payments are made monthly in arrears and are dependant upon the number of weeks worked on a commercial construction site, during the monthly invoice period. The funds created by these contributions provide redundancy payments and a range of other benefits and services to construction industry workers. The amount employers contribute for workers is set down in an Industrial Instrument and the Fund Trust Deed. Employers will continue contributing to a worker s account if they are on: Annual leave Sick leave Long service leave WorkCover (Redundancy and portable sick leave contributions are paid for the first 12 months only) 7 Redundancy Benefits Employers will NOT contribute to a worker s account if they are: On unpaid leave for five (5) consecutive days in one week (Mon-Fri); or Stood down because of an industrial dispute. Incolink was formed to provide redundancy payments to unemployed building and construction industry workers. Call (03)
10 Worker Accounts Workers are now able to select how their redundancy funds are treated. Funds can be held in either; An Incolink Severance Account (default account provided to Incolink worker members), which provides access to funds for workers if their employment is terminated for any reason. Severance termination payments are taxed at the concessional tax rate; or An Incolink Genuine Redundancy Account (GRA) enables workers to claim a genuine redundancy payment if their employment is terminated because their position is made genuinely redundant, at a nil or reduced tax rate, on being made genuinely redundant. Other situations where payments from an Incolink GRA may be claimed include; permanent disability, and death. To select an Incolink GRA, workers will need to complete the Incolink Genuine Redundancy Account Application Form. Once a GRA application has been received and processed, a confirmation letter will be sent to confirm the GRA start date. Casual employees are ineligible to apply for an Incolink Genuine Redundancy Account due to the nature of the terms of their employment. To obtain a copy of this form please contact Incolink or download it from: Claims Severance Account On termination of employment if a worker holds an Incolink Severance Account they shall be entitled to make an Initial Redundancy Claim; called the Initial Benefit. The Initial Benefit will be processed into the workers nominated account upon the date of termination. The Initial Benefit amount will not exceed the maximum amount which is adjusted annually on 1 October (less tax at the rate determined by the Australian Taxation Office). 8 Services Handbook
11 Making a Severance Account Claim On termination of employment if a worker holds an Incolink Severance Account there are two types of payments they can apply for: 1) An Initial Benefit is available ASAP when a worker finishes work. 2) The Balance of Funds Redundancy Benefit, available only after claiming the Initial Benefit, is in the form of a lump sum payment. Initial Benefit A workers can apply to claim their initial benefit (which increases annually in line with CPI), when they become unemployed, a claim is made by completing the Initial Claim Form and forwarding it to Incolink via fax, mail, or delivering it to Incolink s office. A workers employer must confirm termination by one of the following methods; 9 Redundancy Benefits Completing the Confirmation of Termination section of the claim form by an authorised officer of the company and bearing the company stamp/seal. Providing a Separation Certificate completed and signed by an authorised officer of your employer and bearing the company seal/stamp. Providing a letter on company letterhead, signed by an authorised officer, confirming the date of your termination. If a worker is still unemployed after 4 weeks, they are then eligible to make a claim for the balance of funds from their account by making a Balance of Funds Redundancy Benefit Claim. Authorised Officers The following people are authorised to sign documents related to claims on behalf of the employer: A current director of the company A partner in the business An authorised contact for the company as previously advised in writing to Incolink Contact Incolink for a copy of the Initial Claim Form, or download it from:
12 Balance of Funds Redundancy Benefit A worker can apply to withdraw the balance of money left in their account after their initial benefit has been paid, provided the worker meets one of the following criteria: They have been unemployed for 4 weeks and registered as looking for work with Incolink s Member Services Department Employment Service. They have been unemployed for 4 weeks and registered with Centrelink. They need to provide an official document from Centrelink as proof of registration. They have been unemployed for 4 weeks, but not registered with Incolink Member Services Department or Centrelink. They need to provide a completed Statutory Declaration. 