9 EXHIBIT "A" SCOPE OF WORK BACKGROUND The Palm Beach County Adult Drug Court program is operational under the management of the Palm Beach County Department of Public Safety, Division of Justice Services and the Fifteenth Judicial Circuit. The program is a cooperative effort between the Board of County Commissioners, Criminal Justice Commission, the Judiciary, State Attorney, Public Defender, Florida Department of Corrections, Palm Beach County Sheriff s Office and contracted community-based service providers (the Consultant). The Palm Beach County Adult Drug Court program is a rehabilitation program designed to identify, case manage, drug test and provide outpatient substance abuse treatment services and inpatient treatment services when necessary, to nonviolent substanceabusing defendants. The goal of the co-occurring track is to provide twenty-five (25) Drug Court participants with co-occurring disorders access to integrated substance abuse and mental health treatment services, increasing the likelihood that they will enter and complete Drug Court at a rate equal to or higher than those solely provided substance abuse treatment. A. Responsibilities of Consultant The Consultant shall provide mental health services to program participants referred by the Drug Court in accordance with and be licensed under Chapter 394, Florida Statutes. B. Staff Responsibilities 1. The Consultant shall identify a Jail Diversion Specialist who will administer an Initial Mental Health Assessment prior to the defendant s First Appearance. 2. The Consultant shall identify a Single Point of Contact staff member. 3. The Consultant shall provide psychiatric evaluations and medication (if needed) within 72 hours of the defendant s Initial Drug Court hearing.
10 C. Treatment Records Progress reports on each participant shall be submitted weekly in a report and/or electronic format acceptable to the Drug Court. D. Weekly Staffing and Court Hearings The Consultant shall send a treatment liaison to the weekly staffings and court hearings of the Drug Court. The liaison shall report information about the participant s progress. The information may include treatment recommendations, missed appointments, and drug test results. The information may also be requested in an electronic format.

( ) This procedure: ( ) Supersedes ( ) Rescinds ( ) Amends SOP#, Dated PURPOSE/SCOPE: Through an Office of Justice Programs federal grant award, the Palm Beach County Drug Court will expand its services to include a track for co-occurring mental health issues. This enhancement grant will provide fifty (50) Drug Court participants with co-occurring disorders access to integrated substance abuse and mental health treatment services concurrently, increasing the likelihood that they will enter and complete Drug Court at a rate equal to or higher than those solely provided substance abuse treatment. The following six (6) goals will assist us in this endeavor. PROCEDURES: Goal #1: Involve key stakeholders and other potential sources of subject matter and funding expertise in expansion and implementation planning activities to increase the number of court-based diversion programs. Goal #2: Provide consultation and training for Drug Court Team Members specifically related to cooccurring disorders, treatment practices, incentives and sanctions and support services. Goal #3: Identify and divert Drug Court Co-occurring Track eligible offenders as early as possible and provide participants with co-occurring disorders access to collaborative substance abuse and mental health treatment services. Goal #4: Increase the quantity and quality of mental health and other services available to mentally ill offenders. Goal #5: Increase the Drug Court completion rate for participants with co-occurring disorders. Goal #6: Reduce recidivism of the mentally ill in the criminal justice system.

Makes the determination if screening criteria is to be waived. Refers candidates to a Drug Court Specialist for scheduling of the Drug Court Initial Hearing. Attends all Drug Court staffings. Appears in court to represent the State at all Drug Court hearings. Files necessary legal documents. Participates in a coordinated strategy for responding to positive drug tests and other instances of non-compliance. PROCEDURES: The Assistant Public Defender has the following responsibilities: Participates in the assessment of candidates for eligibility at First Appearance. Attends all Drug Court staffings. Represents defendants at all Drug Court hearings.files necessary legal documents. Participates in a coordinated strategy for responding to positive drug tests and other instances of non-compliance. Reviews arrest warrant, affidavits, charging document, and other relevant information, and reviews all program documents (e.g. waivers, written agreements). Fully advises the defendant as to the nature and purpose of the Drug Court, the rules governing participation, the consequences of abiding or failing to abide by the rules, and how participating or not participating in the Drug Court will affect his or her interests. Explains all of the rights that the defendant will temporarily or permanently relinquish. Gives advice on alternative courses of action, including legal and treatment alternatives available outside the Drug Court program, and discusses the long-term benefits of sobriety and a drug-free life.
25 STANDARD OPERATING PROCEDURE # A02i DATED 10/01/09 PAGE 2 Explains that because criminal prosecution for admitting to alcohol or drug use in open court will not be invoked, the defendant is encouraged to be truthful with the judge and treatment staff. Informs the participant that he or she will be expected to speak directly to the judge, not through an attorney, unless a specific legal issue arises that requires attorney intervention. Is a Drug Court Team member.

