GARGOTTA UNITED STATES BANKRUPTCY JUDGE: NOW COMES, INTERNATIONAL BANK OF COMMERCE, ( IBC ) Movant, to file this its Motion to Destroy Books, Records and Documents Belonging to Delta Produce, L.P., Superior Tomato-Avocado, Ltd., Atled, Ltd. and Staci Properties, Ltd. (jointly referred to herein as Debtors ), and would show unto the Court as follows: I. INTRODUCTION 1.1 The Bankruptcy Court has jurisdiction over this proceeding pursuant to 28 U.S.C. 157 and 133 and other applicable sections of the Bankruptcy Code and Amendments. 1.2 IBC is, and has at all times herein mentioned, a federally insured bank duly authorized to transact business in the state of Texas and may be served through counsel of record 1 Debtors are the following entities: Delta Produce, L.P. Case No LMC-11, Superior Tomato-Avocado, Ltd. Case No LMC-11, Atled, Ltd. Case No LMC- 11 and Staci Properties, Ltd. Case No LMC

2 cag Doc#53 Filed 06/10/13 Entered 06/10/13 16:02:21 Main Document Pg 2 of herein. 1.3 On January 3, 2012 (the Petition Date ), the Debtors (with the exception of Staci Properties, Ltd. which filed its Chapter 11 case on January 9, 2012) filed voluntary petitions for relief under Chapter 11 of title 11 of the United States Code, 11 U.S.C (as amended, the Bankruptcy Code ). 1. Pursuant to the provisions of 11 U.S.C. 362(a), the filing of said petition operated as an automatic stay against IBC s rights to proceed against Debtors and/or to enforce its rights under applicable loan documents, including the right to foreclose. Upon IBC s information and belief, Debtors and/or the estate remain in possession of property securing claims owed to IBC. 1.5 IBC filed its Motion for Relief from the Automatic Stay (Doc. No. 357) seeking authority to exercise its rights of foreclosure and otherwise under the laws of the State of Texas and as provided within the IBC loan documents. The Order Granting Motion for Relief from Automatic Stay (the Lift Stay Order Doc. No. 392) on November 5, 2012 terminating the stay, authorizing IBC to take any and all steps under the terms of its loan documents and/or under the laws of the State of Texas to foreclose, offset and/or reposes its collateral. 1.6 On the 3 rd day of December, 2012, IBC foreclosed on the real property consisting of the Meridian property warehouse and otherwise exercise rights under its loan documents with respect to Debtors personal property. Personal property belonging to one or more of the Debtors was stored or contained within the premises of the Meridian property warehouse. That personal property consisted principally of books, records, computers and a variety of stored data/information. 1.7 IBC has located a buyer for the Meridian property warehouse (the Meridian PAGE - 2

The Meridian Buyer did not purchase the personal property, and have requested that the personal property formerly belonging to one or more of the Debtors be removed. 1.8 IBC has communicated with Randy Osherow, Trustee in the above referenced proceeding advising the Meridian Buyer s request for removal of documents and personal property formerly owned by one or more of the Debtors. 1.9 Trustee advises that costs, fees and expenses associated with the removal and storage of the unnecessary documents and data constitute a burden upon the estate. Trustee advises that he has no need for the continued use of the documents and joins with IBC s request that the documents be destroyed. II. ARGUMENTS AND AUTHORITIES 2.1 Bankruptcy Code 55 authorizes the Trustee to abandon any property of the estate that is burdensome to the estate or is of inconsequential value and benefit to the estate following notice and hearing. IBC understands and believes that the personal property is of no benefit to the estate and is inconsequential value. IBC understands that Trustee agrees with IBC acknowledging that the property is of no benefit to the estate and is inconsequential value. IBC and Trustee assert that the costs associated with removal and storage exceed the benefits provided to the estate. PRAYER WHEREFORE, PREMISES CONSIDERED, IBC respectfully requests, upon due consideration, that this Court authorize IBC to remove and destroy any remaining assets of the estate stored within the Meridian property warehouse, and that IBC be provided such other relief at law or in equity to which IBC may be justly entitled.
