1 Guidelines for participation in tenders regarding the EU Trust Funds For awards of tasks to economic operators regarding funding of EU fund programs, SIMEST adopts the following tender procedures that define the methods, criteria and timing, as well as the documentation for tender participation and award. Tender procedures by type of tender and amount Goods and services: 1. for an amount below 10,000 euro, the direct procedure is applied. 2. for an amount between 10,000 and 200,000 euro, the competitive negotiation procedure is applied. 3. for an amount between 200,000 and 400,000 euro, the restricted international procedure is applied. 4. for an amount above 400,000 euro, the open international tender procedure is applied. TENDER FOR THE PROVISION OF SERVICES AND SUPPLIES TENDER AMOUNT BELOW 10, TENDER AMOUNT BETWEEN 10, AND 200, TENDER AMOUNT BETWEEN 200, AND 400, TENDER AMOUNT ABOVE 400, DIRECT PROCEDURE COMPETITIVE NEGOTIATION PROCEDURE RESTRICTED PROCEDURE OPEN INTERNATIONAL TENDER PROCEDURE Execution of tender works: 1. for an amount below 10,000 euro, the direct procedure is applied. 2. for an amount between 10,000 and 300,000 euro, the competitive negotiation procedure is applied. 3. for an amount between 300,000 and 5,000,000 euro, the restricted tender procedure is applied. 4. for an amount above 5,000,000 euro, the open international tender procedure is applied. WORKS EXECUTION TENDER TENDER AMOUNT BELOW 10, TENDER AMOUNT BETWEEN 10, AND 300, TENDER AMOUNT BETWEEN 10, AND 300, TENDER AMOUNT OVER 5,000, DIRECT PROCEDURE COMPETITIVE NEGOTIATION PROCEDURE RESTRICTED PROCEDURE OPEN INTERNATIONAL TENDER PROCEDURE

2 Timing The procedural steps and timing regarding tender participation and award are differentiated by tender type and are included and defined in the tenders issued. However, in general for the following procedures: - Direct SIMEST Invitation to submit an offer 14 days Submission of offers winning offer to all offerors SIMEST receives the offers submitted by economic operators within 15 days following the invitation or publication.

3 - Competitive negotiation SIMEST Invitation to submit an offer 60 days Submission and discussion of offers winning offer to all offerors SIMEST receives and discusses the offers submitted by economic operators within 60 days following the invitation published on the Internet site.

4 - Restricted Procedure Invitation to participate in the tender 60 days Submission, evaluation and selection of participants 30 days Submission of offers of the selected participants winning offers to all offerors SIMEST evaluates and examines the tender participants within 60 days following the invitation to participate published on the Internet site. Within 30 days, SIMEST examines the offers submitted by economic operators that have passed the first selection phase.

5 - Open international tender procedure Tender notice issue 60 days Submission of offers winning offer to all offerors 14 days Submission of appeals by unsuccessful offerors Examination and response to the appeal SIMEST receives the offers submitted by economic operators within 60 days following issue and publication of the tender notice on the Internet site. Unsuccessful offerors may submit appeal within 14 days following communication of the winning offer. Within of receipt of the appeal, SIMEST examines and responds to the questions of the appeal.

6 Criteria for participation Participation in tenders called by SIMEST regarding EU Funds also pursuant to article 93 (articles 133, 133 bis and 134 of the execution methods) of the "EU Financial Regulation applicable to the General Budget and to the 10th European Development Fund", is permitted for any economic operator that: a) is not bankrupt; b) has not been convicted for violation of professional rules and ethics; c) has not committed a serious error in the exercise of professional activities; d) has fulfilled the obligations relating to the payment of social security contributions and tax and fiscal charges; e) has not been convicted of fraud, corruption, involvement in a criminal organization or any other illegal activity affecting the financial interests of the European Union; f) has not been excluded from participation due to problems arising from previous tenders. g) is in possession of the quality certification; h) is in possession of at least 3 financial statements filed; i) is registered in the companies register of the country of origin or the professional register (or other form of professional accreditation).
