Air Quality Management Drilling & blasting will not be carried out in the Mine area. Haul roads & loading area will be regularly sprayed with water to arrest dust from being air-borne. Proper maintenance (preventive as well as scheduled maintenance) of vehicles will be carried out regularly for minimization of generation of gaseous pollutants. No overloading of material will be done during transportation. Personal Protective Equipments (PPEs) such as dust masks will be provided to employees working in dust prone areas. Greenbelt along the Mining Lease periphery will be developed. Periodical air quality monitoring will be carried out. B. Water Quality Management There will be no waste water generation during mining process. Domestic wastewater generated from mines office will be disposed off in soak pit via septic tank. Disposal of waste water from workshop will be treated by oil-water separator before its use for dust suppression. Periodical Ground water level & quality monitoring will be carried out. C. Noise Level Management No drilling & blasting will be carried out in the Mine area. All the HEMMs will be equipped with acoustic cabins for operators. In order to reduce the effect of noise pollution, personal protective equipments like ear plugs, ear muffs will be provided to workers exposed to high noise levels. Scheduled & preventive maintenance of all the machinery will be carried out regularly. Green belt will be developed around periphery of the mining lease and plantation will be done along haul roads to attenuate noise level. Regular monitoring of ambient noise level will be carried out. D. Green Belt/ Plantation Green Belt& plantation will be developed around mine boundary, undisturbed area etc. Local plant species will be planted in consultation with forest department & as per guidelines. Earlier application was submitted to MoEFCC, New Delhi for getting Environment clearance on & project was considered before EAC on for technical presentation. Project was closed & delisted by MoEFCC, New Delhi on due to one court case pending. IDENTIFICATION OF PROJECT PROPONENT M/s. Shree Digvijay Cement Company Limited is a public limited company under Indian Company Act having its registered office and cement plant at Digvijaygram (Sikka), District Jamnagar, Gujarat manufactures ordinary Portland Cement, Pozzalana Cement, Sulphate Resisting Portland Cement and Oil Well Cement Galss G by dry process technology. Mining of Limestone and manufacturing of Clinker / Cement, has been the main life of activity of the company, which it has been carrying out with distinction for last over seven decades period. Shree Digvijay Cement Company Limited, incorporated in the year 1944, started its production in the year 1949 by the then prevailing Wet process Technology, using calcareous sea sand as the main raw material. The various types of cement produced by this company under the brand name KAMAL as per BIS standard are as follows: 1. Ordinary Portland Cement 53 grade (OPC). 2. Ordinary Portland Cement 43 grade (OPC). 3. Portland Pozzolana Cement (PPC) 4. Sulphate Resisting Portland Cement (SRPC) 5. Railway Track Sleeper Cement (IRST-40) 6. Oil well Cement Glass G grade HSR (OWC) as per API standard (ii) BRIEF DESCRIPTION OF THE NATURE OF PROJECT M/s. The same is enclosed as Annexure I. Of Gujarat Letter Reference No. & Date 0.30 MCR (1)-Chh dtd MCR (2)-Chh dtd MCR (3)-Chh dtd The above action of the Govt. of Gujarat was challenged before the Hon ble High Court of Gujarat vide Special Civil Applications No. 367, 368 and 369 of 2006 wherein the Hon ble High Court of Gujarat vide its Interim Orders on Quote: In the meantime, ad-interim relief granted earlier by this Court is modified to the extent that the rights which are conferred in favour of the respondent company HC- will be subject to the result of this petition and the proceedings before the State Government are stayed pending this petition. It is however made clear that the respondent no.4-company shall not claim any equity on the basis of this order and that the preliminary objection regarding alternative remedy is kept open by this Court. Enclosed and Marked Annexure II The above SCA were finally on disposed off by the Hon ble High Court of Gujarat wherein the Court was pleased to observe, inter alia, as under :- Quote: 14. I have also perused the official records which I had called for consideration and I do not find any irregularity in the grant of lease in favour of respondent No.4. The files do suggest that the respondent No.4 had placed details with regard to its Company and its expertise in mining and the purpose for which the Company needed limestone. The authority has rightly come to the conclusion that the respondent No.4 was the proper person who can be given leasehold rights for excavation of limestone. 