Regional Legal Service Office Southwest (RLSO SW) oversees the military naturalization program in the Navy Region Southwest (NRSW) and provides naturalization assistance to service members by assisting with the application process. After a naturalization applicant submits a naturalization application to U.S. Citizenship and Immigration Services (USCIS), the applicant must attend a naturalization interview and oath ceremony to become a U.S. citizen. Military naturalization oath ceremonies are scheduled, onboard USS MIDWAY Museum, on 3 July and 13 November of this year. A service member whose naturalization application is currently pending with USCIS, and desires a naturalization oath ceremony in the San Diego area, may request inclusion in the military naturalization ceremony on 3 July If a service member submits a naturalization application to USCIS before 1 June 2013, the service member may be scheduled to attend the naturalization ceremony on 13 November For further information on attending a military naturalization oath ceremony or applying for naturalization, please call (619) Officer Board of Inquiry Results 2nd Quarter 2013 Enlisted Administrative Board Results 2nd Quarter 2013 Victim and Witness Assistance Program Waterfront Training Outreach Family Immigration Assistance FAMILY IMMIGRATION ASSISTANCE Region Legal Service Office Southwest (RLSO SW), Command Services Department, Immigration and Naturalization Division, provides family immigration assistance at Naval Base San Diego, Building 56. Family immigration assistance is provided on routine family immigration matters, and, when necessary referrals are provided to U.S. Citizenship and Immigration Services or the American Immigration Lawyers Association (AILA). Family immigration assistance is provided on Thursdays from , by appointment only. Appointments may be scheduled by calling (619) , during normal business hours. Staff Judge Advocate Directory
2 Page 2 of 6 COMMAND REPRESENTATIVES TRAINING VIA DCO Command Representatives Training Via DCO Per NAVADMIN 113/08, commanding officers must appoint a CCR to assist non-citizen service members with applying for naturalization. CCR s must be trained. The next training class for Command Citizenship Representatives will be Wednesday July 10 at 0900 and Thursday, 16 October at To schedule training, for further information on becoming a Command Citizenship representative, or applying for U.S. citizenship, please call the RLSO SW Naturalization Team at (619) PERSONAL FIREARMS Personal Firearms Congress recently passed the NDAA for 2013, which included a section on firearms. Specifically, section 1057 states in part that a health care professional who is a member of the Armed Forces, or, a commanding officer, who has reasonable grounds to believe that a service member or DoD employee is a risk for suicide or causing harm to others may inquire with such members as to whether they plan to acquire and/or already possess a privately owned firearm, ammunition, or other weapon. This authority existed prior to passage of the 2013 NDAA. However, Congress memorialized this authority explicitly into law. LEGAL ASSISTANCE DEPARTMENT SERVICES The Legal Assistance Department onboard Naval Base San Diego and Naval Air Station North Island now uses an appointment based system. This will provide for greater planning and flexibility for customers, as well as reduced wait times to meet with our attorneys. NON-FEDERAL ENTITIES ONBOARD NAVY INSTALLATIONS As per CNIC INSTRUCTION , a Non-federal entity (NFEs) is a self-sustaining organization that is not an official component of the Federal government. An NFE may be incorporated or unincorporated. Examples of NFEs include officer wardroom, CPO mess, Petty Officer associations, spouse clubs, the United Service Organization, fraternal organizations, colleges, school districts, and businesses. NFEs may conduct activities on Navy installations only with written approval of the Installation Commanding Officer (CO) and only when their activities are consistent with good order and discipline and enhance the quality of life on the base. Non-Federal Entities Onboard Naval Installations NFEs shall be financially self-sustaining. Neither Department of Defense (DoD) components nor non-appropriated fund (NAF) instrumentalities may provide financial assistance to NFEs. Any logistical support provided by a Navy installation to an NFE may not hinder any Navy or DoD command s military mission or detract from readiness. Installation COs are authorized to deny or revoke an NFE s permission to operate on the base when the organization fails to comply with this instruction. No NFE may receive preferential treatment. Certain NFEs, however, have authorization for unique support. These include groups such as the USO, the American National Red Cross, certain banks and credit unions, labor organizations, and certain youth organizations. CNIC INSTRUCTION provides a list of these organizations, as well as the statutory basis for their support. RESULTS OF TRIAL 2ND QUARTER 2013 Navy E-5 with 8 years and 8 months of service, sentenced to a Bad Conduct Discharge, confinement for 9 months, and reduction in rank to E-1 for unauthorized absence, wrongful use of a schedule II substance and larceny of a value over $ This court was held on January 8, Navy E-6 with 19 years and 1 month of service, sentenced to confinement for 75 days, forfeitures of $1,007 for 1 month, and reduction in rank to E-3 for larceny, false official statement and conspiracy. This court was held on January 9, Navy E-8 with 25 years and 1 months of service, sentenced to 89 days confinement and reduction in rank to E-6 for creating an intimidating hostile, or offensive working environment by making unwanted sexual advances, violating a lawful general order, false official statement and obstructing justice. This court was held on January 11, Results of Trial 2nd Quarter 2013 Navy E-6 with 22 years of service, sentenced to a Dishonorable Discharge and 18 months confinement for possession of child pornography. This court was held on January 18, Navy E-3 with 4 years and 6 months of service, sentenced to a Dishonorable Discharge, confinement for 140 months, and reduction of rank to E-1 for sexual assault on a minor, larceny and sodomy on a minor. This court was held on March 7, 2013.
5 Page 5 of 6 Navy E-1 with 1 year and 8 months of service, sentenced to 330 days of confinement and forfeitures of $ per month for 12 months for failing to go to appointed place of duty, unauthorized absence, wrongful use of a schedule I substance, and wrongful introduction of a schedule I substance onto an armed forces installation. This court was held on March 11, Navy E-5 with 9 years and 3 months of service, sentenced to forfeitures of $ per month for 1 month for dereliction of duty. This court was held on March 13, Officer Board of Inquiry Results 2nd Quarter 2013 OFFICER BOARD OF INQUIRY RESULTS 2ND QUARTER 2013 Navy O-4 was ordered to show cause for retention due to substandard performance of duty: failure to maintain adequate levels of performance as evidenced by the failure to conform to prescribed standards of dress, weight, personal appearance or military deportment. Board members recommended separation with a Honorable discharge characterization. This Board of Inquiry was held on 14 February Navy O-5 was ordered to show cause for retention due to substandard performance of duty: failure to show, over an extended period of time, a loss in confidence and the ability to command. Board members recommended retention. This Board of Inquiry was held on 19 February Enlisted Administrative Board Results 2nd Quarter 2013 ENLISTED ADMINISTRATIVE BOARD RESULTS 2ND QUARTER 2013 Navy E-6 was processed for Separation by Reason of Unsatisfactory Performance - Loss of Security Clearance. The board found no misconduct. This board was held on 19 March VICTIM AND WITNESS ASSISTANCE PROGRAM The Victim and Witness Assistance Program is designed to ensure victims and witnesses of crime are afforded their rights throughout the criminal justice process from initial contact by investigators through any period of confinement adjudged. The Department of Defense requires their services to establish comprehensive Victim and Witness Assistance Programs in order to enhance and protect the rights of victims of crimes committed within the military setting. OPNAVINST A requires every command to appoint a Victim Witness Assistance Coordinator (VWAC) in writing and ensure command personnel are educated on the rights of crime victims and witnesses. Please note that the VWAP program is a separate program from SAPR and FAP, with distinct requirements. RLSO SW provides quarterly training for new VWACs.