39 weeks have passed since BOTH of the following occurred: They have not worked in the industry for 39 weeks since their last employer contributed to Incolink on my behalf. They need to provide a completed Statutory Declaration. 39 weeks have passed since they worked in the commercial/industrial building industry.they need to provide a completed Statutory Declaration. They are over 55 years of age and retired from active employment. They need to provide a completed Statutory Declaration. Contact Incolink for a copy of the Balance of Funds Redundancy Benefit Claim Form or download it from: For more information about claims contact Incolink s Operations Department on (03) To make a claim on any remaining Balance of Funds a worker will need to submit the Balance of Funds Redundancy Benefits Claim Form. If the statutory declaration is completed, this claim form cannot be faxed/ ed and the original document must be posted or brought into the Incolink office. 10 Services Handbook
13 Apprentice Claims For apprentices working on a commercial/industrial construction site, their employer/s will either provide Incolink with the number of days apprentices work on site or provide Incolink with redundancy contribution payments, if required under an Industrial Instrument. Days on site includes days on leave, days on workers compensation, days at school, rostered days off or public holidays. During an apprenticeship, if an apprentice becomes unemployed due to lack of work and they have worked on a commercial/industrial construction site, they may be entitled to make a redundancy claim. If an apprentice becomes unemployed, they can claim their apprenticeship days as redundancy in the following situations: A. An apprentice completes their apprenticeship, then completes 52 weeks within the commerical/ industrial building industry, and their employer/s have paid 52 weeks of employer redundancy contributions into Incolink during the period. B. An apprentice who has not yet finished their apprenticeship is laid off due to a lack of work and there is no arrangement with their employer to re-employ them, and where the apprentice training agreement is cancelled or suspended. C. An apprentice completes their apprenticeship, and is then laid off due to a lack of work within the next 52 weeks. There must be no arrangement with the employer to re-employ them. To be eligible to have the days paid out as redundancy under situation A, the apprentice and the employer must complete and lodge an Initial Claim Form. To obtain a copy of this form please contact Incolink or download it from: Under situations B and C, the apprentice and the employer are required to complete and lodge an Apprentice Credits Application Form, Initial Claim Form and provide the supporting documentation confirming the cancellation of the apprentice s apprenticeship and training contract. 11 Redundancy Benefits Call (03)
14 Genuine Redundancy Claims Workers holding an Incolink Genuine Redundancy Account (GRA) will be able to claim a genuine redundancy payment if their employment is terminated because their position is no longer needed. A workers entire balance will be paid when a claim is made. Other situations where payments from an Incolink GRA may be claimed include: Termination of employment due to permanent disability, Termination of employment due to death, or Retirement/termination for any reason, on or after 65 years of age. The employer is required to confirm the workers redundancy is a genuine redundancy by completing the section of the genuine redundancy claim form. Tax free amounts will be calculated on the workers completed years of employment using the ATO s genuine redundancy Tax rules. The GRA Claim Form can be downloaded from our website: PLEASE NOTE: Workers must submit their Genuine Redundancy Claim to Incolink within 30 days of being made genuinely redundant. If Incolink receives a workers correctly completed Initial or Genuine Redundancy claim form by 10am, the claim will be processed the same day. A cheque will be posted to the worker the same day, or If we are provided with their bank details, the funds will be directly transferred on the same day and workers will have cleared funds in their account the following day. 15 Tax on Benefits When processing the claim, Incolink will deduct tax at the current rate determined by the Australian Tax Office (ATO). It is not against the law for workers not to provide Incolink with their Tax File Number (TFN), however if they do not provide their TFN or confirmation of their exemption from this requirement, tax will be deducted at the maximum marginal tax rate. When Incolink processes a claim, a Group Certificate is sent to workers to use when making their annual tax return. Incolink helping workers get on with the job of building 13 Redundancy Benefits