15. Hence, I do not find any illegality in the order dated passed by the Secretary, Industries & Mines Department, State of Gujarat by which the respondentno.4 has been granted mining lease for a period of 30 years to excavate limestone in different villages of Taluka Bhanvad, Dist. Jamnagar. Hence, the present petitions stand dismissed. Rule discharged in each of the petitions. Interim relief, if any, is hereby vacated forthwith. Sd/- (A.J.DESAI, J.) (iii) NEED FOR THE PROJECT & ITS IMPORTANCE TO THE COUNTRY AND OR REGION In order to meet requirement of Limestone for manufacturing of Cement in their cement plant situated at Digvijaygram (Sikka), District Jamnagar, Gujarat, M/s. Shree Digvijay Cement Company Limited has proposed Pachhtardi Limestone Mine with Production Capacity 0.35 million TPA (ROM) Near Village: Pachhtardi, Taluka: Bhanvad, District: Devbhumi Dwarka (Erstwhile Jamnagar) (Gujarat). Besides this, the project will prove beneficial in terms of socio-economic development as it will provide employment to locals. Further, the average income level, which will be the indicator of socio economic status of households is expected to increase, which will ultimately result in better standard of living of the local people. With respect to the importance of the project to the nation, it can be well said that in a developing nation like India, cement makes a backbone for infrastructural development. Thus, keeping in mind this requirement, mining of limestone is necessary for the nation s growth. (iv) DEMAND SUPPLY GAP Limestone produced from this limestone mine will meet the requirement/demand of limestone for their Cement Plant. (v) IMPORTS VS. INDIGENOUS PRODUCTION Limestone produced from the Limestone Mine will be used for captive purpose in the Cement Plant. (vi) EXPORT POSSIBILITY Limestone produced from the Limestone Mine will be used for captive purpose in the Cement Plant. Hence, no export possibility is there. (vii) DOMESTIC/EXPORT MARKETS Limestone produced from proposed Limestone Mine will be utilized for captive use in their Cement Plant. (viii) EMPLOYMENT GENERATION (DIRECT AND INDIRECT) DUE TO THE PROJECT The total manpower of 73 persons will be required which will be taken from nearby villages. As this is a site specific proposed mine project for which letter of Intent was issued by Government of Gujarat, Department of Industry & Mines, Gandhinagar vide letter dated (iv) SIZE OR MAGNITUDE OF OPERATION The total mine area is ha with Production Capacity 0.35 million TPA (ROM). (v) Project Description with Process Detail A. Local Geology The Millilotic Limestone formation of Pleistocene to sub-recent age is practically horizontal bedded and rests unconformably over the trap (Basalt) rocks of Eocene age, which is also the oldest basement rock exposed in the area. Limestone is generally offwhite to buff in colour and soft, porous and friable in nature, but also compact and hard at top surface. The thickness of Limestone varies widely in depth due to undulating basalt floor. The Limestone formation is practically horizontal bedded and is generally off white to buff in colour. The Limestone is soft, porous and friable in nature but also compact, hard and boundary at many places. No drilling and blasting will be involved in the mining process. Mining will be done using Surface Miner with loader combination. Loading & Transport Loading operations will be carried out by loaders. Transportation of limestone from working face to cement plant will be carried out by hired Trucks/dumpers. (vi) RAW MATERIAL REQUIRED ALONG WITH ESTIMATED QUANTITY, LIKELY SOURCE, MARKETING AREA OF FINAL PRODUCTS, MODE OF TRANSPORT OF RAW MATERIAL AND FINISHED PRODUCT This is a Limestone mining project hence no raw material will be required. Limestone will be used in captive cement plant, so no marketing area will be required. Limestone will be transported from mine to the cement plant by hired trucks/dumpers. (vii) RESOURCES OPTIMIZATION/ RECYCLING AND REUSE ENVISAGED IN THE PROJECT, IF ANY, SHOULD BE BRIEFLY OUTLINED. No waste water will be generated in the Mine Area. (viii) AVAILABILITY OF WATER, ITS SOURCE, ENERGY /POWER REQUIREMENT AND SOURCE A. Water Requirement The total water requirement for the mining will be 22 KLD which will be sourced from nearby area. (ix) QUANTITY OF WASTE TO BE GENERATED (LIQUID AND SOLID) AND SCHEME FOR THEIR MANAGEMENT/DISPOSAL A. Liquid No waste water will be generated during mining operations. Waste water generated from mine office will be disposed off in soak pits via septic tank. Water generated from workshop will be treated by oil- separator & treated water will be used for dust suppression. B. Solid There is no overburden & waste will be generated. 