PROCEDURES: The Palm Beach County Drug Court Coordinator has the following responsibilities: Coordinates activities and communicates to all Drug Court Team members and ancillary social service agencies. Attends trainings specifically related to co-occurring disorders, treatment practices, incentives and sanctions and support services. Visits neighboring counties to observe how defendants with co-occurring disorders are managed in various other Drug Courts. Prepares and assists with contracts for professional services (treatment, mental health services and drug testing). Maintains Drug Court budget and approves Drug Court budget expenditures. Writes and updates Co-occurring Track Standard Operating Procedures. Is responsible for data collection for purposes of program evaluation. Data will include but is not limited to the number of individuals participating, successful completions, number of technical violations of supervision, terminations, days spent in jail, and participants and/or graduates who have committed new crimes. Is a Drug Court Team member.

( ) This procedure: ( ) Supersedes ( ) Rescinds ( ) Amends SOP#, Dated PURPOSE/SCOPE: This procedure explains the role of the Treatment Provider, Counseling Services of Lake Worth, relative to the Drug Court Co-occurring Track. PROCEDURES: The Treatment Provider has the following responsibilities: Coordinates through the Drug Court Program office. Develops an individual treatment plan for each program participant, and updates the treatment plan at least once a month. The treatment plan will contain goals and measurable objectives to address the needs identified in the participant s clinical assessment. Conducts group and individual counseling sessions, providing co-occurring treatment based on SAMHSA s Co-occurring Disorders: Integrated Dual Diagnosis Treatment Evidence-Based Practices Program. Submits participant progress reports weekly in a written and/or electronic format. Coordinates with ancillary social service agencies, recording referrals made to agencies on the corresponding participant s progress report. Signs off on Phase Advancement Tracking Sheets, allowing for the advancement of the participant through Drug Court program phases. Complies with all articles and responsibilities contained within the Palm Beach County Board of County Commissioners Contract for Consulting/Professional Services, including section Exhibit A and B.

PROCEDURES: The DOC Probation Supervision Officers have the following responsibilities: Coordinate through Drug Court Coordinator. Are responsible for reviewing Drug Court Participant Agreements with applicants during or after court hearings and for obtaining their signatures for entrance into program. ( ) This procedure: ( ) Supersedes ( ) Rescinds ( ) Amends SOP#, Dated PURPOSE/SCOPE: All eligible defendants who are booked into the Palm Beach County Jail on qualifying charges, who would benefit from a Drug Court program, and who are unable to bond out of jail will be interviewed by the Drug Court Program Specialist prior to First Appearance, thus allowing eligible participants to be identified early and placed into the Drug Court Co-occurring Track. PROCEDURES: Screening/interviewing for eligible defendants will take place prior to First Appearance, Monday through Friday, beginning at 9:00 a.m. in Courtroom #1 of the Gun Club Criminal Justice Complex. Defendants interviewed by the Drug Court Program Specialist shall be those meeting the eligibility criteria outlined in S.O.P. B05. Defendants will be given the Brief Jail Mental Health Screen and, if indicated, will be referred to the Jail Diversion Specialist who will administer an Initial Mental Health Assessment to determine if the defendant meets the criteria for the Cooccurring Track. If after an explanation of the Drug Court Program is given, the defendant is not interested in the program, or if newly-discovered information disqualifies the defendant, he/she will remain set for a traditional First Appearance Hearing. If the defendant is interested and qualified, he/she shall be given an Initial Orientation packet, which contains instructions for completing four (4) AA/NA meetings, locations of meetings, proof of attendance sheets and information pertaining to his/her appointment at the South County Mental Health Center for a psychological evaluation. Defendants appearing at the Drug Court Co-occurring Track Initial Hearing shall be those meeting the eligibility criteria outlined in S.O.P. B05. The Drug Court Initial Hearing defendants cases should be called at the conclusion of the cases of those in attendance for Status Hearings in order to give the Initial Hearing participants the opportunity to observe how Drug Court Co-occurring Track works. The Drug Court Initial Hearing defendants cases should be called at the conclusion of the cases of those in attendance for Status Hearings so that the applicants who have been referred from Arraignment or from other Court Divisions can receive a Comprehensive Assessment to address treatment needs and determine if they are appropriate for the Drug Court Co-occurring Track. If it is discovered at the Drug Court Co-occurring Track Initial Hearing that the defendant is not interested in the program, or if newly-discovered information disqualifies the defendant, then he/she will be set for a plea conference.

