1 Countryside Alliance Membership Insurance FREQUENTLY ASKED QUESTIONS FOR COUNTRYSIDE ALLIANCE MEMBERS The purpose of this document is to answer many of the questions Countryside Alliance Members ask about the Insurance provided under their Membership. The Information below is designed to act as a guide only, for individual members, and should be read in conjunction with the Countryside Alliance Summary of Cover which can be found on this website. Alternatively you can call the membership insurance helpline on who will be happy to send you a copy. Each Countryside Alliance Member will receive Public Liability and Personal Accident cover whilst taking part in a Countryside Alliance Recognised Activity. These activities have been defined by the Countryside Alliance Board and are not open for negotiation. Any issues arising from this will need to be taken up with the Board. - Riding - Horse drawn carriage driving - Deer Stalking - Exercising Hounds - Taking part legally in Hunting (including hunt followers) - Team Chasing - Hunter trials - Lurcher work - Sporting Shooting (including clay pigeon) other than in USA/Canada - Angling (including sea, coarse and game angling) - Falconry - Ferreting - Terrier work - Hound trailing - Field trials - Vermin control - Whippet racing - Shooting including Sporting shooting, Clay Pigeon shooting, Rifle and target shooting other than in USA/Canada - Dog shows - Conservation work - Fund raising if you are a Group Member with the Countryside Alliance - Your officiating, assisting or spectating in recognised activities - Plus voluntary unpaid duties at shows and events - Coursing only in Northern Ireland or the Republic of Ireland It is important to note that cover will be provided only when the following criteria have been met:- 1. The current annual membership subscription must be paid in full 2. The activity you are taking part in is recognised by the Countryside Alliance Board. 3. The activity must not be one, which you rely upon for remuneration as a main source of income.

2 4. The incident took place whilst you were a fully paid up member of the Countryside Alliance Below is a list of questions, members of Countryside Alliance often ask. Please note the answers to these are brief so if you have a specific question that is not wholly answered below you will need to either refer to your summary of cover or call the help line number for further advice. Public Liability Insurance 1. How do I claim? As soon as possible download a form from this webpage, complete it and send it to the address on it together with any documentation you have received. Do not enter into liability discussions with any third party concerning the incident; simply pass our details onto them and ask them to pass to their own representatives. If they refuse to do so, advise them that your insurers will respond on your behalf and ask them to contact us. 2. What limit of indemnity do I have for Public Liability Insurance? Are higher limits available? Each member will receive a limit of 10,000,000 any one occurrence, in respect of North America and Canada this is reduced to 10,000,000. This is the maximum limit available under the Countryside Alliance Membership Insurance. If a higher limit is required you will need to seek an excess layer liability policy elsewhere. 3. Does the policy cover my pets and horses? The Countryside Alliance Membership Insurance does not provide any cover for injury to or death of the animal itself. It is strongly recommended that members with pets or horses take out specific pet or equine insurance. Such a policy can be designed to cover a wide range of risks and almost without exception would include liability cover to protect the owner of the pet or horse should the animal cause injury to a third party or damage third party property at any time. Where specific insurance has not been arranged the Countryside Alliance Membership Insurance provides liability insurance only whilst the member and his animal are participating in a Countryside Alliance Recognised Activity. There are many providers of Pet Insurance, R K Harrison does not offer Pet Insurance but will be able to provide members with details of companies that should be able to help. 4. I keep my horses in stables. Will the Liability cover reach to when my horse is at the stables, being exercised? In this circumstance, cover is only provided if a Countryside Alliance Member is legally riding the horse as this is a Recognised Activity under the terms of the Countryside Alliance Membership Insurance. If the horse is dismounted and it causes damage to property or injury to a third party, the policy will not provide any cover. As stated above, if you own a horse it is strongly recommended that Equine Insurance is arranged as this will provide cover for all activities. 5. Will any other insurance cover me for Liability Insurance if cover does not fall under the Countryside Alliance Membership Policy?

