1 BUILDING PERMIT APPLICATION GUIDE Issued: February 06 Revised: N/A Page of A building permit is required in the Town of Milton to build a freestanding deck greater than 0 m (08 ft ) or any deck attached to a building. If you are unfamiliar with of the Town of Milton s permit application process/requirements please consult our website at or contact the Planning and Development Department - Building Division at (905) ext. 97. This guide explains the requirements for submitting a building permit application for a Deck in greater detail. Zoning Requirements: Under the Zoning By-law, the location of a deck (and any required stairs) on a property is regulated based on the property zoning and the height of the deck above grade. In addition, the installation of privacy screening on a deck is limited to maximum height of.5 m (4 - ) and the combined length of the privacy screen and house wall (adjacent to the deck) cannot exceed 60% of the entire deck perimeter. General Zoning By-law requirements for your property can be obtained by contacting the Zoning Department at (905) ext. 9 or by checking online at: Engineering Requirements: If your subdivision has not been assumed by the Town you will require a developer s clearance letter from the Builder to build your deck. To find out if your subdivision is assumed please contact Engineering Services at (905) ext. 500 Building Permit Application Requirements: Building permit applications are broken down into major requirements; Permit Application Forms Construction Drawings Complete building permit applications are accepted in person on the nd floor of Town Hall at 50 Mary St. The cost of the building permit and required permit application forms can be found on the Town s website at: Building permit fees are payable by cash, cheque or debit at the time of application. Building permit fees include the review of drawings and all required inspections. Permit Application Forms ) Application for a Permit to Construct or Demolish All sections of the form must be completed, including the full legal description (which can be found on your deed, tax assessment, survey, or is available from the public computer kiosk located on the main floor of Town Hall next to the Reception area). ) Schedule Designer Form This form is required when someone other than an Architect or Licensed Professional Engineer is taking responsibility for the design of the Deck. This person would be either: o the homeowner taking legal responsibility for the design, provided they understand and are willing to take responsibility for the applicable requirements of the Ontario Building Code, or o a registered designer with a Building Code Identification Number (BCIN) qualified in House or Small Buildings Milton Town Hall 50 Mary Street, Milton ON L9T 6Z5 P. 2 Construction Drawings BUILDING PERMIT APPLICATION GUIDE Issued: February 06 Revised: N/A Page of All drawings must be submitted in black and white, drawn to an appropriate scale (min /6 = or metric equivalent), and clearly legible. Drawings in pencil shall be photocopied prior to submission, with the density adjusted so that all information is clear and legible. Every page of the drawings shall include the project address and the following designer information: Homeowner design Qualified BCIN design Architect or Professionally Engineered design - printed name of homeowner, signature and date - printed name, individual/firm (if applicable) BCIN numbers, signature and date - Architect s or Professional Engineer s seal with a signature and date The following construction drawings are required for a Deck: ) Site Plan (Sample D-) ) Deck Structural/Floor Layout (Sample D-) ) Deck Section & Details (Sample ) Refer to the enclosed sample drawings for specific drawing requirements, including the number of copies of each drawing required. Sample includes acceptable deck footings options as well as tables for sizing footings, joists and beams. Where steel helical pier/piles are used additional drawings and documentation is required (see Sample ). Deck design printouts from large box stores are not acceptable construction drawings, and must be redrawn to meet the requirements shown in the sample deck construction drawings. If any proposed guard components (post, top/bottom rail, baluster, etc.) are not wood, the drawings must include connection/construction details stamped by a Professional Engineer Licensed to practice in Ontario. These details are typically available from supplier or manufacturer s websites. In addition, any privacy screen (wood or other material) that also serves as guard must be designed by a Professional Engineer.
