Box San Diego, CA /24/2014 RE: Case #: 2011REO468 To whom it may concern, I filed a real estate fraud complaint with the D.A. s Office in November of It was case #: 2011REO468. My complaint was in regards to the City, illegally incorporating our 103 acres on/adjacent Lake Murray ( APN: & ) into a bogus city park and charging the public illegal park usage fees to access our property. The following is the response that I received from Anthony Samson, the attorney that was in charge of investigating my complaint: After reviewing your request for investigation, we have concluded that the facts presented indicate there is no basis for further action at this time. After I received the above response, I called Mr. Samson and asked him how he could come to such a conclusion - after all the evidence supporting fraud, that I had sent him. Mr. Samson s response was, The City is simply playing games with you. Mr. Samson advised me to contact the San Diego Grand Jury and the San Diego City Council- which I did, to no avail. The truth is, that California s largest government fraud scam is taking place right under the D.A. s nose and they don t even realize it. They think it s a game! Using fraudulent deeds (title fraud) fraudulent maps, fraudulent inundation data, lying under oath in open court (perjury) charging the public illegal fees to fish, boat, and golf over someone s private property, under the false guise that it s a city park, is hardly playing games. If anyone would bother to check the facts, they would realize that all 103 acres of our property, on/adjacent to Lake Murray, are zoned A-R-1-10 or Agricultural Residential - 1 house per every

2 10 acres. In order for property to be incorporated into a city park, it must be legally re-zoned to OSP or Open Space Park. A city government can not use smoke and mirror tactics to illegally acquire private property for a city park. A city can not use smoke and mirror tactics to illegally place a lake, in this instance Lake Murray, into their city park and recreational system. There is not one shred of evidence that Lake Murray was ever legally rezoned or legally incorporated into Lake Murray Park or Mission Trails Regional Park. I repeat, it s all smoke and mirrors. This proof was presented to you in 2011, in the copy of my 2006 San Diego Official Zoning Map Challenge - which I presented to the San Diego Development Service Dept. As a side note, Dan Joyce, the Senior Planner at the Development Service Dept., told me that he did not have the authority to remove our property from illegal park status, and that I d have to speak with Lane MacKenzie at the Real Estate Asset Dept., to see if he could remove it. It appears that Lane MacKenzie continues to be the fall guy, because the representatives of the City are too embarrassed to admit the truth and too embarrassed to do anything about it. It s for this reason that I ll continue to expose this government fraud scam in the media and over the internet, until someone looks into it and someone does something about it. So far, every agency in San Diego appears to be passing the buck and turning a blind eye, in the hopes that I ll go away. They call it a civil issue. This is by no means a civil issue. This is an issue of grand larceny, government fraud, perjury, corruption and cover up. If I have to get Fox News to investigate my complaints, then I ll get Fox News involved. Felony crimes committed by city employees ( in their attempt to overturn and hijack a superior court judge s ruling) should not be considered a game. City officials need to stop charging the public illegal park usage fees to access our private property, under the false guise that our property is a legal city park. Note: 1964 was the same year that San Carlos, now Mission Trails Golf Course course opened was the same year they started leasing portions of our property to the golf corporation. Fraudulent Nun Deed - dated September 10,1971, recorded October 26, 1971, as File No Note this 2nd deed was recorded 1 month after the San Diego Superior Court judge affirmed that the city was NOT on title to our property, but rather had an easement agreement to flood portions of it. Note: Resolution No (adopted in 1964) was never rescinded after the 1971 San Diego Superior Court case ended. The Real Estate Asset Dept., continued to illegally lease our property to the golf corporation. It proves that Lake Murray was never proposed for rezoning into the City s park system.
