3 Substance Abuse Policy and Procedures INTRODUCTION Substance abuse is a national concern. At Alabama A&M University, the Athletic department seeks to maintain an environment that supports and encourages the pursuit of knowledge and fair play without being negatively influenced by drug and alcohol abuse. The illegal use, abuse, possession, manufacturing, dispensing, distribution of, or being under the influence of a controlled substance is prohibited while a member of any Alabama A&M University athletics team is participating in an Alabama A&M University athletic event whether the person is on or off the University s campus. Furthermore, Alabama A&M University athletes are not permitted to use Banned or Impermissible substances as identified by the National Collegiate Athletic Association (NCAA). Alcohol and illicit drugs can have a detrimental effect on the student-athlete s health and performance (see Appendix 1). Anabolic steroids, considered to be a performance enhancer, have been proven to be detrimental to the student-athlete s health (see Appendix 2). The NCAA and all sports federations ban steroid use. Alabama A&M Athletics Administration, coaching staff, and Alabama A&M University condemns the use of any illegal chemicals and the abuse of any illegal chemicals that endanger the safety of Alabama A&M athletes. It is the responsibility of the Athletics staff and coaches to see that alcohol abuse and drug use does not occur on our teams, and if it does, to refer those student-athletes for counseling to prevent further use or abuse. In order to provide an alcohol and drug-free environment, this comprehensive drug and alcohol usage policy and program has been developed and implemented. 3

4 OBJECTIVES The purpose of the substance abuse program, which includes education, screening, counseling, and disciplinary action is: To protect the health and welfare of the Alabama A&M student-athlete by providing a drug free environment. To educate the student-athletes, coaches, and staff members about the physical, social, psychological, financial, and legal problems associated with alcohol abuse and drug use. To identify student-athletes who are abusing alcohol or drugs and assure prompt counseling and treatment To establish a program to assist individuals who use or abuse drugs or alcohol in recognizing their problem and by referring them to counseling and rehabilitation. To develop and maintain a screening program designed to act both as a deterrent to and as a method of detecting possible substance abuse. To provide disciplinary action for any student-athlete found to be involved in improper use of drugs To provide information and warnings about the use of supplements. THE PROGRAM The Drug and Alcohol program consists of these components: drug education, testing, random/probable cause notification, and disciplinary actions. The program complies with and augments NCAA and Alabama A&M University Drug Programs and Policies. 1. Drug Education The basic purpose of the Drug and Alcohol Abuse Policy is one of prevention. An essential part of this program is an ongoing educational component. The intent is to increase the student-athlete s awareness of the physiological, psychological, and legal ramifications of chemical substance abuse. The student-athlete will have an opportunity to participate in various educational experiences that will emphasize the damaging effects of drugs. Every student-athlete will be required to attend the drug education activities. 4

5 At the beginning of the academic year, a presentation will be made by the Sports Medicine Staff to all intercollegiate athletic squads at Alabama A&M University to outline and review the Intercollegiate Athlete Drug Testing Program, its purposes and implementation. A copy of the program will be given to each athlete and a copy will be posted on the website under Athletics/Sports Medicine. All athletes will then be asked to sign a form acknowledging that they have received a copy of the program and understand what is expected of them. 2. Drug Testing An alcohol and drug testing program through urinalysis or oral methodology will be utilized. Other methods to detect alcohol use may be utilized. A. Consent Forms: Each student-athlete must sign an NCAA consent form provided by the Compliance Officer and an AAMU alcohol-drug testing authorization form each year provided by the Sports Medicine Department. These forms will be kept on file. A student-athlete who does not sign the authorization forms will not be permitted to participate in practice or competition. B. Banned Substances As stated in NCAA bylaw , athletes participating in the intercollegiate program ban the following classes of substances for use: anabolic steroids, diuretics, ephedrine, peptide hormones and analogues, and urine manipulators. 6 In addition to the NCAA drug test, AAMU will perform random drug screenings to test for the following substances: Amphetamines, barbiturates, cocaine, opiates, morphine, codeine, tetrahydrocannabinal (THC or marijuana), and alcohol. Alabama A&M University reserves the right to add to the list of substances to be screened for at any time. 3. NOTIFICATION The following methods will be used to select student-athletes for the AAMU drug and alcohol testing program: I. Random Selection: The drug testing schedule will be set by the Sports Medicine staff with the approval of the Athletics Director. The Head Coach will be notified no later than the day of and no sooner than the day prior to the screening, depending on the pre-arranged testing time. Individual student-athlete s will be randomly chosen for screening through the Sports Ware Injury Tracking System in the Sports Medicine Department. All student-athletes will be eligible for testing each time, however not all sports may be tested every time. Testing will be conducted year round. The Sports Medicine staff, head coach or his/her designee will notify the selected student-athletes. If the testing is takes place at another time and location, the student athlete will be contacted via a notification form (Appendix 4). The Athletics Director, head coaches, or athletic training staff have the authority to request additional individual (with probable cause) or team screenings at any time. II. Probable Cause: Student-athletes will be drug-screened and/or evaluated if there is probable cause (reasonable belief that a person has used drugs based on the attached signs and symptoms check list) to suspect alcohol, drug use or abuse. The coaching staff, administrators, academic advisors, athletic trainers, or strength coaches may receive a 6

