1 Section 513. Requirements for Wyoming Public Service Commission (Commission) designation of eligible telecommunications carriers (ETCs), pursuant to sections 214(e) and 254(f) of the federal Telecommunications Act of 1996, as amended, Part 54 of Title 47 of the Code of Federal Regulations, as amended and W. S (a)(vi); (a)(vii). (a) The Commission shall review the carrier s application for ETC designation for compliance with 47 U.S.C. section 214(e) and section 254 of the federal Act, as amended. In determining whether the carrier should be granted ETC status, tthe Commission shall determine whether any such designation serves the public interest, convenience and necessity. The Commission s public interest analysis shall consider the carrier s application; the carrier s response to the requirements provisions set forth below; any cost-benefit analysis done prepared by the carrier relating to customer choice; and any advantages of the carrier s service offering; and evidence produced at hearing, if any hearing is held.; and, the potential for creamskimming by the carrier in those instances where the carrier seeks ETC designation below the study area level of a rural incumbent LEC. In conducting its analysis, tthe Commission shall consider the fundamental goals of preserving and advancing universal service to ; ensureing the availability of quality telecommunications at just, reasonable, and affordable rates; and to promoteing the deployment of advanced telecommunications and information services to all regions of the state, including rural and high-cost areas. (b) Each carrier seeking designation by the Commission as an ETC throughout a specified service area in order to receive high cost support as defined at 47 C.F.R shall: satisfy the following subsections except (b)(xi) and (xii). Each carrier seeking limited designation by the Commission as an ETC throughout a specified service area in order to receive Lifeline low income support as defined at 47 C.F.R et seq. shall satisfy the following subsections except (b)(viii) and (x). (i) Demonstrate the carrier s commitment and technical, financial and managerial ability to provide to all customers making a reasonable request for service, and to advertise using media of general distribution, the supported services/functionalities throughout the service area for which it is requesting ETC designation. to all customers making a reasonable request for service. (ii) Demonstrate the carrier s commitment and technical, financial and managerial ability to advertise the availability of, and charges for, the supported services/functionalities using media of general distribution. (iii) Demonstrate the carrier will offer and advertise the prices and availability of the Lifeline and Linkup programs in a manner designed to reach those likely to qualify for these programs, throughout the service area for which the carrier is seeking ETC designation. (iiiv) Demonstrate the carrier s commitment and technical, financial and managerial ability to provide service on a timely basis to requesting customers within the
2 carrier s service area where the carrier s network already passes the requesting potential customer s premises. (iv) Demonstrate the carrier s commitment and technical, financial and managerial ability to provide service within a reasonable period of time, if athe requesting potential customer is within the carrier s licensed or certificated service area, but outside its existing network coverage, if service can be provided at reasonable cost. by: (D) Modifying or replacing the requesting customer s equipment; Deploying a roof-mounted antenna or other equipment; Adjusting the nearest cell tower; Adjusting network or customer facilities; (E) Reselling services from another carrier s facilities to provide service; or (F) Employing, leasing or constructing an additional cell site, cell extender, repeater or other similar equipment. (vi) Submit a threefive-year plan describing in detail detailing on a wire center basis proposed improvements or upgrades to the carrier s network on a wire center by wire center basis, exchange by exchange (or some other basis) throughout the carrier s proposed designated service area. Each carrier shall demonstrate: how signal service quality, coverage, or capacity, call completion, and access, including broadband acess, will improve due to the receipt of federal high cost support; the projected start date and completion dates and costs for each improvement; and the estimated amount of investment for each project to be funded by federal high cost support; the specific geographic area where the improvements will be made; and the estimated population to be served as a result of the improvements. (vii) Demonstrate the carrier s commitment and technical, financial and managerial ability to remain functional in all emergency situations, including that it has a reasonable amount of back-up power to ensure functionality without an external power source; is able to reroute traffic around damaged facilities; and is capable of managing traffic spikes resulting from emergency situations. (viii) Demonstrate the carrier s commitment to comply with applicable Wyoming service quality standards, consumer protection rules and other related industry standardsthe Cellular Telecommunications and Internet Association (CTIA) Consumer Code, as applicable. (viiiix) Demonstrate the carrier will offer a local usage plan or plans, including considering but not limited to minutes, price and coverage area, comparable to those offered by the incumbent LEC in the service area for which where the carrier is seeking ETC designation.
