1 DEPARTMENT/UNIT Department: Technical Operations INVESTIGATION OFFICER POSITION DESCRIPTION Unit: Development Position Number: REMUNERATION Classification: Band 5 of Golden Plains Shire Council Enterprise Bargaining Agreement No: Salary range: $53,873 - $62,782 per annum plus 9% superannuation Hours per week: 38 Appointment: Prepared by: Approved by: Permanent, Full time Robert Gibson, Team Leader, Environment Services Rod Nicholls Chief Executive Officer Date: June 2010 POSITION OBJECTIVES Promote compliance with principle and subordinate legislation for which Council has a responsibility to administer including building legislation, planning legislation, health legislation, Domestic Animals Act (1994), Environment Protection Act (1970) and Council s Local Laws. Obtain, collate and present evidence to support criminal proceedings in Court, and applications before the Victorian Civil and Administrative Tribunal (VCAT). Provide advice and support to senior officers in the management of offences ORGANISATIONAL RELATIONSHIPS Reports to: Directly Supervises: Nil Development Manager Coordinates: Nil Page 1 of 6
2 Internal Liaisons: Building Department, Planning Department, Environment Services Department, Health Department, Works Unit, Executive Unit, Senior Officers, Corporate Services Unit, and Councilors External Liaisons: Residents, ratepayers, members of the public, other municipalities, State and Federal Government Departments e.g. Dept of Justice, DSE, DPI, EPA, VicRoads, RSPCA, Victoria Police, local businesses, industry groups KEY RESPONSIBILITIES AND DUTIES Duties of the Position Conduct inspections to determine if an offence has been committed. Conduct detailed investigations to ascertain the circumstances surrounding an alleged offence including formal interviews with suspected offenders and obtaining formal witness statements. Prepare accurate notes of conversations and actions taken in relation to possible offences and maintain comprehensive Council records on the same. Liaise with other Council officers when investigating alleged offences Assist the Planning, Building, Health and Environment Services departments in implementing compliance and enforcement strategies. Plan and conduct audits to ascertain compliance levels with Acts, Regulations, local Laws, Codes of Practice, the Golden Plains Planning Scheme and Permits, and prepare associated reports. Conduct Fire Hazard Inspections. Assist with Fire Management Planning. Respond to enquiries on local law issues from offenders, complainants and witnesses. Prepare compliance documents including Notice to Comply and draft Enforcement Orders. Compile a full brief of evidence to support a criminal prosecution in Court or an application before VCAT. Appear in Court proceedings and give evidence on behalf of the Council in matters relating to offences. Prepare applications to VCAT for Enforcement Orders. Act as an Informant in matters brought before the Courts. Corporate Responsibilities Promote excellence in customer service and in conjunction with the Unit Manager, identify, review and implement strategies to improve service quality and efficiency. Maintain strong team relationships among colleagues and community groups, on a formal and informal basis, across all Council functions. Ensure the security of Council s property and assets and maintain a commitment to the care of all Council s property and assets. 3 General Responsibilities Provide support to the Development Unit by undertaking general duties as required Attend relevant training programs approved by the Unit Manager. Other duties within the scope of the employee s skills, competence and training as directed. ACCOUNTABILITY AND EXTENT OF AUTHORITY The Investigation Officer provides specialist advice and regulates clients on matters relating to local laws that are enforceable by Golden Plains Shire Council. The position is authorised to undertake associated regulatory functions relating to compliance including, the issuing of infringement notices for breaches of relevant sections of legislation and Local Laws, and acts as Assistant Fire Prevention Officer under the CFA Act. Freedom to act is subject to close supervision and clear guidelines. The effects of decisions and actions on individual clients may be significant but are always subject to appeal or review by more senior staff. JUDGEMENT AND DECISION MAKING The objectives of the Investigation Officer s work are usually well defined but the particular method, technology, process or equipment to be used must be selected from a range of available alternatives. The work involves solving problems, using procedures and guidelines and the application of technical knowledge or knowledge acquired through relevant experience. Problems are occasionally of a complex nature with solutions not related to previously encountered situations, and some creativity and originality is required. Guidance and advice would usually be available within the time required to make a choice. Decisions of a non-routine or politically sensitive nature are referred to the Development Manager. SPECIALIST SKILLS AND KNOWLEDGE The position requires: A understanding of the Acts, Regulations, Local Laws and the Codes of Practice that the Council is responsible for enforcing, including the underlying principles as opposed to the practices. The ability to interpret and implement legislative procedure with the capacity to ensure evidence is collected in accordance with relevant legislative requirements. An awareness of the function of the position within its organisational context, including relevant policies, regulations and precedents, and an understanding of the role and function of the senior staff in the Unit. An appreciation of the long term goals of the Development Unit and of the wider organisation. MANAGEMENT SKILLS The position requires skills in managing time, setting priorities, planning and organising one s own work so as to achieve specific and set objectives in the most efficient way possible, within the resource available and in particular ensure that offences are dealt within statutory timeframes (1006) Investigation Officer (5) Page 3 of 6
4 INTERPERSONAL SKILLS The position requires a high standard of interpersonal, negotiation and communication skills at a level that enables the officer to gain cooperation and assistance from clients, members of the public and other employees, so as to facilitate cooperation and compliance over prosecution. The officer will be required to prepare reports associated with their investigative duties and prepare external correspondence of a routine nature. QUALIFICATIONS AND EXPERIENCE The position requires skills and knowledge beyond those normally acquired through completion of secondary education alone. The officer shall have relevant experience in law enforcement operations, including the collection, collation and presentation of evidence. SELECTION CRITERIA Sound understanding of legislative enforcement processes. Practical experience in law enforcement. Knowledge of local government s role in managing compliance with legislation. Good interpersonal and negotiation skills with the ability to engage with a wide range of people and obtain their cooperation. Experience in analysing and solving problems. Good administrative and organisational skills. Ability to set priorities and meet deadlines. Ability to contribute and work effectively within a multidisciplinary team environment. Good oral and written communication skills. Proficiency in software applications including Geographic Information Systems and Microsoft Office. Demonstrate an understanding of, and a commitment to, Council s Risk Management Standard Operating Procedure Report all hazards and incidents of which they become aware. Time in lieu will be granted in accordance with the Golden Plains Shire Enterprise Bargaining Agreement. Employment is subject to a satisfactory 6 month probationary period. Employees must comply with Golden Plains Shire Council s Employee Standards of Behaviour. Completion of a pre-employment Disclosure of Pre-existing Injury or Disease form.