7 report of substance abuse or observe certain signs, symptoms, or changes in behavior that may cause him or her to suspect substance abuse. These staff members have a duty to report any suspicions to the Athletic Director. A signed report will be forwarded to the Head Athletic Trainer using the form in Appendix 5. Typical behaviors are included on this form. The student-athlete will be notified of the decision regarding the need for counseling and/or testing. III. An Entire Team There may be times that an entire team is tested for impermissible substances. This may include but is not limited to the following reasons: 1. Prior to post season competition. 2. Suspected widespread use of/or association with Impermissible substances by team members. IV. Medically Advised On the advice of a medical professional, drug testing may be administered on a student-athlete where there is reasonable cause to suspect the use of any of the banned drugs. Reasonable cause may be based on, but not limited to: medical condition, appearance, abnormal conduct, or other behavior symptomatic of drug use. If the student-athlete s medical condition is such that he/she is unconscious or his/her consciousness/mental stability is altered, testing may be performed without notification and/or written consent. V. Positive Testing Follow-Ups Anyone who has previously tested positive on A&M or NCAA drug tests for substance abuse is subject to follow-up testing at anytime during their career at Alabama A&M University. 4. Disciplinary Action A. NCAA Year Round and Championship or Bowl Game Testing Program A positive drug test in the NCAA drug testing program will result in sanctions determined by the NCAA. AAMU has no input in the NCAA s decision-making or control over these sanctions. A positive test result in the NCAA program can be considered a positive test result in the AAMU program. Alabama A&M 7

8 Athletics Department disciplinary actions will be in addition to NCAA s sanctions. B. AAMU Alcohol and Drug Disciplinary Policy The team physician may suspend the student-athlete from all athletic participation if medically indicated following a positive drug test result. FIRST OFFENSE 1. Parent (s), guardian, and/or spouse notified in writing. 2. Suspension from the next eligible 10% of games or contests. This includes post season contests and will be carried over to the next season if necessary. If the student athlete is unable to participate due to injury or any other reason the suspension will be served once the student athlete is cleared for participation. The Head Coach may permit the student-athlete to participate in practices and team meetings during the suspension period only following the team physician s clearance. 3. Evaluation by Team Physician. 4. Student-athlete will follow the treatment plan developed by the Team Physician 5. Random testing as specified by our Physician. 6. Additional disciplinary action as specified by the Head Coach. 7. The student-athlete will be required to complete ten (10) hours of community service at the discretion of the Head Coach which may include but is not limited to grounds detail, drug awareness, campus beautification, cafeteria work, etc. 8. Possible termination from team. 8

9 SECOND OFFENSE 1. Parent (s), guardian, and/or spouse notified in writing. 2. Suspension from the next eligible 50% of games or contests. This includes post season contests and will be carried over to the next season if necessary. If the student athlete is unable to participate due to injury or any other reason the suspension will be served once the student athlete is cleared for participation. The Head Coach may permit the student-athlete to participate in practices and team meetings during the suspension period only following the team physician s clearance. 3. Must be evaluated and complete treatment plan by Bradford or other university designated facility. 4. Random testing as specified by the Team Physician. 5. Additional disciplinary action by the Head Coach. 6. The student-athlete will be required to complete twenty (20) hours of community service at the discretion of the Head Coach which may include but is not limited to grounds detail, drug awareness, campus beautification, cafeteria work, etc. 7. Possible termination from team. THIRD OFFENSE 1. Cancellation of eligibility to participate in the athletic program. 2. Automatic non-renewal of athletic grant-in-aid. 3. Existing grant-in-aid may be canceled in accordance with NCAA and conference guidelines. 4. Parent(s), guardian, and/or spouse will be notified in writing by the Athletics Director. 9

