Artile 5 Legl remedies Eh Prty shll dopt suh legisltive nd other mesures s my e neessry to ensure tht interested prties ffeted y mesures under Artiles 2 nd 3 shll hve effetive legl remedies in order to preserve their rights. Artile 6 Lundering offenes 1 Eh Prty shll dopt suh legisltive nd other mesures s my e neessry to estlish s offenes under its domesti lw, when ommitted intentionlly: the onversion or trnsfer of property, knowing tht suh property is proeeds, for the purpose of oneling or disguising the illiit origin of the property or of ssisting ny person who is involved in the ommission of the predite offene to evde the legl onsequenes of his tions;

Setion 2 Investigtive ssistne Artile 8 Oligtion to ssist The Prties shll fford eh other, upon request, the widest possile mesure of ssistne in the identifition nd tring of instrumentlities, proeeds nd other property lile to onfistion. Suh ssistne shll inlude ny mesure providing nd seuring evidene s to the existene, lotion or movement, nture, legl sttus or vlue of the forementioned property. Artile 9 Exeution of ssistne The ssistne pursunt to Artile 8 shll e rried out s permitted y nd in ordne with the domesti lw of the requested Prty nd, to the extent not inomptile with suh lw, in ordne with the proedures speified in the request. Artile 10 Spontneous informtion Without prejudie to its own investigtions or proeedings, Prty my without prior request forwrd to nother Prty informtion on instrumentlities nd proeeds, when it onsiders tht the dislosure of suh informtion might ssist the reeiving Prty in inititing or rrying out investigtions or proeedings or might led to request y tht Prty under this hpter. Setion 3 Provisionl mesures Artile 11 Oligtion to tke provisionl mesures 1 At the request of nother Prty whih hs instituted riminl proeedings or proeedings for the purpose of onfistion, Prty shll tke the neessry provisionl mesures, suh s freezing or seizing, to prevent ny deling in, trnsfer or disposl of property whih, t lter stge, my e the sujet of request for onfistion or whih might e suh s to stisfy the request. 2 A Prty whih hs reeived request for onfistion pursunt to Artile 13 shll, if so requested, tke the mesures mentioned in prgrph 1 of this rtile in respet of ny property whih is the sujet of the request or whih might e suh s to stisfy the request.

Setion 4 Confistion Artile 13 Oligtion to onfiste 1 A Prty, whih hs reeived request mde y nother Prty for onfistion onerning instrumentlities or proeeds, situted in its territory, shll: enfore onfistion order mde y ourt of requesting Prty in reltion to suh instrumentlities or proeeds; or sumit the request to its ompetent uthorities for the purpose of otining n order of onfistion nd, if suh order is grnted, enfore it. 2 For the purposes of pplying prgrph 1. of this rtile, ny Prty shll whenever neessry hve ompetene to institute onfistion proeedings under its own lw. 3 The provisions of prgrph 1 of this rtile shll lso pply to onfistion onsisting in requirement to py sum of money orresponding to the vlue of proeeds, if property on whih the onfistion n e enfored is loted in the requested Prty. In suh ses, when enforing onfistion pursunt to prgrph 1, the requested Prty shll, if pyment is not otined, relise the lim on ny property ville for tht purpose. 4 If request for onfistion onerns speifi item of property, the Prties my gree tht the requested Prty my enfore the onfistion in the form of requirement to py sum of money orresponding to the vlue of the property. Artile 14 Exeution of onfistion 1 The proedures for otining nd enforing the onfistion under Artile 13 shll e governed y the lw of the requested Prty. 2 The requested Prty shll e ound y the findings s to the fts in so fr s they re stted in onvition or judiil deision of the requesting Prty or in so fr s suh onvition or judiil deision is impliitly sed on them. 3 Eh Prty my, t the time of signture or when depositing its instrument of rtifition, eptne, pprovl or ession, y delrtion ddressed to the Seretry Generl of the Counil of Europe, delre tht prgrph 2 of this rtile pplies only sujet to its onstitutionl priniples nd the si onepts of its legl system.

