Terms & Conditions of Sale In these Terms and condition Nightpark means Nightpark Nursery and Customer means the person, firm or company with whom Nightpark is contracting in the sale of one or more items referred to in this list. Stock This list replaces all previous issues. All plants are offered subject to being unsold, satisfactory growth, crop shortage or failure. Prices All prices quoted are ex-nursery and exclusive of VAT. We will make every effort to maintain prices quoted in this list, however we do reserve the right to alter them without any prior notice. VAT charged on plant No VAT for export customers if VAT registered. Please supply VAT number in advance. Accounts Credit accounts are due for payment within 30 days of invoice. If payment is not received within that period, Nightpark may charge interest on overdue accounts from the date when payment becomes overdue until the date when payment is made at a rate of 1.5% per month. New customers-cod or 30 day post-dated cheque with order. Goods remain the property of Nightpark until the notice has been settled in full. We reserve the right to uplift the goods supplied if payment is not received after one month s written has been given. Minimum Order It is recommended that plugs are ordered in minimum of 60 per variety, pots- 18 per variety. Minimum order Value 150 Advance orders We welcome advance orders from our customers. However, it the event that the Customer cancels their order (in whole or part) prior to delivery, Nightpark shall be entitled (without prejudice to any other rights) to charge an additional sum to cover costs incurred by it up to the date of cancellation. Delivery Orders over 750 delivered Free of Charge within Ireland, Delivery on CC trolleys charged at cost for orders less than 750. For very small orders, please inquire about box deliveries via courier Labels Colour labels available for some lines, please inquire Complaints Many of the species offered by Nightpark are grown form seed, this can lead to some natural variation in the resultant crop. Whilst every care is taken to ensure that plants are true to name, no warranty expressed or implied is given as to description or any other matter. Should any of the plants supplied fail to comply in quality, quantity or description, refund will be given but we shall in no circumstances be liable in respect of any other loss incurred by the buyer as a consequence of the supply of the defective plants.
