4 Why revise??? Technical, legal and administrative problems; The need for a simple, understandable, effective and enforceable regulatory environment; The WEEE Directive had foreseen a general revision including: - new collection targets foreseen by Directive, - new recovery/recycling targets, - possible inclusion of reuse of whole appliances - targets for medical devices; Reduced administrative costs without lowering the level of environmental protection.

5 Scope of WEEE Recast CLOSED SCOPE OPEN SCOPE To cover all EEE, including photovoltaic panels, from SPECIFIC EXEMPTIONS To improve collection, re-use and recycling of EEE; To limit illegal exports of such waste from the EU; To improve the environmental performance of all operators involved in the life cycle producers, distributors & consumers.

6 Change in provisions Categories Current categories Large household appliances; 2. Small household appliances; 3. IT & telecommunications equipment; 4. Consumer equipment & photovoltaic panels; 5. Lighting equipment; 6. Electrical & electronic tools (with the exception of large-scale stationary industrial tools); 7. Toys, leisure & Sports equipment; 8. Medical devices (with the exception of all implanted & infected products); 9. Monitoring & control instruments; 10. Automatic dispensers. 6 YEARS TRANSITIONAL PERIOD Categories of EEE covered by this Directive 1. Temperature & exchange equipment; 2. Screens, monitors, & equipment containing screens having a greater surface than 100cm 2 ; 3. Lamps; onwards 4. Large equipment (any external dimension more than 50cm); 5. Small equipment (no external dimension more than 50cm); 6. Small IT & telecommunication equipment (no external dimension more than 50cm). Medical devices are now not in a separate category

7 Change in provisions take-back obligation MS must continue to ensure that take-back schemes are in place enabling final users and distributors to return WEEE free of charge to readily available and accessible collection facilities. Existing distributor take-back provision will remain (like with like) change Retailers having a sales space of or exceeding 400m 2 will be required to offer take-back of very small EEE free of charge with no obligation to purchase new EEE (dimension not exceeding 25cm) Producers may also set up & operate individual and/or collective take-back schemes for WEEE from private households.

8 Change in provisions - collection targets MS must collect: 4kgs on average per inhabitant per year of WEEE from private households SEPARATE COLLECTION 4 years after entrance into force, 45% of the average weight of EEE placed on the national markets TRANSITIONAL PERIOD years later, 65% of the average weight of EEE placed on the national markets* Some EU MS including Malta may postpone the achievement of these targets: By 14 August 2016 a minimum of 40% & maximum of 45%; By 14 August 2021 at the latest 65%. *or 85% of WEEE generated on the territory of that MS. Further studies will then be carried out on the possibility of revising the targets.

9 Change in provisions recovery/recycling RECYCLING & RECOVERY TARGETS FOR SEPARATELY COLLECTED WEEE For 3 years they will remain similar to the current directive TRANSITIONAL PERIOD Targets will then increase by 5% (with the exception of gas discharge lamps) From Similar targets based on new categorisation Commission will then report on the potential for separate reuse targets 4 years after the Directive came into force.

10 New provisions Illegal shipments Tools to fight illegal export of waste more effectively have been introduced Minimum requirements for shipments WEEE vs. Used EEE Illegal shipments of WEEE Legal shipments of used EEE to circumvent EU waste treatment rules Exporters are now required to test and provide documents on the nature of their shipments.

11 Improvement Registration & reporting Harmonisation of national registration and reporting requirements: MS registers for producers of EEE will now have to be integrated more closely each MS should provide links to other national registers on their webpage; Harmonised format for the supply of information; A significant decrease of administrative burdens.

12 New requirement Authorised representative Producers are allowed to appoint an Authorised representative to fulfill their obligations in each MS. Each MS must ensure producers in their territory selling to another MS appoint an authorised representative in that state to ensure their obligations are fulfilled.

