1 Florida Fish and Wildlife Conservation Commission Division of Law Enforcement Weekly Report Patrol, Protect, Preserve July 9, 2021 through July 15, 2021 This report represents some events the FWC handled over the last week; however, it does not include all actions taken by the Division of Law Enforcement. NORTHWEST REGION CASES ESCAMBIA COUNTY Officers Cushing and Land were patrolling state waters during the Pensacola Blue Angels Air Show. They heard the report of two missing divers approximately six miles south of Pensacola Beach. They responded, as well as units from United States Coast Guard (USCG) in Pensacola. The two divers were located by a Good Samaritan. Officers Cushing and Land assisted getting the divers back to their vessel. While working in the Pensacola Land Cut after the Blue Angels Air Show, Officers Land and Cushing observed a young female on board a bay boat fall from a small crow s nest tower to the deck. The operator of the vessel then ran his vessel aground. Officer Land boarded the vessel to check for injuries. While on board he observed several signs of impairment by the operator. He conducted Standard Field Sobriety Tasks (SFST) and placed the operator under arrest for Boating Under the Influence. While Officer Land was transporting a subject by vehicle, Officer Cushing observed a vessel moving faster than slow speed and creating a large wake. Officer Cushing attempted to stop the vessel, but it continued to be operated in the same manner. After several attempts, the vessel slowed to idle speed. The operator was tense, agitated, not following directions and showed several signs of impairment. Officer Touchton and Lugg arrived on scene to assist. A stop was made, and Officer Touchton came on board the patrol vessel as Officer Cushing proceeded to conduct Standard Field Sobriety Tasks (SFST) and then placed the subject under arrest for Boating Under the Influence (BUI).

2 GULF COUNTY During rough sea conditions, Senior Officers M. Webb, H. Webb, and Lieutenant M. Guy received a capsized boat distress call with all occupants in the water. The officers immediately responded, arriving to the location in their patrol vessel. They found two men struggling to stay on top of their over-turned boat. Skilled boat operation and teamwork by the officers enabled them to safely get close enough to the boaters and pull them on board the patrol vessel. Once they were secured with personal floating devices (PFDs) and sitting on board the patrol vessel, the officers secured a tow line to the 18 over-turned vessel and towed it to calmer waters where it would not be a navigational hazard and could be salvaged by the owner. Senior Officer M. Webb was on patrol, checking vessels returning from fishing at the local city ramp. He observed an offshore vessel with seven people on board. A resource inspection revealed the men had a blend of red and vermilion snapper with a small cobia tucked in the hatch. The cobia measured just over 29 inches. Officer Webb gave out fishing regulations and charged the appropriate subject with undersized cobia. While conducting a vessel safety inspection, Senior Officer J. Lipford developed probable cause to believe that the operator was impaired. As a result, the operator was placed under arrest for Boating Under the influence. Senior Officer H. Webb was conducting JEA dockside marine fisheries inspections when a recreational fishing vessel returned from offshore reef fishing. When asked what they had caught, the crew told Officer Webb that they had a limit of red snapper. Once they emptied their fish boxes and laid all their fish on the dock for a group photo, Officer Webb counted the fish, and determined they were over their daily bag limit. The owner of the vessel took responsibility for the violation and Officer Webb charged him accordingly. Several of the occupants were also warned for not being able to produce their licenses, and for not having reef fish permits. OKALOOSA COUNTY Investigators J. Pifer and J. Bryant were on water patrol in Destin Pass. They stopped a 33 Jupiter center console to do a fisheries inspection. Investigator Pifer boarded the vessel and found them to be in possession of four undersized red snapper and one undersized gag grouper. The fish were seized, and the owner of the boat was issued the appropriate citations. WAKULLA Officers Gray and Korade saw a small Jon boat by Patty s Island with two people actively fishing. They conducted a resource inspection. The inspection revealed that the operator was in possession of a mullet, sheepshead, spotted sea trout and 12 flounder. The operator was cited for having two flounder over the bag limit. The illegal flounder was returned to the water.