10 SAFE HARBOR You are encouraged to voluntarily come forward to seek assistance with alcohol or drug related problems without punitive sanctions. Requests for safe harbor should be made to the head athletic trainer or your team s athletic trainer prior to selection for random testing. You will be given a request form to sign (Appendix 6) that will be kept in your file in the athletic training room. This program requires that you ask for Safe Harbor prior to the first drug test of the first semester of your eligibility. Typically this will be at the beginning of the fall semester for freshmen or the first semester enrolled in classes for a transfer student-athlete. This will be your one and only opportunity to use Safe Harbor while at Alabama A&M University. Once you declare Safe Harbor : You will be drug tested immediately for drugs and/or alcohol You will be evaluated by the team physician regardless of the test results You will follow and complete the drug treatment plan You will be randomly tested for drugs and alcohol at a frequency that will be determined by the team physician You will remain in safe harbor until you are released from the drug treatment program and team physician (a time not to exceed 30 days) You will not be eligible for randomized drug testing while in safe harbor, but will remain eligible for the NCAA drug testing. The team physician may suspend the student-athlete from all athletic participation if medically indicated. Failure to comply with any aspect of the counseling program or any subsequent positive drug test indicating new or increased use of a banned substance will result in removal from the safe harbor program. The student-athlete will then be re-entered into the regular testing program and disciplinary action can be enforced according to the AAMU Alcohol and Drug Policy. 10

11 Only the Athletic Director, Compliance Director, Head Coach, Head Athletic Trainer, Athletic Trainer assigned to your sport, and Team physician will be notified of your request for Safe Harbor. Other university officials may be informed only to the extent necessary for the implementation of this policy. ALL OFFENSES ARE CUMULATIVE THROUGHOUT THE STUDENT-ATHLETE S ELIGIBILITY! Following the first positive test for each offense, the student-athlete will be screened again. Since some drugs can remain in the system for longer periods of time and due to the metabolic rate of individuals varying, the athletes will receive weekly drug tests until he/she receives a negative test result. Once a negative screen is obtained, any subsequent positive test will be treated as an additional offense. Each student athlete will sign a Disciplinary Action Form (Appendix 7). This form will outline disciplinary actions and procedures the student-athlete must follow as part of the Alcohol and Drug Policy. Failure to comply with the terms of the form can result in suspension or termination from the team. FAILURE TO REPORT FOR A TEST IS AN AUTOMATIC POSITIVE TEST RESULT! APPEAL PROCESS If a student-athlete tests positive for a banned substance, he/she has the right to appeal the test result and/or disciplinary action. The Athletics Director must receive the written request found in Appendix 8 within 48 hours of the notification of the positive test. Upon the Athletic Director s approval of the student-athlete s request to have the results of the drug 11

12 screen appealed, the Head Athletic Trainer will contact the Drug Testing Laboratory. The second drug screen can be performed at a certified laboratory using the original sample at the student-athlete s expense (~$25). Testimony regarding the chain of custody and procedures at the laboratory can be provided to the student-athlete by the laboratory, also at the student-athlete s expense. If the student-athlete wishes to appeal a disciplinary decision or procedure, the Athletic Director must receive the written request for appeal within 48 hours of the student-athlete s notification of the penalty. The Athletics Director may assemble an Appeals Committee consisting of the Athletic Director, Senior Women s Administrator (assuming she is not the head coach of the involved team), a Head Coach of another team, Compliance Officer, and Head Athletic Trainer. The Athletic Director will determine participation status of the student-athlete during the appeals process following medical clearance by the Team Physicians. Once the student-athlete is cleared, the Head Coach will still have the discretion to determine participation in team activities. DRUG COUNSELING AND REHABILITATION Alabama A&M University will require all student-athletes who test positive on their drug screen or who have a self-admitted drug, alcohol, or related problem to go through a comprehensive evaluation, counseling, and rehabilitation program to help them overcome their problem. They will meet with the Team Physician to evaluate the problem and establish a treatment plan. The student-athlete will be required to attend counseling sessions and follow the prescribed treatment plan. This plan may include out-patient or in-patient therapy, group sessions, or other special treatments. 12