4.0 SITE ANALYSIS (i) CONNECTIVITY The site is well connected with nearest town & City Bhanvad at about 12.0 km in NE direction from the mine site. (iii) TOPOGRAPHY & DRAINAGE The applied mine area has a gentle slopping topography with minor undulation having slopes towards south and having highest elevation at the Northwest and Southeast side of the area. The south lease boundary is surrounded by the agricultural fields and North West and East side of lease boundary is having hilly area. By way of the present writ petitions filed under Articles 14, 19 (1) (g), 21, 226 and 227 of the Constitution of India, the petitioners in each of the petitions has (i) challenged the order dated passed by the Secretary, Industries & Mines Department, State of Gujarat by which the respondent No.4 has been granted mining lease for a period of 30 years to excavate limestone in different villages of Taluka Bhanvad, Dist. Jamnagar and has (ii) prayed that it may be declared that the provisions of the amending act i.e. Act 38 of 1999 dated made in the Mines and Minerals (Development and Regulation) Act, 1957 would apply prospectively i.e. to those applicants who have applied for such excavation rights after the amended Act came into force; and has further (iii) prayed that the respondent authority be directed to grant lease for excavation of limestone to the petitioners for which they had applied subsequent to the amended provisions of the Act and has also (iv) prayed that it may be declared that the authority which has undertaken hearing of the applications of each of the petitioner is mock and sham in nature. 2. The brief facts arise from the record are as under :- 5.1 That the respondent No.1 issued Notifications on and declared that the piece of land bearing Revenue Survey No.78 of village Pachchhtardi of Tal. Bhanvad, Dist. Jamnagar admeasuring Hectares which was granted to one Mansukh Raghavji Joshi for excavation of limestone for a period of 20 years, has been cancelled for non-payment of royalty by the said leaseholder and would be available for mining of excavation of limestone from under the provisions of the Mineral Concession Rules, Similarly, two pieces of land at village Dhebar Bhuvaneshwar, Survey Nos.166 and 138 admeasuring Hectares and Hectares granted to Mansukh Raghavji Joshi would be available from the said date and land situated at village Mokhana, Tal. Bhanvad, Dist. Jamnagar bearing Revenue Survey No.51 paiki admeasuring Hectares granted to Jupiter Limited, Porbandar would also be available from the said date. 5.2 The petitioners in each of the petitions applied for the leasehold rights as they were interested in excavation of limestone and immediately applied to the respondent No.1 on itself. The petitioners were called for by the respondent No.1 with regard to their applications by communication dated and the hearing was kept on and finally rejected thereafter. 5.3 The petitioners subsequently came to know that the lands for which applications were made by them, were already granted by the respondent No.1 on in favour of the respondent No.4. Thakkar, learned advocate appearing for the petitioner would submit that by the Notification dated , the land in question in each petition was declared available and applications for grant of reconnaissance permit were invited by the respondent authority. The Collector had opined and recommended the State Government to allot the area in question for excavation to the petitioners. He would further submit that the respondent No.4 had made an application for leasehold rights for the above referred three area on i.e. prior to the declaration reconnaissance date i.e He would further submit that amending act i.e. Act 38 of 1999 in the Mines and Mineral (Regulation and Development) Act, 1957 was made applicable from The Collector had considered both these aspects and had rightly opined that the case of the respondent No.4 cannot be even considered and, therefore, the application made by the respondent No.4 could not have been considered by the State of Gujarat. He would further submit that the amended provisions do not specify that the same should be effected with retrospective effect and, therefore, the applications which were filed prior to amendment i.e. prior to could not have taken into consideration while grant of leasehold rights. He would further submit that it is an undisputed fact that the application was made by the respondent No.4 much prior to the amended provision. Therefore, the respondent No.1 has not properly interpreted the provisions of law and has wrongly issued leasehold rights in favour of respondent No.4, which are required to be withdrawn and applications filed by the petitioners are required to be considered on merits by the respondents. 