7 7 ETS 141 Lundering of the Proeeds from Crime, 8.XI If the onfistion onsists in the requirement to py sum of money, the ompetent uthority of the requested Prty shll onvert the mount thereof into the urreny of tht Prty t the rte of exhnge ruling t the time when the deision to enfore the onfistion is tken. 5 In the se of Artile 13, prgrph 1., the requesting Prty lone shll hve the right to deide on ny pplition for review of the onfistion order. Artile 15 Confisted property Any property onfisted y the requested Prty shll e disposed of y tht Prty in ordne with its domesti lw, unless otherwise greed y the Prties onerned. Artile 16 Right of enforement nd mximum mount of onfistion 1 A request for onfistion mde under Artile 13 does not ffet the right of the requesting Prty to enfore itself the onfistion order. 2 Nothing in this Convention shll e so interpreted s to permit the totl vlue of the onfistion to exeed the mount of the sum of money speified in the onfistion order. If Prty finds tht this might our, the Prties onerned shll enter into onsulttions to void suh n effet. Artile 17 Imprisonment in defult The requested Prty shll not impose imprisonment in defult or ny other mesure restriting the lierty of person s result of request under Artile 13, if the requesting Prty hs so speified in the request. Setion 5 Refusl nd postponement of o-opertion Artile 18 Grounds for refusl 1 Co-opertion under this hpter my e refused if: d e f the tion sought would e ontrry to the fundmentl priniples of the legl system of the requested Prty; or the exeution of the request is likely to prejudie the sovereignty, seurity, ordre puli or other essentil interests of the requested Prty; or in the opinion of the requested Prty, the importne of the se to whih the request reltes does not justify the tking of the tion sought; or the offene to whih the request reltes is politil or fisl offene; or the requested Prty onsiders tht ompline with the tion sought would e ontrry to the priniple of ne is in idem; or the offene to whih the request reltes would not e n offene under the lw of the requested Prty if ommitted within its jurisdition. However, this ground for refusl pplies to o-opertion under Setion 2 only in so fr s the ssistne sought involves oerive tion. 2 Co-opertion under Setion 2, in so fr s the ssistne sought involves oerive tion, nd under Setion 3 of this hpter, my lso e refused if the mesures sought ould not e tken under the

8 8 ETS 141 Lundering of the Proeeds from Crime, 8.XI.1990 domesti lw of the requested Prty for the purposes of investigtions or proeedings, hd it een similr domesti se. 3 Where the lw of the requested Prty so requires, o-opertion under Setion 2, in so fr s the ssistne sought involves oerive tion, nd under Setion 3 of this hpter my lso e refused if the mesures sought or ny other mesures hving similr effets would not e permitted under the lw of the requesting Prty, or, s regrds the ompetent uthorities of the requesting Prty, if the request is not uthorised y either judge or nother judiil uthority, inluding puli proseutors, ny of these uthorities ting in reltion to riminl offenes. 4 Co-opertion under Setion 4 of this hpter my lso e refused if: under the lw of the requested Prty onfistion is not provided for in respet of the type of offene to whih the request reltes; or without prejudie to the oligtion pursunt to Artile 13, prgrph 3, it would e ontrry to the priniples of the domesti lws of the requested Prty onerning the limits of onfistion in respet of the reltionship etween n offene nd: i ii n eonomi dvntge tht might e qulified s its proeeds; or property tht might e qulified s its instrumentlities; or d e f under the lw of the requested Prty onfistion my no longer e imposed or enfored euse of the lpse of time; or the request does not relte to previous onvition, or deision of judiil nture or sttement in suh deision tht n offene or severl offenes hve een ommitted, on the sis of whih the onfistion hs een ordered or is sought; or onfistion is either not enforele in the requesting Prty, or it is still sujet to ordinry mens of ppel; or the request reltes to onfistion order resulting from deision rendered in senti of the person ginst whom the order ws issued nd, in the opinion of the requested Prty, the proeedings onduted y the requesting Prty leding to suh deision did not stisfy the minimum rights of defene reognised s due to everyone ginst whom riminl hrge is mde. 5 For the purpose of prgrph 4.f of this rtile deision is not onsidered to hve een rendered in senti if: it hs een onfirmed or pronouned fter opposition y the person onerned; or it hs een rendered on ppel, provided tht the ppel ws lodged y the person onerned.