13 FINANCIAL RESPONSIBILITIES Once a student-athlete tests positive for a banned substance, he or she will be required to be evaluated by the Team Physician to determine the extent of their substance abuse problem. The student athlete will be referred for the appropriate follow-up counseling and treatment. Student-athletes who abuse drugs or alcohol may require long term counseling and in-patient comprehensive care to help them deal with their problems. Financial responsibilities for these counseling sessions and treatments will be the responsibility of the student-athlete and/or his/her parent(s) or guardian. Alabama A&M University will not be financially responsible for services related to drug abuse. SUPPLEMENT USE Alabama A&M University discourages the use of Supplements. All student-athletes must be cautious when using supplements that are available through commercial outlets because many contain substances that are banned by the NCAA. Student-athletes can improve their strength and performance through proper nutrition, conditioning, and rest. See your Athletic Trainer for more information on proper nutrition. According to the NCAA policy, Alabama A&M University can only provide non-ergogenic nutritional supplements as long as they do not contain any NCAA banned substance. Permissible substances may include electrolyte popsicles, carbohydrate/electrolyte drinks, vitamins, and minerals. Any student-athlete, who takes supplements or medications from ANY other source besides AAMU Sports Medicine, MUST complete the Student-Athlete Supplement Form (Appendix 10), meet with the Athletic Trainer, and return the form to the Sports Medicine Department to be kept on file prior to use. 13

14 USE EXTREME CAUTION WHEN TAKING ANYTHING GIVEN OR PURCHASED FROM A COMMERCIAL OUTLET (GNC, VITAMIN SHOPPE, VITAMIN WORLD, COMPLETE NUTRITION, ETC). The labeling on these products is not regulated by the FDA and can be misleading or inaccurate. Sales personnel are paid to sell these products, not look out for your eligibility. Terms such as natural, healthy, or ephedra free do not imply safety nor does it imply that the NCAA approves of the substance. THE STUDENT ATHLETE IS RESPONSIBLE FOR KNOWING WHAT IS CONTAINED IN ANY SUPPLEMENT THAT HE/SHE TAKES. IGNORANCE IS NO EXCUSE AND WILL NOT BE A SUFFICIENT DEFENSE. TOBACCO PRODUCTS In accordance with NCAA legislation, the use of tobacco products is prohibited by student-athletes and all game personnel (coaches, athletic trainers, managers, game officials) in all sports during all practices and competition. If a student-athlete is caught using a tobacco product during an official practice or game, it is considered a positive drug test and the above penalties will be imposed. 14

16 Appendix 2 ANABOLIC STEROIDS This class of drug is a derivative of the male hormone testosterone. Testosterone will increase protein synthesis, when coupled with training and proper diet, may create an increase in lean muscle mass. Being a hormone, the anabolic steroid will interfere with the normal hypothalamic-pituitary-gonadal thermostat and disturb the body s delicate hormone balance. This interference can produce detrimental side effects. Anabolic Steroids are banned by the NCAA, USOC/IOC, all sports federations, and professional athletic organizations. AAMU will not condone or tolerate the use of Anabolic Steroids by the student-athlete. Risks of Steroid Use Aggressiveness leading to violence Mood swings Psychiatric disorders, psychotic episodes Acne Balding Hypertension (high blood pressure) High cholesterol Cardiac Arrhythmias (irregular heart beat) Diminished libido (decreased sex drive) Atrophy of testicles Impotence (unable to reproduce) Stunted Growth Kidney Disease Liver Damage Enlarged Prostate Breast enlargement in males (In Females) Menstrual problems Breast atrophy Excessive hair growth Enlarged clitoris Deepening of Voice Alabama State Law as well as Federal law makes it illegal to sell, possess, or use anabolic steroids. 16