30 C/SCA/367/2006 CAV JUDGMENT the Act read with Rule 59 of the Mineral Concession Rules, 1960 (hereinafter referred to as the Rules ) submit that the respondent No.4 had not made any application on or after and, therefore, the applications filed by the petitioners should have been treated as prior application and the Authority ought to have granted leasehold rights to each of the petitioners. By relying upon Rule 60 of the Rules, he would submit that the land in question was declared available only on and, therefore, all those applications which were submitted prior thereto for leasehold rights, should have been treated as premature applications. Therefore, the Authority has committed a grave error in granting the leasehold rights in favour of the respondent No He would further submit that when the authority had already granted leasehold rights in favour of respondent No.4 by an order dated , there was no need for respondents to issue a communication dated and call upon the petitioners for hearing which suggests that it was an eyewash as far as opportunity of hearing is concerned. He, therefore, would submit that the petitions be allowed in terms of the prayers made in the petitions. 7. Mr. Shirish Joshi, learned advocate appearing for the respondent No.4 Company has vehemently opposed these petitions and submitted that the petitioners have deliberately made false statements in the petitions since the provisions of Section 11 of the Act makes it clear that if any application is pending for leasehold rights for a particular land and is not disposed of, the same would be treated as if it has been filed on the date when the land is available for regrant. He would submit that the respondent authority has never rejected the application filed by the respondent No.4. He, therefore, would submit that with ulterior motives and to get their case covered under the provisions of Section 11 of the Act, such false statements have been made by the petitioners. He, therefore, would submit that the petitions are required to be dismissed on this ground alone. 7.1 By taking me through the Notification dated , he would submit that the leasehold rights granted in favour of the earlier leaseholder was cancelled and on The respondent No.4 had made application only thereafter i.e. on , since the respondent No.4 Company which is in the business of manufacturing cement was interested in excavation of limestone. During the pendency of his application, the lands were declared available for reconnaissance by the respondent No.1 after following the procedure in He would submit that the amended Section 11 of the Act provides that if any application for leasehold right is received prior to the publication of such notification and had not been disposed of, the same is required to be treated as received on the same day for the purpose of assigning priority. He would submit that the application submitted by the respondent No.4 Company was pending and was never rejected and, therefore, the application of the respondent No.4 was required to be considered as if it has been filed on the date of the publication of Gazette i.e Therefore, State of Gujarat after considering the norms provided under the Act for grant of lease, has rightly granted leasehold rights in favour of respondent No.4. He, therefore, would submit that the petitions are meritless and hence, the same may be dismissed. 8. Mr. K.M. Antani, learned Assistant Government Pleader appearing for the State of Gujarat has opposed the petition. He has stated that bald allegations have been made against an Officer of State to justify the challenge made in the petitions. He would further submit that the grounds of challenge made in the petition are also misconceived. 