3 It really depends on the circumstances. The Countryside Alliance Public Liability Insurance is only designed to apply where no other more specific insurance is in force. If Pet or Equine Insurance is in place, any liability claim should be directed to that insurance company accordingly. Most members will also have Home Contents Insurance and these policies generally include Personal Liability Insurance for most events including claims arising from pets and shooting related incidents. Again if Home Contents Insurance is in place, a claim should first be referred to that insurer for consideration. If the other policy in force also has a clause relating to any other insurance being in place, the claim will be equally divided. 6. Will the Liability Insurance cover my occupation? No. The Countryside Alliance Membership Insurance does not provide cover for any activity, even if the activity is a Countryside Alliance Recognised Activity, which you rely upon as a main source of income. 7. I sometimes sell the animals I shoot to third parties for personal consumption. Is any cover provided? Cover will be provided if the product is sold to a local shop or an individual as long as such activity is not relied upon as a main source of income. 8. I sometimes take part in activities abroad, am I still covered? Yes, world-wide cover is provided for a Member taking part in a Countryside Alliance Recognised Activity abroad. Members resident abroad are covered whilst participating in a Recognised Activity in the UK and the Republic of Ireland. Please note that there is no cover for shooting in the USA/Canada. 9. Am I covered whilst fishing in a boat? If you are fishing in a boat, the owner of the boat should have separate insurance in force covering any damage to the boat and any liability arising from the boat itself. For instance, colliding with another boat and causing damage. The Countryside Alliance Membership Insurance covers liability arising from the act of fishing itself, not from the ownership or use of any boat. 10. I am involved in coaching others in a Countryside Alliance Recognised Activity. Am I covered? Yes coaching would be classed as participating in the Recognised Activity and so liability arising would be covered as long as the coaching activity is not the members principle occupation and relied upon as a main source of income. 11. Does the Insurance cover loss or damage to my shooting, fishing or other equipment? No. Such equipment can be most appropriately insured under the All Risks section of a Home Contents Policy. For a competitive quotation at your next renewal call If I am out shooting and someone else who is not a member of the Countryside Alliance injures me, where do I stand? Dependent upon the nature of your injury, cover may be provided under the Personal Accident section of this insurance.

4 Otherwise you would need to seek legal advice as to whether you have a reasonable chance of pursuing a claim for your injuries against the individual concerned. If that individual has Home Contents Insurance, then that policy is likely to include personal liability insurance, and the Home Contents Insurer would have to defend their policyholder accordingly, if you pursued a claim. Much safer to ensure that everyone you shoot with is encouraged to join the Countryside Alliance! No. 13. I have damaged a third party s car whilst out riding. Will I have to pay and excess if I am found liable? 14. If I were taking part in an activity on farmland and a third party is injured, and the injured party were to claim against the landowner and our group, who s insurance would the claim fall under? If an injured party chooses to sue a landowner following an incident occurring on their land, caused by a member, it is likely that the landowners insurers would look to defend liability and themselves redirect the plaintiff s claim in the direction of the member s policy. Obviously, we cannot control who the lawyers representing an injured party choose to sue, but they would have to prove negligence against the landowners. In addition, our Indemnity to Principals clause in the policy provides some additional protection for a landowner who finds themselves caught up in an action. 15. I am in a Hunt Group, are we covered for hunting? Cover is only provided for Hunt Groups in the Republic of Ireland. Personal Accident Insurance 1. I have sprained my ankle whilst shooting. Will I be able to claim under the Personal Accident section of the policy? No, as this is classed as a temporary injury from which you should make a full recovery. The Personal Accident Insurance provides cover for accidental bodily injury which results in death, loss of limbs or eyes, permanent disability, burns or facial scaring. 2. How much will I be paid? Please refer to the summary of cover on this web page which will list the benefits payable or telephone to speak to one of our experienced claims advisors. Unfortunately we are unable to offer members the opportunity to increase any of the standard benefits. If you require increased or wider cover, you should contact your usual insurance adviser. 3. How do I claim? Please download a Personal Accident Claim form from this web page or call out claims team to obtain one and return it to us at the address stated upon it. If your claim relates to permanent partial or total disablement, burns or facial scaring your insurers will need to contact your medical advisers so please ensure that the medical consent is completed. 4. I suffer from a disability bit I am still able to take part in country pursuits. Am I still covered for Personal Accident Insurance? As long as you have a doctor s note, stating you are fit to take part, then yes you will still be covered. You will of course be expected to take sensible precautions when taking part in the sport. The policy will exclude a pre-existing condition.

5 5. I am 76. Can I still make a claim under this policy? Unlike many Personal Accident policies, Countryside Alliance has ensured members will be covered under this section until the membership renewal which falls after their 80 th birthday. The only part which you would be unable to claim under would be the permanent total disablement section which has an age limit of 75. Employers Liability Section Definition of Employee: The legal definition of "employee" - a person who entered into a contract of employment. If a direct employee with a contract of employment is injured any claim arising would be an Employers Liability Claim. In the absence of a contract of employment you must be able to answer Yes to the following in order for someone to be classed as an employee. 1. Was the material activity leading to the injury a "recognised activity " as defined by the policy involving a person taking part, assisting, spectating in a recognised activity? 2. Was the injured person working for the policy holder? 3. Was that work being done under the direct control and supervision of the policyholder? Example Question1: I am an individual member and I own a horse, a young girl comes over once a week after school to ride the horse. Would she be classed as an employee and cover under the Employers Liability section, if she had an accident whilst riding the horse, if it s proven the horse or equipment were unsafe. Answer: Cover is only in force whilst the young girl is carrying out the recognised activity of riding the horse. Example Question 2: I am a Gamekeeper who rears pheasants and I have a young lad on work experience carrying out various duties, such a feeding, cleaning etc. Would he be covered under the Employers Liability section. Answer: No. He would only be covered whilst taking part or assisting in the recognised activity, which would be the shoot itself. Note for Group Members For Group members Employers Liability cover should encompass the day to day running of the group. The restriction of an employee only been covered whilst taking part in a recognised activity does not apply.