17 Appendix NCAA Banned Drugs The NCAA bans the following classes of drugs: a. Stimulants b. Anabolic Agents c. Alcohol and Beta Blockers (banned for rifle only) d. Diuretics and Other Masking Agents e. Street Drugs f. Peptide Hormones and Analogues g. Anti-estrogens h. Beta-2 Agonists Note: Any substance chemically related to these classes is also banned. The institution and the student-athlete shall be held accountable for all drugs within the banned drug class regardless of whether they have been specifically identified. Drugs and Procedures Subject to Restrictions: a. Blood Doping. b. Local Anesthetics (under some conditions). c. Manipulation of Urine Samples. d. Beta-2 Agonists permitted only by prescription and inhalation. e. Caffeine if concentrations in urine exceed 15 micrograms/ml. NCAA Nutritional/Dietary Supplements Warning: Before consuming any nutritional/dietary supplement product, review the product and its label with your athletics department staff! Dietary supplements are not well regulated and may cause a positive drug test result. Student-athletes have tested positive and lost their eligibility using dietary supplements. Many dietary supplements are contaminated with banned drugs not listed on the label. Any product containing a dietary supplement ingredient is taken at your own risk. It is your responsibility to check with athletics staff before using any substance. 17

Check with your athletics department staff to review the label of any product, medication or supplement before you consume it! Stimulants: amphetamine (Adderall); caffeine (guarana); cocaine; ephedrine; fenfluramine (Fen); methamphetamine; methylphenidate (Ritalin); phentermine (Phen); synephrine (bitter orange); etc. exceptions: phenylephrine and pseudoephedrine are not banned. Anabolic Agents: boldenone; clenbuterol; DHEA; nandrolone; stanozolol; testosterone; methasterone; androstenedione; norandrostenedione; methandienone; etiocholanolone; trenbolone; etc. Alcohol and Beta Blockers (banned for rifle only): alcohol; atenolol; metoprolol; nadolol; pindolol; propranolol; timolol; etc. Diuretics and Other Masking Agents: bumetanide; chlorothiazide; furosemide; hydrochlorothiazide; probenecid; spironolactone (canrenone); triameterene; trichlormethiazide; etc. Street Drugs: heroin; marijuana; tetrahydrocannabinol (THC). Peptide Hormones and Analogues: human growth hormone (hgh); human chorionic gonadotropin (hcg); erythropoietin (EPO); etc. Anti-Estrogens : anastrozole; clomiphene; tamoxifen; formestane; etc. Beta-2 Agonists: bambuterol; formoterol; salbutamol; salmeterol; etc. Any substance that is chemically related to the class of banned drugs, unless otherwise noted, is also banned! NOTE: Information about ingredients in medications and nutritional/dietary supplements can be obtained by contacting the Resource Exchange Center, REC, or password ncaa1, ncaa2 or ncaa3. 20 Appendix 5 ALABAMA A&M UNIVERSITY PROBABLE CAUSE TO SUSPECT DRUG USE NOTIFICATION FORM I, (AAMU dept. staff member), under the probable cause to suspect alcohol, drug use, or abuse as outlined in the AAMU Substance Abuse Policy, report the following objective sign(s), symptom(s), or behavior(s) that I reasonably believe warrant (student-athlete) be referred for possible drug testing. 25 Appendix 9 ALABAMA A&M UNIVERSITY DRUG-FREE CAMPUS PROGRAM Policy and Program Overview Alabama A&M University recognizes alcoholism and drug abuse as medical and public health problems. The use and abuse of alcohol and other drugs can and do lead to a broad spectrum of physical, mental, social, and safety and security consequences which militate against the goals and objectives of an academic environment. The University is committed to providing a healthy and safe academic environment. The primary goal of this University-Wide policy and program is to foster an environment that is conducive to the intellectual and personal development and functioning of all members of the University community. This notice certifies that Alabama A&M University subscribes to a drug-free campus, and places in operation this policy and program. It is unlawful for any student, employee, or visitor to manufacture, distribute, dispense, possess, or illegally use a controlled substance on the campus or under the jurisdiction of Alabama A&M University. A violation of any part of this policy, resulting in a conviction by campus or civil authorities, will subject the violator to penalities up to and including suspension or expulsion from the University, discharge from employment, and applicable penalties under the civil laws. To facilitate the drug-free campus policy, a program has been devised consisting of four major thrusts, namely, (1) increasing the awareness of the debilitating effects of drug abuse; (2) student education, counseling, rehabilitation, and assistance; (3) application of University regulations and sanctions against alcohol and drug abuse; and (4) application of local, state, and federal laws against unlawful possession, use or distribution of illicit drugs and alcohol. The Offices of Human Resources and Student Affairs are responsible for implementation and maintenance of the program. 25

