Detailed Rules for Administration of Plant Quarantine Relevant to Fresh Fruits of Sweet Cherry Produced in Designated Production Districts in the United States of America History: Director-General s Instruction No. 1769, June 5, 2009, Food Safety and Consumer Affairs Bureau, MAFF Partial Revision Director-General s Instruction No. 989, May 31, 2013, Food Safety and Consumer Affairs Bureau, MAFF For the administration of plant quarantine concerning the provisions of I-(2) of Ministerial Notification No. 518, May 6, 1992 (Establishing standards of the Minister of Agriculture, Forestry and Fisheries for fresh fruits of sweet cherry shipped from the United States of America; hereafter referred to as Notification relevant to appendix 19 of Annexed Table 2 of the Plant Protection Law Enforcement Regulation (Ordinance No. 73 of Ministry of Agriculture, Forestry and Fisheries, 1950) these Detailed Rules shall apply in addition to the provisions stipulated in Notification. Further, for the administration of plant quarantine concerning the provisions of I-(1) of Notification, Detailed Rules of Plant Quarantine on Fresh Fruits of Sweet Cherry Produced in USA (Director General s Instruction No. 3029, May 2, 1978, Agricultural Production Bureau, MAFF) shall apply instead of this Director-General s Instruction. 1 Designated production district Designated production district of Notification I-(2) shall be designated by US Plant Protection Service and, in case designation or its cancellation is made, US Plant Protection Service shall notify Japan Plant Protection Service with Appended Form 1 every year by the end of trapping survey of 2-(1). 2 Pest surveys in designated production district Pest surveys in designated producing district of Notification II shall be made as follows. (1) Trapping survey (i) Target pest shall be codling moth and survey shall be made from the season of young fruit stage (fruit size: 1.25cm) through the end of harvest season of sweet cherry. (ii) Lures to be used shall be Codling Moth 1X and survey shall be made by 1

2 recovering trap catches once/week while lures shall be refreshed once/4 weeks. (iii) Trap shall be of delta type. (2) Fruit sampling survey (i) Survey upon arrival of harvested fruits at packing facility Fruit sampling survey shall be made upon first arrival of harvested fruits at packing facility by randomly sampling 300 or more fruits from each consignment destined for Japan. (ii) Additional survey Survey shall be made, after sorting and grading of fresh fruits, by randomly sampling 700 or more fruits from each consignment destined for Japan. (iii) Survey shall be made visually and, in case codling moth infestation is suspected by injuries or signs of insect attack, fruits may be dissected as needed to confirm infestation. 3 Measures taken in case codling moth is detected (1) Trapping survey In case average trap catches/week of codling moth (Numbers after the decimal point shall be rounded) for each designated production area exceeds the following numbers as the result of trapping survey as per 2-(1), Japan Plant Protection Service shall be so notified and further export of sweet cherry from the relevant designated production district shall be suspended. (i) The State of California: 10 adult moths (ii) Northwest States (i.e. the States of Idaho, Oregon and Washington: the same shall apply hereafter): 30 adult moths (2) Fruit sampling survey In case, codling moth is detected as the result of fruit trapping survey as per 2-(2), Japan Plant Protection Service shall be notified and further export of all consignments of fresh cherry fruits for Japan shall be suspended from the states of production (i.e. the State of California or Northwest States; the same shall apply hereafter) wherein codling moth was detected 4 Record keeping and report of the result of pest surveys in designated production district (1) As to the results of pest surveys of 2-(1) and 2-(2), US Plant Protection Service shall record and retain the following matters, respectively. (i) Trapping survey 2

3 a. Name of production area b. Date of deployment for each trap c. Date of survey d. Catches of codling moth/week for each trap (ii) Fruit sampling survey a. no. b. Date of survey c. Numbers of fruits surveyed d. Numbers of codling moth and other pests intercepted (2) After export season is over, US Plant Protection Service shall report the records of foregoing (1) to Japan Plant Protection Service. 5 Export inspection (1) Export inspection of Notification IV-(1) shall be made on fresh fruits carried into packing facility after sorting thereby visually inspecting 1% or more of fruit packages for every consignment to confirm that sampled fruits are free of quarantine pests with special reference to codling moth. (2) Results of export inspection shall be recorded and retained by US Plant Protection Service until next year export season is over. (3) In case codling moth is discovered as the result of export inspection as per (1), Japan Plant Protection Service shall be notified and all consignments of fresh cherry fruits for Japan shall be suspended from the states of production wherein codling moth was discovered. (4) In case quarantine pests such as western cherry fruit fly, peach twig borer, oblique-banded leafroller, light brown apple moth, etc. are found as the result of export inspection as per (1), Japan Plant Protection Service shall be notified and the export of the relevant consignment shall be suspended. 6 Confirmation by plant quarantine officer Confirmation of Notification VI by plant quarantine officer shall be conducted jointly with US Plant Protection Service during the export season of sweet cherry. 7 Packing facility Packing facility of Notification VII shall be designated by US Plant Protection Service and, every time it is designated or canceled, shall be reported to Japan Plant Protection Service by Appended Form 2. 3

4 8 Labeling Labeling of Notification IX shall be made by the following wordings and shall appear on readily discernible places such as the sides of package in easily confirmable font size. (1) Label of completion of export plant quarantine CERTIFIED, PPQ-APHIS-USDA (2) Label of destination FOR JAPAN 9 Import inspection (1) Import inspection shall be made at port of entry thereby confirming relevant fresh fruits and accompanying phytosanitary certificate. (2) In case phytosanitary certificate is not attached, or in case package is broken or opened, or sealing as per Notification VIII is lacking, or labeling of Notification IX is missing, the relevant fresh fruits shall be either disposed or reshipped. (3) For procedure and method of import inspection other than the preceding (1) and (2), Regulation and Import Plant Quarantine Rules (Ministry of Agriculture, Forestry and Fisheries No. 206, July 8, 1950) shall be applied. (4) In case codling moth is detected, plant quarantine officer shall take the following measures. (i) He shall order either disposition or reshipment of all the amount of consignment involving the relevant fresh fruits. (ii) He shall request US Plant Protection Service to stop cherry fruit export for Japan from the State of production where codling moth was detected and shall suspend further import inspection.