18 Building & Construction Industry Accident & Illness Benefits Program Incolink provides building and construction workers redundancy benefits along with an extensive list of insurance benefits. Cover is only available for those workers where the employer continues to pay redundancy contributions. Insurance cover will only be provided where the employer continues to pay redundancy contributions. Insurance cover will only be provided where your employer continues to pay the agreed contribution payments. To ensure that you are covered by Incolink s insurance benefits, you are required to ensure your employer pays the agreed contribution payment to Incolink on time each month. Workers who receive contribution payments to Incolink s redundancy scheme will be eligible for insurance cover under Incolink s Personal Accident Leisure Time Insurance Scheme. Workers who receive Income Protection and Trauma (IPT) contribution payments to Incolink will be eligible for Incolink s IPT benefits program. The Incolink Portable Sick Leave (PSL) scheme is exclusive to Incolink; workers will be eligible for this scheme where the employer is required to make contributions under an Industrial Instrument (EBA), and is making PSL contribution payments to Incolink on their behalf. Personal Leisure Time Accident Insurance* Incolink offers benefits to workers who have suffered an accident, resulting in an injury outside working hours that prevents a worker from working. Benefits include a weekly benefit for up to three years (where aged over 65 the benefit periods is limited to two years), lump sum benefits for example, death, paraplegia, loss of limbs and includes a broken bones benefit were the injury has resulted in a break or fracture of a bone. Where a lump sum, death benefit has been paid under this section, for a worker with dependants, as defined, there is a reimbursement for child care expenses. *Conditions and exclusions apply. 16 Services Handbook
19 Dental Accident Benefits* Provides cover to the worker and extends to the worker s dependants for accidental damage to sound and healthy teeth which occurs outside working hours. *Conditions and exclusions apply. Journey Cover* Incolink offers benefits to workers who have suffered an accident resulting in an injury whilst in direct travel to and from work which does not involve a motor vehicle. Benefits include a weekly benefit for up to three years (where aged over 65 the benefit periods is limited to two years), lump sum benefits for example, death, paraplegia, loss of limbs. Where a lump sum, death benefit has been paid under this section, for a worker with dependants, as defined, there is a reimbursement for child care expenses. *Conditions and exclusions apply. Emergency Transport Provides cover to the worker and extends to the worker s dependants for ambulance usage anywhere in Australia which is not work related and not covered under any statutory transport accident scheme *Conditions and exclusions apply. Funeral Cover* Provides a lump sum benefit payable to the beneficiary or funeral parlour when a worker dies. *Conditions and exclusions apply. 17 Building & Construction Industry Accident & Illness Benefits Program Insurance cover will only be provided whilst an employer continues to pay the agreed redundancy contribution payments and IPT contribution payments on a worker s behalf. Where there are gaps in redundancy contributions or insurance contribution payments, no cover will apply for those periods. 20 Leisure Time/Illness/WorkCover Top-Up/ TAC Top-Up & Workplace Death Trauma Benefits* Income Protection and Trauma Insurance (IPT) This insurance has been established to provide benefits for those workers who have Income Protection & Trauma (IPT) Insurance premiums contributions paid on their behalf and provides Leisure Time Illness, WorkCover Top-Up, TAC Top-Up and Workplace Death and Trauma Benefits. To be included as member of the Incolink IPT scheme, employers must be paying the IPT contribution to Incolink which pays the premium on the Insurance policy which provides the various IPT benefits to workers. Provides a range of insurance covers, to workers where a worker suffers an illness, a workplace accident or a motor vehicle accident whilst in direct travel to and from work. Benefits include: Weekly benefits for up to three years for a worker suffering from an illness, (two years where aged 65 and over). Top-up benefits for workers suffering an injury whilst in direct travel to and from work, which is covered by any statutory transport accident scheme. Top-up benefits from the 53rd week of disablement for workplace accidents, whilst a worker is in receipt of WorkCover payments. Death and trauma benefits for workplace accidents only. Where a lump sum, death benefit has been paid under this section, for a worker with dependants, as defined, there is a reimbursement for child care expenses. *Conditions and exclusions apply. 21 Portable Sick Leave Scheme* In addition to providing workers with redundancy benefits Incolink provides an EXCLUSIVE Portable Sick Leave (PSL) scheme to building and construction workers. Cover is only available to those workers where the employer continues to pay PSL contributions to Incolink. The Incolink Portable Sick Leave (PSL) scheme has been set up to take over the sick days you would normally lose when you leave or are terminated by your current employer. On termination of your employment, your employer will send to Incolink the number of sick leave credits you have remaining. It is important that your employer completes the form at the time of termination. If your employer fails to pay PSL premiums, cover will not be provided. 