26 Appendix 10 UNIVERSITY ALCOHOL/DRUG-RELATED REGULATIONS AND PENALTIES 1. The unlawful manufacture, possession, use, sale, distribution, or dispensation of controlled substances by students, employees or visitors while on University property or under University jurisdiction or on University business is prohibited. 2. Students who engage in unlawful activity involving or related to alcohol and drugs will be subject to disciplinary actions up to and including expulsion from the University. Non students and students will be subject to penalties provided in the criminal laws of Alabama. 3. The legal use of prescribed medication under the direction of a licensed physician is permitted. Students using prescribed medication should consult with a physician concerning the safe use of drugs while on University property or off-campus on University business. 4. The use, consumption, distribution, storage, or sale of any alcoholic beverage, or the possession of sealed or unsealed containers of alcoholic beverages on any property owned or leased by the University, or any unit or subdivision thereof, is prohibited and subject to disciplinary action up to and including suspension and expulsion. 5. The use of any funds of the University, including but not limited to student activity money, or any attempt to obligate such funds for use, consumption, possession, distribution or sale of alcoholic beverages and/or illegal drugs is strictly prohibited and subject to disciplinary action up to and including suspension or expulsion. 6. Being under the influence of alcohol or illegal drugs while off-campus on University business is prohibited and subject to disciplinary action up to and including suspension and expulsion. 7. Reporting to class under the influence of alcohol or illegal drugs is subject to disciplinary action up to and including suspension or expulsion. 8. Possession of illegal drug paraphernalia while on University property is subject to disciplinary action up to and including suspension or expulsion. 26

27 Appendix 11 STATE ALCOHOL/DRUG-RELATED PENALTIES ALCOHOL a. Public intoxication (Sec 13A-11-10): Up to $2000 fine, one year in jail for repeated offenses. b. Driving under the influence (Sec 32-5A-191): a. First Offense: Up to one year in jail and a fine of $250-$1000, 90 day suspended license. b. Second Offense within 5 years: Fine of $500-$2500, up to one year hard labor with mandatory minimum of 8 hours in jail or 20 days community service. License suspended for one year. c. Third offense within 5 years: Fine of $1000-$5000; Sixty (60) days to one year hard labor, license suspended for three years. NARCOTICS a. Possession of Marijuana (Sec 13A ): Personal use only: Fine of up to $2000, up to one year in jail. Second Offense: One year and one day to 10 years, up to $5000 fine. Other than personal use (Sec 13A (2): Same as second offense. b. Possession of Paraphernalia or visiting where drugs are being used (Sec ): First Offense: Up to one year in jail. Second Offense: Two to 15 years in jail. c. Controlled substances other than Marijuana (Sec ): Four to 30 years and up to $50,000 fine. No Suspended Sentence and No Probation Enhancements (Sec ): Second Offense of any crime except marijuana possession for personal use can draw up to twice the fine and jail time. Habitual Offender Act (Sec 13A-5-9) Provides up to life without parole on third felony conviction, whether or not first two occurred in Alabama. 27

AAMU CODE OF STUDENT CONDUCT All Alabama A&M University students (all persons taking courses at the University, both full-time and part-time, pursuing undergraduate and graduate studies), are expected to prescribe to conduct set hereto. Any student found to have committed acts of misconduct in the following categories is subject to disciplinary sanctions by the University as described in section D of this Handbook. Category I - Offenses against the University 1. Acts of dishonesty, including but not limited to the following: a. Furnishing false information to any University official, faculty member, or office. b. Forgery, alteration, or misuse of any University document, record, or instrument of identification. c. Tampering with the election of any University-recognized student organization. 2. Disruption or obstruction of teaching, research, administration, disciplinary proceedings, or other University activities on or off-campus, including non-university activities which occur on University property. 3. Failure to comply with directions of University officials or law enforcement officials acting in performance of their duties and/or failure to identify oneself to these persons when requested to do so. 4. Violation of published University policies, rules or regulations, including, without limitation, the Student Handbook and University catalogues. Category II - Offenses against Persons 1. Physical abuse, verbal abuse, threats, stalking, intimidation, harassment, sexual misconduct, coercion, and/or other conduct which threatens or endangers the health or safety of any person. (This is intended to include any contact or communication which threatens, harasses, or injures a person). 2. Hazing, or any act which endangers the mental or physical health or safety of a student, or which destroys or removes public or private property, for the purpose of initiation, admission into, affiliation with, or as a condition for continued membership in a group or organization. Category III -Offenses against Property 1. Attempted or actual theft of and/or damage to property of the University or property of a member of the University family or other personal or public property. 2. Unauthorized possession, duplication, or use of keys to any University premises, or vehicles or unauthorized entry to or use of University Property. 3. Theft or other abuse of computer time, including but not limited to: a. Unauthorized entries into a file, to use, read, or change the contents for any other purpose. b. Unauthorized transfer of a file. c. Unauthorized use of another individual s identification and password. d. Use of computing facilities to interfere with the work of another student, faculty member or University official. e. Use of computing facilities to send obscene or abusive messages. f. Use of computing facilities to interfere with normal operation of the University computing system. g. Use of computers and other technology for personal and nonuniversity business or to view or promote pornography. 4. Damage to or littering on public grounds of the University, including driving motor vehicles on lawns or 29

