5 In re: Garlock Sealing Technologies LLC, et al., 504 B.R. 71 (W.D.N.C. Bankr. 2014) Gasket and sealing company forced into bankruptcy in 2011 by crush of tens of thousands of asbestos claims with more to come. Purpose of bankruptcy is to determine Garlock s current and future liability to claimants in order to establish and fund an asbestos claims trust, thereby channeling all current and future claims to the trust and allowing Garlock to emerge and continue normal operations.
6 Estimation Trial: July-August, 2013 Honorable George R. Hodges presiding Question for Judge Hodges: How Much? Must estimate Garlock s liability to current and future asbestos claimants to assist in determining how much money should fund the asbestos claimants trust.
7 Billion Dollar Fight Over How Much Garlock: $125 Million Asbestos Claimants: $1.3 Billion
8 The way it s been v. The way it should be Asbestos Claimants: use the same estimation method as most of the prior 30 bankruptcies extrapolate from debtors settlement history and multiply from there. Garlock: use a method actually based on legal liability in the tort system.
9 Leg #1 for Garlock: gaskets cause disease is like saying: one who pours a bucket of water into the ocean has substantially contributed to the ocean s volume. Moeller v. Garlock Sealing Techs., LLC, 660 F.3d 950, (6th Cir. 2011).
10 Leg #2: Legal liability determines the trust funding, not settlement history Settlement admission of liability Dr. Charles Bates (Bates White) constructed an econometric and economic model using Garlock s claims database, claimant questionnaires, historical asbestos litigation outcomes, and other factors to determine a range of liability Garlock reasonably would experience in the tort system if all current and future claims were litigated.
11 Leg #3: Garlock s settlement history is an improper basis for estimation The way it has always been done is not an adequate argument. Extrapolating Garlock s last five years of settlement amounts is unscientific and unreliable. Garlock s settlement history is infected with plaintiffs intentional concealment of dozens of exposures to actually dangerous products.
12 Defendants obstructed from $30 Billion Bankruptcy Trust System By the mid-2000 s, almost all of the dangerous product manufacturers had entered the bankruptcy system, leaving the non-dangerous product manufacturers (like Garlock) alone in the tort system to face the well-funded plaintiffs bar. While those two systems bankruptcy and tort should have been structured to work together, the opposite happened. A wall was constructed by the claimants attorneys who typically administered the asbestos trusts to shield the tort system defendants from seeing who was making claims for payment from the 30+ asbestos trusts.
13 Tort Plaintiffs Hide Their Other Exposures For the five years pre-bankruptcy: Garlock sat alone at the defense table, whereas before the bankruptcy wave, they had a small seat behind dozens of dangerous product defendants. Now, plaintiffs only remember Garlock products in their exposure testimony, whereas before plaintiffs zealously presented evidence of dozens of dangerous product exposures. Garlock s payments skyrocket.

16 Garlock Goes After Trust Claims Discovery and Uncovers Concealment During estimation discovery, Garlock fought through the plaintiffs attorneys multiple obstructions to obtain trust claims data for as many former plaintiffs as allowed by the Court. Discovery revealed that, on average, while prosecuting lawsuits against Garlock, Plaintiffs did not disclose their claims against NINETEEN asbestos bankruptcy trusts, only disclosing TWO claims.
17 What Happened? The Decision This matter is before the court after a hearing to determine the reasonable and reliable estimate of Garlock Sealing Technologies, LLC s liability for present and future mesothelioma claims. The court has concluded that the amount sufficient to satisfy that obligation is $125 million. (In re: Garlock, 504 B.R. 71, 72 (W.D.N.C. Bankr. 2014)
18 Judge Hodges Calls Out Plaintiffs Lack of Disclosure in the Tort System evidence of exposure disappeared effort of some plaintiffs and their lawyers to withhold evidence of exposure some perverted ethical duty Garlock demonstrated that exposure evidence was withheld in each and every one of them. (emphasis not added) each and every one of them contains demonstrable misrepresentation (emphasis not added) It appears certain that more extensive discovery would show more extensive abuse. Id. at

Hodges: Plaintiffs Concealment in Tort System Guts Settlement Approach The court has concluded that it cannot adopt the settlement approach. the settlement history data does not accurately reflect fair settlements because exposure evidence was withheld. While that practice was not uniform, it was widespread and significant enough to infect fatally the settlement process and historic data. It has rendered that data useless for fairly estimating Garlock's liability to present and future claimants. Id. at 94.