13 Some other existing provisions still present Requirement to provide a guarantee when placing products on the market financing WEEE obligations; Producers are to set up and operate either individually or collectively, systems for fulfilling WEEE obligations; MS may require producers to show purchasers the costs of waste management separately; Provision of information on: a) the return and collection systems available to consumers, b) the potential environmental and health effects of hazardous substances in EEE, c) the meaning of the crossed-out wheelie bin symbol.

14 Summary Obligations on the Commission Scope Review of scope, including parameters, & presentation of a report to EP & Council + legislative proposal if appropriate. Collection rate By a report shall be presented to EP & Council on the re-examination of deadlines relating to collection rates & on possibly setting individual collection rates for one or more categories + legislative proposal if appropriate; Impact study, & if it is considered that the collection rate based on WEEE generated requires revision, a legislative proposal shall be submitted to EP & Council.

15 Summary Obligations on the Commission Proper treatment Evaluate whether certain entries need to be amended; By not later than a request shall be made to the European standardisation organisations to develop European standards for treatment, including recovery, recycling and preparation for re-use, of WEEE, reflecting state of art. Implementing acts may then be adopted laying down minimum quality standards based on these developed standards.

16 Summary Obligations on the Commission Recovery targets On the basis of a report, and if appropriate a legislative proposal, the EP & Council shall by re-examine the recovery targets, examine the possibility of setting separate targets for WEEE to be prepared for re-use & re-examine the calculation method to analyse the feasibility of setting targets on the basis of products & materials resulting from recovery, recycling & preparation for re-use processes.

17 Summary Obligations on the Commission Financing in respect of WEEE from private households By may report on the possibility of developing criteria to incorporate the real end-of life costs into the financing of WEEE by producers, & submit a legislative proposal to the EP & Council if appropriate. Registration, information & reporting Reports on the implementation of this Directive shall be published.

18 Summary Obligations on the Commission Implementing acts shall be adopted by to establish a common methodology for the calculation of weight of EEE placed on the national market + a common methodology for the calculation of the quantity of WEEE generated by weight collection rate; may be adopted laying down minimum quality standards based on these developed standards proper treatment; may be adopted establishing additional rules on the calculation methods for the application of the minimum targets recovery targets;

19 Summary Obligations on the Commission Cont/ Implementing acts shall be adopted establishing the format for registration & reporting & frequency of reporting to the register registration, information & reporting; may be adopted establishing additional rules on inspections & monitoring & in particular uniform conditions for implementation inspection and monitoring.

20 Summary Obligations on the Commission Delegated acts shall be adopted to lay down transitional arrangements to address difficulties faced by MS collection rate; shall be adopted to introduce other treatment technologies that ensure at least the same level of protection for human health & environment proper treatment; by not later than delegated acts shall be adopted to lay down detailed supplementary rules, in particular criteria for assessment of equivalent conditions shipments of WEEE.

21 Summary Obligations on Malta ensure take-back schemes are in place; achieve separate collection targets; achieve recovery/recycling targets; control of shipments to target illegal shipments; ensure a registration and reporting procedure is in place; producers selling to other MS should be able to appoint an authorised representative in that state to ensure obligations are met; ensure producers provide a guarantee, financing WEEE obligations, when placing products on the market.

22 Timeline future progress Directive entered into force on Recycling and recovery targets for separately collected WEEE to remain the same during the transitional period 15 Aug 2015 Recycling and recovery targets for separately collected WEEE to increase by 5% (with the exception of gas discharge lamps) 15 Aug 2018 Similar targets based on new categorisation To be transposed by A collection rate of 4kgs on average per inhabitant per year of WEEE from private households during the transitional period 14 Aug 2016 A collection rate that is lower than 45% but higher than 40% of the average weight of EEE placed on the market 14 Aug 2021 A collection rate that is lower than 65% of the average weight of EEE placed on the market 13 Aug 2012 Directive entered into force 24 Jul 2012 Publication in OJ Transitional period laid down in Article 2 as regards to EEE categories set out in Annex I 14 Feb 2014 Transposition 15 Aug 2018 All EEE shall be classified within the categories set out in Annex III