The following outline offers an illustration of a typical Status Hearing: 1) Prior to the participant s case being called, the participant will report to the Drug Court Program office to: a) provide a Drug Court Program staff member with a recent NA/AA Proof of Attendance Form and a payment toward program fees, and b) meet with the assigned Case Manager and discuss any problems or needs he/she may have. 2) The participant will be greeted by the Drug Court Team and discuss his/her progress or lack thereof in the program. 3) The following information is reported during the Status Hearing: a) Treatment providers will report on the participant s counseling and individual progress.

Probation Officer will report on supervision status, including monthly reporting and employment. 4) When the participant is progressing in a satisfactory manner, the entire Drug Court Team will offer encouragement and incentives. 5) When the participant is not progressing satisfactorily or, when sanctions are warranted, the Drug Court Table of Sanctions (SOP D02) will be utilized to apply sanctions in a fair and consistent manner. 6) Regardless of whether or not the participant is showing progress, prior to being dismissed from court, he/she will be treated in a manner designed to encourage success. The Drug Court Co-occurring Track Status Hearing will also be the venue in which phase advancement will take place. This will be accomplished by the participant submitting a completed Phase Advancement Tracking Sheet.

Eligible participants will be scheduled for graduation after successfully completing a minimum of one year in the program. Exceptions to the one year minimum will be made for those who signed a contract on the first through the tenth (10) day of the month and would otherwise have to remain in the program an additional month while waiting for a graduation date. The case(s) of the graduate(s) will be called at the beginning of the docket so that recognition can be given by as many individuals in attendance as possible. The graduate(s) will receive a Certificate of Achievement by the Drug Court Judge. The Certificate of Achievement will be completed by the Drug Court Program Office and signed by the Drug Court Judge, Assistant State Attorney, Assistant Public Defender, Drug Court Coordinator, Supervising D.O.C. Officer, and Assessor. The Drug Court Program Office will complete an information sheet on each graduate s individual accomplishments while in the Drug Court program, which will be read during the graduation ceremony. PROCEDURES: Each program participant will be informed at orientation that he/she is required to call the random urinalysis voice mail system Monday through Friday. On a monthly basis, the Drug Court Program Secretary or designee will select a team color for each Monday through Friday of the month, to be used to determine which group (or team ) of participants must report for urinalysis on a particular day. Phase I (green team) and Phase II (white team) will be tested a minimum of twice weekly, Phase III (red team) will be tested a minimum of once per week, and Phase IV (blue team) will be tested randomly. This is the ongoing treatment/relapse prevention phase, which lasts a minimum of 16 weeks; includes updating and identifying treatment goals and objectives, focusing on relapse prevention issues and coping skills, random urinalysis, regular attendance at 12-step meetings (at least two per week), two group counseling sessions per week, one individual counseling session per month, monthly reporting to DOC Probation Officer, ongoing medication management and frequent court hearings with the Judge. Once these participants are discharged from participation in the halfway house component of treatment, either successfully or unsuccessfully, they must report in person to their Drug Court Status Hearing and all subsequent hearings, if applicable. This exception does not apply to those participants who are living at a halfway house that is not under the Florida Department of Corrections supervision. The Department of Corrections Probation Officer and/or CARP Treatment Liaison will be responsible for reporting on the status of each participant while in CARP s residential and/or halfway house treatment, during the Drug Court Co-occurring Track Staffing and Treatment Status Hearing.