3 Officers Bradshaw, Gray and Korade were patrolling the West Flats in Wakulla County. They saw a commercial vessel with two people on board actively fishing with a sein or gill net. They stopped the vessel to conduct a resource inspection. The inspection revealed that the individual had three sein nets tied together greater than 500 square feet as well as oversized mesh. The operator was cited for the oversized mesh and the net was seized. WALTON COUNTY Multiple Officers participated in Operation Dry Water targeting a variety of boating violations and specifically Boating Under the Influence (BUI). Officer Fowler observed an individual returning to the boat ramp and performed a boating safety inspection. Further investigation revealed multiple signs of impairment from the operator. The operator was placed under arrest for BUI and transported to the Walton County Jail. NORTH CENTRAL REGION CASES DIXIE COUNTY Investigator Ayers and Officer Sheffield responded to a call about a subject hunting squirrel out of season and shooting towards a residence. They arrived on scene and observed where shot gun pellets had struck the side of a nearby home. They contacted the subject and he admitted to shooting squirrels because they were being a nuisance. The officers returned a short time later to conclude their investigation and observed the subject walking across the road carrying a shotgun. The subject was acting in a suspicious manner which led the officers to discover he was a convicted felon. The firearm was seized as evidence and charges will be direct filed with the state attorney s office for possession of a firearm by a convicted felon. HAMILTON COUNTY Lieutenant Kiss and Reserve Officer Redmond were patrolling Eagle Lake Fish Management Area when they observed an SUV parked in the road and a man fishing at a bridge. Upon contact with the fisherman, the officers noticed another man in the SUV. The officers asked the men if they had any luck and the driver of the vehicle said they caught some crawfish. The officers asked to see the crawfish and Officer Redmond noticed a small alligator in the trunk area. A search of the SUV revealed drug paraphernalia. Miranda warnings were read and post interview, both men admitted to catching the alligator and one man admitted the paraphernalia was his. Lieutenant Kiss issued both men a misdemeanor citation for possession of an American alligator without permit and the fisherman a written warning for expired freshwater fishing license. The

4 drug paraphernalia was seized as evidence, pending further investigation, and turned into the Lake City Regional Office evidence facility. NASSAU COUNTY Officer Specialist Stuhr responded to a call of an illegal take of an alligator. Two subjects removed the alligator from their personal pond and relocated it to another location. Both were charged with illegal take or possession of and American alligator and no trappers licenses. Both subjects were issued notices to appear. SENTINEL OSPV The crew of the offshore patrol vessel Sentinel, Officers Geib, Read, and Lentz were on a federal fisheries patrol and approached a fishing reef approximately 17 miles offshore of Mayport Inlet. Officer Read maneuvered the Sentinel alongside a vessel and Officer Geib boarded to conduct an inspection. The inspection found the subjects had a legal limit of red snapper during the season but also had several undersize black seabass and fish not in whole condition. The vessel also lacked several boating safety requirements. Officer Geib explained why regulated fish need to remain in whole condition with head and fins intact and documented of the violation. A citation was issued to the captain of the fishing vessel. Another vessel was inspected later the same day approximately 15 miles east of Nassau Sound. Officer Geib operated the patrol vessel and Officer Read boarded a boat and found several undersize vermilion snapper in a five gallon bucket and the live well. The captain was advised that the possession of undersize vermilion snapper is prohibited, and a citation was issued. SEARCH AND RESCUE FWC crews responded (in coordination with several other agencies) to a missing diver offshore of Jacksonville. Multiple officers assisted with the search for multiple days aboard the FWC patrol vessel Sentinel. COMMUNITY ORIENTED POLICING EXPANDING PARTICIPATION HAMILTON COUNTY Officer Cline participated in a career day event for the youth attending the local 4-H summer camp. This is a summer camp program sponsored by the University of Florida, Agriculture Extension Office in Jasper. The participants were able to learn and interact with conservation law enforcement on topics like job responsibilities, work equipment and personal job-related experiences. Approximately 30 participants attended the career day event. NORTHEAST REGION