3 (x) Certify the carrier acknowledges the Commission may require it to provide equal access to long distance carriers in the event no other eligible telecommunications carrier is providing equal access within the service area. (ixi) Provide a detailed map of the service area for which the carrier is seeking ETC designation, showingincluding the location and the effective coverage area of each cellular tower, ifas applicable. The Ccommission may require such maps be submitted in a designated electronic format. (xii) Demonstrate the carrier will offer the supported services using either entirely its own facilities or a combination of its own facilities and resale of another carrier s services. (xi) Provide documentation from the Federal Communications Commission (FCC) demonstrating approval of the carrier s Compliance Plan and receipt of forbearance from the own facilities provisions of federal law. (xii) Provide documentation describing the terms and conditions of any voice telephony service plans offered to Lifeline subscribers, including details on the number of minutes provided as part of the plan, additional charges, if any, for toll calls, and rates for each such plan. (xiii) Provide a copy of the carrier s application to the affected tribal government and tribal regulatory authority, as applicable, at the time the carrier files with the Commission for any tribal lands included as part of the carrier s request for ETC designation.
4 Section 514. Annual reporting requirements for all previously designated Eligible Telecommunications Carriers (ETCs) pursuant to the annual certification guidelines and standards set forth in Part 54 of Title 47 of the Code of Federal Regulations, as amended. (a) In order ffor an ETC previously designated by the Wyoming Public Service Commission (Commission), or previously designated by the Federal Communications Commission (FCC), to be certified to receive support for the following calendar year, or to retain its ETC designation, each ETC shall submit to the Commission the annual reporting information listed below on or before July 15.on or before a date to be determined annually by the Commission. ETCs failing to meet these annual report filing requirements may not be certified by the Commission to the FCC and the Universal Service Administrative Company (USAC) as eligible to receive federal support. (b) Each designated ETC shall file: receiving any high cost support as defined at 47 C.F.R shall file for the previous calendar year, and satisfy the following subsections except (b)(xvii). Each ETC receiving any Lifeline low income support as defined at 47 C.F.R et seq. shall file for the previous calendar year, and satisfy the following subsections except (b)(i) and (vi). (i) Documentation detailing Tthe number of requests for service from potential customers within the ETC s service areas that were unfulfilled, during the past year and written submission detailing including how it attempted to provide service to those potential customers, as set forth in Rules 513(b)(iii) and (iv).47 C.F.R (a)(1)(i). (ii) Documentation detailing Tthe number of complaints per 1,000 access lines or handsets connections (fixed or mobile). (iii) Documentation detailing Written submission detailing how the carrier is complying with applicable Wyoming service quality standards, consumer protection rules and other related industry standards. /or the Cellular Telecommunications and Internet Association (CTIA) Consumer Code (if applicable). (iv) Documentation detailingwritten submission detailing how the carrier is able to function in emergency situations as set forth in Rule 513(b)(vi). 47 C.F.R (a)(2). (v) Acknowledgment the Commission may require the carrier to provide customers with equal access to long distance carriers in the event no other ETC is providing equal access within the service area. (vi) Documentation detailing Tthe total amount of all federal high cost and low income support received in the previous calendar year, and in the current year to date, categorized by support mechanism.
