1 ELMIRA CITY SCHOOL DISTRICT ELMIRA, NEW YORK SPECIAL MEETING OF THE BOARD OF EDUCATION District Office Boardroom July 25, Hoffman Street 6:00 pm Elmira, NY MEETING CALLED TO ORDER ATTENDANCE: Board President Dan Hurley called the Special Meeting of the Board of Education to order at 6:10 p.m. and opened with the Pledge of Allegiance. Present: Timothy Blandford, Michael Crimmins, Anthony Fisher, Jr., Lynn Grottenthaler, Dan Hurley, Robin Long, Rodney Strange, Mary Beth Turner APPROVAL OF AGENDA Mrs. Grottenthaler moved, seconded by Mr. Strange that the Board approves the agenda as presented. Motion Carried: OATH OF OFFICE TO NEW BOARD MEMBER The oath of office was administered to Mr. Timothy Blandford; his term of office will be July 1, 2007 to June 30, The following statement was read by Mr. Blandford. I m here today only because of the people who stood with me during this time of my ordeal. I would like to thank one private citizen in particular, Kevin Jones. He is the real hero in this story. I believe that I would not be here today if it had not been for him bringing the matter to the forefront. It is only because of private citizens like Kevin Jones who help to keep public officials honest and accountable. It also helps to avoid a possible miscarriage of justice. Kevin Jones, on his own, sought information regarding this election. Without Kevin Jones, it is highly possible that many voters would have been disenfranchised. Elections are too 74

2 important to be subject to what many perceive as the 2007 election follies. I believe there is still much work that needs to be done to keep this from happening to someone else in the future. It is my hope that this Board will change the process by which we canvass the results, and the way information is exchanged and examined. Why not just follow the law as written? I also feel that the Legal Department did not thoroughly do its job, by initially giving this Board only one option on May 31. We now know that there were at least several other options that the Board could have considered, when this mistake was discovered. Why weren t those options given to the Board? I believe that the School Board could have made a much more informed decision had the options been presented to them at that time. I believe that I could have been seated sooner. I am not here with any agenda or axes to grind. I am here to carry out the will of the people, as mandated in one of the Board policies. And, this includes making sure that the people we hire also work to carry out the will of the people and of the tax paying citizens. With that said, let us work together to better serve and continue to improve the school district for all children. EXECUTIVE SESSION Mr. Fisher moved, seconded by Mrs. Turner that the Board move into Executive Session for the medical, financial, credit or employment history of a particular person or corporation, or matters leading to the appointment, employment, promotion, demotion, discipline, suspension, dismissal or removal of a particular person or corporation. Mr. Hurley appointed Dr. Bryant as Clerk Pro Tem in the absence of the Clerk. (6:15 p.m.) Motion Carried: Dr. Raymond Bryant Clerk Pro Tem 75

3 RETURN TO OPEN SESSION Mrs. Grottenthaler moved, seconded by Mr. Blandford that the Board returns to open session. (9:18 pm) Motion Carried: Dr. Raymond Bryant Clerk Pro Tem VISITORS WISHING TO ADDRESS THE BOARD Rev. Arthur Keith addressed the Board with his concerns with diversity in the district. Maureen Blandford congratulated her brother as the newest member of the Board of Education. PERSONNEL RESIGNATIONS Mr. Strange moved, seconded by Mrs. Grottenthaler that the Board approves the Personnel Packet as presented. Instructional Timothy J. The District has been unable to fill the vacancy despite good faith efforts which would have allowed sufficient time for SED clearance or conditional clearance. 2. There is no other qualified person available to fill the vacancy temporarily. The position needs to be filled to maintain services, which the District is legally required to provide, or services which are necessary to protect the health, education or safety of students and staff. 77