5 CASES VOLUSIA COUNTY Master Officer McDonough and Officer Specialists Miller, Demeter, and Bertolami were on an Offshore Patrol Vessel (OPV) detail out of Ponce Inlet targeting vessels harvesting red snapper the day before the start of the three-day season opening. The team inspected a vessel fishing 15 miles offshore. Officer Miller located two red snapper during the boarding, which the subjects had harvested approximately two hours before the season opened. Officer Miller issued the vessel captain a federal citation for the violation. ST. JOHNS COUNTY Investigator Thomas and Officer Specialists Lawrence and Harris responded to a boating accident just south of the State Road 206 bridge in the Intracoastal Waterway (ICW). The accident involved multiple vessels (two making way and two secured at a nearby floating dock) and an apparent impaired operator. While Investigator Thomas researched the intricate chain of events causing the multiple-vessel collisions, Officer Lawrence conducted Standardized Field Sobriety Tasks (SFSTs) on one of the operators showing signs of impairment. Officer Lawrence arrested the operator for boating under the influence (BUI) and booked him into the St. Johns County Jail. SOUTHWEST REGION CASES HERNANDO COUNTY Officers Little, Scinta and Canamero along with Lieutenant Grover were conducting resource inspections at Bayport when they located a vessel which was two gallons over the bag limit of bay scallops. A further check of the vessel revealed another 2.5 pints of scallop meat inside of two water bottles. Appropriate citations were issued. K-9 Officer Wolff along with Officers Scinta, Canamero and Lieutenant Grover stopped a vessel who was found to be running an illegal charter fishing business. The subject was charged with state violations. Federal charges are pending. HILLSBOROUGH COUNTY While on land patrol, Officer Rorer observed an individual walking along a canal carrying a fishing pole. Officer Rorer contacted the individual and conducted a fisheries inspection. At the conclusion of the inspection, Officer Rorer found the individual to be in possession of three largemouth bass which were all over sixteen inches. Officer Rorer

6 issued the individual a misdemeanor citation for harvesting more than one largemouth bass which measured over sixteen inches in length. While on land patrol, Officer Rivard observed a vehicle parked along Southwest Florida Water Management District (SWFWMD) property and saw an individual trespassing inside of it. Officer Rivard drove to a concealed location and watched as the individual began picking up multiple items and placing them in his pockets. Officer Rivard contacted the individual as he returned to his vehicle and asked if he was collecting artifacts. The individual advised that he was attempting to collect artifacts and removed 156 pieces of miscellaneous ones from his pockets. The artifacts were seized as evidence and the subject was cited accordingly. LEE COUNTY Officer Hardgrove conducted a resource inspection of a fisherman returning to a boat ramp. The inspection revealed the fisherman was in possession of two spotted seatrout greater than nineteen inches. One of the spotted seatrout was seized as evidence and the fisherman was issued a Notice to Appear for possession of more than one spotted seatrout greater than nineteen inches. Officer Hardgrove conducted a resource inspection of a vessel returning to a boat ramp. The inspection revealed the fisherman was in possession of an out-of-season gray triggerfish. The triggerfish was seized as evidence and the fisherman was issued a Notice to Appear for possession of gray triggerfish during a closed season. Officer Hardgrove conducted a resource inspection of a boat returning to a boat ramp. The inspection revealed one of the anglers was in possession of three live shellfish (Lightning Whelks). The shellfish were returned to the water and the angler was issued a Notice to Appear for possession of live shellfish in the waters of Lee County. Officer Hardgrove conducted a resource inspection of a vessel returning to a boat ramp. The inspection revealed one of the fishermen to be in possession of an undersized yellowtail snapper. The snapper was seized as evidence and the fisherman was issued a Notice to Appear for possession of undersized yellowtail snapper. Officer Hardgrove conducted a resource inspection of a vessel returning to a boat ramp. The inspection revealed one of the fishermen to be in possession of a cell phone bag containing eleven fillets. Of the eleven fillets, two of them still had the skin intact and were identified as mangrove snapper. The fillets were seized as evidence and the fisherman was issued a Notice to Appear for failure to land mangrove snapper in whole condition. Officer Hardgrove conducted a resource inspection of a vessel returning from an offshore trip. The inspection revealed one of the anglers was in possession of an amberjack during the closed season. The amberjack was seized as evidence and the