5 (vii) For the previous calendar year, a Documentation detailing on a wire center basis detailed schedule/exhibit showing the actual dollar amounts expended by the carrierexpenditures for the previous calendar year and the current year to date, in the provision, maintenance, upgrading, plant additions and associated infrastructure costs within the service areas in Wyoming for the provision, maintenance, and upgrading of facilities and services for which the support is intended where the carrier has been designated an ETC. (viii) Documentation detailing how the carrier offers the nine supported services/functionalities, listed through (I) below, throughout the service areas in Wyoming where the carrier has been designated an ETC. equivalent; Voice grade access to the public switched network or its functional equivalent; Local usage at no additional charge to end users; Dual tone multi-frequency signaling or its functional (CD) Single party service; (DE) Access to emergency services; and (F) Access to operator services; (G) Access to interexchange services; (H) (EI) Access to directory assistance; and Toll limitation for qualifying low-income consumers. (viiix) Documentation detailing how the carrier offers and advertises the prices and availability of the Lifeline and Linkup programs in a manner designed to reach those likely to qualify for these programs, throughout the service areas for which the carrier has been designated an ETC. (ix) A copy of the service agreement the carrier offers to its universal service customers, including all terms and conditions. (xi) Documentation detailing and support how the carrier can is committed to, and has the capability to, provide its universal service product/offerings throughout the service areas to all customers who make a reasonable request for service in Wyoming where the carrier has been designated an ETC.
6 (xii) A detailed map of the service areas for which the carrier has been designated an ETC, including showing the location and the effective coverage area of each cellular tower, if applicable. The Ccommission may require such maps be submitted in a designated electronic format. (xiii) The total amount of all federal high cost support received year-todate for the current calendar year. (xiv) For the current calendar year-to-date, a detailed schedule/exhibit showing the actual dollar amounts expended by the carrier in the provision, maintenance, upgrading, plant additions and associated infrastructure costs for any universal service products/offerings within the service areas in Wyoming where the carrier has been designated an ETC. This should include the carrier s plans and budgets for any build-out projects, upgrades and installations applicable to any universal service products/offerings not yet completed during the current calendar year. (xiixv) A copy Copies of the previous and current year s annual reports required by 47 C.F.R (b) and (c) to be filed by the carrier with the Universal Service Administrative Company (USAC) applicable to the service areas in Wyoming where the carrier is designated an ETC. (xiiivi) A fivethree-year service quality improvement plan report on a wire center basis, which includes:, including maps detailing its progress towards meeting its annually revised plan targets; an explanation of how much federal universal service support was received and how it was used to improve servicesignal quality, coverage, or capacity, call completion, and access, including broadband access; and an explanation regarding any unfulfilled network improvement targets. that have not been fulfilled. The information shall be submitted at the exchange level, study area level or some other similar service area level description. (xivii) Detailed information on a wire center basis ofn any outage, as that term is defined in 47 C.F.R. 4.5, of at least 30 minutes in duration for each service area in which an ETC is designated for any facilities it owns, operates, leases, or otherwise utilizes that potentially affect (i) at least ten percent of the end users served in a designated service area; or (ii) a 911 special facility, as defined in 47 C.F.R. 4.5(e). Specifically, the ETC s annual report must include information detailing: (D) The date and time of onset of the outage; A brief description of the outage and its resolution; The particular services affected; The geographic areas affected by the outage;
7 (E) (F) Steps taken to prevent a similar situation in the future; and The number of customers affected. (xv) Documentation detailing the carrier s holding company, operating companies, affiliates, and any branding (a d/b/a or brand designation), as well as universal service identifiers. Affiliates is defined as a person that (directly or indirectly) owns or controls, is owned or controlled by, or is under common ownership or control with, another person. Own means to own an equity interest (or the equivalent thereof) of more than 10 percent. (xvi) If applicable, to the extent the carrier serves Tribal lands, documentation demonstrating the ETC had discussions with Tribal governments that, at a minimum, included: (D) A needs assessment and deployment planning with a focus on Tribal community anchor institutions; Feasibility and sustainability planning; Marketing services in a culturally sensitive manner; Rights of way processes, land use permitting, facilities siting, environmental and cultural preservation review processes; and (E) Compliance with Tribal business and licensing requirements. Tribal business and licensing requirements include business practice licenses that Tribal and non- Tribal business entities, whether located on or off Tribal lands, must obtain upon application to the relevant Tribal government office or division to conduct any business or trade, or deliver any goods or services to the Tribes, Tribal members, or Tribal lands. (xvii) Documentation describing the terms and conditions of any voice telephony service plans offered to Lifeline subscribers, including details on the number of minutes provided as part of the plan, additional charges, if any, for toll calls, and rates for each such plan. (xviii) Documentation demonstrating the ETC s compliance with the provisions of 47 C.F.R