30 grounds of University property, without prior authorization from the appropriate University official. Category IV-Offenses Disrupting Order or Disregarding Health and Safety 1. Use, possession, or distribution of narcotic or other controlled substances except as expressly permitted by law. 2. Use, possession, or distribution of alcoholic beverages on University property. 3. Possession of firearms, explosives, other weapons, or dangerous chemicals on University property. 4. Participation in campus demonstration which disrupts the normal operations of the University and infringes on the rights of other members of the University Family; leading or inciting others to disrupt scheduled and/or normal activities within any campus building or area; and intentional obstruction which unreasonably interferes with the freedom of movement, either pedestrian or vehicular, on campus. 5. Conduct which is disorderly, lewd, or indecent; breach of peace, or aiding, abetting, or procuring another person to breach the peace, on University property or at functions sponsored by, or participated in by, the University. 6. Violation of federal, state, or local law on University property or at University sponsored or supervised activities. 7. Entering false fire alarms or bomb threats and/or tampering with fire extinguishers, alarms, or other safety equipment. 8. Violation of traffic and parking rules and regulations, including, but not limited to: a. Repeated or flagrant violations of the rules as set forth by the University Department of Public Safety (DPS). b. Tampering with, removal of, or theft of barricades, traffic cones, or traffic control devices. 9. Violation of federal, state, or local law off University property and not related to University sponsored or supervised activities which adversely affects the University family and/or the pursuit of its mission. The decision to pursue disciplinary action under this provision is that of the Vice President for Student Affairs.* If a student is charged with an off campus violation of federal, state, or local laws, but not with any other violation of the code, disciplinary action may be taken and sanctions imposed for misconduct which demonstrates disregard for the University family. University disciplinary proceedings may be instituted against a student charged with violation of a law which is also a violation of this student code if both violations result from the same factual situation, without regard to the possible outcome of civil litigation in court or criminal arrest and prosecution. Proceedings under this Code of Student Conduct may be carried out prior to, simultaneously with, or following civil or criminal proceedings off campus. Category V-Non compliance with University Judicial System 1. Failure to obey the summons of the Judiciary Board or Judiciary Officer. 2. Falsification, distortion, or misrepresentation of information before the Judiciary Board. 3. Disruption or interference with the orderly conduct of the judiciary proceedings. 4. Failure to comply with judiciary sanction(s). 30

National, state and local laws and campus policy prohibit the unlawful use, possession, sale, dispensation or distribution of illegal drugs, alcohol or controlled substance. Violators will be subject to arrest and/or suspension, expulsion, or fines. Smoking is prohibited in all areas of the residence halls. This program includes education and counseling with regard to substance abuse; and disciplinary sanctions which might be imposed as a result of this program if it is determined that I (the student-athlete) have violated the provisions or intent of the policy. In consideration for the opportunity for the Student-athlete names below to participate in intercollegiate athletics at Alabama A&M University, I enter into the terms of this consent and authorization. I hereby give my consent to have samples of my (the student-athlete s ) urine collected before, during, or after the academic year for testing for the presence of certain drugs or substances in accordance with the provisions of the Alabama A&M University Department of Athletics Substance Abuse Policy.