7 fisherman was issued a Notice to Appear for possession of amberjack during the closed season. Officer Hardgrove was conducting resource inspections at a local boat ramp. Officer Hardgrove found multiple boats with illegal fish onboard including undersized yellowtail snapper, undersized spotted seatrout, and filleted mangrove snapper. The violations were all documented/cited appropriately. Officers Hardgrove, Stapleton and Lieutenant Barrett were patrolling a local pass when they spotted a large sport fishing vessel returning from an offshore trip. The officers recognized the vessel as one that had previously landed out of season fish, so they conducted a resource inspection. The officers found the captain of the vessel to be in possession of a greater amberjack during the closed season. The captain was charged appropriately. Officers Hardgrove, Stapleton and Lieutenant Barrett were assisting another patrol vessel during a Boating Under the Influence (BUI) investigation when they saw a personal watercraft (PWC) heading their way. Because it was several hours after sunset, the officers stopped the PWC. When they contacted the operator, it became apparent that he was extremely intoxicated. The operator had no idea where he was or how to get back to the boat ramp he had left earlier in the day. The operator was arrested and charged with BUI. MANATEE COUNTY Officer Gonzales conducted a resource inspection of a group of subjects fishing from the shoreline. During the inspection, the officer discovered one of the fishermen to be in possession of an undersized common snook that was caught with a cast net. The snook was seized as evidence and the fisherman was issued a Notice to Appear for possession of common snook less than twenty-eight inches and for illegal method of taking the common snook. Officer Dalton conducted a resource inspection on a group of subjects who were shoreline fishing. One fisherman was in possession of a common snook, a mangrove snapper and a sheepshead. The fisherman was also arrested for an active warrant and issued a Notice to Appear for possession of snook during closed season, and possession of undersized sheepshead and mangrove snapper. SOUTH REGION A CASES BROWARD COUNTY

8 Officers Dudas and Ryan were on patrol in the ocean offshore of Commercial Blvd. They conducted a marine fisheries inspection on a vessel. Pursuant to the inspection, one individual was issued a criminal notice to appear for possession of undersize mutton snapper. One dead undersize mutton snapper was seized as evidence. PALM BEACH COUNTY Officers Harris and Brodbeck were on marked vessel patrol when a commercial vessel was observed returning through Lake Worth Inlet with fishing equipment in plain view. A vessel stop was initiated to conduct a resource inspection. On board the vessel, the officers located an undersized cobia. The vessel operator was issued a resource citation for the violation, and the cobia was seized for evidence. Officers Harris and Brodbeck were on marked vessel patrol near Peanut Island when the operator of a PWC was observed without their PFD properly fastened. A vessel stop was initiated to address the violation. While speaking with the operator, numerous indicators of impairment were detected. Seated field sobriety tasks were conducted, and the operator was placed under arrest for suspicion of BUI. After being read implied consent, the operator refused to provide a breath sample. Warnings were issued for no fire extinguisher and improperly worn PFD. The operator faces enhanced penalties for having a passenger under the age of 18 on board. Lieutenant Kirkland, along with Officers Harris and Brodbeck were on marked vessel patrol when a distress call was overheard regarding a rental vessel sinking in the ICW with numerous occupants. Upon arrival, USCG recovered the passengers and Sea Tow was salvaging the vessel. The vessel had taken a large wake over its bow and capsized. Lieutenant Kirkland, along with Officers Harris and Brodbeck were on marked vessel patrol at night near Peanut Island when a vessel was observed with improperly displayed navigation lights. Additionally, the vessel was towing a smaller unlit vessel. Upon activating the blue light to initiate a vessel stop, the operator switched places with another vessel occupant. Upon contacting the vessel operator, numerous indicators of impairment were detected. Seated field sobriety tasks were utilized, and the operator was placed under arrest for suspicion of BUI. After being read implied consent, the operator refused to provide a breath sample. Post Miranda, the operator admitted to consuming a large quantity of liquor, as well as using cocaine. A written warning was issued for the navigation light violation and the operator faces enhanced penalties for having a passenger under the age of 18 on board. Officer Brodbeck was on patrol at Phil Foster Park when a vessel was observed returning to the dock with fishing equipment in plain view. A resource inspection was conducted, during which the officer located a large bag of dolphin fillets. The owner of the vessel was issued a resource citation for possession dolphin not in whole condition. The fish were photographed and seized for evidence.

