REGULATION ON REQUIREMENTS FOR CLASS 3 MEDICAL CERTIFICATION OF AIR TRAFFIC CONTROLLERS. Article 1

1 On the basis of the Article 123(2), Article 125(1) of the Air Transport Law ( Official Gazette of SRY, No 12/98,5/99-corrigendum, 38/99, 44/99, 73/00, 70/01 and Official Gazette of the Republic of Serbia, No 101/05), Item14(2) of the Decision on the Establishment of the Civil Aviation Directorate of the State of Serbia and the State of Montenegro ( Official Gazette of the Republic of Serbia No 102/03), Decision on Exercising the Founder s Rights in the Civil Aviation Directorate of the State of Serbia and the State of Montenegro ( Official Gazette of the Republic of Serbia, No53/06) and the Conclusion on changing the title of the Civil Aviation Directorate of the State of Serbia and the State of Montenegro ( Official Gazette of the Republic of Serbia, No 12/07), The Council of the Civil Aviation Directorate of the Republic of Serbia lays down the following REGULATION ON REQUIREMENTS FOR CLASS 3 MEDICAL CERTIFICATION OF AIR TRAFFIC CONTROLLERS Article 1 The following Regulation lays down the requirements to be met by air traffic controllers and student air traffic controllers to be granted, renewed and revalidated medical certificates, requirements and medical examinations, as well as requirements to be met by Aeromedical Centres and Authorized Medical Examiners for granting an aviation medicine certificate and for granting medical certificates. Article 2 The terms used in this Regulation have the following meaning: 1) Air Navigation Service Provider means the Serbia and Montenegro Air Traffic Services Agency, Limited, which is established on the basis of the Agreement of the Government of the Republic of Serbia and the Government of the Republic of Montenegro concluded on 31 October 2003; 2) Aeromedical Centre - (AMC) - a specialized medical institution designated and authorized to carry out clinical aviation medicine and related activities; 3) EUROCONTROL is the European Air Navigation Safety Agency created by the International Convention relating to co-operation for the safety of air navigation, of 13 December 1960 ; 4) Joint Aviation Authorities (JAA) an associated body of the European Civil Aviation Conference (ECAC) representing the Civil Aviation Regulatory Authorities of the ECAC State members; 5) Joint Aviation Requirements - Flight Crew Licencing (JAR FCL 3) - requirements laying down conditions and procedures to obtain, issue, revalidate and renew licences and authorizations of aeroplane and helicopter pilots and flight engineers, as well as the conditions and procedures to grant medical certificates on their medical fitness;

2 6) Licence holder in respect of this Regulation, a student air traffic controller and an air traffic controller quliafied and authorized to exercise the air traffic controller functions in accordance with ratings and rating endorsements and licence endorsements entered on the licence; 7) Class 3 Medical Certificate a medical document which is to confirm the medical fitness of air traffic controllers and student air traffic controllers to exercise the privileges of the licences; 8) Medical examiner acceptable for Aeromedical Section a physician specialist from the list of experts approved by the Civil Aviation Directorate (hereinafter referred to as: Directorate); 9) Renewal the process which takes place whereby a medical examination is carried out following expiry of the current medical certificate. The new medical certificate will be issued with a validity from the date of renewal for the appropriate period; 10) Authorized medical Examiner (AME) A physician appropriately trained and authorized to carry out medical examinations and to issue Class 3 medical certificates; 11) Operational Unit operating environment within Air Traffic Services Agency; 12) Aeromedical Section (AMS) the competent Aeromedical Section of the Directorate responsible to implement and apply aeromedical standards, evaluate and judge medical fitness, and if necessary issue class 3 medical certificates; 13) Revalidation The process whereby a medical examination is carried out within a 45- day period preceding the date of expiry of the current medical certificate, enabling the new certificate to be issued with a validity from the date of expiry for the appropriate period; Article 3 A holder of an air traffic controller licence and a student air traffic controller licence shall be physically and mentally fit for exercising the privileges of his licence and shall hold a valid Class 3 Medical certificate which confirms his medical fitness. Article 4 In respect of requirements to be met by air traffic controllers and student air traffic controllers, for granting, renewing or revalidating Class 3 medical certificates a EUROCONTROL Document Requirements for European Class 3 Medical Certification of Air Traffic Controllers EMCR (ATC) ) shall be applied, given in Annex 1 and Annex 2 to this Regulation. In case of non-compliances or different interpretations of the provisions contained in the Annex 1 and Annex 2 to this Regulation, the text of the original EUROCONTROL document Requirements for European Class 3 Medical Certification of Air Traffic Controllers, in English language issued in 2006 shall prevail. Article 5 The initial medical examination for evaluating the medical fitness of air traffic controllers and student air traffic controllers shall be conducted by Aeromedical Center.