8.1 He would submit that reliance on Rule 60 of the Rules to contend that an application of grant of lease preferred by respondent No.4 was premature, is misconceived since Rule 60 requires rejection of the application as premature. He would further submit that Rule 60 prescribes eventualities if when satisfied would empower competent authority to (a) deem application for grant of lease as premature (b) not entertain such application deemed premature. He would, therefore, submit that unless the application of respondent No.4 were rejected while deeming it as premature, the same would remain pending and thus saved by the application of amended Section While relying upon records, he would submit that proper procedure has been followed while granting the lease to respondent No.4. He would also submit that the petitioners were given opportunity of being heard after the grant of lease to the respondent No.4 as it is a requirement under Rule 26 of the Rules. 33 C/SCA/367/2006 CAV JUDGMENT respective parties. The lands which are referred herein above were originally granted in favour of Mansukh Raghavji Joshi and M/s. Jupiter Cement Limited in the year 1981, 1982 and 1985 respectively for a period of 20 years. As per the contract entered into between the State of Gujarat and leaseholders, royalty is required to be paid by the holder and if the same is not paid, the leasehold right can be cancelled by the State Government. The leaseholders did not pay royalty in time and hence, leasehold rights were cancelled by the State Government on The respondent No.4 Company is in the business of manufacturing cement and is interested in getting excavation leasehold rights for limestone which is used for manufacturing cement. Therefore, the Company having interested in the land, of which agreement was cancelled on , made applications on The communication dated issued by the respondent No.4 Company which is referred as an order in the petition is only a notice to the Company to submit necessary documents in support of his application which was filed on Pursuant to the said notice, the respondent No.4 Company had submitted its detailed reply and produced necessary documents and requested to consider his application. Therefore, it is an undisputed fact that the applications submitted by the respondent No.4 on had never been rejected or disposed of. In view of the above background, Section 11 of the Act which deals with the preferential right amongst the applicants is required to be dealt with and, therefore, the same is reproduced herein below :- 11. 34 C/SCA/367/2006 CAV JUDGMENT right for obtaining a prospecting licence or mining lease, as the case may be, in respect of that land over any other person: Provided that the State Government is satisfied that the permit holder or the licensee, as the case may be (a) has undertaken reconnaissance operations or prospecting operations, as the case may be, to establish mineral resources in such land; (b) has not committed any breach of the terms and conditions of the reconnaissance permit or the prospecting licence; (c) has not become ineligible under the provisions of this Act; and (d) has not failed to apply for grant of prospecting licence or mining lease, as the case may be, within three months after the expiry of reconnaissance permit or prospecting licence, as the case may be, or within such further period, as may be extended by the said Government. (2) Subject to the provisions of sub-section (1), where the State Government has not notified in the Official Gazette the area for grant of reconnaissance permit or prospecting licence or mining lease, as the case may be, and two or more persons have applied for a reconnaissance permit, prospecting licence or a mining lease in respect of any land in such area, the applicant whose application was received earlier, shall have the preferential right to be considered for grant of reconnaissance permit, prospecting licence or mining lease, as the case may be, over the applicant whose application was received later: Page 10 of 15 HC-NIC Page 10 of 15 Created On Tue Oct 18 18:48:08 IST 2016

35 C/SCA/367/2006 CAV JUDGMENT Provided that where an area is available for grant of reconnaissance permit, prospecting licence or mining lease, as the case may be, and the State Government has invited applications by Notification in the Official Gazette for grant of such permit, licence or lease, all the applications received during the period specified in such notification and the applications which had been received prior to the publication of such Notification in respect of the lands within such area and had not been disposed of, shall be deemed to have been received on the same day for the purposes of assigning priority under this sub-section: Provided further that where any such applications are received on the same day, the State Government, after taking into consideration the matter specified in sub-section (3), may grant the reconnaissance permit, prospecting licence or mining lease, as the case may be, to such one of the applicants as it may deem fit.