25 Support for Building & Construction Workers Incolink is committed to looking after the physical health and emotional wellbeing of worker members. We provide access to a range of services which are confidential and at no cost. Financial Rights Counselling & Budget Support Program Incolink provides access to professional, confidential, financial rights counselling and budget support services in relation to all debt issues, at no cost to Incolink members. Personal Counselling Personal issues can affect your ability to work safely and efficiently on site. An Incolink counsellor can help you work through your issues, home or work-related, in confidence and at no cost. Critical Incident Support Counsellors are available throughout Victoria to ensure complete coverage of critical incidents. To assist with post incident effects Incolink offers OH&S and First Aid courses on suicide prevention to the Industry to help reduce the number of people attempting to take their own lives. Incolink has been recognised with a national award for its work in this area. Alcohol & Drug Program Incolink s Drug and Alcohol Support Workers have developed a harm-awareness program to help workers and employers deal with the effects of alcohol and drug use. Grief Counselling A terminal or life-threatening illness or the loss of a friend, colleague or loved one can be extremely stressful. Incolink provides access to a free grief counselling service to help workers through these difficult times. 23 Incolink Member Services
26 Support for Apprentices Apprentice Support Workers Incolink s Apprentice Support Workers provide advice and support to apprentices to ensure they are equipped to deal with workplace pressures. This includes information on issues like drug and alcohol abuse and suicide prevention. Life Care The Life Care service is a project between Incolink and Cbus, aimed at suicide prevention for apprentices and young workers. The program is delivered across Victoria and is designed to teach Life Care skills to apprentices and young workers to assist them to prepare for and cope with the pressures of work and daily life. 27 Training, Employment and Careers Developing Skills for Your Industry Incolink offers financial support to worker members keen to develop new or upgrade existing skills. For eligible members, Incolink assist with a contribution towards the cost of a variety of industry-related training courses. Workers can apply for the training subsidy by either contacting Incolink direct or downloading the request for Individual Training Assistance Form from the Incolink website: Incolink can also assist workers currently employed as tradespersons, who are not formally qualified, to obtain their trade accreditation. Incolink advisors have up-to-date information on a range of courses and training programs available. You can register either by contacting Incolink, downloading the Job Registration Form or completing it online on the Incolink website: Incolink also provides a free résumé service. Incolink provides a free employment referral service to assist our employer members who are seeking workers. By maintaining a list of workers who are experienced and qualified, Incolink can advise employers of workers who may be suitable for their jobs. Employers can complete an online form to post jobs with Incolink. 31 Occupational Health & Safety Initiatives Incolink has funded a variety of Occupational Health and Safety (OH&S) projects on a range of issues. From Safe Work on Roofs and Noise Awareness programs, to the training of site OH&S representatives and supervisors. We are involved in the development of long-term initiatives to address drug and alcohol problems and formulate new approaches to rehabilitation. Incolink was responsible for funding an OH&S Management System. This System included the production of an Audit Capability manual providing detailed, procedure-based, quality management information and principles for contractors and sub-contractors. The Safety Handbook, Safe, is a comprehensive reference for employers and workers on construction sites, is regularly updated by Incolink for the benefit of the Industry. Help for Out-of-Trade Apprentices Incolink assists out-of-trade apprentices find employment, by registering their availability on an Apprentice Register. Referrals are then made to interested employers as work opportunities arise, enabling the apprentices to gain the experience they need to complete their certificates. Other Activities Incolink provides financial assistance to the Victorian Building Industry Disputes Panel, supports Building Industry Picnics and other key Industry events throughout the State. 29 Incolink Member Services Call (03)
