1 MANCHESTER-BY-THE-SEA BOARD OF SELECTMEN TOWN HALL Manchester-by-the-Sea, Massachusetts Telephone (978) FAX (978) MINUTES OF THE BOARD OF SELECTMEN May 2, :00 p.m. Town Hall MEMBERS PRESENT: Chairman Kehoe, Vice-Chair Driscoll, Mr. Barclay, Eli Boling & Mrs. Beckmann (5:40pm) MEMBERS ABSENT: STAFF PRESENT: Greg Federspiel, Town Administrator; Debi Morong, Admin. Assistant; Mary Reilly, Grants Administrator PRESS: none At 5:00 p.m., Chairman Kehoe called the meeting to order noting that the meeting was being audio-taped by Debi Morong and asked that if anyone in the audience was taping the meeting, they should let the Board of Selectmen know. (At 5:30PM the meeting began to be video-taped by volunteers from Cape Ann T.V.) Announcement: Reminder to go out and vote on Tuesday, May 17 th from 7am-8pm at the Memorial School. Chairman Kehoe asked for a moment of silence for Condon McDonough. Citizens Open Forum: no comments Captain Dusty s, Inc. Common Victualler s License Selectman Barclay made a motion to approve the renewal of Captain Dusty s Common Victualler s License for Selectman Boling seconded the motion and it was approved (4-0). Chairman Kehoe mentioned that the owners of Captain Dusty s should apply for and have approval of this license in the future before they officially open for the season. *It was noted by Chairman Kehoe that prior to sending out renewal applications in the Fall that the Board should review the licensing fees. Atwater Kent Foundation Donation Vice Chairman Driscoll made a motion to accept the $2000 donation from the Atwater Kent Foundation to go into the Selectmen s Gift Fund Account. Selectman Boling seconded the motion and it was approved (4-0). Board of Selectmen minutes Page 1

2 First Baptist Church of Manchester (Cornerstone Church) Donation Vice Chairman Driscoll made a motion to accept the $500 donation from the First Baptist Church of Manchester to go into the Fire Engine Gift Fund/Donations Account. Selectman Barclay seconded the motion and it was approved (4-0). Proclamations 1. John E. Haynie Eagle Scout 2. Liam P. Dingle Eagle Scout 3. Selectmen s Citizenship Award nominee Vice Chairman Driscoll made a motion to approve the proclamations and Citizenship awards as presented. Selectman Boling seconded the motion and it was approve (4-0). Consent Agenda 6th Annual Coast to the Cure Bike Ride to benefit Neurofibromatosis Northeast: 9/10/ Touch a Truck Event: 6/29/2016 in the Town Hall Parking Lot Appointment Policy 89-5: Updated Procedures Thank you Letter to Boy Scout Troop 3: Delivery of Annual Town Reports Election Warrant April 19, 2016 BOS Meeting Minutes The Appointment Policy 89-5 update was pulled from the Consent Agenda. Selectman Barclay made a motion to approve the remaining items in the Consent Agenda. Vice Chairman Driscoll seconded the motion and it was approved (3-0-1). (Selectman Boling abstained from the vote due to missing the April 19 th BOS Meeting.) Correspondence Resident Letter: Parking Committee Recommendations dated 4/21/2016 Tower Point Capital: Cell Tower Correspondence National Grid letter dated Right of Way Herbicide Treatment update Town Administrator s Report 1. Boat Ramp still continues to be a struggle. We are Hopeful for the end of June for completion. Paddle Boarders may have a struggle without the ramp; Harbormaster Pike may need to reach out to these folks and explain other alternatives. 2. Pine Street is progressing nicely. Still on target to be completed by July 4 th. 3. The new Town Website start date has been delayed until the end of May. 4. A resident complaint has come in regarding the Elm Street Project being run by Windover Construction. We have requested updates from Windover and from DEP. Derosa Environmental is overseeing the project. Will keep the Board updated when information comes in. 5. Parking: Regarding the buffer from crosswalks, back in 2005 the Board approved a 10 buffer. This was not implemented in all locations. Best way to make a crosswalk safer is to construct bump outs. Also, the 30 minute Board of Selectmen minutes Page 2