3 Aeromedical Section (AMS) shall be responsible for granting the initial Class 3 Medical certificate. Medical examinations for revalidating or renewing the Class 3 medical certificates shall be carried out by the Aeromedical Center (AMC), or class 1 authorized medical examiner pursuant to JAR-FCL 3 and Class 3 Assessment Qualification Training referred to in paragraph in Annex 1 to this Regulation. Article 6 The class 3 medical certificate issued to air traffic controllers shall be valid from the date of its issuance and for 24 months until the age of 40. The class 3 medical certificate issued to air traffic controllers shall be valid from the date of its issuance and for 12 months above age of 40. The contents and the layout of the class 3 medical certificate form are given in the Appendix 3 to this Regulation. Article 7 Individual licence holders shall be responsible for arranging their own initial and renewal and revalidation medical examinations. The initial medical examination form is published in the Appendix of JAR-FCL 3 and makes an integral part of the medical documentation of the Aeromedical Center. Article 8 The holders of air traffic controller licences and student air traffic controller licences who fail a medical examination shall not provide an air traffic controller service even though the previous medical certificate held may not have expired. The holders of air traffic controller licences and student air traffic controller licences who fail a medical examination or have any medical limitations or conditions placed on the medical certificate, shall notify the Unit management. Any limitations or conditions imposed shall be clearly indicated on the medical certificate to the extent that Unit management can tell from the medical certificate if the air traffic controller or the student air traffic controller concerned is complying with those limitations or conditions. Medical limitations or conditions placed on the medical certificate may involve (see JAR-FCL3 limitations): 1) reduction in the period of the validity of the medical certificate; 2) limitations for exercising specific privileges of the licence; 3) use of glasses or lenses on the operational position; 4) use of mechanical and electro-mechanical aids. Article 9 A holder of an air traffic controller licence or a student air traffic controller licence who have failed a medical examination or who is not satisfied with the medical certificate

4 may demand an examination by the medical commission established by the minister in charge of air transport. Article 10 A licence holder who becomes aware of a decrease in his medical fitness that may render him unable to safely exercise the privileges of his licence shall inform the Unit management. Article 11 The holders of air traffic controller licence or student air traffic controller licence who suffer personal injury or illness involving incapacity to exercise the privileges of their licence must inform the Aeromedical Section (AMS) or or Aeromedical Centre (AMC) of the situation. A woman air traffic controller who has reason to believe that she is pregnant must inform the Aeromedical Section (AMS) or Aeromedical Centre (AMC). In both cases the Aeromedical Section shall consider the suspension or revocation of a medical certificate, if necessary due to medical fitness of a holder. Where the medical certificate is suspended or revoked due to personal injury or illness or other reasons, the designated Aeromedical Section should advise the licence holder of any conditions or procedures for having the suspension or revocation lifted. Article 12 The holders of air traffic controller licence or student air traffic controller licence shall not provide an air traffic control service, while under the influence of psychoactive substances, including any medicine that might have a negative influence on their capacity to provide a safe air traffic control service. The Aeromedical Section should make provisions to enable licence holders to ask for advice and/or provide information in the form of Aeronautical Information Circulars on which prescription or non prescription medicines will, or are likely to, impair their ability to the extent that they should not provide an air traffic control service. Article 13 An Air Traffic Services Agency shall ensure that: 1) Each operational unit has procedures when there is a justified doubt that the air trafffic controller fails to meet the prescribed medical fitness criteria; 2) Procedures are in place for monitoring controllers for psychoactive substances abuse; 3) Procedures are in place to provide the necessary advice to controllers while taking medicines; 4) Procedures are in place when there is decrease in air traffic controller s medical fitness due to personal injury or illness involving incapacity to exercise the privileges of his/her licence or when a woman air traffic controller is pregnant;

5 5) Procedures are in place for advising licence holders when medical certificates are due for renewal and for arranging medical examinations; 6) Procedures are in place for the air traffic controllers to undergo medical examinations prior to being engaged on their duties, at any time during their service and after their duties. Article 14 The Directorate may recognize a valid medical certificate granted by an authorized medical institution abroad or authorized medical examiner, if the conditions under which it is issued are as strict as the conditions laid down by this Regulation. Medical certification summary of minimum periodic requirements, considered as requirements laid down by this Regulation, are contained in Annex 4 to this Regulation. Article 15 Medical certificates granted by the date of the enforcement of this Regulation shall be valid until their expiry date in the licence. Authorizations granted to medical institutions and medical examiners to carry out examinations of air traffic controllers and assistant air traffic controllers pursuant to the Regulations in force up to the enforcement of this Regualtion shall be valid until its expiry dates. Article 16 On the date of the entry into force of this Regulation the provisions of the Regulation on medical requirements for exercising the functions of aviation and other personnel and on specific requirements for medical examinations of aviation and other personnel to be met by medical organizations ( Official Gazette of SFRY No 81/89) shall cease to be valid in the part related to air traffic controllers and assistant air traffic controllers. Article 17 This Regulation shall enter into force on the fifteenth day following the day of its publication in the Official Gazette of the Republic of Serbia.
