8 Preface The United Nations primarily through its agency UNCITRAL (United Nations Commission on International Trade Law) are eagerly productive in creating instruments which regulate international business law. So is UNIDROIT, the International Institute for the Unification of Private Law in Rome. The goal of these activities is the worldwide harmonisation of this branch of law. And in fact, a considerable unification of international trade law has been already achieved. In practice, for international commerce, for business circles, for international merchants the regulations which have been passed by the two organisations play an increasingly important role. One has only to mention the New York Convention of 1958 or the CISG. However, despite the evident relevance of this legislative work a practical collection of all instruments of the two organisations had still been missing. It is the purpose of this book to provide the reader with one single source which contains all relevant material. In the early days before and shortly after UNCITRAL had been founded in 1966 international instruments used to take the form of an international convention. Since about two decades also softer forms of international legislation have been adopted like principles, model acts or guides which provide recommendations for national legislators. This collection therefore contains 24 conventions, model acts and guides concerning the field of international business law. Even the most recent drafts are included. The instruments are put in a systematic order with contract law in general at the beginning, followed by regulations for specific contracts and property rights and finally with arbitration and insolvency law also addressing important procedural aspects. The international dissemination of the conventions and model acts varies considerably from instrument to instrument. Therefore the state of ratifications is recorded with respect to UNCITRAL and UNIDROIT conventions.