3 restriction on Central Street where the dry cleaner is may no longer be desired as this business is closing. The 30 minute parking restriction will need to be rescinded at a formal hearing along with any new additions or previously approved decisions by the Board of Selectmen. Sawmill Project & Hazardous Mitigation Study Update Representatives from Tighe & Bond, Gabrielle Belfit; Senior Environmental Scientist and Janet Moonan P.E.; Project Engineer were present to give the Board of Selectmen and update. Sawmill Brook; The culvert that serve the lower end of the brook are undersized and are a cause of flooding problems which will only get worse in the years ahead (more intense storms and rising sea levels). A phased approach to improvements starting at the Central Street Dam/Culvert and working our way upstream is a logical approach to take. Removing the tidal gate significantly improves drainage. This will of course impact the tidal pond. Alternatives to the pond, including enhanced landscaping and creation of a park area may present an attractive option. Seeking funding to pursue the next level of design and public outreach is recommended. Sawmill Brook Watershed concerns: Inland flooding poor soils, impervious surface, channelized drainage Coastal Flooding High Tide, Wave Action, Storm Surge Water Quality Issues Bacteria, Low PH, Sedimentation Rainbow Smelt Habitat Accessibility, Spawning Habitat, Low Flows Updating the town s Hazard Mitigation Plan to include climate change highlights our areas of vulnerability; the village area around the Rail Road Tracks, Town Hall, the Waste Water Treatment Plant, Route 127 at the Western & Eastern Boarders and Raymond Street are all susceptible to sea level rise and enhanced storm surges. Coordinated Grants: Massachusetts Office of Coastal Zone Management Watershed Assessment Field Survey Identify Flood Mitigation locations Conceptual Designs for Flood Mitigation Public Involvement & Participation Coordinated Grants: FEMA Identify Community Assets Enhance Hazard Mitigation Plan Update Hazard Mitigation Plan Public Involvement & Participation They identified 9 Potential Flood Reduction Improvement locations. Funding Strategy to reach 25% design: Pre-permitting discussion Physical Studies Fish, Water Quality Survey Revise Modeling Board of Selectmen minutes Page 3

4 Public Hearings Depending on the Grant Application, some require to have a town match. This would require a Town Meeting Vote to move forward. For the Master Plan and for Financial Planning purposes, Tighe & Bond would need to know where the matches are so they could place them properly and know when to ask for funds. With no questions, Vice Chairman Driscoll made a motion to support ongoing efforts of Tighe & Bond including the submittal of new grant applications. Selectman Beckmann seconded the motion and it was approved (5-0). Police & Fire Chief Recruiting Firm: Integrity Testing; Rick Stanley Rick Stanley came in to discuss their proposal. They are a small firm that has specialized in promotional testing for public safety personnel. They would like to expand into the recruiting field and have offered a very competitive price. This would be their first recruitment job and are here to do what the town wants. They do extensive background checks, have worked with Boards, commissions and Citizens Panels to discuss what their priorities are and firmly believe in treating internal candidates the same as external candidates. They approach each client specific to what their needs and wants are. Key attributes of a Candidate: Leadership Integrity Accountability Transparency Team Approach Team Player Professionalism Commitment Ideally the Town is looking to have the Chiefs in place by September Interim Chief Beardsley of the Fire Department will be leaving us by late summer and the Police Chiefs contract ends in September. Chairman Kehoe thanked Rick Stanley for coming in. The Board of Selectmen would like to look into all options; Director of Public Safety vs. Police & Fire Chief. They want to educate themselves and the public on what can be done before making any decisions. The Board did have some hesitation regarding Integrity Testing due to their lack of experience and not having any Fire Chief background. Board of Selectmen minutes Page 4

5 Chairman Kehoe received a copy of an officer s log of a dog complaint from Loading Place Road. Once the report is written from the ACO, we will discuss. Chairman Kehoe made a motion to adjourn the meeting. Selectman Barclay seconded the motion and it was approved (5-0).
