1 SDPB Holdings, Inc 4629 Cass Street, Suite 255 San Diego, CA Dear Mr. Donovan: Subject: Fir Street & Public Right-of-Way Vacation Project No : Assessment Letter; Internal Order No Greater Golden Hill Community Planning Area. The Development Services Department has completed the initial review of the project referenced above, and described as: A proposal to a Public Right of Way Vacation and Site Development Permit (Process 5) to vacate portions of Fir Street and 28th Street and construct five new detached single family homes. The vacant.603 acre property site is located south of Fir Street, between 28th Street and Granada Avenue in the RS-1-7 zone, within the Greater Golden Hill Community Planning area. Enclosed is a Cycle Issues Report (Enclosure 1) which contains review comments from the staff review team. The purpose of this assessment letter is to cover the cycle issues report, identify significant project issues, outline required submittal requirements and update the status of your deposit account. I. PROJECT ISSUES: The project issues are summarized below. Resolution of these issues could affect your project. Additional explanation is provided in the Cycle Issues Report. Public Opposition While this is not a land use issue, I feel it is important for you to understand that this application has generated a large amount of public interest. Since the notice of application was mailed out my office has received hundreds of s and phone calls seeking information about the project. All comments received have been negative and there will be a great deal of opposition to the project. Environmentally Sensitive Lands Staff has noted that City maps and records indicate the project site may contain sensitive biological resources including

2 Page 2 potential habitat. To determine what resources may be located on the property a site-specific biological survey letter must be provided. The survey must be prepared by a qualified biologist and in accordance with the Biological Guidelines within the Land Development Code. Variance Required As designed the project would require variances from the minimum standards of the RS-1-7 Zone including minimum lot dimensions, street frontage and setbacks. Please see LDR Planning comments and provide variance findings to support the deviations. Right-of-Way Vacation the Engineering reviewer has listed a number of issues with the proposed right-of-way vacation. Engineering is requesting an alignment study demonstrating the infeasibility of providing the improvements to 28 th Street and Fir Street in a manner that would allow the normal access and frontage to the subdivision. The reviewer has also noted that the partial vacation cannot be supported and the full vacation of the right-of-way would be required. The reviewer has some question regarding the revision rights for 28 th Street and is requiring additional information to confirm it would be standard half-width reversion on either side of the center line. Additionally, the engineer has noted that a Site Development Permit will also be required for all improvements within the right-of-way where the applicant is not the adjacent owner. This comment includes the retaining walls and the private driveway within the right-of-way and outside of the project site. The reviewer has noted revisions to the Storm Water Applicability Checklist is required and determined that a Water Quality Technical Report will be required. There are several other comments and corrections for the Engineering review Landscape the project will require a Brush Management Plan prepared in accordance with the City s Landscape Technical Manual. In addition a Water Budget and Conservation Plan will be required. The reviewer has indicated it may be in your best interest to hold off on landscape issues until such time that it can be determined if a redesigned project is feasible. Fire the reviewer is requesting information regarding addressing that would be visible from the street, fire hydrant location and fire access roadways. This is a health and safety issue. Planning Airport The project is located within the Airport Influence Area (AIA) and a Land Use Consistency Determination from the Airport Land Use Commission is required. Please provide an extra set of plans for the commission

3 Page 3 on the next submittal. The reviewer has also noted an Avigation Easement will be required. Transportation Engineering The reviewer has commented that support of the proposed vacation cannot be made at this time due to the lack of information in the initial submittal. As well as the explanation as to the feasibility of full improvements (as stated by planning and engineering) the reviewer is requesting information regarding the partial improvements shown as access. The reviewer has noted that additional parking spaces are required per the Land Development Code when driveways are less than 20 feet in length. The reviewer has noted the Greater Golden Hill Bike and Pedestrian path and has requested the plans demonstrate where this access would be provided. Map Check The map checker has indicated the vacation must be shown on a separate instrument meaning it cannot be done as a part of the development permit plans. The vacation must be shown on a Tentative Map along with other site improvements or on a separate B-Sheet in accordance with the Streets and Highways Code. Environmental Review The environmental review will not be fully complete until all other disciplines clear outstanding issues that may have environmental impacts. To that end, the environmental planner has listed potential issues with the Biology, Water Quality/Drainage, Geography, Airports, Nesting Birds, Brush Management, Community Plan consistency and Paleontology. Several of these issues will require a technical Report as indicated in the comments. Remaining Comments There were multiple other comments made by the individual reviewers I did not highlight above. Please refer to the Cycle Issues Report and address all of the staff comments upon the next submittal. II. REQUIRED APPROVALS/FINDINGS - Your project as currently proposed requires the processing of: Required approvals: Site Development Permit (Environmentally Sensitive Lands and nonadjacent right-of-way improvements) - Process 3. Variance for deviations to the LDC) - Process 3. Right-of-Way Vacations Process 5

4 Page 4 Please note all required approvals must be consolidated into a single application and processed as one project. The decision maker will be the highest level required for the approvals necessary. As currently proposed the project will be a Process 5 City Council decision. Required Findings: In order to recommend approval of your project, certain findings must be substantiated in the record. Development Permit and Variance findings have been provided by the planning review in the issues report and may accessible through our web site at: III. IV. PROJECT ACCOUNT STATUS: The Development services Project Tracking System (PTS) does not include a current balance for the project. Your project manager will research the account balance and inform you if additional money is required. Please note that due to the unusually high volume of public contact the account will need additional funds deposited soon. SCHEDULE: A revised submittal will include a business day turnaround for each subsequent review. V. COMMUNITY PLANNING GROUP: Staff provides the decision maker with the recommendation from your locally recognized community planning group. Once the project is submitted, staff will forward a copy of the plans/exhibits to the planning group. You will also be requested to contact the chair of the planning group to schedule your project for a recommendation from the group.