9 9 ETS 141 Lundering of the Proeeds from Crime, 8.XI When onsidering, for the purposes of prgrph 4.f of this rtile if the minimum rights of defene hve een stisfied, the requested Prty shll tke into ount the ft tht the person onerned hs deliertely sought to evde justie or the ft tht tht person, hving hd the possiility of lodging legl remedy ginst the deision mde in senti, eleted not to do so. The sme will pply when the person onerned, hving een duly served with the summons to pper, eleted not to do so nor to sk for djournment. 7 A Prty shll not invoke nk serey s ground to refuse ny o-opertion under this hpter. Where its domesti lw so requires, Prty my require tht request for o-opertion whih would involve the lifting of nk serey e uthorised y either judge or nother judiil uthority, inluding puli proseutors, ny of these uthorities ting in reltion to riminl offenes. 8 Without prejudie to the ground for refusl provided for in prgrph 1. of this rtile: the ft tht the person under investigtion or sujeted to onfistion order y the uthorities of the requesting Prty is legl person shll not e invoked y the requested Prty s n ostle to ffording ny o-opertion under this hpter; the ft tht the nturl person ginst whom n order of onfistion of proeeds hs een issued hs susequently died or the ft tht legl person ginst whom n order of onfistion of proeeds hs een issued hs susequently een dissolved shll not e invoked s n ostle to render ssistne in ordne with Artile 13, prgrph 1.. Artile 19 Postponement The requested Prty my postpone tion on request if suh tion would prejudie investigtions or proeedings y its uthorities. Artile 20 Prtil or onditionl grnting of request Before refusing or postponing o-opertion under this hpter, the requested Prty shll, where pproprite fter hving onsulted the requesting Prty, onsider whether the request my e grnted prtilly or sujet to suh onditions s it deems neessry. Artile 22 Reognition of foreign deisions 1 When deling with request for o-opertion under Setions 3 nd 4, the requested Prty shll reognise ny judiil deision tken in the requesting Prty regrding rights limed y third prties. 2 Reognition my e refused if: d third prties did not hve dequte opportunity to ssert their rights; or the deision is inomptile with deision lredy tken in the requested Prty on the sme mtter; or it is inomptile with the ordre puli of the requested Prty; or the deision ws tken ontrry to provisions on exlusive jurisdition provided for y the lw of the requested Prty. Setion 7 Proedurl nd other generl rules Artile 23 Centrl uthority 1 The Prties shll designte entrl uthority or, if neessry, uthorities, whih shll e responsile for sending nd nswering requests mde under this hpter, the exeution of suh requests or the trnsmission of them to the uthorities ompetent for their exeution. 2 Eh Prty shll, t the time of signture or when depositing its instrument of rtifition, eptne, pprovl or ession, ommunite to the Seretry Generl of the Counil of Europe the nmes nd ddresses of the uthorities designted in pursune of prgrph 1 of this rtile. Artile 24 Diret ommunition 1 The entrl uthorities shll ommunite diretly with one nother. 2 In the event of urgeny, requests or ommunitions under this hpter my e sent diretly y the judiil uthorities, inluding puli proseutors, of the requesting Prty to suh uthorities of the requested Prty. In suh ses opy shll e sent t the sme time to the entrl uthority of the requested Prty through the entrl uthority of the requesting Prty.

Artile 25 Form of request nd lnguges 1 All requests under this hpter shll e mde in writing. Modern mens of teleommunitions, suh s telefx, my e used. 2 Sujet to the provisions of prgrph 3 of this rtile, trnsltions of the requests or supporting douments shll not e required. 3 At the time of signture or when depositing its instrument of rtifition, eptne, pprovl or ession, ny Prty my ommunite to the Seretry Generl of the Counil of Europe delrtion tht it reserves the right to require tht requests mde to it nd douments supporting suh requests e ompnied y trnsltion into its own lnguge or into one of the offiil lnguges of the Counil of Europe or into suh one of these lnguges s it shll indite. Artile 27 Content of request 1 Any request for o-opertion under this hpter shll speify: d the uthority mking the request nd the uthority rrying out the investigtions or proeedings; the ojet of nd the reson for the request; the mtters, inluding the relevnt fts (suh s dte, ple nd irumstnes of the offene) to whih the investigtions or proeedings relte, exept in the se of request for notifition; in so fr s the o-opertion involves oerive tion: i the text of the sttutory provisions or, where this is not possile, sttement of the relevnt lw pplile; nd