9 Officer Brodbeck was on patrol at Phil Foster Park when a commercial charter vessel was observed returning to the dock. During the resource inspection, the officer located nine kingfish. The captain of the vessel stated they were commercially fishing, however, none of the kingfish were gutted which is typical of fish heading to a market. Additionally, the fish were soft and had cloudy eyes. The captain further stated he was going to sell the kingfish to Inlet Fisheries, a commercial wholesale dealer. After questioning the mate on board, the fish were found to have been recreationally caught the day prior. Recreationally caught fish may not be sold. Officer Brodbeck issued the vessel captain a resource citation for interference and obstruction of an FWC Officer for willful deception and concealing the true origin of the fish on board. Officer s Harris, Leon, and Rea were conducting fisheries inspections when they stopped a subject with a cooler in his truck fishing with a group on top of the Blue Heron bridge. Upon inspection of the subject s cooler, two undersized snook were located. The subject admitted to knowing the season was closed. He was cited for out of season snook, violation of the snook size limit, and the bag limit. He was also cited for not having a snook permit. Officer Brodbeck assisted the Palm Beach County Sheriff s Office with conducting resource inspections. A vessel was observed returning to Phil Foster Park. Officer Brodbeck boarded the vessel and located three large bags of dolphin fillets. The officer assisted PBSO Deputy Deneen in documenting the violation and writing the applicable administrative code violation. The bags of fillets were seized, and the vessel owner was issued a citation from PBSO for dolphin not landed in whole condition. Officers Harris, Rea, and Brodbeck were on marked vessel patrol in Lake Worth inlet while boats fishing a local tournament were returning to Sailfish Marina. While inspecting vessels, the officers found several vessels with fish violations, to include undersize dolphin, mutton snapper, and hogfish. The violations were addressed with the appropriate law enforcement action. Late in the afternoon, a vessel was stopped, and the operator displayed numerous signs of impairment. After seated field sobriety tasks, the operator was placed under arrest for suspicion of BUI. After being read implied consent, the operator refused to provide a breath sample. The operator faces enhanced penalties for having a passenger under 18 on board. MARTIN COUNTY Officers Pecko, Godward, and Brevik responded to a boating accident where a vessel had ramped a dock with unknown occupants. With assistance from Stuart PD and Martin County Sheriffs Marine Units, the vessel was discovered on the Stuart City docks. Due to signs of impairment, the operator voluntarily completed Standardized Field Sobriety Tasks. The operator was placed under arrest for Boating Under the Influence and booked into the Martin County Jail, where he refused to provide a sample of his breath. He was also issued a citation for violation of a navigation rule resulting in a boating accident.

10 Officers Pecko, Godward, and Lieutenant Kirkland observed a vessel violating the manatee zone in the Manatee Pocket. A vessel stop was conducted to address the violation and conduct a safety inspection. Due to signs of impairment, Officer Pecko asked the operator if he was willing to voluntarily complete Standardized Field Sobriety Tasks. The operator refused Standardized Field Sobriety Tasks and was subsequently arrested. He was booked into the Martin County Jail for operating a vessel while normal faculties are impaired. He refused to provide a sample of his breath and was cited accordingly. Officer Pecko was on patrol at the Palm City Bridge when he watched a subject exit the fishing pier and load gear into a vehicle. A resource inspection was conducted, and two snook fillets were found in his backpack. The subject was cited accordingly for snook during closed season. COMMUNITY ORIENTED POLICING GLADES COUNTY Lieutenant s Laubenberger and Seiler, Investigator Teems and Officers Trawinski and Matthews participated in a ceremony as FWC Honor Guard Members at the Moore Haven Lock and Dam. The ceremony was for the renaming of the lock and dam to the Julian Keen Jr. Lock and Dam in honor of Officer Keen, who was killed in the line of duty in June of 2020.