WITNESSETH: I have a substance abuse problem and would like to benefit from the strict requirements of the Palm Beach County Drug Court Program. I hereby agree to enter and successfully complete the Drug Court Program including evaluation, counseling, random urinalyses, attendance at 12-Step Meetings such as Narcotics Anonymous or Alcoholics Anonymous, scheduled court appearances and other treatment considered necessary. I agree that while I am a participant in the Drug Court Program, I waive (i.e., give up) my right to a speedy trial. I understand that if I enter the Drug Court Program, but later decide that I do not wish to remain in the program, that I may choose to opt out. A comprehensive substance abuse assessment will be conducted to determine whether my participation in the Palm Beach County Drug Court Program is appropriate. I will cooperate fully with the substance abuse evaluator, and answer all questions honestly and to the best of my ability. 3. I will fully cooperate in the completion of all background checks that will be conducted to determine if my participation in the Drug Court Program is appropriate. 4. I affirm that I have never been found guilty nor had adjudication withheld for any violent felony offense anywhere. 5. I will appear at all Drug Court Hearings, when and as ordered by the court. I understand that failure to appear in court shall constitute a violation of the terms of this agreement, and I acknowledge that failure to appear may result in my being withdrawn from the program and the original prosecution may resume. If I fail to appear for a hearing, the Judge will order a warrant for my arrest. I will contact the Drug Court Program office and/or my attorney immediately for instructions. 6. I will report to the substance abuse treatment provider as instructed which will be as soon as possible after placement into the program. Treatment will continue for one year but may be extended if considered necessary by the Drug Court Judge. 7. I agree to fully participate in the substance abuse treatment that will be delivered in the following four Drug Court Program phases. I also understand that advancement to a higher phase will be conditional upon final approval of the Drug Court Judge. I understand that Probation Officers employed by the Florida Department of Corrections (DOC) will conduct supervisory contacts concerning me. These contacts may occur at my home, the treatment center, the courthouse, probation office, or anywhere considered necessary. I will report when and where as directed by my Probation Officer. PROCEDURES: Pursuant to the Palm Beach County Drug Court Agreement Participation Application and Disclosure, which is signed by the Participant at the time of entering the Drug Court Program, any overnight travel to destinations outside of Palm Beach County on Monday through Friday must be approved by the Drug Court Team. The Participant must secure an approved, signed Participant Travel Permit for traveling overnight outside of Palm Beach County on Monday through Friday. Travel permits will be approved on a limited basis, as the Drug Court Team does not endorse interruptions in the participant s treatment and/or drug testing. The need for travel must be verified by an independent source, whose name and phone number is provided to the Drug Court office staff for verification. No travel permits will be approved if the participant has any positive drug test(s), dilute(s) or no show(s) for drug tests that haven t been discussed with the Drug Court Team in court or within the prior thirty (30) days of requesting the permit. Participants with approved, signed Travel Permits must report for a drug test prior to leaving and immediately upon their return. Participant must provide proof of travel upon return, such as plane ticket, hotel bill or gasoline receipts. Travel for business/work purposes: Participants must submit a letter on employer s letterhead stationary written by the employer explaining the reason for out-of-town travel. If participant is self-employed, he/she must submit proof of out-of-town employment, such as a signed contract to provide services. Participants who are terminated at the discretion of the Drug Court Judge will be given an arraignment date within two (2) weeks of termination and under no circumstances will be allowed to re-enter the Drug Court Program. Participants who personally opt out of the Drug Court program will be given an arraignment date within two (2) weeks of termination. At the time of such arraignment, should the participant wish to re-enter the Drug Court program, his/her case may be set on a regularly scheduled Drug Court hearing date to be staffed by the Drug Court Team for possible re-entry into the program.