Artile 29 Plurlity of requests 1 Where the requested Prty reeives more thn one request under Setions 3 or 4 of this hpter in respet of the sme person or property, the plurlity of requests shll not prevent tht Prty from deling with the requests involving the tking of provisionl mesures. 2 In the se of plurlity of requests under Setion 4 of this hpter, the requested Prty shll onsider onsulting the requesting Prties. Artile 30 Oligtion to give resons The requested Prty shll give resons for ny deision to refuse, postpone or mke onditionl ny o-opertion under this hpter. Artile 31 Informtion 1 The requested Prty shll promptly inform the requesting Prty of: d e the tion initited on request under this hpter; the finl result of the tion rried out on the sis of the request; deision to refuse, postpone or mke onditionl, in whole or in prt, ny o-opertion under this hpter; ny irumstnes whih render impossile the rrying out of the tion sought or re likely to dely it signifintly; nd in the event of provisionl mesures tken pursunt to request under Setions 2 or 3 of this hpter, suh provisions of its domesti lw s would utomtilly led to the lifting of the provisionl mesure. 2 The requesting Prty shll promptly inform the requested Prty of: ny review, deision or ny other ft y reson of whih the onfistion order eses to e wholly or prtilly enforele; nd ny development, ftul or legl, y reson of whih ny tion under this hpter is no longer justified. 3 Where Prty, on the sis of the sme onfistion order, requests onfistion in more thn one Prty, it shll inform ll Prties whih re ffeted y n enforement of the order out the request.

Artile 37 Aession to the Convention 1 After the entry into fore of this Convention, the Committee of Ministers of the Counil of Europe, fter onsulting the Contrting Sttes to the Convention, my invite ny Stte not memer of the Counil nd not hving prtiipted in its elortion to ede to this Convention, y deision tken y the mjority provided for in Artile 20.d. of the Sttute of the Counil of Europe nd y the unnimous vote of the representtives of the Contrting Sttes entitled to sit on the Committee. 2 In respet of ny eding Stte the Convention shll enter into fore on the first dy of the month following the expirtion of period of three months fter the dte of deposit of the instrument of ession with the Seretry Generl of the Counil of Europe. Artile 38 Territoril pplition 1 Any Stte my, t the time of signture or when depositing its instrument of rtifition, eptne, pprovl or ession, speify the territory or territories to whih this Convention shll pply. 2 Any Stte my, t ny lter dte, y delrtion ddressed to the Seretry Generl of the Counil of Europe, extend the pplition of this Convention to ny other territory speified in the delrtion. Artile 39 Reltionship to other onventions nd greements 1 This Convention does not ffet the rights nd undertkings derived from interntionl multilterl onventions onerning speil mtters. 2 The Prties to the Convention my onlude ilterl or multilterl greements with one nother on the mtters delt with in this Convention, for purposes of supplementing or strengthening its provisions or filitting the pplition of the priniples emodied in it. 3 If two or more Prties hve lredy onluded n greement or trety in respet of sujet whih is delt with in this Convention or otherwise hve estlished their reltions in respet of tht sujet, they shll e entitled to pply tht greement or trety or to regulte those reltions ordingly, in lieu of the present Convention, if it filittes interntionl o-opertion. Artile 40 Reservtions 1 Any Stte my, t the time of signture or when depositing its instrument of rtifition, eptne, pprovl or ession, delre tht it vils itself of one or more of the reservtions provided for in Artile 2, prgrph 2, Artile 6, prgrph 4, Artile 14, prgrph 3, Artile 21, prgrph 2, Artile 25, prgrph 3 nd Artile 32, prgrph 2. Artile 41 Amendments 1 Amendments to this Convention my e proposed y ny Prty, nd shll e ommunited y the Seretry Generl of the Counil of Europe to the memer Sttes of the Counil of Europe nd to every non-memer Stte whih hs eded to or hs een invited to ede to this Convention in ordne with the provisions of Artile Any mendment proposed y Prty shll e ommunited to the Europen Committee on Crime Prolems whih shll sumit to the Committee of Ministers its opinion on tht proposed mendment. 3 The Committee of Ministers shll onsider the proposed mendment nd the opinion sumitted y the Europen Committee on Crime Prolems nd my dopt the mendment. 4 The text of ny mendment dopted y the Committee of Ministers in ordne with prgrph 3 of this rtile shll e forwrded to the Prties for eptne. 5 Any mendment dopted in ordne with prgrph 3 of this rtile shll ome into fore on the thirtieth dy fter ll Prties hve informed the Seretry Generl of their eptne thereof. Artile 43 Denunition 1 Any Prty my, t ny time, denoune this Convention y mens of notifition ddressed to the Seretry Generl of the Counil of Europe. 2 Suh denunition shll eome effetive on the first dy of the month following the expirtion of period of three months fter the dte of reeipt of the notifition y the Seretry Generl. 3 The present Convention shll, however, ontinue to pply to the enforement under Artile 14 of onfistion for whih request hs een mde in onformity with the provisions of this Convention efore the dte on whih suh denunition tkes effet.
