As a reminder, self-study is limited to 18 hours per renewal period (9 hours for new licensees during their initial license renewal period) and self-study is not acceptable for prelicensed persons gaining hours for workshops, training sessions, seminars, and conferences. Gaining continuing education hours just became easier! What do you need to do to take advantage of this opportunity? Read the articles from the Compendium and then answer the true/false assessment questions accompanying this information packet. Be sure to record your answers on the enclosed answer sheet and then submit your completed answer sheet to CAMFT for grading. Submit completed course evaluation attached. The word advertise means some sort of public communication, but does not include advertisements sent through the mail because those sorts of advertisements are considered person-to-person communications. 2. A practitioner s website for his or her own psychotherapy practice must comply with the advertising requirements of 651 of the California Business & Professions Code. 3. A marriage and family therapist cannot, as a matter of law, refer to himself or herself as a psychotherapist in his or her advertising. 4. Advertising with one s suitemates under an umbrella name, such as Third Street Family Counseling, creates a risk of liability because the arrangement could be classified as a joint venture. 5. The scope of practice for marriage and family therapists does not include the use of applied psychotherapeutic techniques. 6. California licensing law establishes an individual s scope of competence. 7. An eleven-year old may consent to her own mental health care under California Family Code Legal guardians do not have the same rights as biological parents to consent to a child s mental health treatment. 9. Sole legal custody means that either parent can lawfully consent to a child s mental health treatment. 10. The Caregiver Authorization can be signed by a minor s babysitter to allow a child under twelve to obtain necessary mental health treatment because the babysitter is caring for the child during the day and the babysitter reasonably believes that the child is being abused by the child s mother. 11. Section of the California Health & Safety Code gives parents an automatic and legally enforceable right to examine the mental health treatment records of their minor children. 12. Minor s Counsel has the statutory authority to waive privilege, but not assert privilege, on behalf of a minor he or she has been appointed to represent. 13. Any mental suffering experienced by a child is mandated to be reported as child abuse. 14. A report of suspected child abuse may be made to a police or sheriff s department. 15. The pregnancy of a minor, in and of itself, does not require a suspected child abuse report to be made. 5

Under existing law, if a minor discloses to her therapist that the minor was raped at a party last weekend, the therapist has the right to keep such information confidential from Child Protective Services or the police to avoid re-traumatizing the minor. 17. Assuming there is no evidence of exploitation, a sixteen-year old female may engage in consensual sexual intercourse with her nineteen-year old boyfriend without such activity being reported to applicable authorities as child abuse. 18. A marriage and family therapist does not report abuse of an elder if such elder resides in a state other than California. 19. Marriage and family therapists are required by California law to keep patient records. 20. If Dave asks Stan to cover his practice while he goes on vacation, Dave should discuss with Stan those of his patients who have a history of suicide attempts as well as their present risk of suicide. 21. If patient records are subpoenaed for a trial or hearing, a psychotherapist is required by California law to disclose the records to the subpoenaing party prior to that trial or hearing. 28. Ordinarily, a trainee or intern may earn up to forty (40) hours of experience per week towards licensure, but if the California Board of Behavioral Sciences approves an additional ten (10) hours for a given week, the trainee or intern could then earn up to fifty (50) hours of experience towards licensure during that week. 37. A trainee or intern does not have to get supervision each and every week they acquire hours of experience towards licensure so long as the trainee averages an hour of supervision for every five hours of client contact and the intern averages an hour of supervision for every ten hours of client contact. 38. If a person does not complete his or her hours of experience during the initial six-year intern registration period, the person can apply for a second six-year intern registration period, but the person would be precluded from working in a private practice until he or she obtained a license to practice marriage and family therapy. 39. An intern can be an independent contractor, but a trainee can only be an employee or volunteer. 40. A licensee who once treated an individual for depression can supervise that individual as an intern in the licensee s private practice so long as it has been at least two years since the clinical work ended. 7
